Public Hearing to consider the application of Mr. Tom Prebil and
Mr. John Garagozza, on behalf of MVA Construction Co., Inc., for
approval of a Tentative Subdivision Map (TS 98-02) and a Site
and Architectural Approval (S 98-18) to allow a subdivision to
create six parcels on property located at 1113 Crockett Avenue
(northwest comer of Crockett & Westmont) in an R-l-6 (Single
Family Residential) Zoning District. An Initial Study has been
prepared for this project and a Negative Declaration has been
recommended which concludes that there are no significant
environmental impacts related to the project. A copy of the Initial
Study and Draft Negative Declaration are available for public
review in the Planning Office. Tentative City Council Meeting
Date: November 16, 1999.
Ms. Katrina Rice Schmidt, Planner II, presented the staff report as follows:
· Advised that the applic, ants are seeking a Tentative Subdivision
Map and Site and
Architectural Approvals to allow the creation of six single-family residential lots and six new
single-family residences.
· The project site is located on the northwest comer of Westmont and Crockett and is within an
R-l-6 (Single Family Residential) Zoning District.
· The project site consists of 1.39 acres and is surrounded by single family residences. The
property is within the San Tomas Area Neighborhood.
· The proposed project is consistent with the Zoning and the provisions of the San Tomas Area
Neighborhood Plan. The proposed density is 4.33 units per acre.
· The individual lots will range in size from 6,945 square feet to 8,217 square feet and will be
created from two existing parcels. Two lots will face onto Westmont Avenue and four will
face onto Crockett, although two will be flag lots.
· The homes will consist of 2,500 to 3,000 square feet which represents a .42 Floor Area Ratio.
The homes will feature both front and rear porches, cedar siding, stucco walls. Mature trees
have been removed and will be replaced.
· SARC reviewed this project on October 12, 1999, and is supportive.
· Reminded the Commission that two communications distributed this evening are relating to
this project. A letter from Valley Transportation Agency asks for continuous sidewalks and
ramps. A letter from neighbor, Mr. Michael Wu, seeks full improvements along the west
side of Crockett Avenue.
· Advised that Conditions of Approval 11 and 14 require a dedication should the San Tomas
Area Neighborhood Plan be amended within the next year to require public improvements.

Commissioner Gibbons advised that the site plan would have to be modified if the public right of
way improvements are required for this project.
Ms. Katrina Rice Schmidt advised that the applicant is opposed to the additional dedication. The
dedication will affect Floor Area Ratios and lot coverage but the footprint of the structures can
stay the same with the exception of one garage that would have to become detached. The lots are
still well within requirements even with the dedication.
Commissioner Gibbons sought clarification that if Council approves changes to the San Tomas
Area Neighborhood Plan within one year, the dedication would be required.
Mr. Steve Piasecki advised that the applicant would have to leave room for the additional right-
of-way for one year. He added that each lots is reduced by 250 to 300 square feet if the
dedication is ultimately required.
Commissioner Gibbons presented the Site and Architectural Review Committee report as
follows:
· SARC met on October 12, 1999, to review this project.
· SARC is supportive of the architectural design and requested substantive trees for the site,
window details and fence details.
Commissioner Lindstrom sought clarification that the SARC requirements are included within
the Conditions of Approval.
Ms. Katrina Rice Schmidt replied that the SARC requirements were incorporated into the
Conditions of Approval.
Chairman Jones opened the Public Hearing for Agenda Item No. 2.
Mr. Tom Prebil, Applicant:
· Stated that he supports sending this project on to Council.
Chairman Jones closed the Public Hearing for Agenda Item No. 2.
Chairman Jones expressed his appreciation for the large lot "Country" estates and stated his
support for staff recommendations.
Commissioner Gibbons suggested another alternative, following existing rules of the San Tomas
Area Neighborhood Plan.

Upon motion of Commissioner Gibbons, seconded by Commissioner
Lindstrom, the Planning Commission adopted:
A. Resolution No. 3241 recommending that Council approve a Tentative
Subdivision Map (TS 98-02) to allow the creation of six residential

B. Resolution No. 3242 recommending that Council grant Site and

C. That Council adopt a Negative Declaration for this project.

expansion to an existing massage school located at 2231-A
Winchester Boulevard in a C-2-S (General Commercial) Zoning
District. This Project is Categorically Exempt from environmental
review. Planning Commission decision final unless appealed in
writing to the City Clerk within 10 days.
Ms. Aki Irani, Planner I, presented the staff report as follows:
· Advised that the applicant is seeking approval for the expansion
of hours and scope of
operation for a massage school on Winchester Boulevard.
· The project site is located on the northwest comer of Winchester and Catalpa.
The surrounding uses include a vacant residential lot to the west, vacant commercial to the
east and commercial to the north and south.
· The property is zoned C-2-S (General Commercial).
· The use includes lectures and instruction and massage clinics where the students actual work
on clients. No payment is made to the students. The compensation for the massage therapy
is paid to the school. Students earn credit on their tuition.
· The expansion of hours is from 7 a.m. to 11 p.m. The last class would end at 10 p.m. The
last hour would be to allow students an opportunity to speak with instructors after class and
allow the school to be shut down for the evening.

I am a resident of 998 Crockett Avcnuc. This letter is regarding new Single Family Residential
development project (File No_ TS 98-02tS 98-18).
I had an opportunity to sec thc design packagc through Mr. Garagozza last week ! like the design
and the quality of the work they are trifling to achieve. I welcome the developer like Mr.
Garagozza. The only concern related to this project, as well as to the future project in this
n¢~$hborhood is the potential inconsistency o£the zoning regulation, more specifically, the issue
related to the curb, gutter & sidewalk (C/G & sidewalk). Currently, my next door's ncighbor and
my property are the only two properties in this street have a standard C/G & sidewalk_ The
remaining of thc str~'t is unimproved. In my view, there are only three options available.
Option lll--.Full improvement with the standard CIG & sidewalk.

The Santa Clara Valley Water District (District) has reviewed the subject tentative subdivision map sent

subdivision map for the division of 1.12 acres at the northwest comer of Westmont and
Crockett Avenues into 6 single-family lots. We have the following comments.
Currently, VTA operates no bus service on Crockett or Westmont Avenues adjacent to
the project site. However, service is provided on San Tomas Aquino Road, approximately
0.4 miles south of the project sim, by Lines 38 and 60.
To provide residents and visitors of the project with convenient and ~fe access to the
transit services in the area, VTA staff recommend that the City condition the developer
to provide the following pedestrian access improvements as part of the project:
· Continuous sidewalks along all public and private streets within and adjacent
to the project site.
· WbeelchoJr curb ramps, consistent with Americans with Disabilities Act (ADA)
requirements, at all driveways and intersections within and adjacent to the
project site.

Message: Thanks for the cross sections along the creek tbr the subject project. It looks like a
significant portion of the creek frontage has either a curb or swale at the property line. This
places the curb pretty much at the top of bank with no room for any planting, minimal space for
a fence. We typically see problems with driveways and fence lines in such close proximity to
the creek banks. This bank is fairly steep and therefore more subject to erosion or failure.
Activities associated with a driveway: vehicle loads on the adjacent ground/top of bank,
passenger loading/unloading, children playing etc all can impact the creek bank and fencing. We
request that the curb be located away from the top of bank to allow adequate space for fencing,
perhaps planting and a flat ground buffer area. As we discussed, I mentioned a minimum of 5
feet.
I have the same concern with the setback of the house on lot 7 as it appears to be very close (8')
to the top of bank. Setbacks from hazards such as steep banks should be considered in addition
to normal zoning setback requirements.

Subject: Status of project at 1113 Crockett Avenue, a.k.a. 1345 Westmont
It is my understanding from discussion with Mr. Garagozzo, your engineer, Mr. Prebil, and your
architect, Mr. McCarthy, that the following is the status of the above application:
Tract Map: You have located the heirs to the well site shown on the map submitted, and
with their consent, have obtained quiet title to remove any claim they have to the property.
Also, the easement over the property by the Orchard Valley Water Company has no effect,
as the company is defunct, with no person or entity inheriting their rights of easement. I
understand that your engineer has reviewed this and is sending the required two copies to
the City.
Grading, Drainage and Lotting Plan (Tentative Map). Tom Prebil dropped off a revised plan
on the 8th for the City to review, prior to his submitting a full set of plans. He also provided
this to Sue Tippets at the Water District. The revised grading and drainage appears to meet
the City and Water District's concern to not raise the elevation along the Creek. We are
requesting a memo from the Water District regarding the revised plan.
Public Works requests that two cross-sections be added to the map for the Creek area, one
next to Westmont Avenue, showing the "worst case" re fill, and one further to the south, as
a "typical".
The Planning Department requests that all zoning setback lines for buildings be removed as
they are not needed, and are misleading as shown. (the side setback is not 5', but 5' or V2 the
building wall height, whichever is greater; the front setback is 20' for the house, but is 25
feet for the garage face.).
Also, the City development standards require any tree which is 4" or greater is to be
indicated. From looking at aerials and visiting the site, it can been seen that 9 of the trees on

the plan are correct, 5 are either incorrectly located or have been removed, and that about a
dozen are not shown.
These need to be accurately indicated in order for us to evaluate whether they can be saved
relative to the grade changes. The trees which particularly need accuracy of grade and
location, as they are the ones which appear might be worth saving, are those two located on
what will be the rear yard of Lot 3, the 12" tree located closest to the north side property line
of Lot 2, the maple in the rear yard of Lot 1, and the acacia located in the area between Lots
4 and 7.
Architectural Plans. The plans first submitted by your designer did not meet required side
setbacks on three lots. The massing of the houses was also not in keeping with the San
Tomas Area Neighborhood Guidelines. Mr. McCarthy has since revised those plans, and
brought by a set of revised plans at the end of December, which the Director and I
commented upon. He is preparing plans to respond to those comments. However, a set of
revised plans have not yet been submitted.
Arborist Report. No arborist report has been submitted as yet. This is required for any trees
of a diameter of 4" or greater. The report shall include information on the size, species,

which need the closest scutiny in order to determine if they are worth saving.
Tree replacement. Note that any trees which are not saved are required to be replaced by
either 24" box trees or 36" box trees, depending upon the size of the removed tree and the
ability of the sites to accommodate the number of trees. Copies of the relevant pages from
the San Tomas Neighborhood Plan, the Water Efficient Landscpe Guidelines, and the Tree
Ordinance are enclosed.

Subject: Status of project at 1113 Crockett Avenue.
It is my understanding from discussion with Mr. Garagozzo, your engineer, Mr. Prebil, and your
architect, Mr. McCarthy that the following is the status of the above application:
Tract Map: You have located the heirs to the well site shown on the map submitted, and
with their consent, will be filing a quit claim to remove any claim they have to the property.
Also, the easement over the property by the Orchard Valley Water Company has no effect,
as the company is defunct, with no person or entity inheriting their rights of easement. Once
these items have been taken care of, you will be providing the City with a copy of the Title
Report, which is a missing item from your application.
Grading and Drainage Plan. The plan submitted with the application indicates up to 3 feet
of fill to be placed at the top of bank along Smith Creek. No indication of a retaining wall
was included. The City requested a response from the Santa Clara Valley Water District,
owner of the Creek property, regarding the proposed fill. Sue Tippets of the District
responded indicating that the District would not want fill placed here, nor allow any change
which would redirect flood water onto properties across the creek.
The City prefers that the grades remain as natural-appearing as possible, especially at
property boundaries. We therefore met with your engineer and determined a solution, but
that it entailed a second drainage into the creek. Sue Tippets' fax to us indicated that a
second drainage outlet would not be permitted by the District. However, our conversations
with Mr. Prebil since then have indicated that he has worked out a way for this to happen
which is acceptable to the District. This revised grading and drainage map has not yet been
submitted to the City.
Architectural Plans. The plans first submitted by your architect did not meet required side
setbacks on three lots. The massing of the houses was also not in keeping with the San
Tomas Area Neighborhood Guidelines. Mr. McCarthy has since revised those plans, and
brought by a set of revised plans which the Director and I commented upon. He is preparing

plans to respond to this comments. However, a set of revised plans have not yet been
submitted.

Dear Mr. Movassate,
In reviewing the application for the seven lot development on the northwest comer of Westmont
and Crockett Avenues, the Community Development Department finds the following
information to be needed to comply with City ordinances, and to complete the application:
As required by the Tree Ordinance and WELS standards (enclosed), a survey and evaluation
by a licensed arborist of all existing trees on the lot which are over 4 inches in diameter. The
site plan by your architect indicates that four trees are planned to be saved, however, a
review of the proposed grading plan indicates that only the 12" apricot tree on Lot 3 can be
saved, as the grade difference around the others will be too severe.
The Level 1 Soil Survey prepared by Soil Tech Engineering, Inc. refers, on page 4, to two
other reports dealing with the removal of two underground storage tanks. Please supply us
with a copy of these reports. These are needed for environmental review purposes, as the
City has documentation that a gas station was located on the comer of the site as early as
1939, and that some sort of auto business was in operation continuously since then, until the
last business, Bemal's Autos, was recently demolished. The auto business, however, used
the comer area for parking, with the buildings and work being done more to the north. If
possible, it would be best to be able to determine that there are no other tanks or containers
below the surface, which could prove a problem during construction.
We would like to be sure that in removing the tanks, that the soil under and around them
was examined. The Level 1 survey is a superficial survey as the review was limited to
aerials dating back to 1954 only, a visual survey of the site, and any documented spills. As
you may be aware, almost all of the buildings and uses on the site were/are without permit.
It could be likely that spills or other soil contaminating activities were not reported.

Both the City and the property owner have the responsibility and liability to future property
owners to ensure that the site is clean enough for the families who will be living there in the
future.

Dear Mr. Hodgins,
The City of Campbell is requesting, for the second time, Westmont Crockett Investments'
permission to enter onto their properties at 987 and 1113 Crockett Avenue, on the northwest comer
of Crockett Avenue and Westmont Avenue, in the City of Campbell on Wednesday, August 26,
1998, between the hours of 10 a.m. and 1 p.m. The City is requesting access to all the buildings,
including the mobile homes and trailers, for the purpose of determining what exists on the property
relative to code compliance.
Based upon information provided by the County of Santa Clara for the years when the property was
under its jurisdiction, together with City records, it appears that no building permits have ever
been issued for either parcel, even though permits have been required since 1947.
The parcels also border on property owned by the Santa Clara Valley Water District, and no
permits have been issued for either parcel by that entity, although a representative of the
District has observed that several outfalls have been placed to their channel from the
properties.
The City of Campbell believes that the development on the two parcels may pose conditions
which are detrimental to the health, safety and welfare of the community, which must be
abated.
Previous maps submitted by you in 1989 for a subdivision which was never recorded, aerials, and
views from adjacent public streets indicate that the two properties contain, at least the following:
1. A multiple family dwelling on the Water District's propertyline.
2. Two single-wide mobile home trailers.
3. Five other residential buildings, some of which may be multi-family dwellings
