Campbell Avenue- Dear Mr. Bowen: The Community Development Department has reviewed your letter dated August 31, 1999, wherein you describe your intent to temporarily occupy a vacant tenant space at 389 E. Campbell Ave. Office uses on the ground floor of buildings located along this portion East Campbell Avenue are not permitted under the C-3- S(Centml Business District) Zoning District, however, the temporary use of this space for an office use is acceptable for a period of 9 months to one year while your new office building is being constructed at 54 N. Central Ave. Please be advised that the previous travel service agency was considered a service commercial use. As such, this use was a non-conforming use based upon those uses permitted in the C-3-S(Central Business District) Zoning District. The establishment of a temporary office use for 9 months to one year will discontinue the previous service commercial non-conforming use for more than 6 months and will invalidate the previous non- conforming status of this property. Consequently, at the termination of the office tenancy, the use of this space will need to return to a use pennitted in the C-3-S Zoning District. Campbell Travel, the previous tenant, has vacated the location. Due to the scheduled demolition of our current office, we are seeking temporary offices until the new office building is complete. The anticipated completion date is nine months to a year from this September. We understand the interest in establishing retail businesses along Campbell Avenue and assure you that we will continue to do our part to help the downtown thrive. Dear Mr. Piasecki; This letter represents the opinion of the undersigned Downtown Campbell merchants that as many of the first floor commercial spaces as possible in the two blocks of East Campbell Avenue between Harrison Avenue and First Street, should be retail usages. As you well know, this opinion conforms to City policy. In particular we object to the pending usage of number 389 for offices. The previous tenant in this space was Campbell Travel Service, which we regard as an equivalent retail usage, in the sense that its door was open at all times to the general public without appointment, for the purpose of purchas- ing a service at retail. An office, on the other hand, is primarily for the private business of the tenant. The general shopping public is not welcome. The front door is for the use of the private clients of the tenant. The reason for this letter is our belief that the commercial vitality of the downtown core is based on it being filled to capacity with retail businesses which attract walk-in as well as destination-bound customers. The greater the variety of such businesses, the more popular the core will become. We understand something of the rules governing the grandfathering of non-conforming usages, but we believe that Campbell Travel Service should have been considered a conforming usage for the reasons stated above. We respectfully request that you and the planning staff recommend against an office usage at num- ber 389 East Campbell Avenue, and that you encourage the owner to lease to a retail business whose offerings will add variety and interest to the commercial mix of businesses we already enjoy.
