Even though there is currently no automatic irrigation system in place at the parking lot where the modular classroom building is located, (nor at much of the grounds of the facility), there is a groundsperson on-site daily. As a result, all of the plants and landscaping receive exceptional care and sufficient watering by hose. Therefore, extending an automated irrigation system to this area from within the center of the complex seems a costly and unnecessary action given the level of care that has existed at the school/church facility for many years. Please see the attached photos for evidence of the long-term care which has been provided. The school will extend this same level of care to the 100 square foot area where the required tree and groundcover will be planted. The species selected are low-maintenance materials and require no more than the irrigation supplied by nature after the first year of growth. It is in the interests of both the school and the City for the school grounds to maintain their attractiveness and the Campbell Christian School Board will see to it that this continues to be the case. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application PLN2000-89 (M): There is adequate parking on-site to accommodate the proposed use based upon the staggered use of the site by the church and school uses. The proposed use of the modular building for additional classroom space is consistent with the existing uses on the property. The proposed modular classroom is placed so as to provide sufficient distance from the nearest residential uses to minimize conflicts regarding potential noise problems. Adequate circulation has been provide on-site andthe site is so situated that adequate access has been provided to the site. Based on the foregoing findings of fact, the Planning Commission further finds and concludes that: The placement of a portable classroom will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. The proposed site is adequate in size and shape to accommodate the yards, wall, fences, parking and loading facilities, landscaping and other development features required in order to integrate said use with uses in the surrounding area. The proposed use is compatible with the uses in the area. The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions in accordance with the ordinance of the City of Campbell and the State of California. The lead department with which the applicant will work is identified on each condition where necessary. Project Approval - Approval of this Modification (PLN2000-89) of Conditional Use Permit (LIP 97-15) allows the placement of a one-story, 960 square foot modular classroom building on the western side' of property located at 1075 W. Campbell Avenue. This approval is valid for one year, or until September 12, 2001. One Year Review: Should the school wish to install additional classrooms or continue use of this modular classroom beyond that date, the applicant is required to return to the Planning Commission for an extension of approval and a (1) one year review. A. Project shall substantially comply with the site plan prepared by Sugimara & Associates Architects, dated 5/5/00. Modular Building Colors/Elevations: The modular classroom building shall be painted to match the existing structures on site. Additionally, the classroom classroom building shall include additonal o Trash Enclosure(s): Owner or applicant to construct trash enclosure(s) per City standards. Enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. Enclosure(s) to be constructed at grade level and have a level area adjacent to the trash enclosure area for ease of service and collection. The Community Development Director shall approve the location and design of the trash enclosure(s). Landscape Plan: The applicant shall submit four copies of a landscape/irrigation plan for review and approval of the Community Development Director, providing landscaping and irrigation within the triangular area south of the proposed classroom structure. The building permit shall include Electrical/Plumbing/Mechanical fees when such work is part of the permit. o Construction Plans: The Conditions of Approval shall be stated in full on the cover sheet of construction plans submitted for building permit. o Size of Plans: The maximum size of construction plans submitted for building permits shall be 24 inches by 36 inches. o Site Plan: A competently prepared site plan shall be submitted showing all pertinent features and structures proposed for the site. Elevations of all "paths of travel" related to access for the disabled shall be called out. Site Plan shall be stamped and signed by responsible engineer. o Soils Report: Two copies of a current soils report, prepared to the satisfaction of the Building Official, containing foundation and retaining wall design recommendations shall be submitted with the building permit application. This report shall be prepared by a licensed civil engineer specializing in soils mechanics. 10. Foundation Inspections: A pad certificate, prepared by a licensed civil engineer or land surveyor, shall be submitted to the project building inspector upon foundation inspection. This certificate shall certify compliance with the recommendations as specified in the soils report and the building pad elevation and on-site retaining wall locations and elevations are prepared according to approved plans. Horizontal and vertical controls shall be set and certified by a licensed surveyor or registered civil engineer for the following items: A. Pad Elevation B. Finish Floor Elevation (First Floor) C. Foundation Comer Locations 11. Title 24 Energy Compliance: California Title 24 Energy Standards Compliance forms shall be blue-lined on the construction plans. Compliance with the Standards shall be demonstrated for conditioning of the building envelope and lighting of the building. 12. Special Inspections: When a special inspection is required by U.B.C. Section 1701, the architect or engineer of record shall prepare an inspection program that shall be submitted to the Building Official for approval prior to issuance of the building permits, in accordance with U.B.C. PURPOSE A Use Permit allows for special consideration of certain specified uses which may be compatible with an area depending on the specifics of the particular case. The Use Permit process is designed to provide the City sufficient flexibility to determine whether a specific land use on a certain site will be compatible with its environs and the General Plan. PROCESS Proiect Consideration & Pre-Application Review: In reviewing a use permit application, the staff and Planning Commission will evaluate such items as building placement and size, traffic generation, noise, hours of operation, adequacy of parking, circulation, drop-off facilities and overall compatibility of use with adjoining properties. It is recommended that the applicant submit a preliminary proposal to the Planning Department prior to submission of formal application. This will allow the Planning staff to review the request and inform the applicant of possible concerns related to the proposal. and building design and then forwards a recommendation to the Planning Commission. StaffReview: The Planning staffwill review the application and conduct a site investigation to determine the relationship of the request with the City's General Plan and to analyze land use, traffic, site plan and other impacts or concerns of the proposed project. A written staff report will be prepared for the Planning Commission (PC) that includes staff's recommendations and a description of the development proposal. A copy of this report will be sent to the applicant during the week prior to the PC hearing on the application. Copies are also available to the public. Public Notice: All use permit applications require a public heating which is held during the Planning Commission meeting. At least ten days prior to the meeting, property owners within 300 feet of the site will be notified by mail of the public hearing and a notice will be published in the Campbell Express. Filing of Application: The applicant should submit a completed application, filing fee, a written statement and other required information to the Planning Department. A planner will be assigned to review the material to make sure all the required information is provided. The applicant will be notified within 30 days as to whether the application is complete or whether additional information is required. Environmental Review: Typically, use permits are categorically exempt from the environmental review process. Planning Commission Meeting: The staff will present an oral report and recommendation for your application. This presentation will be followed by testimony from the applicant and then by any interested persons who may wish to comment on the application. The Planning Commission may then close the public hearing and make a decision approving or conditionally approving the request, denying the request or postponing the decision to a later date. Unless an appeal is filed, the Planning Commission's decision will become final unless ratification is required by the City Council. Senna, on behalf of the Church of Christ, for a use permit and approval of plans to allow construction of a new classroom building, a new office building, and an outdoor learning area, along with partial remodeling of the existing structure on property known as 1075 West Campbell Avenue in a Public Facilities Zone, as per the application filed in the office of the Planning Department on December 5, 1975, and after presentation by the Planning Director, proponents, and opponents, the hearing was closed. After due consideration of all evidence presented, the Commission did find as follows: l. That the establishment, maintenance and operation of the proposed use will not be detrimental to the health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such use, or be detrimental or injurious to property and improvements in the neightborhood or to the general welfare of the City. Based on the above findings, the Planning Commission does hereby grant the requested use permit subject to the following conditions: I. Landscape plan indicating type of plant materials, location of hose bibs or sprinkler system and type of fencing to be submitted for approval of the Planning Director at time of application for buildin.g permit. 2. Landscaping shall be maintained in accordance with the approved landscape plan. 3. Faithful performance bond in the amount of $3,000 to be posted to insure landscaping, fencing and striping of parking area within three (3) months of coopletion of construction, or applicant may file written agreement to complete landscaping, fencing and striping of parking area prior to final building department clearance. 4. All mechanical equipment located on roofs shall be screened as approved by the Planning Director. The applicant is notified as part of this application that he is required to meet thefoliowing conditions in accordance with Ordinances of the City of Campbell. A. Ali parking and driveway areas to be developed in compliance with Section 21.50 of the Campbell Municipal Code. Trash container(s) of a size and quantity necessary to serve the development shall be located in areas approved by the Fire Department. Unless otherwise noted, enclosures shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level. G. Applicant shall meet all state requirements for the handicapped. BUILDING DEPARTMENT H. Roof covering shall be fire retardant. PUBLIC HEARINGS Commissioner Pack reported for the Architectural Review Committee: UP 75-15 Church of Christ Senna, R.D. This is the time and place for continued public hearing on the application of Ronald D. Senna, on behalf of the Church of Christ, for a use permit and approval of plans to allow construction of a new classroom building, a new office building and an outdoor learning area, along with partlcal remodeling of the existing structure on property known as 1075 West Campbell Avenue in a Public Facilities Zone. Commissioner Pack reported that the Architectural Review Committee and the Architectural Advisor met with Mr. Senna, representing the Church of Christ, and they recommend approval subject to the conditions outlined by staff. _66 The applicant suomitted a revised plan showing more detail as requested by the committee and Mr. Senna indicated that they were in agreement with the recommended conditions. Mr. Kee advised that a letter had been received expressing con- cern about the access to the subject property. He presented a map showing the location of the development and the ingress and egress to it. The Architectural Review Committee recommends that the traffic problem be referred to the traffic engineer, and Mr. Senna indicated that he would work with the traffic engineer, in an effort to resolve the problems that might result from the traffic. Commissioner Hebard questioned the reference to a business operation on the property. Mr, Kee advised that a nursery school is in operation on the property. This is a permitted use in any zone with a use permit, and the church did receive a use permit in 1966 for the operation of a day school. Commissioner Dickson arrived and was seated at 7:45 p.m. Commissioner Campos stated that there is a statement in the letter that the church is being used for other than church related uses. Mr. Kee stated that this was in reference to the nursery school and the fact that the church property is next to Coventry School. Possibly the parking to the rear of the property is being used by people not associated with the church. During the week it is a convenient place to park for people going to Coventry School activities. Commissioner Hebard requested that the letter be referred to the other departments that might be interested in the use of the parking lot and also that Mm. Swiderskl, 1020 Hedegard Avenue, be notified of the action being taken by the Planning Commission. Mr. Kee advised that the Architectural Review Committee did not feel that the project should be held up until the traffic problems are solved, and he was of the opinion that the matter of ingress and egress should be worked out between the applicant and the traffic engineer. Commissioner Dickson also pointed out that the portion of Hedegard adjacent to the church property is in the county and this matter should be referred to the Sheriff's Department. Mr. Kee stated that the traffic problem on Hedegard would be under the jurisdiction of the Sheriff's Department, however, the on-site traffic circulation would be within the City of Campbell's jurisdiction. Chairman Lubeckis stated this is a continued public hearing and asked if anyone in the audience wished to speak for oP against the application. - 2 - 167 There being no one present wishing to be heard, Commissioner Stewart moved that the public hearing be closed, seconded by Commissioner Pack and unanimously adopted. Vernon Smith, on behalf of the Calvary Temple Church, for approval of plans to construct an addition to the front of the church audit6r~um and to construct a multi-purpose nursery school building on property known as 202 Railway Avenue in a Planned Development Zoning District. Commissioner Pack reported that'the Architectural Review Committee discussed this application at the meeting. The applicant was not in attendance and the committee recommends continuance in order that the applicant can submit revised plans. The committee recommends continuance to the second regularly scheduled meeting in February. Commissioner Hebard moved that PD 75-8 be continued to the February 19th meeting, seconded by Commissioner Stewart and unanimously adopted. PD 75-5 Roberts, C.T, This is the time and place for continued public hearing on the application of C.T. Roberts for approval of plans, elevations and development schedule to allow construction of an additional living unit on property located at 206 West Rincon Avenue in a Planned Develop- ment Zone. Commissioner Pack reported that the Architectural Review Committee discussed this application at length with Mr. Roberts. The plans he has now submitted show that he wishes to construct a new building rather than convert the existing structure. The
