After notification and public hearing, as specified by law, and after presentation by the" Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application V 98-04: Granting of the variance to allow the construction of a wooden fence in lieu of a masonry wail for screening along the eastern property line adjacent to residentially zoned properties is necessary for the preservation and enjoyment of the applicant's property rights to develop the property with the same privileges as enjoyed by other properties in the same zoning district. The proposed 36-inch diameter water pipeline exists in locations on or in close proximity to the eastern property line and presents an exceptional circumstance applicable to the property which will not permit the construction of a masonry wall in compliance with the City's M-1-S zoning ordinance. The proposed wooden fence will serve the purpose of screening of the mini-storage facility from the adjacent residentially zoned properties as the required masonry wall would. The Santa Clara Valley Water District will not permit a masonry Wall to be constructed on or in close proximity to the existing pipeline, but will permit a wooden fence with supports off-set onto the Storage USA side of the property. 5. A variance is needed to allow the development of a mini-storage facility to proceed and to allow reasonable use of the property that is generally enjoyed by others. Based on the foregoing findings of fact, the Planning Commission further finds and concludes that: Strict or literal interpretation and enforcement of the specified regulation would result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of the zoning ordinance. The granting of the variance will not constitute a grant of special privilege inconsistent with the limitations on other properties classified in the same zoning district. 5. The granting of the variance will not be detrimental to the public health, safety, or welfare, or be materially injurious to properties or improvements in the vicinity. The proposed wooden fence in lieu of a masonry wall is architecturally compatible with the proposed mini-storage development and to the adjacent residential properties to the east. 4. The proposed wooden fence serves the same screening purpose as the required masonry wall from adjacent residentially zoned properties. 5. The proposed 8-foot high wooden fence will not impair pedestrian or vehicular safety. 6. The proposed 8-foot high fence results in a more desirable layout of the applicant's property. Based on the foregoing findings of fact, the Planning Commission fmrther finds and concludes that: The proposed wooden fence is compatible with the objectives of the General Plan and the Zoning Ordinance, with approval of a Variance, and will aid in the harmonious development of the immediate area. 2. The project site is located on the east side of Curtner Avenue, north of Camden Avenue and south of McGlincey Lane. Surrounding land uses include an animal hospital and garden equipment business to the north, a motel to the south, single-family residences to the east and a restaurant and Highway 17 to the west. The proposed wooden fence is to be constructed adjacent to the rear yards of five (5) single-family residential properties east of the project site located on Shamrock Drive. Background: On February 10, 1998, the Planning Commission approved a Reinstatement application (R 97-06) to reinstate a Site and Architectural Review Permit (S 96-16) and a Conditional Use Permit (96-18) to allow the development of a 94,265 square foot mini-storage facility with on-site manager's living unit on properties currently referenced as 50, 98 and 110 Curtner Avenue. The Site and Architectural Review Permit and Use Permit were initially approved by the Planning Commission on January 28, 1997. On September 29, 1998, Planning Staff met with Santa Clara Valley Water District representatives and Storage USA representatives to discuss efforts to allow Storage USA to proceed with the development of its project site as a mini-storage facility. During the meeting, Santa Clara Valley Water District indicated that a wall of masonry construction would not be permitted along the east property line of the project site due to the location of a 36-inch diameter water pipeline near and along the eastern property line of the project site adjacent to the residential properties. The 36-inch diameter pipeline is only approximately 18 inches below grade. Due to the close proximity of the pipeline to the property line and the existing grade, the Water District has stated that the masonry wall construction, including footing and supports for the wall, will obstruct the Water District's ability to operate and service the pipeline; and, therefore, objects to the wall. The Water District requested that an alternative design for the wall which would allow for operation and service of the pipeline be proposed. ANALYSIS General Plan Designation: The General Plan land use designation for the project site is Industrial. The proposed fence of wood construction will serve the purpose of a required masonry wall along the adjacent residentially-zoned properties to provide screening of the mini- storage facility from the residential properties. The proposed wood fence will allow the proposed development to proceed as a mini-storage facility with an on-site manager's living unit, which is consistent with the General Plan land use designation for the site. Under Section 21.32.110 of the Zoning Ordinance, any use conducted in an M-1-S zoning district shall be effectively screened at the property line from any abutting residentially zoned property and shall require screening in the form of a masonry wall not less than six (6) feet in height. In addition, such screening shall include trees and plants to effectively screen such use from the adjoining residentially zoned property. The applicant is requesting approval of a Variance from the screening requirement of the Zoning Ordinance and a Modification to the condition of approval which requires the construction of a minimum six (6) foot high masonry wall along property lines abutting residentially-zoned properties. The applicant is requesting approval of a wooden fence in lieu of a masonry wall to fulfill the screening requirement. Variance Criteria: Under the Zoning Ordinance, the Planning Commission may grant variances to prevent and lessen practical difficulties and unnecessary hardships inconsistent with the Zoning Ordinance that would result from strict or literal interpretation of the zoning regulations. Approval of a variance requires that the Planning Commission make the following five (5) mandatory findings: A. Strict or literal interpretation and enforcement of the specified regulation would result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of the zoning ordinance. B. This presents an exceptional circumstance applicable to the property which generally does not apply to other properties in the same zoning district. That the Santa Clara Valley Water District will not permit a masonry wall to be constructed on or in close proximity to the existing pipeline, but will permit a wooden fence along the property line with supports off-set onto the Storage USA side of the property. 3. That a variance is needed to allow the development to proceed as a mini-storage facility and to allow reasonable use of the property that is generally enjoyed by others. That strict and literal interpretation of the regulations requiring a masonry wall for screening will result in a practical difficulty and physical hardship to develop the mini-storage project as proposed and as approved, and would deprive Storage USA of privileges enjoyed by other properties in the M-1-S zoning district. That the wooden fence will serve the purpose of screening as the masonry wall would and will, therefore, not constitute a grant of special privilege inconsistent with the limitations on other properties in the same zoning district. 6. That denial of the variance will result in a hardship to proceed with the development of the mini-storage facility. That an 8-foot high wooden fence in lieu of a 6-foot high masonry wall will provide improved screening of the development from the adjacent residential properties and will aid in noise attenuation of the mini-storage use, and therefore, will not be detrimental to the public health, safety, or welfare, or be materially injurious to properties in the vicinity. Staff finds that the proposed variance meets the findings required to be made by the Planning Commission to approve the variance and believes the approval of a wooden fence will not result in the granting of a special privilege that is contrary to the intent or purpose of the zoning regulations or General Plan. Therefore, Staff is supportive of the variance for a wooden fence in lieu of the masonry wall. Modification application: The Reinstatement application approved on February 10, 1998 requires compliance with all previous conditions of approval as stated in Resolution No. 3071 of the originally approved Site and Architectural Review Permit (S 96-16). Under Condition No. 21 of Resolution No. 3071, the applicant is required to provide a masonry wall adjacent to all residentially-zoned properties. Storage USA is also requesting at this time a Modification to the previous Site and Architectural approval to revise Condition No. 21 to allow a wooden fence to suffice in lieu of the masonry wall for screening. Staff Report - Planning Commission Meeting of October 27, 1998 V 98-04/M 98-14 - 50, 98 and 110 Curtner Avenue Page 5 Fence Design: The proposed fence consists of an 8-foot high wooden fence to be constructed along the eastern property line for a length of approximately 251 feet. The fence will consist of 8-foot long vertical wooden panels which will be removable to allow the Water District access to operate and service the existing 36-inch diameter water pipeline. The concrete casson supports for the wooden fence will be off-set onto the Storage USA side of the property and the fence will then cantilever over onto the property line. The proposed 8-foot high fence, which is two (2) feet higher than the minimum required 6-foot high masonry wall, also requires approval of a fence exception for the additional 2-feet of height, which may be approved in conjunction with the approval of the Variance and Modification applications. Storage USA is proposing the 8-foot high fence to provide improved screening of the development from the adjacent residentially zoned properties, in lieu of the required 6-foot high masonry wall, which will serve the intent of the screening requirement in the Zoning Ordinance. The Water District has reviewed the wooden fence plans and finds the conceptual fence plans acceptable with the additional requests that there be a minimum 18-inch distance from the outside diameter of the pipeline to the fence and its supports, and that root barriers be installed parallel to the fence at the piles to discourage roots from growing onto and around the pipeline. Staff is also supportive of the proposed fence application as proposed with the understanding that all adjacent residential property owners have no objection to the proposed wooden fence. Site and Architectural Review Committee: The Site and Architectural Review Committee reviewed this project at its meeting of October 13, 1998 and expressed support for the Variance (V 98-04) and Modification (M 98-14) applications to allow a wooden fence in lieu of a masonry wall along the eastern property line of the project site with the following additional conditions: That prior to the public hearing, the applicant obtain written consent from all property owners of adjacent residentially zoned properties demonstrating no objection to the proposed 8-foot high wooden fence. 2. MEETING: October 27, 1998 Attachment #1 Findings for Approval of a Variance to allow the construction of a wooden fence in lieu of a masonry wall along the eastern property line of the subject property adjacent to residentially zoned properties The Planning Commission finds as follows with regard to File No. V 98-04: Granting of the variance to allow the construction of a wooden fence in lieu of a masonry wall for screening along the eastern property line adjacent to residentially zoned properties is necessary for the preservation and enjoyment of the applicant's property rights to develop the property with the same privileges as enjoyed by other properties in the same zoning district. The proposed 36-inch diameter water pipeline exists in locations on or in close proximity to the eastern property line and presents an exceptional circumstance applicable to the property which will not permit the construction of a masonry wall in compliance with the City's M-1- S zoning ordinance. 3. The proposed wooden fence will serve the purpose of screening of the mini-storage facility from the adjacent residentially zoned properties as the required masonry wall would. The Santa Clara Valley Water District will not permit a masonry wall to be constructed on or in close proximity to the existing pipeline, but will permit a wooden fence with supports off- set onto the Storage USA side of the property. 5. A variance is needed to allow the development of a mini-storage facility to proceed and to allow reasonable use of the property that is generally enjoyed by others. Based on the foregoing findings of fact, the Planning Commission further finds and concludes that: Strict or literal interpretation and enforcement of the specified regulation would result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of the zoning ordinance. There are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property which do not apply generally to other properties classified in the same zoning district. There have been no changes in the General Plan and Zoning in the area since the original approvals. No other changes in the development standards or regulations of this project are requested other than a modification to the conditions of approval to allow a wooden fence in lieu of a masonry wall adjacent to residentially zoned properties. 3. The proposed wooden fence in lieu of a masonry wall is architecturally compatible with the proposed mini-storage development and to the adjacent residential properties to the east. 4. The proposed wooden fence serves the same screening purpose as the required masonry wall from adjacent residentially zoned properties. 5. The proposed 8-foot high wooden fence will not impair pedestrian or vehicular safety. 6. The proposed 8-foot high fence results in a more desirable layout of the applicant's property. Based on the foregoing findings of fact, the Planning Commission further finds and concludes that: The proposed wooden fence is compatible with the objectives of the General Plan and the Zoning Ordinance, with approval of a Variance, and will aid in the harmonious development of the immediate area. 2. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application S 96-16: The proposed mini-storage facility is a permitted use for the site and is consistent with the M-1-S (Light Industrial) zoning designation and Industrial General Plan land use designation for the site. The proposed project is of an appropriate scale and design and is compatible with the existing surrounding uses. The provision of 16 total on-site parking spaces adequately meets the needs of the proposed project based upon the parking analysis submitted by the applicant and contained in the attached report. The proposed project site is of adequate size to develop the proposed mini-storage facility. o The proposed project is anticipated to generate 98 vehicle trips during the average weekday and will not impact existing transportation facilities that serve the area. 6. The proposed mini-storage facility is a clean and quiet operation that will integrate well with the existing surrounding uses. The conditions of approval are roughly proportional and reasonably related in nature and extent to the impacts of the project. The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions is in accordance with the ordinance of the City of Campbell and the State of California. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified: Approved Plans: Approval is granted for a Site and Architectural Review Permit to allow a three-story, 94,000 square foot mini-storage facility to include approximately 750 storage units, a 1,200 square foot office and a maximum 1,000 square foot on-site manager's living unit for security purposes on properties located at 50, 98 and 110 Curmer Avenue. Project approval shall substantially comply with plans and material color board as submitted by the applicant, except as modified by the conditions of approval herein. o Development Schedule: Applicant shall begin construction within one (1) year of final approval of this application. Building Design: Approval of the building design is granted as represented on the elevations submitted by the applicant. Modifications to' the conceptual floor plans shall not affect exterior changes to the approved buildirig design. The type of tree selected shall be reviewed and require approval by the Community Development Director. Installation of six (6) 36" box street trees within the front yard setback to provide shading over the new sidewalk to be constructed along Curmer Avenue. The type of trees selected shall be reviewed and require approval by. the Community Development Director. Standard Street Improvements: Prior to issuance of any building permits for the site, the applicant shall prepare plans, pay fees, sign an agreement, post securities, and provide insurance to obtain an encroachment permit to construct public street improvements on Curtner Avenue, as required by the City Engineer. All construction shall be in accordance with the City of Campbell's Standard Specifications and Details. Public Street Improvement plans shall be prepared by a registered Civil Engineer licensed in the State of California, and shall include the following: a. Driveway approaches: Removal of the existing curb, gutter and sidewalk as needed to construct two new driveway approaches. Sidewalk: Construction of new sidewalk along parcels 31 and 32 to conform with the existing sidewalk along parcel 30. Repair existing sidewalk as determined by the City Engineer. c. Street Trees: Installation of street trees behind sidewalk at 40 feet on center, including irrigation facilities. d. Street Lights: Installation of street lights, as needed, to conform to the city of" Campbell's Street Lighting Policy. Traffic Control' Improvements: Removal of existing traffic striping, slurry sealing of pavement, and installation of new traffic striping and related traffic control improvements, as needed, to create two traVel lanes and a continuous left turn lane (no parking) from about 150 feet no/th of the northerly property line thence southerly to Camden. Planning Commission Resolution No. 3071 S 96-16 - 50-110 Curmer Avenue - Mini-Storage Facility Page 4 o Transition Improvements: Removal and replacement of about 70 feet of curb and gutter northerly of the northern property line as needed to construct a transition from a 20 foot off-set from centerline to a 30 foot off-set. Transition shall commence at the northerly property line of Parcel 32 and terminate approximately at the southerly end of the existing concrete driveway approach for APN 414-01-033. Utilities Boxes: Relocation of all utility boxes to back of walk. Water Meter & Sewer Clean Out: Relocation of eXisting placement of new water meters and sewer clean outs behind the property line. Grading and Drainage Plans: Prior to issuance of any building permits for the site, the applicant shall conduct hydrology studies, as necessary, prepare grading and drainage plans, and pay fees required to obtain necessary grading permits from the Building Division. All storm runoff shall be collected on site and conveyed under the sidewalk to the street gutter. The drainage study shall be based upon a 1 O-year frequency storm. Storm Drain Area Fee: Prior to issuance of any building permits for the site; the applicant shall pay the required storm drainage area fee of $2,500 per acre for assessor's parcels 30 and 31. Tentative Parcel Map: Applicant shall submit a tentative parcel map, for approval by the City, to merge assessor's parcels 30, 31 and 32 into one parcel. Prior to issuance of any building permits for the site, the applicant shall prepare and submit a final parcel map for approval by the City Engineer and recordation. A current preliminary title report must be provided. Monumentation security must be provided guaranteeing the cost of setting all monuments, as shown on the map. The current fee for the tentative parcel may is $2,150 and the current final parcel map fee is $1,085 ($1,060 plus $25 per parcel created). Right-of-way: Prior to issuance of any building permits for the site, the applicant shall submit an' application for the City to vacate excess public street right-of-way, as needed, to create 60' of public right-of-way adjacent to assessor's parcel 30. Dedication to provide 60'of public right-of-way adjacent to assessor's parcels 30, 31 and 32 is required. Based on the information provided by the applicant, 60' of right-of-way exists adjacent to assessor's parcels 31 and 32. The current fee is $550. Completion of Public Street Improvements: Prior to issuance of occupancy for the site, all public street improvements, as required by the encroachment permit, must be completed and accepted by the City Engineer and the applicant must provide the one-year maintenance security. 11. 12. 13. Under~ound Utilities: Ail new on-site utilities shall be installed underground per Section 20.36.150 of the Campbell Municipal Code. The existing power poles in the public fight-of-way adjacent to the site shall be removed and the distribution. and service facilities shall be placed underground. Applicant shall comply with all plan submittals permitting, and fee requirements for the serving utility company. Applicant shall submit a Utility Coordination Plan and Schedule for approval by the City Engineer for installation of all utilities. The plan shall minimize the damage to all public facilities, including utilities off site serving this site, and on-site , consistent with the codes. Storm Water Management: Comply with California Storm Water Best Management Practices Handbook, prepared by Storm Water Quality Task Force, Santa Clara Valley Water District. Building Division Requirements: Applicant shall comply with all Building Code requirements, obtain necessary permits as determined by the Building Division and additionally comply with the following: For S-l/R-3 Occupancies, Type II-N Construction, the basic total allowable square footage = 67,000 square feet, given a maximum of 33,600 square feet per floor (UBC 505.3, 504.2). b. A maximum of two (2) stories is allowed, unless the building is sprinklered. If the building is sprinklered, one (1) additional story may be allowed. Automatic sprinklers are required when there is less than 20 sq. f. of openings in 50 linear feet of exterior wall. (Note: If less than 20 sq. ft. of openings, area and height increases might not be allowed in addition to satisfaction of this requirement). UBC 904.2.2. d. One (1) hour fire resistive construction required if exterior if exterior wall is less than twenty (20) feet from (assumed) property line. UBC T-3B. Central Fire Protection District Requirements: Applicant shall obtain any permits and/or approvals as determined necessary by the Central Fire Protection District prior to the issuance of any building permits for the' site and shall additionally' comply with the following: ao The required fire flow is 5,550 GPM at 20 psi. residual pressure. When it was suggested at our Site and Architectural Review Committee Meeting on October 13, 1998, that we attempt to get the written support of our rear neighbors, I commented at the time that we cannot guarantee anything other than our best effort in obtaining neighbor written support. To date, we have written letters to each of the property owners (four in total). We have gotten written support of two property owners representing three of the five parcels. We have spoken to a third property owner which gave his verbal support. We anticipate receiving written support by the property owner by the time of our meeting of October 27, 1998. The fourth property owner, Betty and Bobby Landrum, we have written, and left notes at their property. We also have attempted to contact them through their fellow neighbors. To date, our attempts to make contact with the Landmm's has been unsuccessful. Since that approval, Storage USA has been seeking permit approvals to begin construction of its project. Upon review of the construction plans for the project, the City was notified by Storage USA and the Santa Clara Valley Water District that a 36-inch diameter water pipeline currently exists on or near your property line. This pipeline is in close proximity to the eastern property line of the Storage USA development site and the western (rear) property line of your property. Due to the close proximity of the pipeline to the property line, Storage USA is not permitted to construct a masonry wall along this property line and is, therefore, not able to fulfill a condition of approval of its project. Under the City's M-1-S (Light Industrial) zoning district requirements, a minimum 6-foot high masonry wall is to be constructed on property lines adjacent to any residentially zoned properties. Consequently, Storage USA is not able to obtain further approvals to begin construction of their project until this issue is resolved. As a means to correct this situation, Storage USA is proposing to install a minimum 8-foot high wooden fence along the eastern property line of the project (and along your rear (western) property line) in lieu of the masonry wall. The proposed fence appears like a "good neighbor" type of fence and will be constructed of vertical fence boards. This proposal will require approval of a Variance application (V 98-04) from the M-1-S (Light Industrial) zoning district requirements and a Modification (M 98-14) of the approved Site and Architectural Review Permit. At this time, please find enclosed a copy of the plans submitted by Storage USA for the proposed wooden fence. Mr. Stephens said that the Water District is supportive of the conceptual fence plans and that a wooden "good neighbor" fence with removable panels is more preferable than a fence with wood on one side and stucco or metal on the other side. Mr. Stephens said that the supports and footings for the fence should be located a minimum of 18 inches away from the outside diameter of the 36-inch underground pipeline and that details of the proposed fence construction should be submitted to the Water District for review and formal approval of the fence. Mr. Stephens indicated that he will submit a fax to me which indicates support of the conceptual fence proposal. With respect to the objection filed by the Water District to the final parcel map approval, Mr. Stephens indicated that there is an additional issue which needs to be resolved in addition to the fence issue. The Water District will not rescind its objection to the final parcel map approval for the project until an easement is recorded in favor of the Water District around the pipeline. Mr. Stephens said that even if the Variance and Modification applications are approved by the Planning Commission to resolve the fence issue, the Water District will not be supportive of release of grading permits and will not rescind the objection to the final parcel map until the easement is recorded. To date, Mr. Stephens said that Storage USA has made no good faith efforts to show that they will be recording an easement on the property for the Water District. They have not submitted any final grading plans and final parcel map which show this easement. Mr. Stephens said that he has submitted written correspondence to Storage LISA notifying them of the outstanding issues to be resolved prior to the Water District's approval of the final parcel map and that these issues have been outstanding for several months. I have also spoken to Sharon Fierro, Senior Planner, regarding the Planning Div. ision's position on the release of grading permits. The purpose of my letter is to recap my understandings from our meeting yesterday. The following was discussed: The findings of Storage USA civil engineering feasibility study which reviewed the suggested alternative by the SCVWD to reroute the existing 36 inch pipe 5 feet on to our property. This solution does not seem to be practical given the fact that to minimize energy losses the transitions for this pipe would have to commence 100 feet on each side of our neighbor's properties. These transitions bring the pipe extremely close to existing building foundations. We discussed several solutions for a cantilever fence supported by peirs and steel columns that would provide a removable panelized fence at the property line. This solution would work with our current grading drawing and the proposed grades. This plan would also work with the existing landscaping. The details that were provided were prepared by a licensed structural engineer along with a letter under his signature outlining how the foundations for this fence can be designed to transfer no loads on to the SCVWD existing pipe. We discussed the provisions of the map act and the fact that the reason for our meeting and subsequent public meetings was to resolve the objection placed to our final parcel map by SCVWD. We further discussed the specifics in the Map Act for response time and scope of such public meetings. It was pointed out the timeframe that these proposed meetings are outside the timeframes defined by the Map Act in section 66436.a.3.A.v. It was also discussed that Storage USA will pursue the vadance through the Planning Commission per the city's request to resolve this objection by the SCVVVD, we had reservation that this was not the proper body. Our attorney Garth Picket, will address this separately, by letter with the City Attomey. In addition to the objection placed by SCVVVD regarding our required masonry fence, we also discussed the issuing of grading plan for our project. You acknowledge that you were the person that had stopped the grading permit. We gave you are reasons why we felt that the permit should be issued. You said that you would discuss this further with the City Attorney and make a final decision shortly regarding the release of the grading permit. We also discussed the need to get a response from the city regarding proposed scope of our underground electrical utilities for the project. You promised you would discuss this with Public Works to see if that can be released as soon as possible, since it has a potential beadng on the processing of our final parcel map.
