John Hanna, 525 University Ave., Palo Alto, addressed the City Council
on behalf of the applicant, Mr. Bruce Hodgin. Mr. Hanna stated that
the State Map Act allows a charge for park fees, and the City's
ordinance is based on the State Map Act; however, the underlying basis
for charging parks fees is due to creation of an additional demand for
parks.
The applicant is requesting a two-year extension of the previously
approved subdivision map, and that the original fee based on the
then-fair- market value of the land, or $16,000, be imposed, rather
than an additional $50,000 that would be charged pursuant to the
current fee structure. Mr. Hanna requested that the City Council make
a finding that there is no additional need for parks as a result of
this project in order to assure the developer that no additional fee
will be assessed at the time a building permit is obtained.
Councilmember Kotowski clarified that the City of Campbell does not
have sufficient parks in relation to its population. He stated that
the reason behind the park impact fee is to provide continued
maintenance to parks that are already in, as well as provision of
parks for those future residents.
City Attorney Seligmann pointed out that the amount to be assessed
under the second park impact fee ordinance is not the issue before the
City Council this evening. The issues under consideration are: 1)
granting of an extension; 2) and the conditions to be placed on
whatever extension might be granted.
Mr. Hanna discussed the issue of legality of the existing structures
and the question of additional park need.
There being no further discussion by the audience, the Mayor declared
the public hearing closed.
Councilmember Ashworth - requested that the issue concerning the
remaining fees be scheduled for consideration and City Council
position in the near future.

RESIDENTIAL/LOW DENSITY RESIDENTIAL) ZONING

After notification and public hearing as specified by law on the application for
approval of an extension to a previously approved Tentative Subdivision
Map as referenced in the above heading; as per the application filed in the
Planning Department on February 7, 1992; and, after presentation by the
Planning Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the City Council did find as
follows, with respect to File No. R 92-03 (TS 89-07):
The proposed subdivision density of 4.1 units per gross acre is
consistent with the Low Density Residential land use designation of
the General Plan.

The proposed map is consistent with the development standards for
an R-l-6 (Single-Family Residential) Zoning District, and

There are no changes to the Tentative Subdivision Map proposed by
the applicant since the previous approval.
Based upon the above-findings, the City Coundl does hereby approve this
map, subject to the Conditions of Approval attached hereto, as Exhibit A.
1. The proposed subdivision is consistent with the General Plan.
The proposed subdivision improves the balance between the
housing needs of the region and the service needs of its residents.
The site is physically suitable for the proposed density and type of
development.

DISCUSSION
Backqround. On March 20, 1990, Council approved the tentative
subdivision map for 987 and 1113 Crockett Avenue and 1345 Westmont
Avenue. This map creates 6 new parcels to replace the 2 that exist
now. The development proposed for this site will consist of 6 new
single family residences to replace a number of existing dwelling
units and an automotive repair business. A condition of this
approval was the payment of Quimby (subdivision) park fees of
$2,717 per new parcel created by the tentative map. Since 6 new
parcels were being created by the subdivision map, Quimby fees of
$16,302 were required as a condition of approval. The tentative
map approval expired on March 20, 1992. Prior to the expiration,
the applicant applied for a two year extension to the tentative map
approval.
According to the Subdivision Map Act, the map is automatically
extended for a period of 60 days or until action is taken on the
extension request. Cities may extend tentative maps for a period
or periods not to exceed a total of three years beyond the initial
approval period. When granting an extension of a tentative map,
the city cannot add new conditions unless the subdivider agrees
with the new condition. If the subdivider does not agree to a new
condition, the city can deny the extension if the city finds that
unless the condition is imposed, the development will be injurious
to the public health, safety or general welfare.
On April 14, 1992, the Planning Commission held a public hearing to
consider the applicants request for a two year extension. Staff's
recommendation to the Planning Commission was for a one-year
extension, with no change in the park fee condition of approval.
The Planning Commission expressed concern over requiring the
applicant to pay another filing fee if the applicant were to make
another request for an extension within one year, and noted that if
the City proposes to collect increased fees at a later date, this
must be made clear in the conditions of approval. The Planning
Commission is recommending approval of the applicants request to

extend the tentative map for a period of two years with the revised
condition of approval adding an escalation clause to cover future
fee increases.
The applicant has since verbally indicated to staff that he is not
in agreement with the proposed amendment to the conditions of
approval, if it will significantly increase his park fee above the
$16,302 previously specified.
On July 3, 1990, City Council adopted Ordinance No. 1804 which
imposes park impact fees on all new dwelling units constructed
within the City. These fees are assessed at the time the building
permits for the new units are requested. Any previously paid
Quimby fees are to be credited toward the park impact fees that are
assessed when the building permits are requested for any new
dwelling units.
Currently, the park impact fees for the 6 unit development would be
$10,990 per new dwelling unit. This equates to a total park impact
fee of $65,940 for the six new units that would be assessed at the
time the building permits were requested for these units. Any
previously paid Quimby fees would be deducted from the total fees
due. For this reason, revising the Quimby (subdivision) park fee
condition of approval of the original tentative map approval may
not have any affect on the ultimate fees collected for this
development.
The new Park Impact Fee Ordinance is unclear regarding the
definition of "new" residential units. The property in question
has several existing residences. Since many of these residences
were built when the property was in the county, there is some
question as to their "lawful" existence (i.e. built without
building permits). This raises the question as to whether or not
they should count as existing units which would not be assessed the
Quimby or park impact fees under the current ordinance.
If the applicant were to apply for building permits today, the park
impact fees would be $65,940 (for 6 units if no credit was given
for the existing units). The previously paid Quimby fees of
$16,302 would be deducted from this total.
Staff is currently preparing proposed revisions to the subdivision
Quimby and park impact fee ordinance to clarify these and other
concerns, including the policy for dealing with developments that
were initiated prior to adoption of the previous or future
ordinance revisions.

In conclusion, staff recommends the extension of the tentative map
for a period of one year subject to the original conditions of
approval. Staff's recommendation is not consistent with the
Planning Commission's recommendation and adopted resolution. The
Planning Commission's resolution is attached for reference. If the
staff's recommended action is taken and the Quimby Fee of $16,302
is maintained, Council will still have a future opportunity to
collect additional park impact fees when the building permits are
issued, if that is Council's desire. Council's future action on
the park impact fee ordinance will provide an opportunity to decide
how previously approved projects that do not have final map or
building permits for new dwelling units are to be treated.

ANALYSIS
Staff requests a continuance in order to review existing ordinances and
administrative policies pertaining to park dedication fees and determine their
applicability to the subject application.
ALTERNATIVES
Deny the extension. The Council can deny staff's request for a continuance
and take action to deny the request for an extension which will cause the
Tentative Subdivision Map approval to expire.
Modify the extension. The Council can deny staffs request for a continuance
and take action to modify the request for a two-year extension by granting a
one-year extension or by modifying the conditions of approval
recommended by the Planning Commission.

Chairperson Fox read the application into the record.
Mr. Tim J. Haley, Associate Planner, presented the staff report noting the following:
· Applicant's request f6r a a two-year extension.
· Location and surrounding uses.
· Staff recommends a one-year extension, since it has been the practice of the
decision making body to recommend one-year extensions.
Commission Discussion:
Commissioner Perrine requested clarification for staff's recommendation for one year
vs. two, as requested by the applicant. Mr. Haley indicated that staff generally
recommends extensions on projects for only one year.
Commissioner Alne and Mr. Haley discussed a letter received by an anonymous
neighbor opposed to the extension.
Chairperson Fox opened the public hearing.
Public Comment:
Mr. Kurt Anderson, Project Architect, 380 Industrial Street, Campbell, presented three
reasons for the two-year extension request, as follows:
1. Current economy and current lending practices.
2. Doubt that the project will not be built within a year. The applicant will have
to return to the Commission again next year with the same request.
3. Client has already spent a substantial amount of money for this project on
street improvements and engineering costs.
Commissioner Alne asked Mr. Anderson whether it was the funding of the project, or
the fact that the applicant was trying to avoid returning to the Commission that
prompted a request for two years. Mr. Anderson indicated that the lack of funding
could create a need for a similar request next year, and his client would like to avoid
returning to the Commission.
Mr. Martin Bernal, 1133 Monroe Street, asked that the request for two years be granted,
since a delay in construction would defer the relocation of his shop currently located at
the site, to a more economically feasible time for him.
Commissioner Perrine asked if staff has a problem with a two-year extension.
Steve Piasecki, Director of Planning, expressed concern that changes in polices, and fees
would occur; and, that the Conditions of Approval may require revision if the project is

ex-rended beyond a year. He stated that staff would like the option to make necessary
changes and possibly deny the application, if after a year no progress has been made.
Commissioner Alne asked if the applicant were to return again next year with the same
request, would he again have to pay the filing fee. Mr. Piasecki indicated that he would.
Commissioner Alne asked if an escalation clause had been included in the conditions for
this application. In response, Mr. Piasecki stated that the Conditions of Approval do not
specify fees amounts.
Commissioner Alne referred to discussion held at the Planning Commissioners' Institute
State Conference, noting that if a city expects to collect fees at a later date, the fees
should be specified. He suggested that the applicant could 'be required to pay fees
applicable to the time permits are pulled.
Mr. Anderson expressed a concern that staff had provided the Commission with the
impression that no progress had been made since original approval of the application.
He noted that he has worked with the Civil Engineering Division of the Public Works
Department to get the Tentative Map approval, that the County Assessor had reviewed
and accepted the conditions of the map and recently the tentative map has been
approved and will shortly be recorded.
Further, Mr. Anderson addressed the issue of future fee amounts stating that his client is
aware that fees will increase and is anticipating paying the higher fee amounts; the
difference in cost would be the fee for the extension.
Commissioner Dougherty asked for reasons that the final map has not been filed, to
date.
Mr. Anderson pointed out that the final map is in progress, and noted that the parcel is
owned by several individuals, who must read and sign the documents.
Mr. Bruce Hodgin, 106 West Campbell Avenue, one of the General Partners, noted that a
condition of final map recordation is demolition of existing structures; that currently the
structures are occupied. Further, he noted prices for new homes, such as those being
proposed, have dropped 20% to 25% since the previous approval.
Discussion ensued between the Chair and the Director of Planning relating to building
permits and demolition of the site.
Commissioner Alne asked about Council's policy relating to extending projects longer
than one year. Mr. Piasecki stated that the Council is concerned about the length of
extensions, however, extensions of over a year have been granted for larger
developments, and not usually for minor developments.
Mr. Tim Haley noted an error to the Conditions of Approval which should be made if
the Commission accepts the staff recommendation for a one-year extension.

MOTION:
On motion of Commissioner Perrine, seconded by
Commissioner Dougherty, it was unanimously ordered that the
public hearing be closed.
Commissioner Perrine moved to extend the project for one year, and the
motion was seconded by Commissioner Htggtns.
Chairperson Fox stated that since it is unrealistic to assume that the project will be built
within one year, that the Commission will most likely see the applicant back to apply for
another extension next year, that there were no controversial issues relating to the
project, and that he would not support the motion for extension for one year.
Commissioner Dougherty pointed out that the request is for two years and that two
years should be considered at this time and not pushed back for a decision next year.
He would not support the motion.
Commissioner Perrine asked for a friendly amendment.
Commissioner DoUgherty moved to extend the tentative map for two years.
Commissioner Higgins agreed that if the project cannot be developed within a year, a
two year extension would be appropriate. She seconded the motion.

Commissioner Higgins, an amendment was made to the motion
for approval of the tentative map extension for a two-year
period.
The following discussion ensued relating to the proposed motion.
Commissioner Alne, was not interested in doubling the fees for the applicant's request,
hOwever, he was supportive of the applicant's willingness to pay higher fees for permits
if the project were extended and the fees increased. Further, he noted that he would like
it clearly understood that this does not mean an automatic approval of two years for any
developer making the request; and, that exceptions in policy should be made on when
there are no controversial issues other than time.
Chairperson Fox suggested addition of an escalation clause to cover future fee increases.
City Attorney Seligmann expressed that it would be a good idea to include the escalation
clause in the Conditions of Approval at this time.
Commissioner Alne noted that his rational is that the city could suffer no loss in fees and
noted that the applicant was willing to accept the additional costs, should there be any.

Commissioner Perrine noted that the area for the project site has been a concern for a
long time. He was supportive of sending a message to the lending institutions that the
City wants to see more single-family housing built.

unanimously adopted recommending that City Council extend

The applicant filed a request prior to the expiration date, which under the
Subdivision Map Act extends the approval an additional 60 days to May 20,

approving the Tentative Subdivision Map are attached.
PROJECT DESCRIPTION
The applicant is requesting a two year extension of the Tentative Subdivision
Map to March 20, 1994. No changes to the Tentative Subdivision Map are

GENERAL PLAN AND ZONING CONSISTENCY
Zoning: The subject property is zoned R-l-6 (Single Family Residential,
minimum lot size 6,000 square feet). The six lots range from 6,000 - 6,111
square feet and are consistent with the zoning district.

proposed project is developed at a density of 4.1 units per gross acre, and is
consistent with the General Plan.
DISCUSSION
Since the City Council approval of the Tentative Subdivision Map on March
20, 1990, there have been no changes in the General Plan or Zoning in this
area.
Staff has reviewed the applicant's request for a two year extension of the
Tentative Subdivision Map with previous applications for extensions of
time. This review indicates that a one year extension has typically been
granted.
SUMMARY AND RECOMMENDATION
Staff finds that the application is consistent with the General Plan and
Zoning, and recommends that the Planning Commission consistent with
previous approvals, forward a recommendation to the City Council to grant a
one year extension of the Tentative Subdivision Map to March 20, 1993.

Previous Approval: On March 20, 1990, the City Council approved a
Tentative Subdivision Map creating 6 lots on the subject properties. The
Tentative Subdivision Map approval was valid for two years and expired on
March 20, 1992. Construction has not commenced within this time period
therefore, the applicant submitted an application for extension of the
Tentative Subdivision Map approval.
Applicant's Request: The applicant is requesting a two-year extension of the
Tentative Subdivision Map to March 20, 1994.
Planning Commission Action: On April 14, 1992, the Planning Commission
adopted Resolution No. 2793, recommending that the City Council extend the
Tentative Subdivision Map to March 20, 1994. Staff had recommended a one-
year extension of the Tentative Subdivision Map subject to the previous
Conditions of Approval. The Planning Commission action recommends a
two-year extension with a condition providing an added escalation clause.
ZONING AND GENERAL PLAN CONSISTENCY
Zoning: The subject property is zoned R-1-6 (Single-Family Residential,
minimum lot size 6,000 square feet). The six lots ranging from 6,000 to 6,111
square feet are consistent with the zoning district.

General Plan: The Land Use Element of the General Plan indicates Low
Density Residential, and allows less than six units per gross acre. The
proposed project is developed at a density of 4.1 units per gross acre, and is
consistent with the General Plan.
DISCUSSION
Since the City Council approval of the Tentative Subdivision Map on March
20, 1990, there have been no changes in the General Plan or Zoning in this
area.
Staff has reviewed the applicant's request for a two year extension of the
Tentative Subdivision Map with previous applications for extensions of
time. This review indicates that a one year extension has typically been
granted.
SUMMARY AND RECOMMENDATION
Staff finds that the application is consistent with the General Plan and
Zoning, and recommends that the Planning Commission consistent with
previous approvals, forward a recommendation to the City Council to grant a
one year extension of the Tentative Subdivision Map to March 20, 1993.

BACKGROUND
This item was continued from the previous Planning Commission meeting of
February 13, 1990, so that revised subdivision layouts could be presented
to the Site and Architectural Review Committee. The Site and
Architectural Review Committee met with the applicant of February 20,
1990, and reviewed a number of alternative site layouts for this
proposal.
DISCUSSION
After review of the various layouts and discussion of the applicant's
intent, in terms of developable lots, the Site and Architectural Review
Committee agreed that the previously presented layout was a reasonable
solution for this property.
At the February 13, 1990, meeting several Commissioners expressed concern
regarding the location of a cul-de-sac adjacent to the creek channel.
The applicant has indicated a desire to work with the Public Works
Department to provide a less than standard cul-de-sac width which would
accommodate a landscaping strip along the western portion of the
cul-de-sac. This revised design would also accommodate on-street parking
along the creek channel.
The less than standard cul-de-sac radius and width may be supported in
this situation because only three lots are serviced by the proposed
cul-de-sac. The applicant is confident that adequate parking on-street
and on-site can be accommodated for the proposed residential uses in this
subdivision.
A copy of the previous Staff Report and Comment Sheet is attached for the
Commission's review. Additionally, there are two proposed alternative
layouts for this development. One with a private street accessing
Crockett Avenue, and a second with a half street along the northerly
property line of the property.
ARCHITECTURAL ADVISOR'S COMM~I~rS
The Architectural Advisor was absent during the February 20, 1990, Site
and Architectural Review Committee meeting. Since the architectural
plans have not been developed Staff has not yet obtained any comments
from the Architectural Advisor.

Several Commissioners were concerned about the building form possible on
lot 3. The Commission may want to consider requiring the Site and
Architectural plans return to the Site and Architectural Committee for
approval. The ordinance currently requires Staff to review the
architectural plans for an R-1 subdivision with minimum 6000 square foot
lots.

The proposed map would allow the creation of six single family lots. Three
of the proposed lots would have frontage on Crockett Avenue and three lots
would have frontage on a new cul-de-sac accessing Westmont Avenue adjacent
to the westerly property line.
DISCUSSION
The layout of the proposed subdivision maintains the orientation of the
lots along the Crockett Avenue frontage and allows lots with access to
Westmont Avenue via a new cul-de-sac. This layout discourages the
orientation of homes towards Westmont Avenue.
Westmont Avenue. Approximately a 30' wide portion of the Westmont Avenue
frontage is currently owned by the Santa Clara Valley Water District. The
Public Works Department has required that this developer reserve a 45'
area from center line for street right-of-way in the future and that
street improvements be constructed at this time at a 30' from center line
dimension. The present map illustrates the requested dedication.
Alternate Layouts. An alternate subdivision layout which provides access
by way of Crockett Avenue cul-de-sac was also considered for this
proposal. This layout, however, created lots backing onto Westmont Avenue
and having a frontage on Westmont Avenue and the new cul-de-sac.
Consequently, the present layout was considered more desirable.
RECOMMENDATION/SUMMARY
Staff finds that the proposed subdivision created a reasonable lot
configuration which is consistent with the General Plan and the zoning for
this area.

This is in reponse to the hearing on February 13, 1990, File
No. TS 89-07.
We are against breaking up three lots 987 & 1113 Crocker
Avenue and 1345 Westmont Avenue into six lots. Two other
subdivisions have been built in our area in the past year and
this creates more traffic which our streets the way they are now
will not hold. Right now it is hard to get out of our street in
the mornings. Adding more houses means more autos on these
roads.
We have lived in this area for 26 years and have watched
this area grow but it has not lost its country atmosphere which
we like. With these homes being built we are loosing this and we
reallx think this is sad. We value our location being so close
to Los Gatos and Saratoga but we are growing farther from those
cities by allowing Big Business to come in and build up our
community to look like a Big City. Please do not let this
happen.

a reasonable solution providing a lot arrangement which maintains
the residential pattern established along Crockett Avenue and
visible building fronts from Westmont Avenue.
Planning Commission:
- The Commission continued the item from its meeting of February
13, 1990 and referred review of optional subdivision patterns to
the Site and Architectural Committee. The Committee reviewed the
applicant's optional "study" plans and concluded the proposal
represented a reasonable subdivision of the subject site.
- Five members of the full Planning Commission concurred with the
Architectural Committee and are recommending approval of the
application.
- The dissenting Commissioners expressed a concern regarding the
placement of the proposed cul-de-sac along the creek channel.
Commissioner Christ felt the proposed subdivision may not be the
optimal layout for the property. He felt the site may ideally
accommodate only 5 lots, instead of the 6 lot subdivision proposed,
or perhaps a Planned Development would offer better design
solutions.

SUMMARY
The Planning Commission at its meeting of February 27, 1990, adopted
Resolution 2659 recommending approval of this map subject to the
attached Conditions with a 5-2-0-0 vote, with Commissioners Christ and
Olszewski voting no.

After notification and public hearing as specified by law on the application
for approval of a Tentative Subdivision Map as referenced in the above heading,
as per the application filed in the Planning Department on October 23, 1989;
and, after presentation by the Planning Director, proponents and opponents, the
hearing was closed.
After due consideration of all evidence presented, the Planning Commission did
find as follows:
The proposed subdivision density of 4.1 units per gross acre is
consistent with the Low-Density Residential Land Use designation of
the General Plan.
The proposed subdivision does not impair the balance between the
housing needs of the region and the public service needs of the
residents.
The proposed map is consistent with the development standards for a

Chairperson Perrine read the Application into the record.
Planning Director Steve Piasecki reviewed the Application and discussed the
Staff Report indicating the net acreage, location, adjacent properties, density
and existing uses in the area. Further, he discussed:
- Various site options presented to the Site and Architectural Review
Committee on February 20, 1990
- The aerial map and architectural renderings displayed
- History of the application
- Staff recommendation to approve the application
- Street right-of-way
Commissioner Olszewski asked what assurance the Commission has that the
intention of the adjacent property owner is to develop his section of the
cul-de-sac and asked about the net acreage of each lot and why alternatives
were not presented to the Commission as requested at the February 13, 1990,
Planning Commission meeting.
Mr. Piasecki stated that two alternative site plans are included in the
Commission packets; that the lots would be slightly greater than 6,000 square
feet each; that relative to the intention of the adjacent property owner, the
owner is present and is willing to discuss his intentions to the Commission.
Commissioner Wilkinson queried regarding the ground contamination.
Mr. Piasecki informed Commissioner Wilkinson that an environmental evaluation
is part of the review process.
Mr. Kurt Anderson, Project Architecture, addressed the Commission and discussed
the following:
- Nine alternatives presented to the Site and Architectural Review
Committee
- Mr. Hodgin's intention not to develop the site with less than six lots
- The current uses on the property
- Land use
- Marketing strategies and yield
Street trees along the canal and lot adjustments
Similar approved developments and noted the Robnick Court project
On-site parking, and
Requested approval of the project subject to the design specifications
returning to the Site and Architectural Review Committee and subject
to review by Public Works and the Planning Departments
Chairperson Perrine asked Mr. Anderson why the current drawings do not indicate
the lot adjustment requested.

Mr. Anderson stated the when the application returns for a tentative map
approval the adjustment will be noted which will make the lots larger and the
streets smaller and he noted that the cost for this adjustment is overwhelming.
Further discussion ensued between Commissioners Olszewski, Fox, Alne and Mr.
Anderson relative to the following:
- Restriction of sidewalk diameter
- Concern with the cul-de-sac being "shoved up against the creek"
- Suggestion that the cul-de-sac be moved over one lot
- Property frontages
- Resident visibility
- Locations of fences
Commissioner Christ expressed that he was appreciative that the Site and
Architectural Review Committee received design options, but was concerned since
the Commission had requested these options and have not received them. Further,
he pointed out that it is the Commission that will make the decision and not
the Site Committee.
Cox~issioner Meyer reported on the Site and Architectural Review Committee's
discussions noting the amount of time that the Cox~ittee spent on alternative
site plan review and that the Committee recommended approval of the plan
presented. Commissioner Fox added that brief discussion occurred relative to
placement of fences along Westmont Avenue and that various floor plans were
discussed.
The Public Hearing on TS 89-07 was opened.
Public Comments:
There were no public comments.
Commissioner Olszewski suggested that more creativity is needed to provide the
desired results and noted concerns regarding fencing and the creation of a
cul-de-sac along a ditch. Further, he suggested that the applicant consider a
U-shaped driveway in order to eliminate fences completely.
Mr. Piasecki suggested that the Commission approve the application subject to
site and landscape plans returning for Commission review.
Mr. Anderson indicated that the process does not require him to return to the
Commission with these plans; that usually the plans return to the Site and
Architectural Review Committee only; however, he noted that he is willing to
provide these plans to the Commission, as long as it does not impede the
project unnecessarily.
Commissioner Olszewski reminded Mr. Anderson that delays in time are not the
concern of the Commission. Mr. Anderson explained that delays were created by
the Public Works Department and not the applicant. Further, he mentioned that
this cul-de-sac would be an improvement to the auto repair business currently
at the location.
Commissioner Alne stated that the idea to clean up the area was initiated the
City; that this idea was not initiated by the applicant, but merely a response
to the City's request.

Further, Mr. Alne noted his attendance at the Site and Architectural Review
meeting where he examined several options and stated that he will support
approval of this application since it would improvement the area substantially.
Commissioner Christ asked if the applicant reviewed an option of eliminating
one of the lots.
Mr. Anderson stated that that option was not economically feasible since the
current use generates income for the applicant and eliminating one lot to
address the City's concern could not be economically justified.
Commissioner Christ noted that his action would not depend upon financial
benefit to the developer nor the City's attempt to eliminate an undesirable
use, but rather upon benefits to the community.
Commissioner Fox clarified that the developer would not be here at all if the
City had not requested that he clean up the site.
Commissioner Christ asked for "planning reasons," for their request and in
response, Commissioner Fox stated that there were none.
Commissioner Christ affirmed his position that he would not support the
application because:
- Lack of information
- Not provided with enough alternative designs
- Objection to request from City for a development to alleviate an
undesirable use.
Commissioner Alne discussed the Site and Architectural Review Committee's
review of this item and stated that he would support the proposal since he felt
it would benefit the City as well as the developer.
Commissioner Wilkinson asked who would be responsible for maintenance of the
landscape strip abutting the canal.
Mr. Helms, City Engineer, indicated that the Public Works Department is not
supportive of the landscape strip since no one would maintain it, however, he
indicated that Public Works would support a sidewalk and tree wells along the
canal, which would be the responsibility of the City.

BACKGROUND
This item was continued from the previous Planning Commission meeting of
February 13, 1990, so that revised subdivision layouts could be presented
to the Site and Architectural Review Cox~ittee. The Site and
Architectural Review Committee met with the applicant of February 20,
1990, and reviewed a number of alternative site layouts for this
proposal.
DISCUSSION
After review of the various layouts and discussion of the applicant's
intent, in terms of developable lots, the Site and Architectural Review
Committee agreed that the previously presented layout was a reasonable
solution for this property.
At the February 13, 1990, meeting several Commissioners expressed concern
regarding the location of a cul-de-sac adjacent to the creek channel.
The applicant has indicated a desire to work with the Public Works
Department to provide a less than standard cul-de-sac width which would
accommodate a landscaping strip along the western portion of the
cul-de-sac. This revised design would also accommodate on-street parking
along the creek channel.
The less than standard cul-de-sac radius and width may be supported in
this situation because only three lots are serviced by the proposed
cul-de-sac. The applicant is confident that adequate parking on-street
and on-site can be accommodated for the proposed residential uses in this
subdivision.
A copy of the previous Staff Report and Comment Sheet is attached for the
Commission's review. Additionally, there are two proposed alternative
layouts for this development. One with a private street accessing
Crockett Avenue, and a second with a half street along the northerly
property line of the property.

The Architectural Advisor was absent during the February 20, 1990, Site
and Architectural Review Committee meeting. Since the architectural
plans have not been developed Staff has not yet obtained any comments
from the Architectural Advisor.

lot 3. The Commission may want to consider requiring the Site and
Architectural plans return to the Site and Architectural Committee for
approval. The ordinance currently requires Staff to review the

Commission Discussion
In answer to Commissioner Alne's question regarding communication from the
architect of the project who expressed concern that the size of the proposed
cul-de-sac would reduce the building envelope for the parcel fronting Westmont
Avenue, Mr. Helms assured the Commission that the minor revision to the radius
and width of the throat can be resolved at the staff level. The tentative map
met all the ordinance requirements and the revisions can be done between the
tentative and final map stages.
There was concern on the part of the Commission that the proposed lot sizes
were not in the spirit of the San Tomas Policy which "encouraged larger than
normal" lot sizes.
Mr. Haley assured the Commission that all of the lot sizes met the minimum
R-l-6 requirements. Mr. Haley also pointed out that there had been very little
development in this area over the past 30 years and that this project was more
consistent with recent City-approved developments.
Mr. Bruce Hodgins, the applicant, addressed the Commission noting that the
property was made up of various types of structures that were built back in the
1950's. The original owner has passed away, his estate sold the properties and
the applicant bought these lots with the intent of developing them into the
type of development the City was looking for.
Chairperson Perrine opened Public Hearing on TS 89-07.
Don Armstrong, 66 Christopher Ave., Campbell, expressed concern regarding
traffic on Westmont and suggested that the architect extend the cul-de-sac
out to Crockett Avenue.
2. Greg Linafecter, 1250 Capri Dr., Campbell, spoke in opposition of the
proposal - his concern was relative to the density in the area.
3. Mike Tippets, 1553 Capri Dr., Campbell, expressed concern regarding the
density and was opposed to the proposal.
4. Logan Cartright, 1664 Whitwood, Campbell, opposed the project due to the
high density in the area.
In response to Commissioner Olszewski's question regarding applicability of the
San Tomas Policy relative to this project, the Staff stated that it was
applicable relative to design, new development and compatibility with existing
structures

In response, Mr. Helms stated that the precise number of square feet had not
yet been determined; that the frontage road has been examined and that staff
has determined that some flexibility could be allowed since not having lots
fronting on one side of the cul-de-sac would dispense with a parkway strip on
that side of the street so the face of the curb would be immediately adjacent
to the front of the sidewalk. Mr. Helms stated that this would provide a
right-of-way fence for the Water District, which would be immediately adjacent
to the back of the walk, that the curb distance would be the same and that the
typical 5' parkway strip on the west side would not be available.
In answer to traffic concern and widening of Westmont Avenue, Mr. Helms
reported this matter still uncertain at this time. Both he and Director
Piasecki noted the Circulation Element of the General Plan would be reviewed in
the upcoming Fiscal Year but felt that the traffic generated by this project
would be minimal.
5. Molly Klupfell, 1450 Walnut Dr., Campbell, encouraged the City's
development of larger than normal lot sizes and expressed concern relating
to the traffic and the widening of Westmont Avenue.

Commissioner Olszewski raised the concern that he saw the cul-de-sac in the
wrong location.
Commissioner Christ said that was why he had voted no and wanted to explore
other solutions to the location of the cul-de-sac.
Commissioner 01szewski also noted that it would b~ difficult to visualize a
harmonious neighborhood development with a cul-de-sac that would be shoved over
to one side, against a creek remnant. Too much cement against cement. He also
asked the Planning director if there was to be any mitigation for landscaping
along the creek side?
Director Piasecki said that could be a possibility - along the west side of the
cul-de-sac.

Commissioner Christ raised the question of why the cul-de-sac de couldn't be
placed off Crockett Avenue, as opposed to Westmont . It was difficult to
understand why the homes could not all face the cul-de-sac and not have any
backing out onto Westmont. From a safety standpoint, it would be better to
have traffic coming off one street rather than coming out of a court and a
street. It would be less confusing to have a street right next to the concrete
ditch. If there were a house there, with a fence up against the ditch and
landscaping, it would more or less hide the ditch rather than draw attention to
it - making the overall development more attractive.
Director Piasecki reported that applicant had looked at all of the concerns
voiced by the Commissioners and felt that fronting homes onto Westmont Avenue
was not as desirable from his standpoint vs fronting homes onto quieter
Crockett. However it was because of the City's specifications that he has been
left with the present design. Landscaping would also take care of softening
the hard cement look. If a cul-de-sac would be placed in the center of the
project, then the actual yield would be 5 lots, not 6. The lot size is simply
not big enough to double load the cul-de-sac efficiently.
Commissioner Christ reaffirmed his position that a better layout would make
better sense both appearance and safety-wise. He did not have a problem with
there being six units, but it was the manner it which it was laid out that was
causing the difficulty.
Chairperson Perrine suggested reopening the Public Hearing for additional Site
and Architectural Committee review, as there was a consensus that a different
layout of the cul-de-sac needed to be addressed.
Commissioner Olszewski agreed that would be a prudent option and would give the
Commission a chance to look and hear alternative layouts.

Commission. He reported that although they had previously prepared other
layout sketches, they were no longer available.
Chairman Perrine noted that that was unfortunate, but that the Planning
Commission was being asked to make a decision and they had not had an
opportunity to review any other layouts. He asked the applicant if he would
object to bringing in additional sketches to a Site and Architectural Review
Committee meeting which would be scheduled for the following week. This
hearing, then, could be continued for two weeks to the next regularly
scheduled Planning Commission meeting.
Commissioner Olszewski asked that a Public Works representative be present at
the Site and Architectural Review Committee meeting.

STAFF RECOMMENDATION
Public Hearing to consider the request of
Mr. Bruce Hodgins for a Tentative Subdivision Map to
divide two lots into six lots, on property known as
987 and 1113 Crockett Avenue and 1345 Westmont Avenue
in an R-l-6 (Single-Family) Zoning District.
That the Planning Commission take the following actions:
1. REC~ that the City Council grant a Negative Declaration for
this property.
2. ADOPT a resolution, incorporating the attached Findings,
recommending that the City Council approve the map, subject to the
attached Conditions.
APPLICANT'S PROPOSAL
The applicant seeks approval of a tentative subdivision map to create six
single family lots on the northwest corner of Westmont Avenue and Crockett
Avenue. The project site is currently comprised of two parcels which are
developed with five residential structures and an auto repair shop.

BACKGROUND
The subject properties currently are developed with a number of residential
units which were constructed when these properties were in Santa Clara
County's jurisdiction. The residential uses and the existing auto repair
shop do not conform to the current R-l-6 (Single Family Residential) zoning
shown for this area.
GENERAL PLAN AND ZONING CONSISTENCY
a. General Plan Designation:
The site is designated for Low Density
Residential on the Land Use Element of the General Plan which permits
less than six units per gross acre. This proposal would be developed
at 4.1 units per gross ac~e.

Zoning Designation: The~site is currently zoned R-l-6 (Single Family
Residential). The proposed lots all have a minimum of 6000 sq. ft. in
area and a minimum average lot width of 60 feet. The proposed lots
are consistent with the Zoning District.

The proposed map would allow the creation of six single family lots. Three
of the proposed lots would have frontage on Crockett Avenue and three lots
would have frontage on a new cul-de-sac accessing Westmont Avenue adjacent
to the westerly property line.
DISCUSSION
The layout of the proposed subdivision maintains the orientation of the
lots along the Crockett Avenue frontage and allows lots with access to
Westmont Avenue via a new cul-de-sac. This layout discourages the
orientation of homes towards Westmont Avenue.
Westmont Avenue. Approximately a 30' wide portion of the Westmont Avenue
frontage is currently owned by the Santa Clara Valley Water District. The
Public Works Department has required that this developer reserve a 45'
area from center line for street right-of-way in the future and that
street improvements be constructed at this time at a 30' from center line
dimension. The present map illustrates the requested dedication.
Alternate Layouts. An alternate subdivision layout which provides access
by way of Crockett Avenue cul-de-sac was also considered for this
proposal. This layout, however, created lots backing onto Westmont Avenue
and having a frontage on Westmont Avenue and the new cul-de-sac.
Consequently, the present layout was considered more desirable.
RBCO~ATION/SUMMARY
Staff finds that the proposed subdivision created a reasonable lot
configuration which is consistent with the General Plan and the zoning for
this area.

CONDITIONS OF APPROVAL
Install standard street improvements on Westmont and Crockett Avenues,
and the new cul-de-sac as directed by the City Engineer.
(Improvements on Westmont Avenue to be installed pending ownership
transfer of land from Santa Clara Valley Water District to the City of
Campbell. Improvements to be installed for a 30 foot half street at
this time, with the additional 15 foot strip of land reserved for
possible future street purposes.)
Obtain approval from the Civic Improvement Commission and the County
Communications Office for the proposed street name of the new
cul-de-sac.
3. File and process a final tract map.
4. Provide 5 sets of grading and drainage plans.
5. Dedicate additional right-fo-way for proposed cul-de-sac.
Sewers: Installation of a sanitary sewerage system to serve all lots
within the subdivision in conformance with the proposed plans of the
County of Santa Clara Sanitation District No. 4. Sanitary sewerage
service to be provided by said District No. 4.
Water Service: Installation of a water distribution system to serve
all lots within the subdivision in conformance with the plans of the
San Jose Water Works. Water service to be provided by said water
company. Fire hydrants and appurtenances shall be provided and
installed at the locations specified by the Fire Chief, Fire
Department, City of Campbell. Fire hydrant maintenance fees shall be
paid to City at the rate of $195 per fire hydrant.
Subdivision Map Act: Compliance with the provisions of Title 20,
Subdivisions of the Campbell Municipal Code.
9. Storm Drain Fee: Subdivider to pay Storm Drainage Area Fee.
10. Surety: Subdivider shall install street improvements and post surety
to guaranty the work.
