Shinn APPROVAL OF MINUTES Motion: On motion of Commissioner Meyer-Kennedy, seconded by Commissioner Lowe, the Planning Commission minutes of June 14,1994, were approved. (7-0-0) COMMUNICATIONS There were no communications. AGENDA MODIFICATIONS OR POSTPONEMENTS There were no agenda modifications or postponements. CANCI~.LLATION OF !ULY 12.1994 MEETING Chairperson Perrine announced the cancellation of the Planning Commission meeting of July 12, 1994, due to a lack of agenda items. City Attorney William Seligmann advised that the cancellation should be posted. pUBLIC HEARINGS Chairperson Perrine read Item No. 1 into the record. 1. UP 94-08 Public Hearing to consider the application of Ms. Claudia Peterson, on behalf of Pacific Coast Academy, for approval of a Use Permit to allow a 2,000 square foot karate school located at 2507 S. Winchester Boulevard (Campbell Plaza) in a C-2-S (General Commercial) Zoning District. Ms. Gloria Sdara, Planner I, presented the staff report noting the following: · Applicant is seeking approval of a Use Permit to allow a 2,000 square foot karate school at the Campbell Plaza Shopping Center. · The Center has 319 parking spaces available for the shared use of all of the tenants of the Center. · The proposed use is consistent with the City's General Plan and Zoning for the site. The proposed use is complimentary to other uses in the area. · The site is a sufficient distance so as to avoid adverse impact on residential uses. · Staff is supportive of the request and is recommending approval of a Resolution. Commissioner Meyer-Kennedy asked for clarification as to precisely where in the Center this proposed tenant space was located. Ms. Gloria Sciara replied that the space was located near the theaters. Commissioner Kearns inquired about the hours of operation for Sunday which are listed as 8:30 a.m. to 11:30 p.m. on Sunday. Ms. Gloria Sciara replied that this was a typographical error and that the correct hours for Sunday are from 8:30 a.m. to 11:30 a.m. Planning Commission Minutes of June 28, 1994 Page 3 Chairman Perrine opened the Public Hearing on Item No. 1. There were no parties interested in addressing Item No. t. MOTION: On motion of Commissioner Aine, seconded by Commissioner Kearns, the Planning Commission moved to close the Public Hearing. (7-0) MOTION: On motion of Commissioner Kearns seconded by Commissioner Lindstrom, the Planning Commission adopted Resolution 2922, allowing the establishment of a karate school (Pacific Coast Academy) on property located at 2507 S. Winchester Boulevard, by the following roll-call vote: AYES: NOES: ABSENT: Alne, Higgins, Kearns, Lindstrom, Lowe, Meyer-Kennedy, Perrine None None This action is final in ten days, unless appealed. Chairperson Perrine read Item No. 2 into the record. 2. V 94-01 Public Hearing to consider the application of Mr. Mark Bisho for approval of a variance allowing a 16'9" garage setback for a residential addition on property located at 1251 Fewtrell Drive in an R-l-6 (Single Family Residential) Zoning District. Ms. Gloria Sciara, Planner I, presented the staff report noting the following: · The applicant is seeking a variance allowing a garage setback of 16'9" instead of the required 25' to allow the construction of a new two-car garage and the expansion of the existing residence. · Under the Zoning Ordinance, the Planning Commission has the authority to allow a variance for a reduced garage setback. · All other alternatives were considered by the applicant and this proposal is the only viable alternative. · Staff finds that this application conforms to variance criteria and is supportive of the request. Planning Commission Minutes of June 28, 1994 Page 4 The Site and Architectural Review Committee was supportive of the request but wanted the Architectural Advisor's feedback on a planned skylight which he has now made. Staff recommends approval. Commissioner Lowe asked what is the average size of a garage and whether this proposed garage was exceedingly large. Ms. Gloria Sciara replied that the garage was a standard sized two-car garage. Commissioner Kearns stated her concerns about any impacts on visibility for traffic on Fewtrell and Midway that may occur as a result of the reduced setback. Ms. Gloria Sciara replied that the 16'9" setback will still leave room for two cars to park in tandem in the driveway. This variance request is similar to others approved in the City. Commissioner Alne asked for clarification on the parking space in the driveway. Ms. Gloria Sciara replied that there was room for two cars in the driveway. Commissioner Alne asked whether this reduced driveway setback would in effect encourage additional street parking by the residents. Ms. Gloria $ciara replied that the Parking Ordinance requires residential properties to provide two parking spaces. One space must be a covered space and the second may be uncovered. The applicant's proposal provides two covered parking spaces and two uncovered parking spaces which more than meets the requirement. Commissioner Meyer-Kennedy provided the Site and Architectural Review Committee (SARC) report as follows: · SARC was supportive of this proposed variance. Commissioner Alne asked staff what situation would cause staff not to support this variance request. Ms. Gloria Sciara replied that staff utilizes a list of standard findings which must be met in order to support a variance request. Planning Commission Minutes of June 28, 1994 Page 5 Commissioner Lowe inquired how many similar variance requests would be approved before the City would change its requirements in the City Codes. Ms. Gloria $ciara replied that staff maintains a checklist of variance approvals. This approval of variances is not prevalent. If an applicant's request can be met by using another part of their property, a variance would not be approved. Mr. Darryl Jones, Senior Planner, clarified that the intent is to look at variance requests on a case-by-case basis and to limit the number of exceptions to the general rule. Chairman Perrine opened the Public Hearing on Item No. 2. There were no parties interested in addressed Item No. 2. MOTION: On motion of Commissioner Meyer-Kennedy, seconded by Commissioner Kearns, the Planning Commission moved to dose the Public Hearing. (7-0) MOTION: On motion of Commissioner Meyer-Kennedy, seconded by Commissioner Higgins, the Planning Commission adopts Resolution No. 2923 approving a variance allowing a 16'9" garage setback for a residential addition on property located at 1251 Fewtrell Drive in an R-1-6 (Single-Family Residential) Zoning District, by the following roll-call vote: AYES: NOES: ABSENT: Alne, Higgins, Kearns, Lindstrom, Lowe, Meyer-Kennedy, Perrine None None This action is final in ten days, unless appealed. REPORT OF THE COMMUNITY DEVELOPMENT DIRECTOR The written report of Mr. Darryl M. Jones, Senior Planner, on behalf of Mr. Steve Piasecki, Community Development Director, was accepted with the following highlights made by Mr. Darryl Jones, Senior Planner: · SARC meeting of June 30th has been canceled. The next meeting will be held on July 14, 1994. Planning Commission Minutes of June 28, 1994 Page 6 The July 12th Planning Commission meeting has been canceled. The next meeting will be held on July 26, 1994. Commissioner Lindstrom inquired whether SARC meetings might not begin at 9 a.m. instead of 8:30 a.m. Commissioner Meyer-Kennedy, Chair of SARC, replied that 9 a.m. was an acceptable start time. ADJOURNMENT The Planning Commission meeting adjourned at 7:58 p.m., to the next Planning Commission meeting of July 26, 1994, at 7:30 p.m., in the Council Chambers, City Hail, 70 North First Street, Campbell, California.
