Planning Commission City of Campbell, California February 25, 1992 CITY HALL COUNCIL CHAMBERS TUESDAY Minutes The Planning Commission of the City of Campbell convened this day in regular session, at 7:30 p.m., in the City Hall Council Chambers, 70 North First Street, Campbell, California. The meeting was called to order by Vice Chairperson Alne, due to the absence of Chairperson Fox, and the following proceedings were had to wit: ROLL CALL Commissioners Present: Vice Chairperson I. Haley Planning Assistant, Lynette Dias City Attorney, Bill Seligmann City Engineer, Joan Bollier Reporting Secretary, Karon Shaban APPROVAL OF THE MINUTES On motion of Commissioner Wilkinson, seconded by Commissioner Meyer- Kennedy, the January 28, 1992, minutes of the Planning Commission, were approved, as amended, (6-0-1), Chairperson Fox being absent. COMMUNICATIONS Vice Chairperson Alne drew attention to the newspaper clipping before the Commissioner's daises, relating to the new interim City Manager. Commission Minutes of February 25, 1992 Planning page 3 MOTION: MOTION: AYES: NOES: ABSENT: On motion of Commissioner Meyer-Kennedy, seconded by Commissioner Dougherty, it was unanimously ordered that the Public Hearing be closed. On motion of Commissioner Meyer-Kennedy, seconded by Commissioner Dougherty, it was unanimously ordered Resolution No. 2783 be adopted, approving the application, incorporating the findings, and, subject to Conditions of Approval by the following roll call vote: Commissioners: Commissioners: Commissioners: Higgins, Perrine, Wilkinson, Dougherty, Meyer-Kennedy, Alne None Fox o UP 92-02 Public Hearing to consider the application of Mr. Mark Heinz, M. Heinz and Mr. Bob Martinelli, for approval of a Martinelli, B. Conditional Use Permit to allow the establishment of a Tanning Salon, on property located at 2532 South Winchester Boulevard, in a C-2-S (General Commercial) Zoning District. Vice Chairperson Alne read the application into the record. Associate Planner, Tim J. Haley, presented the staff report noting the following: · Applicant's request is to continue an existing business. · The applicant was erroneously issued a Business License. Because of an amendment to his 1989 License, a Use Permit is required. He is seeking to bring his business operation into compliance with the current City Zoning. · Hours and days of operation. · Site locations and size. · The requested use was transmitted to other departments within the City and there were no objections, therefore, staff is recommending approval. Commission Discussion: Planning Commission Minutes of February 25, 1992 pa~;e 5 Associate Planner, Mr. Tim J. Haley, presented the staff report noting that: · Modifications are generally on the interior of this commercially zoned building. The Central Business District Zoning requires a Conditional Use Permit. · Number of parking spaces. Staff recommends approval of the project with the following modifications: · Enlarging the landscaped area at the parking area, incorporating a raised planter or potted plants on the sidewalk along the Campbell Avenue frontage. Mr. Haley informed the Commission that the applicant has indicated that he would repaint the building, and add an awning treatment. Staff is suggesting modification to the design of the awning, and requested that revisions return to the Planning Department for approval. In response to Commissioners' questions, Mr. Haley stated that the building will not be expanded, and that available parking exceeds the ordinance requirements. Commissioner Wilkinson presented the Site and Architectural Review Committee meeting of February 12, 1992, as follows: · The Committee requested modification to the proposed awning design. · Requested additional landscaping; and, · The Committee recommends approval, with the above changes. Vice Chairperson Alne opened the public hearing. Public Comment: There was no public comment. MOTION: On motion of Commissioner Dougherty, seconded by Commissioner Meyer-Kennedy, it was unanimously ordered that the Public Hearing be closed. Commissioner Meyer-Kennedy noted her support for prior improvements made in the downtown area by Mr. Raffanti. However, she expressed concern that increases in office uses in the downtown area may limit the retail space in the future. Planning Commission Minutes of February 25, 1992 page 7 Ordinances and also require the City to adopt architectural design standards. Staff is recommending that the Commission discuss the proposal and requesting direction in the following areas: · The Commission's degree of comfort with delegation of responsibilities to the Committee. · Specification of what portions of the proposal the Commission is supportive of. · Additional modifications to the review process. After receiving direction from the Commission, Staff will prepare a report outlining which, if any, amendments would be required to City Codes and Ordinances, and return the report on April 14, 1992. The following issues were discussed the Commission: · Commissioner Wilkinson: Preferred that requests for variances be kept for review by the full Commission. · Commissioner Meyer-Kennedy: Addressing Associate Planner, Tim Haley, asked if implementation of these, changes would impact the Planning Department's workload, and to estimate the number of applications forwarded to the Commission forwarded to the Commission due to disagreement between Administration and the applicant. Mr. Haley explained that it is his understanding that the Chairperson's intent was to simplify applications that cannot be resolved at staff level by allowing the applicant to appeal and get final approval from the SARC. Mr. Tsuda suggested that if development guidelines were developed, it would clarify what standards the Committee should review. Vice Chairperson Alne: expressed an opinion that the proposal could work in favor of the applicant, shortening the review process when resolution could not be reached, and minimizing the applicant's fees. He was supportive of the proposal. Commissioner Meyer-Kennedy: Again directed the question to Mr. Haley regarding impact on the Planning Department Staff workload. Planning page 9 Commission Minutes of February 25, 1992 appeal to the Planning Commission for resolution. Commissioner Dougherty: Asked that if these modifications are adopted, the Commission appoint three members of the Planning Commission to sit on the Committee, instead of two, as currently structured. Commissioner Higgins: Would like the Committee authorized to approve sign requests. Regarding the Establishment of Neighborhood Design Standards: Commissioners provided the following comments: Commissioner Dougherty initiated concern relating to establishing neighborhood design standards. He was not supportive of established guidelines since Campbell is composed of numerous neighborhoods and numerous designs. Commissioner Wilkinson was not supportive of establishing design standards for neighborhood design, because there are too many different neighborhoods and opinion regarding design is also varied. Vice Chairperson Alne was opposed to establishing guidelines that would make architectural design too limited and too controlled. He asked Staff to consider how the Commission would attempt to set boundaries between one neighborhood and another. Commissioner Meyer-Kennedy reminded the Commission that opinions do vary as to what is architecturally pleasing. She spoke about a previous architectural design, which was approved prior to this Commission's tenure, noting this Commission's current position relating to its design. A Commission approved it, and that the people that bought them like them. Commissioner Higgins concurred with the other Commissioners regarding the establishment of neighborhood design standards. Commissioner Dougherty asked for input from the Architectural Advisor relative to this issue. He concluded that he is uncertain whether or not the Commission or the Council desires to control things such as how a property owner feels about what he would like to see on his property. Vice Chairperson Alne noted the Commission's decision seemed to be that Planning Commission Minutes of February 25, 1992 pa$;e 10 there is no interest in pursuing rigid control of what people do with there property. Further, that the Commission is not interested in overwhelming the Planning Department Staff by significantly increasing its workload. I-Ie asked for a report in one month. REPORT OF THE PLANNING DIRECrOR The report of the Planning Director was accepted.
