Campbell Avenue - Massage Use Dear Ms. Jaffari: Thank you for taking the time to prepare the floor plan for your business. I have reviewed this material carefully and conducted a site visit at your business location. This information indicates that the proposed tenant space for the massage use is located approximately 43 feet from the Campbell A venue property line. In the C-3 zoning district, message uses are considered the same as a health spa. Considered as a health spa, Section 21.1O.060.C of the Campbell Municipal Code requires that the business be "located in a separate tenant space that is a minimum of 50 feet from the East Campbell Ave. property line; and the separate tenant space does not have a door or entrance that takes access from East Campbell Avenue." The intent of this ordinance is to allow non-retail uses at the rear of deep parcels fronting on Campbell Avenue. If the message use is considered ancillary to the beauty salon, as we discussed, the existing beauty salon is considered a "legal non-conforming use" and the addition of a massage use is considered an intensification of the use, which is also not allowed by the Municipal Code. Parcel 279-41-010 to offer Massage Therapy. Villa de Style is a full service Hair Salon located at the above address. The Massage Therapy room is located at the rear of the building, 51 ft from the front property line, and is adjacent to the rear entrance of Villa de Style. The room is being use by an Esthetician and the plan is to share the room with a Massage Therapist on a part time basis. The current schedule is planned usage Monday and Fridays from 4:00 PM to 8:00 PM (which is within the normal business hours 8 AM - 8 PM of Villa de Style) with an occasional Saturday usage between the hours of 9:00 AM and 4:00 PM (also within the normal business hours 8 AM - 6 PM of Villa de Style). There will only be one Massage Therapist using this room on the days specified. There is only one Esthetician that will use the room on a schedule that does not conflict with the Massage Therapist's schedule. Therefore, only one person will use the room during their scheduled shift. The traffic generation by adding a Massage Therapist is minimal. Typically, only 2-3 clients are scheduled during the Massage Therapist's shift. Because Villa de Style is a full service salon, it pride's itself on meeting its customers needs by offering massage therapy in addition to hair styling and skin care. Campbell Avenue is considered to be a "legal non-conforming use". This means that the use, while legally established, in not consistent with the current zoning requirements for Downtown Campbell. The Zoning Code does not allow beauty salons on the ground floor of parcels abutting Campbell Avenue (see CMC 21.1O.060.B - Permitted Uses in C-3 Zone). The addition of a massage use at this location would be considered an 'intensification" of the existing use, and consequently could not be issued a Business License by the City. The City has determined that a massage use can be approved under the Health Spa use listed in the C-3 Zoning District, however this use is also not allowed on the ground floor of parcels abutting Campbell Avenue (see CMC 2111O.060.C).
