After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. COMMUNITY DEVELOPMENT DEPARTMENT Planning Division Approved Pro. ject: Approval is granted for a Site and Architectural Review Permit and Conditional Use Permit to allow the installation of six (6) wireless telecommunications antennas. The project utilizes stealth techniques to reduce potential visual impacts. Project approval shall comply with project plans prepared by On Design Architects, dated October 10, 2001, except as modified herein in the Conditions of Approval. 2. Color and Finish of Antenna Screen: The fiberglass screen shall be painted and textured to match the existing building facade, which is a light colored stucco. Maintenance of Finish: It is an ongoing obligation of MetroPCS, assignees and successors in interest to maintain the exterior finish of the fiberglass panels in good order. Fade'd, peeling or damaged paint or material shall be repainted as soon as practical. 4. Site and Architectural Review Permit and Conditional Use Permit Approvals Expiration: Within one year from the date of approval, a building permit must be obtained and construction completed one year thereafter or the Site and Architectural Review Permit and Conditional Use Permit approvals shall be void. Length of Permit Term: This Site and Architectural Review Permit shall expire five years after permit approval, on December 11, 2006. If the use is to continue, the applicant shall apply' for additional five-year periods, subject to approval by the Community Development Director. Screening of Equipment Cabinets: Equipment cabinets installed on the building roof shall not be visible to the public from the street or shopping center parking lot. Campbell Avenue - Site & Use Permits- Stealth Antennas Page 3 o Cessation of Operations: The service provider shall provide written notification to the Community Development Director upon cessation of operations on the site exceeding a 90- day period. The service provider shall remove all obsolete or unused facilities from the site within 180 days of termination of its lease with the property owner or cessation of operations, whichever comes earlier. New Permit Required: If a consecutive period of 180 days has lapsed since cessation of operations, a new Site and Architectural Review Permit and Conditional Use Permit shall be required prior to use or reuse of the site. ° Security Required: Prior to issuance of any permits for this facility, the applicant shall provide an irrevocable letter of credit, cash deposit, or other reasonable form of security, satisfactory to the City Attorney, in an amount reasonably sufficient to cover the cost of removal, for the removal of the facility in the event that its use is abandoned or its Site and Architectural Review Permit expires or is terminated and the equipment is not voluntarily removed. MetroPCS shall provide an estimate of the cost of removal for review by the City prior to submittal of security. 10. Upgrading of Facility Required: If technological improvements or developments occur which allow the use of materially smaller or less visually obtrusive equipment, the service provider will be required to replace or upgrade the approved facility upon application for a new Site and Architectural Review Permit to minimize adverse effects related to land use compatibility, visual resources, public safety or other environmental factors. 11. Utilities: All new on-site utilities shall be installed underground per Section 20.36.150 of the Campbell Municipal Code for any new or remodeled buildings or additions. Applicant shall comply with all plan submittals, permitting, and fee requirements of the serving utility companies. 12. Business License Required: A City Business License shall be obtained for this operation prior to the issuance of a building permit and shall be renewed annually. 13. Cables: All external cables or equipment shall be obscured from public view by enclosing them in architecturally designed cabinets painted to match the structure. 14. Compatibility With City and County Fire Emergency Services: The facility shall not be operated nor caused to transmit on or adjacent to any radio frequencies licensed to the City or County Fire Department for emergency telecommunication services such that the agencies' emergency telecommunications system experience interference. 15. No Interference with Emergency Transmissions: The installation shall not interfere with any City or County Fire Department emergency service telecommunications facilities transmission. Lighting: The use of lighting shall not be allowed on telecommunication facilities unless required as a public safety measure. Where lighting is used, it shall be shielded to prevent glare on adjacent uses. 17. No Advertising: No advertising signage or identifying logos shall be displayed on wireless telecommunications facilities, except for small identification plates used for emergency notification or hazardous or toxic materials warning. 18. Noise: The telecommunications facility, including power source, ventilation and cooling facilities, shall not generate noise discernible to a person of normal hearing who occupies the fire station facilities. The noise level on adjacent residential uses shall not exceed an exterior noise level of 65dBA or noise level audible from a residential use with windows and doors closed an interior noise level of 45dBA. 19. Back-Up Generators: Backup generators shall comply with the noise standard referenced above and shall only be operated during power outages or for testing and maintenance between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday. 20. Maintenance Hours Restricted in Residential Areas. Normal maintenance activities shall only occur between the hours of 7:00 a.m. and 5:00 p.m., Monday through Saturday, excluding emergency repairs. 21. Heat Generation: The wireless telecommunication facility, including power source and cooling facility, shall not be operated so as to cause the generation of heat that adversely affects any building occupant. 22. Odors: The testing of back-up generators shall not produce odors that adversely affect the public. 23. Safety: Public Access Restricted: Antennas are to be sited in such a way and barriers and signage provided to prevent a person from passing within the safety limits established by the FCC-adopted standards for controlled access. Warning Signs: Signage shall be maintained at the facility identifying all wireless telecommunication facility equipment and safety precautions for people nearing the equipment as may be required by any applicable FCC-adopted standards, including the RF radiation hazard warning symbol identified in ANSI C95.2-1982, to notify persons that the facility could cause exposure to RF emissions. Emissions Conditions: It is a continuing condition of this authorization that the facilities be operated in such a manner so as not to contribute to ambient RF/EMF emissions in excess of then current FCC adopted RF/EMF emission standards; violation of this condition shall be grounds for revocation. Campbell Avenue- Site & Use Permits- Stealth Antennas Page 5 Periodic Safety Monitoring: The wireless telecommunications service provider shall submit to the Community Development Director 10 days after installation of the facilities, and every two years thereafter, a certification attested to by a licensed engineer expert in the field of EMR/RF emissions, that the facilities are and have been operated within the then current applicable FCC standards for RF/EMF emissions. As a co- location site, the report shall compare EMR/RF emissions at this location generated by all uses to the limits established by the FCC. The report shall be written in plain English. Emergency Contact: The service provider shall provide signage as required, including phone numbers of the utility provider, for use in case of an emergency. The signs shall be visibly posted on the communications equipment cabinet. Building Division 24. Permits Required: A building permit application shall be required for the proposed structure. The building permit shall include Electrical/Plumbing/Mechanical fees when such work is part of the permit. 25. Construction Plans: The Conditions of Approval shall be stated in full on the cover sheet of construction plans submitted for building permit. 26. Size of Plans: The maximum size of construction plans submitted for building permits shall be 24 inches by 36 inches. 27. Plan Preparation: This project requires plans prepared under the direction and oversight of a California licensed Engineer or Architect. Plans submitted for building permits shall be "wet stamped" and signed by the qualifying professional person. 28. Structural Drawings and Calculations: Plans shall include appropriate structural details and calculations prepared by California licensed engineer to justify design. 29. Transfer of Structural Loads: Plans shall detail how new rooftop equipment loads are supported and transferred within the existing structure. 30. Special Inspections: When a special inspection is required by U.B.C. Section 1701, the architect or engineer of record shall prepare an inspection program that shall be submitted to the Building Official for approval prior to issuance of the building permits, in accordance with U.B.C Section 106.3.5. Pollution Control Program: The City of Campbell, standard Santa Clara Valley Non-point Source Pollution Control Program specification sheet shall be part of plan submittal. Campbell Avenue. The antennas will be completely screened from view since they will be recessed in the building faCade and a portion of the existing faCade material will be removed and replaced with a radio-frequency friendly material painted and textured to replicate the existing stucco exterior. Staff Report -- Planning Commission Meeting of December 11, 2001 PLN2001-122 & 126- 1630 W. Campbell Avenue Page 2 of 3 Background: The subject property, the Kirkwood Plaza Shopping Center, is located on Campbell Avenue between San Tomas Aquino Road and Fulton Avenue. The site is surrounded by commercial uses on three sides, with multiple-family residential units to the south. The proposed antenna installation would be located on the building faCade of the Kirkorian Development office and retail building. An existing Nextel antenna facility on the building was installed in September 2001 after obtaining an administrative approval of a Site and Architectural Review Permit. There is also a Sprint antenna facility that resembles a light pole in the parking lot to the east of the subject building. ANALYSIS General Plan Designation: The General Plan land use designation for the project site is Neighborhood Commercial. The proposed project is consistent with the General Plan land use designation. Zoning Designation: The zoning designation for the project site is C-1 (Neighborhood Commercial). Wireless telecommunications facilities are permitted in the C-1 zoning district. When the facility meets the requirements for a "stealth" facility it is subject to the approval of a Site and Architectural Review Permit. Since an existing antenna facility is already located on this building, a Conditional Use Permit is also required per the Wireless Telecommunications Facility Ordinance. Use: MetroPCS is a new wireless phone carder that was authorized to provide personal telecommunications services from the Federal Communications Commission. The proposed facility is essential to developing a network in order to meet FCC requirements for seamless coverage of wireless telecommunications service. The network must be activated by early 2002. Antenna Description and Mounting Technique: The proposal consists of six antennas that will be mounted on the east, south and west building facades. Each directional antennas measure 56 inches high, six inches wide, and 3 inches thick. A portion of the stucco building faCade will be removed, the antennas will be installed in the faCade, and radio-frequency transparent material painted and textured to replicate the existing stucco exterior will replace the removed stucco. The new material will be flush with the fagade and will not project from the building wall. The antennas and related equipment would be located entirely behind the screen and would not be visible from the exterior. The location of the antennas is a preferred location under the Wireless Telecommunications Facilities Ordinance. The proposed antenna siting and mounting techniques are preferred under the Wireless Telecommunications Facilities Ordinance. Height: The maximum building height in the Neighborhood Commercial Zoning District is 35 feet. The top of the antennas would be 29 feet four inches, which falls below the maximum height. Equipment Cabinets: The freestanding radio and power cabinets will be installed on the roof behind an existing screen wall and will not be visible to the public. Maintenance of the equipment requires a standard check only four times a year. The equipment runs continuously and in case of a power outage would have battery backup for several hours. Staff finds that the stealth installation method meets this criterion and would not create visual blight or negative impacts on the neighborhood or shopping center. Parking: The installation of the telecommunication antennas at this location will not have an impact on the necessary parking required for the site, and no additional parking is required for the project. Compatibility: Based on the current proposal, staff finds that the antennas are architecturally integrated with building facade and finds that the use is compatible with the existing commercial uses and the surrounding area. The facility would not cause any negative noise impacts nor would maintenance of the site will be performed on a monthly basis during regular business hours. Project approval shall comply with project plans prepared by On Design Architects, dated October 10, 2001, except as modified herein in the Conditions of Approval. 2. Color and Finish of Antenna Screen: The fiberglass screen shall be painted and textured to match the existing building fagade, which is a light colored stucco. o Maintenance of Finish: It is an ongoing obligation of MetroPCS, assignees and successors in interest to maintain the exterior finish of the fiberglass panels in good order. Faded, peeling or damaged paint or material shall be repainted as soon as practical. Site and Architectural Review Permit and Conditional Use Permit Approvals Expiration: Within one year from the date of approval, a building permit must be obtained and construction completed one year thereafter or the Site and Architectural Review Permit and Conditional Use Permit approvals shall be void. o Length of Permit Term: This Site and Architectural Review Permit shall expire five years after permit approval, on December 11, 2006. If the use is to continue, the applicant shall apply for additional five-year periods, subject to approval by the Community Development Director. o Screening of Equipment Cabinets: Equipment cabinets installed on the building roof shall not be visible to the public from the street or shopping center parking lot. If necessary, the height of the existing screen wall shall be raised to block the view of the cabinets. Campbell Avenue o Cessation of Operations: The service provider shall provide written notification to the Community Development Director upon cessation of operations on the site exceeding a 90-day period. The service provider shall remove all obsolete or unused facilities from the site within 180 days of termination of its lease with the property owner or cessation of operations, whichever comes earlier. o New Permit Required: If a consecutive period of 180 days has lapsed since cessation of operations, a new Site and Architectural Review Permit and Conditional Use Permit shall be required prior to use or reuse of the site. ° Security Required: Prior to issuance of any permits for this facility, the applicant shall provide an irrevocable letter of credit, cash deposit, or other reasonable form of security, satisfactory to the City Attorney, in an amount reasonably sufficient to cover the cost of removal, for the removal of the facility in the event that its use is abandoned or its Site and Architectural Review Permit expires or is terminated and the equipment is not voluntarily removed. MetroPCS shall provide an estimate of the cost of removal for review by the City prior to submittal of security. 10. Upgrading of Facility Required: If technological improvements or developments occur which allow the use of materially smaller or less visually obtrusive equipment, the service provider will be required to replace or upgrade the approved facility upon application for a new Site and Architectural Review Permit to minimize adverse effects related to land use compatibility, visual resources, public safety or other environmental factors. 11. Utilities: All new on-site utilities shall be installed underground per Section 20.36.150 of the Campbell Municipal Code for any new or remodeled buildings or additions. Applicant shall comply with all plan submittals, permitting, and fee requirements of the serving utility companies. 12. Business License Required: A City Business License shall be obtained for this operation prior to the issuance of a building permit and shall be renewed annually. 13. Cables: All external cables or equipment shall be obscured from public view by enclosing them in architecturally designed cabinets painted to match the structure. 14. Compatibility With City and County Fire Emergency Services: The facility shall not be operated nor caused to transmit on or adjacent to any radio frequencies licensed to the City or County Fire Department for emergency telecommunication services such that the agencies' emergency telecommunications system experience interference. 15. No Interference with Emergency Transmissions: The installation shall not interfere with any City or County Fire Department emergency service telecommunications facilities transmission. Lighting: The use of lighting shall not be allowed on telecommunication facilities unless required as a public safety measure. No Advertising: No advertising signage or identifying logos shall be displayed on wireless telecommunications facilities, except for small identification plates used for emergency notification or hazardous or toxic materials warning. 18. Noise: The telecommunications facility, including power source, ventilation and cooling facilities, shall not generate noise discernible to a person of normal heating who occupies the fire station facilities. The noise level on adjacent residential uses shall not exceed an exterior noise level of 65dBA or noise level audible from a residential use with windows and doors closed an interior noise level of 45dBA. 19. Back-Up Generators: Backup generators shall comply with the noise standard referenced above and shall only be operated during power outages or for testing and maintenance between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday. 20. Maintenance Hours Restricted in Residential Areas. Normal maintenance activities shall only occur between the hours of 7:00 a.m. and 5:00 p.m., Monday through Saturday, excluding emergency repairs. 21. Heat Generation: The wireless telecommunication facility, including power source and cooling facility, shall not be operated so as to cause the generation of heat that adversely affects any building occupant. 22. Odors: The testing of back-up generators shall not produce odors that adversely affect the public. 23. Safety: Public Access Restricted: Antennas are to be sited in such a way and barriers and signage provided to prevent a person from passing within the safety limits established by the FCC-adopted standards for controlled access. Bo Warning Signs: Signage shall be maintained at the facility identifying all wireless telecommunication facility equipment and safety precautions for people nearing the equipment as may be required by any applicable FCC-adopted standards, including the RF radiation hazard warning symbol identified in ANSI C95.2-1982, to notify persons that the facility could cause exposure to RF emissions. Co Emissions Conditions: It is a continuing condition of this authorization that the facilities be operated in such a manner so as not to contribute to ambient RF/EMF emissions in excess of then current FCC adopted RF/EMF emission standards; violation of this condition shall be grounds for revocation. Bo Emergency Contact: The service provider shall provide signage as required, including phone numbers of the utility provider, for use in case of an emergency. Facade-mounted antennas are required under the Wireless Telecommunications Facilities Ordinance to be camouflaged by incorporating the antennas as part of an architecturally compatible design element of the building that adds visual interest to the building. Antenna Facilit~ Description The proposed facility is called a distribution site and consists of 6 directional flat panel antennas connected to a five cabinet radio and power rooftop unit. Power Unit Connections The power specifications call for a 200A, 120/208V service with a total connected power load of 10.5 KVA/240 on single-phase connection. The power unit and radios draw less than 100 amps of electricity paid directly to the local electric utility provider by MetroPCS. The facility is plugged into the telephone system and requires connection of 8 pairs twisted standard POTS wires. MetroPCS makes all connections per local telco specifications and pays for telephone service directly to the local telephone provider. Maintenance and Access The facility is un-manned and the equipment requires a standard check only a few times a year. The equipment runs continuously and silently and in case of an emergency power outage has battery back up for about four hours. Mostly due to emergency situations, MetroPCS requests the need for unrestricted access - 24 hours/day, 7 days/week, 365 days/year. Co-Location This building houses an existing NEXTEL site with antennas mounted to the outside of facade. These existing antennas are screened behind protruding boxes mounted directly to the facade wall. In working with City Staff, MetroPCS has completely incorporated the new flat panel antennas into and behind the building facade, invisible to the eye. This allows the building to house additional antennas without taking away fi.om the architectural integrity of the elevation or facade while meeting the City's co-location policy. Site Select, on A MetroPCS network cluster map is included in this application to show locations of other sites in the surrounding area. MetroPCS is mandated by the FCC in each metropolitan area (in this case the San Francisco Bay area) to provide seamless coverage of wireless telecom services so that consumers get the best connectivity allowed by latest technology. The network map shows the first phase of development that will launch initial MetroPCS service in and around the San Jose region including Campbell. This is the extent of the plan so far with future yearly expansion plans to be projected after phase one is complete. Radio Frequency Engineers choose site location areas based on adjacent sites as the signal from a handset is handed offfrom antenna to antenna~ The idea is for the user to be as close to one particular source antenna at any time. Network Engineers are designing sites to hand off in a quarter mile radius, which limits the number of potential candidates in an area like this with both commercial and residential land uses. Kirkwood Plaza offered the best co-located commercial use and in this case, MetroPCS looked at two other possible locations within the plaza that did not comply with city height and aesthetic standards for telecom development. Environmental Assessment CEQA Article 19, Sections 15301-15305 outline that low impact investor owned utility facilities like MetroPCS are exempt from environmental review and more background information can be found under the environmental law sections of the 1996 telecom Act related to NEPA, regional and state agencies. MetroPCS o Proposed Base Station (Site No. oFA-C07-116C) 1630 West Campbell Avenue * Campbell, California Statement of Hammett & Edison, Inc., Consulting Engineers The firm of Hammett & Edison, Inc., Consulting Engineers, has been retained on behalf of MetroPCS, a wireless telecommunications carrier, to evaluate the proposed PCS base station at 1630 West Campbell Avenue in Campbell, California (Site No. SFA-C07-116C), for compliance with appropriate guidelines limiting human exposure to radio frequency electromagnetic fields. Prevailing Exposure Standards The U.S. Congress requires that the Federal Communications Commission ("FCC") evaluate its actions for possible significant impact on the environment. In Docket 93-62, effective October 15, 1997, the FCC adopted the human exposure limits for field strength and power density recommended in Report No. 86, "Biological Effects and Exposure Criteria for Radiofrequency Electromagnetic Fields," published in 1986 by the Congressionally chartered National Council on Radiation Protection and Measurements ("NCRP"). A summary of the exposure limits contained in NCRP-86 is shown in Figure 1. Separate limits apply for occupational and public exposure conditions, with the latter limits generally five times more restrictive. The more recent Institute of Electrical and Electronics Engineers ("IEEE") Standard C95.1-1999, "Safety Levels with Respect to Human Exposure to Radio Frequency Electromagnetic Fields, 3 kHz to 300 GHz," includes nearly identical exposure limits. These limits apply for continuous exposures and are intended to provide a prudent margin of safety for all persons, regardless of age, gender, size, or health. The transceivers are often located at ground level and are connected to the antennas by coaxial cables about 1 inch thick. Because of the short wavelength of the frequencies assigned by the FCC for wireless services, the antennas require line-of-sight paths for HAMMETT & EDISON, INC. The antennas are designed to concentrate their energy toward the horizon, with very little energy wasted toward the sky or the ground. Along with the low power of such facilities, this means that it is generally not possible for exposure conditions to approach the maximum permissible exposure limits without being physically very near the antennas. Computer Modeling Method The FCC provides direction for determining compliance in its Office of Engineering and Technology Bulletin No. 65, "Evaluating Compliance with FCC-Specified Guidelines for Human Exposure to Radio Frequency Radiation," dated August 1997. Figure 2 attached describes the calculation methodologies, reflecting the facts that a directional antenna's radiation pattern is not fully formed at locations very close by (the "near-field" effect) and that the power level from an energy source decreases with the square of the distance from it (the "inverse square law"). The conservative nature of this method for evaluating exposure conditions has been verified by numerous field tests. Site and Facility Description Based upon information provided by Metro, including zoning drawings by On Design Architects, dated June 30, 2001, it is proposed to mount six EMS Model RR6518-02 directional panel antennas on the face of the two-story office building located at 1630 West Campbell Avenue in Campbell. The antennas would be mounted in pairs near the top of the walls, behind new fiberglass screens, at an effective height of about 27 feet above ground, and they would be oriented at 120© spacing, to provide service in all directions. The maximum effective radiated power in any direction would be 1,890 watts, representing six channels operating simultaneously at 315 watts each. Located on the same building are similar antennas for use by another wireless telecommunications carrier. Study Results The maximum ambient RF level anywhere at ground level due to the proposed Metro operation by itself is calculated to be 0.0064 mW/cm2, which is 0.64% of the applicable public exposure limit. It should be noted that this result includes several "worst-case" assumptions and therefore is expected to overstate actual power density levels. Due to the physical separation of the Metro antennas from those of the other carrier, and due to the antenna directivities employed, the additive effect of the proposed Metro operation on those of the other carrier, and vice versa, is negligible. The highest cumulative exposure level in publicly accessible areas resulting from the simultaneous operation of both carriers is expected to be many times below the allowable limit. To prevent occupational exposures in excess of the FCC guidelines, no access within 5 feet in front of the antennas themselves should be allowed while the site is in operation, unless other measures can be demonstrated to ensure that occupational protection requirements are met. Posting explanatory warning signs* on the parapet behind each transmitting antenna and on the screens in front, such that the signs would be readily visible from any approach angle to persons who might need to work within that distance, would be sufficient to meet FCC-adopted guidelines. Conclusion Based on the information and analysis above, it is the undersigned's professional opinion that the base station proposed by MetroPCS at 1630 West Campbell Avenue in Campbell, California, can comply with the prevailing standards for limiting human exposure to radio frequency energy and, therefore, need not for this reason cause a significant impact on the environment. The highest calculated level in publicly accessible areas is much less than the prevailing standards allow for exposures of unlimited duration. This finding is consistent with measurements of actual exposure conditions taken at other operating base stations. The factor of 2.56 accounts for the increase in power density due to ground reflection, assuming a reflection coefficient of 1.6 (1.6 × 1.6 = 2.56). The factor of 1.64 is the gain of a half-wave dipole relative to an isotropic radiator. The factor of 100 in the numerator converts to the desired units of power density. This formula has been built into a proprietary program that calculates, at each location on an arbitrary rectangular grid, the total expected power density from any number of individual radiation sources.
