Shinn APPROVAL OF MINUTE~; Motion: On motion of Commissioner Jones, seconded by Commissioner Lowe, the Planning Commission minutes of March 26, 1996, were approved. (5-0-1; Commissioner Meyer-Kennedy was absent) COMMUNICATIONS There were no communications. AGENDA MODIHCATIONS OR POSTPONEMENTS There were no agenda modifications or postponements. Planning Commission Minutes of April 9, 1996 Page 2 ORAL REQUESTS: There were no oral requests. PUBLIC HEARING Acting Chair Kearns read Agenda Item No. 1 into the record. 1. (ZIP 1996-2003 Public Hearing to consider the City of Campbell's 1996- 2003 Capital Improvement Plan. Mr. Nelson Fialho, Administrative Analyst, presented the staff report as follows: The CIP includes 46 project. The CIP document is a way to match resources/revenues with the goals and objectives of the City and its General Plan. Only the projects outlined in the first year of the CIP actually have funds appropriated in the City's budget. Years two through seven are simply for planning purposes. If the CIP 1996-2003 is approved, $1.9 million will be included in the 1996/97 budget. Of the 46 projects in the CIP 1996-2003, 19 projects are scheduled for 1996/97. Per City Council policy, only projects costing over $25,000 are included as CIP projects. The entire estimated cost for all 46 projects outlined in the CIP 1996-2003 is $10.8 million. Commissioner Alne has questions regarding the Winchester Drive-In site Planning Commission Minutes of April 9, 1996 Page 3 purchase and Street Maintenance. Mr. Nelson Fialho advised that street maintenance is included in the City's operating budget. Commissioner Alne asked why then was maintenance of Third Street included in the CIP. Mr. Nelson Fialho responded that this was in the CIP as a place holder. Maintenance is generated out of operating budget not the capital budget. Commissioner Lowe asked about the year 1998/99 when nearly $4 million is included in the CIP. Why is this amount so much higher. Mr. Nelson Fialho responded that of that figure $1.6 million represents Parks and Open Space. This large amount skews that year's figure. This amount is for open space acquisition. Revenue comes from Park Dedication Fees based on development. The City does not have this revenue yet. Again, this is a place holder for future acquisition. Commissioner Lowe asked about the $1.2 million slated for low income housing in the South of Campbell Avenue Area. The City of Campbell is well over the requirements for affordable housing. How much affordable housing does the City need. Mr. Darryl M. Jones, Senior Planner, advised the Commission that a portion of RDA funds must be used for affordable housing and is not part of the CIP. Commissioner Lowe questioned the expenditures for the Police Department, mobile data unit, firearms and construction. Mr. Nelson Fialho advised that firearms have a usable life of 10 years. The construction will add 500 square feet for locker rooms as well as interior remodels to create additional work stations. Mr. Darryl M. Jones: · Advised that the CIP reflects the nature and general direction of the City and provides a continuation of projects already approved by Council. · Informed the Commission that the purview of where the CIP dollars are spent is with the City Council and not with Commissions and Boards. · Announced that a Public Hearing will be held by the City Council on April 16th where concerns about proposed CIP projects can be raised. Commissioner Lowe asked whether inflation and the cost of money is taken into Planning Commission Minutes of April 9, 1996 Page 4 consideration when budgeting CIP funds. Mr. Nelson Fialho responded that interest and a factor for inflation is considered. Commissioner Alne stated that the City has already spent $3.8 million for the Winchester Drive-In site which has cut down the City's available reserves. Asked what the City's current reserves are at this time. Have they been all used; half used; 10%, 1%? Mr. Nelson Fialho replied that the funds for the purchase of the Winchester Drive-In site came from three different reserve accounts. Commissioner Alne asked how much open space the City hoped to acquire. Mr. Nelson Fialho advised that the City is investigating joint use with schools and percolation ponds. Commissioner Alne asked where the proposed $4 million came from. The City has collected Park Impact Fees since approximately 1991 and the City has nowhere near that amount. Mr. Nelson Fialho responded that the amount set for park acquisition is $1.6 million not $4 million. Commissioner Alne asked how many acres the City needed and/or wanted for open space. Is the ratio still four acres per thousand in population? Mr. Darryl M. Jones advised that this question represents a land use issue not a CIP issue. Chairman Lindstrom added that the Commission needs to consider the CIP. Commissioner Alne questioned what the purpose was for the Planning Commission's review of the CIP. Chairman Lindstrom responded that the Commission must direct any concerns about spedfic projects to the Coundl. Mr. Darryl M. Jones added that the Commission needs to review the CIP for conformity with the City's General Plan and to recommend approval of the Negative Declaration. Chairman Lindstrom added that the actual dollars spent are not the purview of the Commission. The Commission needs to recommend the Negative Planning Commission Minutes of April 9, 1996 Page 5 Declaration. Commissioner Alne asked for darification as to what they should consider. City Attorney William Seligrnann advised that the Commission has two issues: · To determine whether the CIP is consistent with the General Plan. · If a Negative Declaration should be issued. If a determination can be made that the projects included in the Cip will not have a major or significant impact on the environment and whether the plan will have an impact on the environment. Chairman Lindstrom advised the Commission that in October 1995 a letter was sent offering an opportunity to participate in the development of projects. The Commission's role is regarding environmental issues not financial. That responsibility belongs to the Coundl. Commissioner Alne asked what data can be used by the Commission to make their determination? Chairman Lindstrom replied that the Strategic Plan and Civic Improvement Plan documents. Commissioner Alne asked the City Attorney to restate the Commission's two jobs. City Attorney William Seligmann reminded Commissioner Alne that they are to review for consistency with the General Plan and determine whether the Commission can recommend that the Council issue a Negative Declaration. Commissioner Alne stated that he didn't feel that the park acquisition goals were possible. City Attorney William Seligmann advised Commissioner Alne that this was a valid point of inquiry. Acting Chair Kearns opened the Public Hearing for Agenda Item No. 1. There being no parties present to address the CIP 1996-2003, Acting Chair Kearns closed Public Hearing No. 1. Mr. Darryl M. Jones clarified that the CIP is used by the City to understand maintenance needs and to schedule projects. The Negative Declaration is based upon review and comments in the initial study that no negative impacts are expected from the CIP projects in accordance with CEQA. The plan should be found to be consistent with the General Plan. If the Commission agrees, then the Planning Commission Minutes of April 9, 1996 Page 6 Commission should recommend certification of the Negative Declaration. If not, they should not recommend certification of the document. Motion: Upon motion of Commissioner Lindstrom, seconded by Commissioner Jones, the Planning Commission moved to recommend that the City Council adopt a Negative Declaration and find the 1996-2003 Capital Improvement Plan to be consistent with the City's General Plan, by the following voice vote: AYES: NOES: ABSENT: ABSTAIN: Jones, Kearns, Lindstrom, Lowe, Lowe Meyer-Kennedy Alne This item will be considered by the City Council at its meeting of April 16, 1996. REPORT OF THE COMMUNITY DEVELOPMENT DIRECTOR The written report of Mr. Steve Piasecki, Community Development Director was accepted as presented with the following comments by Senior Planner Darryl M.
