19 (1982)MEMORANDUM To: From: Subject: ~ ~~~j ' - CIT'_.O~, (_AMPBE LL Art Kee, Planning Director Date: N - ovembe r Bi ngineering Manager LINDA GRIDLEY APPLICATION--SOUTHWEST CORNER OF THIRD ST ORCHARD CITY DRIVE After our discussion this morning with Mrs. Gridley and her attorney, I reviewed the plan submitted to determine whether it would be possible to recommend any compromise arrangements for ingress and egress for the application on the Third Street site. A critical factor in that analysis was a statement from Mrs. Gridley regarding the sizes of vehicles that would be used for delivery of mer- chandise. I called Mrs. Gridley on the phone and indicated to her that it would not be possible for the staff to support deliveries by any type of tractor-trailer rig because it would not be physically possible to ingress ~and egress the site. I further indicated that the staff could support the use of small box-type vans not to exceed a total vehicle length of 30 feet. These types of vehicles could successfully negotiate the access into and out of the property if deliveries were made in the off-peak hours. Specifically, I indicated to Mrs. Gridley that the staff could support her application with: 1. the elimination of the driveway opening on to Orchard City drive 2. the restriction of delivery vehicles to a maximum of 30 feet in length 3, the restriction of delivery times to between the hours of I0 a.m, and 12 noon, and 1:30 p.m. and 3:30 p.m. on weekdays. Hrs. Gridley said that she had no control over the types of vehicles that goods would be shipped in, but that it would be possible for her to make arrangements to have any deliveries that arrive in tractor-trailer rigs be o~f-~daded_at ~ a business associate's site in another location and then picked up by one of her own vans and transported to the subject property. I believe that this is a satisfactory solution to the problem. Give me a call if you would like to discuss this compromise proposal. Third Street in a PD (Planned Development/Commercial) Zoning District, as per the application filed in the Office of the Planning Director on September 13, 1982 and after presentation by the Planning Director, proponents and opponents, the hearing was closed (UP 82-22). After due consideration of all evidence presented, the Commission did find as fo l 1 ows: That the establishment, maintenance, and operation of the proposed use will not be detrimental to the heal th, safety, peace, morals, comfort, or general welfare of the persons residing or working in the neighbohrood of such use, or be detrimental or injurious to property and improvements in the neighborhood or the general welfare of the City. Based on the above findings, the Planning Commission does hereby grant the requested use permit, subject to the conditions attached hereto as Exhibit A. The applicant is notified as part of this application that she is required to comply with all applicable Codes and/or Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified. USE PERMIT SHALl_ NOT BECOME EFFECTIVE UNTIL RATIFIED BY THE CITY COUNCIL.
