Shinn APPROVAL OF MINUTES Motion: On motion of Commissioner Lowe, seconded by Commissioner Meyer- Kennedy, the Planning Commission minutes of June 25, 1996, were approved. (5-0-2; Commissioners Alne and Jones abstained.) Plannin~ Commission Minutes of July 9, 1996 COMMUNICATIONS: There were no communication items. Pa~e 2 AGENDA MODIFICATIONS OR POSTPONEMENTS: There were no agenda modifications or postponements. ORAL REQUESTS There were no oral requests. PUBLIC HEARING Chairman Lindstrom read Agenda Item No. 1 into the record. 1. S 96-08 Public Hearing to consider the application of Mr. Anthony Motamedi for a Site and Architectural Approval to allow a new single family residence on property located at 392 Waldo Drive in an R-1-16 (Single Family Residential) Zoning District. Ms. Barbara Ryan, Planner I, presented the staffreport as follows: · Project site is on Waldo Road between Budd Avenue and Sunnyoaks Avenue. · Site is vacant and is surrounded by residential properties. · To the east is a two-story home and to the west is a one-story home. · Zoning and General Plan designations are consistent with a residential use of this lot. · The parcel was split prior to the implementation of the San Tomas Area Neighborhood Plan and met the standards at that time. · Current proposal includes 27% lot coverage. · Current proposal has a Floor Area Ratio (FAR) of 44%. Forty-five percent (45%) is the maximum allowed. · All setback requirements are met. · Applicant has moved the proposed residential structure back from the required front yard setback of the property by a couple of feet in order to save a large walnut tree on the site. · Proposed structure has one and two-story portions. It includes wood siding and will be painted gray with gray trim A dark gray asphalt ~hingle roof will be installed. · Staffrecommends approval of this project. Commissioner Kearns presented the Site and Architectural Report as follows: · SARC is supportive of this proposal with the exception of a vent which is proposed for the gable. · SARC is pleased that the applicant worked around the walnut tree in order to save it. · The proposed structure looks good. Hannin~ Commission Minutes of July, 9, 1996 Pa~e 3 Commissioner Alne asked whether the walnut tree was far enough ~om the foundation of the new structure to prevent problems. Ms. Barbara Ryan responded that the foundation is outside of the drip line of the tree. Chairman Lindstrom asked whether the Commissioners had any questions for staff. Chairman Lindstrom opened the Public Hearing for Agenda Item No. 1. Ms. Pat McCullough, 771 Old Orchard Road: · Asked if the applicant owns the property. If not, why is he trying to obtain approval for a property he does not own. · Stated that she found the house to be nicely designed. · Asked about a mature tree near the street and whether it too would be saved. Ms. Barbara Ryan advised that that tree was in the public right-of-way and would not be removed as part of this project. Commissioner Lowe asked for clarification as to whether the property is owned by the applicant. Mr. Anthony Montamedi responded that he is the owner of the property, his escrow closed in June. Chairman Lindstrom closed Public Heating for Agenda Item No. 1. Motion: Upon motion of Commissioner Lowe. seconded by Commissioner Kearns, the Planning Commission moved to adopt Resolution No. 3033 allowing the construction of a new single-family residence on property located at 392 Waldo Road. (7-0) Chairman Lindstrom read Agenda Item No. 2 into the record. 2. SA 96-19 Continued Public Heating to consider the City-initiated application for a Text Amendment to the Zoning Ordinance to require greater sideyard setbacks for comer residential lots. Plannin~ Commission Minutes of July 9, 1996 Pal~e 4 Mr. Tim J. Haley, Associate Planner, presented the staffreport as follows: · Staff is recommending a text amendment to expand the sideyard setback requirements for comer residential lots. · Current setbacks are 5 feet for most of Campbell, 8 feet in the San Tomas Area Neighborhood Plan. · Staff finds the minimal setbacks unacceptable bom an aesthetic standpoint and also from a traffic engineering standpoint. · Staff recommends amending the sideyard setbacks to a minimum of 12 feet. · In surveying surrounding cities, the range of required sideyard setbacks is from 9 to 15 feet on average and 20 to 25 feet in some cases. Staff finds 12 feet to be a compromise. · Additionally staff is recommending that changes to allow legal but non-conforming buildings to build along the existing structures wall line. · Staff is recommending that the Planning Commission grant a two week continuance to allow staffto fine tune the language of the amendments. Mr. Tim J. Haley advised that there are difficulties with the language of the proposed changes. Chairman Lindstrom asked whether he needed to open the Public Hearing and continue this item and asked City Attorney Seli~tnnann for clarification. City Attorney William Seligmann advised that the wording is not as clear as it can be. He has no problem with the concept but feels that the language needs to be clear and concise. Commissioner Gibbons agreed that she found it difficult to follow the language. She added that illustrations would be helpful. Chairman advised that a continuance is required. Commissioner Alne asked whether Saratoga distinguishes between lots created before 1992 and after 1992 when the Ordinance was passed. He added that current provisions akeady allow additions to legal but non-conforming structures. Mr. Tim J. I-Ialey advised that there are two separate issues, lots and buildings. Mr. Steve Piasecki suggested that staff work on language to make 12-foot sideyard setbacks the standard. Chairman Lindstrom opened the public hearing for Agenda Item No. 2. Larry Gratton, 1136 Steinway Avenue: · This amendment makes him happy as he has a lot on his street soon to be developed with a house. A 12-foot sideyard setback is good. Planning Commission Minutes of July 9, 1996 Page 5 Commissioner Alne advised that this neighbor would not be covered. Mr. Tim J. Haley advised that there is no date yet for implementation of these changes. City Attorney William Seller-mann advised that the ordinance changes will apply if an approval is not obtained prior to the adoption of these amendments and construction has not occured. Mr. Steve Piasecki stated that the applicant will be warned. Commissioner Kearns asked about requiring 15 feet instead ofjust 12. Is 12 enough? Commissioner Gibbons responded that the range in the survey is 5-20 feet. Staff is addressing diverse neighborhoods. Fifteen feet is large for some lots. Staff can encourage applicants as they did with the previous applicant from tonight's agenda. Chairman Lindstrom closed Public Hearing for Agenda Item No. 2. Motion: Upon motion of Commissioner Meyer-Kennedy, seconded by Commissioner Gibbons, the Planning Commission moved to continue TA 96-01 to the July 23, 1996, meeting. (7-0) REPORT OF THE COMMUNITY DEVELOPMENT DIRECTOR The written report of Mr. Steve Piasecki, Community Development Director was accepted as presented with the following comments: · Introduced planning intern, Steve Patterson. · Advised that the contract has been awarded for the construction of two of the three proposed bridges. · SARC meets on Thursday, July 11th.
