After notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the heating was closed.
After due consideration of all evidence presented, the Planning Commission did find as follows
with respect to application PLN2000-53.
There have been no changes in the General Plan and the zoning of the property since the
previous approval of the project.
There have been no changes in the development standards or regulations that would
warrant change to the conditions of approval, other than the request for a reinstatement.

Ms. Darcy Smith, Planner I, presented the staff report as follows:
· Advised that the applicant, Mr. Bruce Bowen, is seeking a Reinstatement allowing a one-year
extension (requiring that construction begin by May 9, 2001) of a previously-approved Site
and Architectural Approval to allow the construction of a 12,711 square foot, two-story
office building.
· Stated that the project site is located at the southeast comer of Civic Center Drive and North
Central Avenue.
· Said that this project was originally approved on November 24, 1998, and that Council
amended Condition of Approval No. 3 in January 1999.
· Informed that approvals are for one year and when the applicant had submitted plans for
building permits, staff realized that the approval for this project had expired.
· Staff is recommending that the Commission adopt a Resolution approving this
Reinstatement. There are no changes to the originally approved plan and the project is
consistent with both the General Plan and Zoning designations for the property.

DISCUSSION
Applicant's Proposal: The applicant is requesting a reinstatement of a Site and Architectural
Review Permit (S 98-09) to allow the construction of a two-story office building, with an interior
first floor parking garage for 20 vehicles and an exterior parking area for 10 vehicles, at the
southeast comer of Civic Center Drive and N. Central Avenue. The square shaped parcel is
currently occupied by a one-story, 2,332 square foot office building and a parking lot striped for
37 vehicles. The approval was originally granted on November 24, 1998 and requires a building
permit to be obtained within a year of approval. The applicant is currently in the process of
obtaining approvals for the project plans, and is requesting the extension of the Site and
Architectural Review Permit for a period of one year to facilitate completion of the project.
ANALYSIS
Background: On November 24, 1998, the Planning Commission approved Resolution 3205
granting Site and Architectural Approval (S 98-09) to allow the construction of a 12,711 square
foot, two-story office building, subject to conditions of approval.
On December 4, 1998, the applicant filed an appeal of Condition of Approval No. 3 which
required the recording of a covenant, running with the land, that would provide shared parking,
consistent with the Downtown Development Plan and the C-3-S Zoning District, which
incorporates the provision to make all parking spaces available to tenants, employees, and
customers of other downtown uses after 6:00 p.m. on weekdays, and during the day and night on
weekends and holidays, until 2:30 p.m. On January 5, 1999, the City Council heard the
applicant's appeal and adopted Resolution number 9481 modifying the Site and Architectural
Review Permit by amending Condition No. 3 of the Planning Commission Resolution 3205 to
read: "The ten (10) outside parking spaces located immediately off the alley shall be available to
the public after 6:00 p.m. on weekdays, and during the day and night on weekends and holidays,
until 2:30 p.m." Thus the Council eliminated the requirement for the recordation of a covenant
and substituted the 10 shared parking space requirement in lieu of all the parking spaces.
Reinstatement of the Site and Architectural Review Permit: The application for the
Reinstatement of the previously approved Site and Architectural Review Permit (S 98-09) does
not entail any revisions to the previously approved plans. There have been no changes in the
development standards, regulations, facts, circumstances, project plans, site, or physical

environmental conditions that would warrant changes to the conditions of approval, other than
the request for a reinstatement.
Site and Architectural Review Committee: The Site and Architectural Review Committee did
not review this application given that the application entails only a request for a reinstatement of
the previously approved Site and Architectural Review Permit. No other change is requested of
the previous approval.
