The Planning Division has reviewed your plan submittal for the above referenced property in light of the
Planning Commission approval per Resolution No. 3309. The submitted plans are generally consistent with
this approval, subject to the following modifications or the provision of additional details:
Condition 4 Landscape Plan. Your letter dated November 7, 2000 describes the provision of 12
24 inch boxed trees as temporary landscaping. Please submit additional information regarding a
variety of plant materials and a detail of the containers and the method of irrigation.
2. The color scheme is considered acceptable as provided in your November 7, 2000 letter.
Please provide a construction phasing plan that illustrates the location of construction materials
and office trailers. It is recommended that a maximum amount of the parking area remain open
and available for existing uses as well as the temporary retail space for Avery's.

After notification and public heating, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as follows
with respect to application PLN2000-135:
The temporary sales trailer will be painted to blend with the existing buildings and trees
will be installed to soften its appearance.
The temporary sales trailer is necessary to provide temporary space for Avery's Gift Store
because they are being evicted from their current location before construction of their new
store on this site can be completed.
The temporary sales trailer will be used the minimum amount of time necessary to allow
Avery's to move into their new store. This approval is limited to a maximum of eight (8)
months or whenever the new store is completed, whichever is sooner.
4. Sufficient parking is available near the trailer to accommodate this use.
Based on the foregoing findings of fact, the Planning Commission further finds and concludes
that:
1. The development is consistent with the City's General Plan and zoning Ordinance.
2. The proposed project provides a desirable site layout for a commercial use within the
Kirkwood Shopping Center on this section of W. Campbell Avenue.
3. The proposed project will aid in the enhancement and the harmonious development of the
immediate area.

The applicant is hereby notified, as part of this application, that he/she is required to meet the
following conditions in accordance with the ordinance of the City of Campbell and the State of
California. The lead department with which the applicant will work is identified on each
condition where necessary. Additionally, the applicant is hereby notified that he/she is required
to comply with all. applicable Codes or Ordinances of the City of Campbell and the State of

COMMUNITY DEVELOPMENT DEPARTMENT REQUIREMENTS
1. Project Approval - Approval of this Modification (PLN2000-135) of Site and Architectural
Review Permit (PLN2000-86) to allow the placement of a one-story, 1,440 square foot
temporary sales trailer for Avery's on the eastern side of Kirkwood Shopping Center on
property located at 1600 W. Campbell Avenue. This approval is valid for a period of eight
(8) months from the date of approval or until the permanent retail building is completed
Building Colors/Elevations: The temporary sales trailer, decks and walkways shall be
painted to match the existing structures on site.

Portable Toilet: The portable toilet shall be reviewed by the Community Development
Director for compatibility with the surrounding uses and shall be maintained in a clean and
healthful condition at all times. Should the use of the portable toilet become a nuisance, it
shall be removed and restroom facilities be provided either in the building or in a nearby
permanent facility.
Landscape Plan: The applicant shall submit four copies of a landscape/irrigation plan for
review and approval of the Community Development Director. Sufficient trees shall be
temporarily placed on the site to provide adequate enhancement of the trailer and to screen
unenhanced elevations.
BUILDING DEPARTMENT REQUIREMENTS
5. Permits Required: A building permit application shall be required for the proposed
structure. The building permit shall include Electrical/Plumbing/Mechanical fees when
such work is part of the permit.
Construction Plans: The Conditions of Approval shall be stated in full on the cover sheet
of construction plans submitted for building permit.

Size of Plans: The maximum size of construction plans submitted for building permits

Site Plan: A competently prepared site plan shall be submitted showing all pertinent
features and structures proposed for the site. Elevations of all "paths of travel" related to
access for the disabled shall be called out. Site Plan shall be stamped and signed by
responsible engineer.
Title 24 Energy Compliance: California Title 24 Energy Standards Compliance forms
shall be blue-lined on the construction plans. Compliance with the Standards shall be
demonstrated for conditioning of the building envelope and lighting of the building.

Non-Point SoUrce Pollution Control Program: The City of Campbell Standard Santa Clara
Valley Non-Point Source Pollution Control Program specification sheet shall be part of the
plan submittal. The specification sheet (size 24 inches by 36 inches) is available at the

BACKGROUND
On August 22, 2000 the applicant received a Site and Architectural Approval to construct a new
two-story, retail/office building with associated parking and landscaping improvements at the
Kirkwood Shopping Center. The ground floor of the building will be leased to Avery's, a retail
girl store specializing in fine china and crystal. Avery's is currently located at the rear of the
Kiddie World Center on the comer of Steven's Creek Boulevard and San Tomas Expressway in
San Jose. Avery's was given notice that they would need to vacate their current location by
March, 2001, to allow Courtesy Chevrolet to relocate to this location. The approval of the Site
and Architectural Permit in August would allow the permanent building to be completed within
eight months.
In September, Avery's received notice that the premises would need to be vacated by November
18, 2000, four months earlier than anticipated and during the critical holiday sales period, one of
their busiest times. In an effort to assist their future tenant, Kirkorian Enterprises has submitted
an application to allow the installation of a temporary sales trailer that will allow Avery's to
operate without closing its doors to its customers. The applicant has submitted a letter
explaining the circumstances of this request (Attachment 4).
DISCUSSION
Applicant's Proposal: The applicant, John Kirkorian, is requesting approval of a Modification to
the Site and Architectural Permit to allow the installation of a temporary sales trailer that will
allow Avery's to conduct business until the newly approved building is completed, from
approximately November, 2000, to March, 2001. The application requests permission to operate
for an eight (8) month period from the temporary trailer to allow for any potential construction
delays.
The Kirkwood Shopping Center is located on the southwest side of W. Campbell Avenue at the
intersection with San Tomas Aquino Road. The proposed temporary sales trailer would be
located on the easterly portion of the site, near the Shell Gas Station, in an area that will be used
for parking once the construction is completed.
ANALYSIS
General Plan Designation: The General
Commercial.
Plan Land Use designation for the project site is
Zoning Designation: The Zoning Designation for the project site is C-1-S (Neighborhood
Commercial). The proposed temporary sales trailer is a permitted use within the C-1-S Zoning
District, subject to a Site and Architectural Review Permit.
Site Layout: The site plan illustrates the installation of the temporary sales trailer in the easterly
portion of the parking lot near the Shell Gas Station. This is an area of parking that will be used
by the newly constructed buildings and therefore will not affect parking or traffic circulation for
the stores in the existing center. Staff had asked if the temporary sales trailer could be placed on

the vacant pad next to the new building site. The applicant explained that they intend to seek
approval of a Walgreen's Drug Store for that site within a few weeks and begin construction to
coincide with that of the new retail/office building. The proposed location is removed from the
construction site to avoid traffic conflicts and in an area that will not disturb the visibility of
other tenants. The existing mature trees separating the Shell Gas Station and the shopping center
will screen the rear of the temporary trailer. A portable chemical toilet is to be located in the
parking lot to the south of the trailer. This unit is screened by trees and will be available to the
employees and customers of Avery' s.
Building Design: The building elevations illustrate the installation of a 1,440 square foot triple-
wide temporary sales trailer. The building has wood siding and will be painted to match the
predominant background color of the shopping center. Trees in large boxes will be placed
around the trailer soften its visual impacts. A deck/ramp will provide access to customers and
will comply with the accessibility requirements of the Americans with Disabilities Act. Any
signage will be reviewed and approved by staff in compliance with the provisions of the Sign
Ordinance.
Staff believes the request is reasonable because of Avery's unique circumstances and the
temporary nature of the request. A recommended Condition of Approval limits the length of
time the trailer may be used to not more than eight (8) months or until the construction of the
permanent building is completed, whichever comes first.
Parking: The temporary sales trailer will be placed in the parking lot, removing 14 parking
spaces. However, the trailer will only be used until the permanent building is completed and
Avery's can move into its new location during which time there will be 128 parking spaces that
are allocated for the new construction that will be available for parking for the construction
workers and Avery's. The parking demand for the temporary structure will be 8 spaces, with 129
available for their use (parking spaces located adjacent to the building pads have been subtracted
from the parking spaces shown on the approved site plan.
Landscaping: The applicant has indicated that a total of 12 trees in boxes will be placed adjacent
to the trailer to enhance its appearance. Staff will work with the applicant to select trees that will
provide evergreen varieties that will provide a sufficient canopy to enhance the site while not
blocking signs for the adjacent businesses. Upon completion of the permanent retail building,
the trees may be removed from the site and planted permanently elsewhere.
Site and Architectural Review Committee: The Site and Architectural Review Committee
reviewed this proposal at its meeting of September 24 and October 10, 2000. The Committee
was supportive of the applicant's proposal.

Dear Sharon and Tim:
As you know, we are working with Avery's to relocate them from San Jose to Kirkwood
Plaza. The target completion date of their new premises is March I, 2001. Averv's is
very excited in the prospects of being involved in a very active shopping center with
excellent "traffic". Aver,/s has been located in the Kiddie World Center since Nancy
Trainor purchased the store in March of 1986. Ave~'s is the largest independent gift and
tabletop store in Santa Clara County. They carry, the most varied selection of fine gifts,
c,hina, stemware, flatware, silver, home accessories, everyday dinnerware, crystal
gitSware (Waterford, Laiique, etc...), as weil as a full holiday shop that is filled (and
busy) year round, not just at C,hristmas. The day-in, day-out business of selling seasonal
merchandise has truly exploded in the last few years and Avery's has capitalized on the
trend quicHy. The total store has seen steady, expansive growth and they anticipate the

Avery's must vacate their existing location by November 15, 2000. As stated in Nancy

The temporary trailer would benefit Avery's in many ways. First, it will provide a
location for Avery's to sell their seasonal merchandise. Second, it will get Avery's

PURPOSE
The Site and Architectural Review Area is intended to
promote orderly development; to enhance the character,
stability, and integrity of neighborhoods and zoning districts;
to secure the general purpose of the City's Zoning Ordinance
and General Plan, and to assure high quality architectural
design and optimum site design through the architectural
review process.
PROCESS
Pre-Application Review: It is recommended that the applicant
make an appointment with a planner prior to submitting an
application to discuss the preliminary design of the project.
This will help the applicant determine if the proposal is
consistent with existing review standards and ordinance
requirements.
Filing of Application: The completed application must be
filed with the Planning Department along with the appropriate
fee and all required data. The staff planner who is on duty
will give the application and data a cursory review for
completeness. The application cannot be accepted if the
submittal is incomplete.
After the project has been assigned to a planner, it will be
reviewed in more detail for completeness. A letter stating if
the application is complete or if additional information is
required will be sent to the applicant within 30 days after
receipt of the application.
Environmental Review: Nearly all Site and Architectural
Review requests are required to have an environmental
assessment to determine if it will be necessary to prepare an
Environmental Impact Report or a Negative Declaration.
Traffic safety, congestion, and site circulation;
Landscaping; and
Building and site layout.
Staff Review: The Planning Staff will evaluate the request by
conducting an investigation of the site and considering the
proposal in relation to adjoining structures. Staff will prepare
a written report for the Planning Commission which will
analyze the development proposal and provide staff
recommendations. A copy of this report will be sent to the
applicant.
Site and Architectural Review Committee (SARC): Prior to
the Planning Commission meeting your application will be
reviewed by SARC. The Committee reviews the application
for site layout and building design and then forwards a
recommendation to the Planning Commission.
Public Notice: At least 10 days prior to the public heanng,
property owners within 300 feet of the subject property will be
notified by mail of the hearing. In addition, a notice of the
public hearing will be published in the Campbell Express.
Planning Commission Meeting: The Planning Commission is
required to review and approve detailed site, building, and
landscape plans. Staff will present an oral report and
recommendation for the proposed project. This presentation
will be followed by testimony from the applicant and then by
any interested persons who may wish to comment on the
application. The Planning Commission may then close the
public hearing and make a decision approving or conditionally
approving the request, denying the request, or postponing the
decision to a later date. Unless an appeal is filed, the Planning
Commission's decision is final.
Application Review: The Planning Staff, the Site and City Council: Site and Architectural Review applications are
Architectural Review Committee, and the Planning not required to go before the City Council, unless the Planning

As you know, we are working with Avery's to relocate them from San Jose to Kirkwood
Plaza. The target completion date of their new premises is March 1, 2001. Avery's is

excellent "traffic". Avery's has been located in the Kiddie World Center since Nancy
Trainor purchased the store in March of 1986. Avery's is the largest independent gift and
tabletop store in Santa Clara County. They carry the most varied selection of fine gifts,

giftware (Waterford, Lalique, etc...), as well as a full holiday shop that is filled (and
