Shinn APPROVAL OF MINUTES Motion: On motion of Commissioner Gibbons, seconded by Commissioner Francois, the Planning Commission minutes of December 13, 2005, were approved as submitted. (7-0) COMMUNICATIONS There were no Communications Items. AGENDA MODIFICATIONS OR POSTPONEMENTS There were no Agenda Modifications or Postponements. ORAL REQUESTS There were no Oral Requests. Planning Commission Minutes of January 10, 2006 Page 2 *** PUBLIC HEARINGS Chair Alderete read Agenda Item No. 1 into the record as follows: 1. PLN2005-151 Mundy, J. Public Hearing to consider the application of Mr. Jason Mundy, on behalf of Mr. Joe O'Brien and Mr. Roger O'Brien, for a Site and Architectural Review Permit (PLN2005-151) to allow the construction of a new single- family residence on property owned by Mr. Joe O'Brien and Mr. Roger O'Brien located at 1059 Audrey Avenue in an R-1-10 (Single Family Residential) Zoning District. Staff is recommending that this project be deemed Categorically Exempt under CEQA. Project Planner: Stephanie Willsey, Planner I Ms. Stephanie Willsey, Planner I, presented the staff report as follows: · Advised that the applicant is seeking approval of a Site and Architectural Review Permit to allow the construction of a new one-story single-family residence with attached garage on property located at 1059 Audrey Avenue, which is located on the north side of Audrey Avenue and surrounded on all sides by single-family residences. · Described the General Plan Land Use designation as Low Density Residential and the Zoning Designation as R-1-1 0 (Single Family Residential). · Explained that this proposal is consistent with the provisions of the Zoning, General Plan and San Tomas Area Neighborhood Plan and includes representative architectural features such as simple rectangular forms, porch, composition roofing and a mixture of stucco and horizontal wood siding. · Recommended approval of this application as conditioned. Commissioner Rocha presented the Site and Architectural Review Committee report as follows: · SARC reviewed this project at a special meeting held on December 20, 2005, and was supportive. Chair Alderete opened the Public Hearing for Agenda Item NO.1. Mr. Rory Pilkington, 994 Steinway Avenue, Campbell: · Said that he has no concerns about this proposed new house, which is located directly behind his home. · Added that he is pleased that what is planned is a single-story home with a maximum height of 19 feet. · Said that his only concern is the fact that Audrey has above grade lots from Steinway. Explained that there used to be a three foot culvert that handled water but it is no longer there. · Reported that his property gets a pond in the rear yard as a result of this grade difference as does the property of his neighbors on this side of Steinway Avenue. · Stated that he had put in a fence that he had hoped would last a long time but due to the difference in grade and the back fill that touches the fence, it is in need of replacement already and he hopes that some sort of retaining wall would prevent damage to this replacement fencing. · Assured that he wants to work with this neighbor on the inclusion of a minimal retaining wall with a fence atop it. · Reiterated that he is pleased with the proposed size of this house. Chair Alderete closed the Public Hearing for Agenda Item No.1. Chair Alderete asked staff to address the drainage issue raised by Mr. Pilkington. Planner Stephanie Willsey said that site drainage would be addressed with the Building Permit. By law, each project must maintain its own drainage on the property. Commissioner Gibbons asked how the grade difference is addressed when considering fencing. Planner Stephanie Willsey replied that the person on the higher side gets the six-foot height, which results in a slightly taller fence on the lower grade side. Commissioner Gibbons asked whether Mr. Pilkington could get information about site drainage from Public Works or Building. Director Sharon Fierro pointed out that Condition of Approval 16 addresses a retaining wall on the property line. Commissioner Francois asked if Mr. Pilkington's concern is addressed with this Condition of Approval. Director Sharon Fierro replied yes. Motion: Upon motion of Commissioner Rocha, seconded by Commissioner Francois, the Planning Commission adopted Resolution No. 3705 approving a Site and Architectural Review Permit (PLN2005-151) to allow the construction of a new single-family residence on property owned by Mr. Joe O'Brien and Mr. Roger O'Brien located at 1059 Audrey Avenue, by the following roll call vote: AYES: Alderete, Doorley, Ebner, Fran~ois, Gibbons, Rocha and Roseberry NOES: None ABSENT: None Planning Commission Minutes of January 10, 2006 Page 4 ABSTAIN: None Chair Alderete advised that this action is final unless appeal in writing to the City Clerk within 10 calendar days. *** REPORT OF THE COMMUNITY DEVELOPMENT DIRECTOR The written report of Ms. Sharon Fierro, Community Development Director, was accepted as presented with the following additions: · Reported that Council at its meeting of January 3, 2006, held a hearing on Hazardous Vegetation. She explained that usually the process starts with about 60 properties on the list and the final list abated is generally reduced to four or five properties. · Announced that Council has scheduled Neighborhood Meetings that will offer the community an informal opportunity to discuss issues of interest with specific city departments. The first meeting will be held at Capri School on January 31, 2006. Tables will be set up for each department and appropriate staff will be present to field questions from the community. · Advised that one item from the January 24th Planning Commission meeting has been withdrawn. That item was an appeal of an Administrative Decision to allow a second story residential addition. · Informed that on February 28th a Planning Commission Study Session would be held to begin work on design guidelines. Chair Alderete suggested that the Commissioners offer suggestions for Study Session topics. Commissioner Rocha suggested discussing issues of compatibility between adjacent industrial and residential uses. Director Sharon Fierro advised that there is no certain date for the Zoning Code Update. She added that staff has a list of items to include in the Zoning Code Update such as an Inclusionary Ordinance, design guidelines, interfacing and minor clean up of the Code. She said this work would begin some time in April. Commissioner Gibbons suggested the need to set standard specific parameters for site drainage requirements. ADJOURNMENT The Planning Commission meeting adjourned at 7:46 p.m. to the next Regular Planning Commission Meeting of January 24, 2006.
