The Planning Commission meeting of December 27, 1994, was called to order at
7:30 p.m., in the Council Chambers, 70 North First Street, Campbell, California by

APPROVAL OF MINUTES
Motion: On motion of Commissioner Lindstrom, seconded by
Commissioner Lowe, the Planning Commission minutes of
December 13, 1994, were approved (6-0-1; Commissioner Meyer-
Kennedy was absent).

Motion: On motion of Commissioner Lindstrom, seconded by
Commissioner Lowe, the Planning Commission unanimously
elected Commissioner Meyer-Kennedy to serve as Planning
Commission Chair for 1995 (6-0-1; Commissioner Meyer-Kennedy
was absent).

Lowe, the Planning Commission unanimously elected
Commissioner Lindstrom to serve as Planning Commission Vice
Chair for 1995 (6-0-1; Commissioner Meyer-Kennedy was absent).

pUBLIC HEARING
Chairman Perrine read Item No. 1 into the record.
1. S 94-03 to
S 94-07
Public Hearing to consider the application of Mr. Bruce
Johnson, on behalf of Mr. Vernon Suart, for Site and
Architectural approval to allow five single-family homes
located at 1475 York, 1494, 1513, 1600 and 1605 Van Dusen Lane
in an R-l-9 (Single Family Residential) Zoning District.
Ms. Gloria Sciara, Planner I, presented the staff report regarding S 94-03 (1475 York
Avenue) noting the following:
· The applicant is proposing moving onto the site a single-family two-story
residence.
· Structure has 2,200 square feet.
· Applicant will be adding windows and a prominent porch element to
enhance the architectural features to be compatible with the area.
· The installation of this structure will comply with all the provisions of the
San Tomas Area Neighborhood Plan.
Commissioner/kine asked the age of the move-on homes.
Ms. Gloria Sciara replied that the homes were built in the mid-70s.

Commissioner Alne further inquired whether the homes would include new
furnaces and window upgrades.
Ms. Gloria Sciara replied that these structures would be treated ..as new
construction and therefore must meet all Uniform Building Code standards.
Under Code, the windows are not required to be changed to double-glazed.
Commissioner Lindstrom presented the Site and Architectural
Committee report as follows:
· Each of the proposed move-on homes has had upgrades proposed.
recommends approval for all five.
Review

Chairman Perrine opened the Public Hearing for S 94-07 (1475 York Avenue).
Mr. Bruce Johnson, AIA, architect for the applicant.
· Made himself available to answer any questions regarding this project.
· Stated that all issues had been resolved with staff.
· Houses look different than the original submittal.
· There have been a significant number of new windows added to front
elevations. Any new windows will be double glazed.
· Project complies with Code.

· Made himself available to address any questions.
· Issues have been addressed through staff.
· Many improvements have been made.
Commissioner Alne inquired where the homes are coming from.
Mr. Vernon Suart replied that these residences are being moved from Penmore
and Branham Lane as a result of the construction of Highway 85.

Maggie Blanco, 1435 York Avenue.
Visited the Planning Department this morning to review plans.
Her father, who is the owner of 1435 York, is an elderly man in his 80s. He
and many of the other elderly residents of the area are concerned with all of
the changes in their neighborhood particularly the extra traffic.
Stated that she has a problem with the installation of a two-story home on
York.
Quoted the San Tomas Area Neighborhood Plan's requirement that homes
should be compatible with the surrounding neighborhood. Currently, there
are no two-story homes on York.

Inquired whether the applicant for this project has the right to demand that
adjacent property owners install a fence on their property. She stated that her
elderly father had been frightened by someone who insisted that he was
obligated to install a fence. Their fence was removed during the construction
of Highway 85.
Ms. Gloria $ciara replied that there is no City requirement for fencing. The
applicant will be installing good neighbor fences on the five sites.
Chairman Perrine inquired who paid for good neighbor fencing.
City Attorney William Seligmann replied that typically both property owners
share the cost of installing fences. However, there is no City requirement for the
installation of fences.
Chairman Perrine clarified that their was no City requirement for fencing.
Ms. Gloria Sciara replied that he was correct.
Commissioner Alne asked Ms. Blanco whether she was asking the Commission to
deny the approval for the installation of the two-story home at 1475 York Avenue
in favor of a one-story home.
Ms. Blanco replied that he was correct in his assumption.
Commission Alne inquired what her rationale was for her position.
Ms. Blanco replied that she felt the two-story structure was not compatible with
the area and would tower over the existing homes.

Vernon $uart, Applicant.
Stated that he did not recall ever discussing fencing with Mr. Blanco. Perhaps
his father did.
The way that they are utilizing the site on York for the two-story structure
will minimize the effect on the surrounding area.
The second story simply consists of three bedrooms and represents only 400
to 500 square feet.
He has been sensitive to the area and the massing in the area when deciding
which structure should be placed on which site.
The garage for this site will be detached.
The house will be pulled off the corner and landscaped in order to improve
the entry area.

Community Development Director Steve Piasecki reviewed the five sites and
agreed that the York site was the best site for this particular structure.
Ms. Gloria $ciara reiterated that there was limited space in the second story and
few windows overlooking adjacent properties.
Mr. Vernon Suart added that he has had discussions with the property owner
directly behind 1475 York to consider the possibility of his purchasing that site.
Stated his sensitivity to the neighborhood.
Ms. Gloria Sciara advised the Commissioners that a two-hour meeting with the
applicant, his architect, herself and representatives from the San Tomas Area
Neighborhood was held to review the plans for these five move-on homes into
the area. Landscape plans were developed for each project site to include trees and
shrubs.
Ms. Susanne Waher, 1381 Estrellita Way.
· Thanked the Commission and staff for the opportunity to participate in the
review of this project in the joint meeting with staff, the applicant and local
residents of the San Tomas Area Neighborhood.
· Over a two-hour period, this group reviewed each project.
· Landscaping will shield and soften the impact of the two-story and felt
satisfied that this house is appropriately placed on the York lot.
Commissioner Lowe inquired whether earthquake standards would be met.
Mr. Bruce Johnson replied that they are required by Code to meet current
standards. The project meets every aspect of seismic design.

Commissioner Kearns the Planning Commission unanimously
moved to close the Public Hearing (6-0-1; Commissioner Meyer-
Kennedy was absent).

On motion of Commissioner Lindstrom, seconded by
Commissioner Lowe, the Planning Commission adopted
Resolution 2942 granting a Site and Architectural approval (S 94-07)
to allow a single-family home to be relocated onto property located
at 1475 York Avenue in a R-l-9 (Single-Family Residential) Zoning
District, by the following roll-call vote:

Ms. Gloria Sciara, Planner I, presented the staff report regarding S 94-05 (1494 Van
Dusen Lane) noting the following:
The structure is 1,700 square feet with a detached garage, a stucco exterior, a
trellis element at the front porch and a tile roof.
· Project meets the requirements of the San Tomas Area Neighborhood Plan.
· Staff recommends approval.
Commissioner Lindstrom presented the Site and Architectural Review
Committee report as follows:
· With the inclusion of the porch enhancements SARC was supportive of this
project.
Chairman Perrine inquired whether the road was private.
Ms. Gloria Sciara replied that currently the road belongs to the State. A proposal
in under consideration to turn it over to the jurisdiction of the City.
Chairman Perrine opened the Public Hearing for S 94-05 (1494 Van Dusen Way).
There were no parties intesting in addressing this project.
MOTION:
On motion of Commissioner Lowe, seconded by Commissioner
Higgins, the Planning Commission unanimously moved to close
the Public Hearing (6-0-1; Commissioner Meyer-Kennedy was
absent).

Lindstrom, the Planning Commission adopted Resolution 2943
granting a Site and Architectural approval (S 94-05) to allow a single-
family home to be relocated onto property located at 1494 Van

Dusen Way) noting the following:
· This structure is a two-story home with 2,360 square feet.
· Site backs onto the freeway and is not highly visible.
· Garage is detached and overlay windows will be added

approximately 1,600 square feet.
· Project has wood siding and a prominent porch will be added. The garage is
detached.
· Project meets all requirements under the San Tomas Area Neighborhood
Plan.
· Staff recommends approval of this project.

Chairman Perrine inquired whether the property was considered to be on Harriet
Avenue.
Mr. Darryl Jones, Senior Planner, replied that the assigned address for the site is
on Van Dusen.
Commissioner Lindstrom presented the Site and Architectural Review
Committee report as follows:
With the improved porch structure, SARC is supportive of this project and
finds that it provides consistency with the surrounding area.
Chairman Perrine opened the Public Hearing for S 94-04 (1600 Van Dusen Way).
Ms. Dawn Vadbunker, 1360 Burrows Road.
· Supports the project and finds that
it meets the character of the
neighborhood.
Moving existing houses is "recycling at its best" instead of becoming land fill.
Finds that the added windows offer enhancement of the structures.
One concern (however, not a serious objection) is the fact that the siding on
this particular structure does not go ail away around.
Overall, she is enthusiastic about this project and supportive.

Staff supports the proposed project.

REPORT OF THE COMMUNITY DEVELOPMENT DIRECTOR
The written report of Mr. Steve Piasecki, Community Development Director, was
accepted with the following highlights by Mr. Darryl M. Jones, Senior Planner:
· The January 10, 1995, Planning Commission meeting is cancelled due to a
lack of agenda items. The next Planning Commission meeting will be held
on January 24, 1995.
· The Site and Architectural Review Committee will meet on Thursday,
December 29, 1994, with new members Commissioner Lindstrom and
Commission Kearns. Commissioner Alne has agreed to be available for
SARC meetings in the event he is needed to cover for the absence of one of
the members.
Commissioner Alne inquired of Mr. Jones whether any Planning Commission
items have been appealed to the City Council.
Mr. Darryl Jones replied that on January 3, 1995, the Council will hear the appeal
on the Use Permit for 935 Steinway Avenue (Large Family Day Care). On January
23, 1995 (a Monday night), the City Council will hear an appeal of the fencing
exception granted by the Planning Commission for 1265 Burrows Road.

The Planning Commission meeting adjourned at 8:14 p.m., to the next Planning
Commission meeting of January 24, 1995, at 7:30 p.m., in the Council Chambers,
