Ms. Willsey,
I would like to withdraw the Use Permit and Site Review Permit applications for
our proposed site at 1600 Dell Avenue. I assume this will include a refund of our plan
check fees. The screening requirements set forth by the city make the project
prohibitively expensive, and lowering the antennas would completely eliminate the
effectiveness of the site. Since the property has been deemed by the city to be out of
compliance with zoning codes, and the "visual impact" issue has created such a
controversy, we feel it is no longer a viable candidate to pursue. For the sake of our
customers in the city of Campbell, I do hope we will be able to find a suitable alternative
in the area.

Site and Architectural Review Permit & Use Permit Application
Dear Mr. Ney:
Thank you for your submittal of a Site and Architectural Review Permit and Use Permit application for
the installation of a Nextel wireless communications facility at 1600 Dell Avenue.
Based on a detailed analysis of the application submittal, staff has determined that the proposed antenna
facility does not meet the requirements for a stealth facility under the City's Telecommunications
Ordinance. Screening panels may be used to mitigate visual impacts but they must be designed to blend
with the architecture of the building. The proposed partial screen walls are not architecturally
compatible with the existing building. Staff recommends that you revise your plans to incorporate
stealthing techniques such a new parapet around the perimeter of the roof or flush mounting the antennas
to the side of the building and painting them to match.
Pursuant to the Telecommunications Ordinance, when a proposed facility is located on a commercial
building and meets the definition of a stealth facility, only a Site and Architectural Review Permit shall
be required which can be approved at staff level by the Community Development Director. At the
discretion of the Community Development Director, a Use Permit may be required in addition to the Site
and Architectural Review Permit and the application referred to the Planning Commission where such
installation does not blend with the architectural features of the building and is deemed to not be a stealth
facility.
A site inspection of the subject property revealed that there is a significant amount of outdoor storage
located on the side and rear of the building. Pursuant to Section 21.30.120 (Other Development
Standards) of the Campbell Zoning Ordinance, all material storage shall be maintained at all times
within an enclosed building. This outdoor storage will need to be removed prior to any approvals for the
property.

Proof of Ownership: Prior to issuance of any grading, drainage, or building permits for the
site, the applicant shall provide a current preliminary title report, grant deed, or other
satisfactory proof of ownership.
Right-of-Way for Public Street Purposes: Prior to issuance of any grading or building
permits for the site, the applicant shall cause additional Right-of-Way to be granted, as
necessary, for Public Street Purposes along the Dell Avenue frontage to accommodate a 33
foot half street right-of-way. The applicant shall cause all documents to be prepared by a
registered civil engineer/land surveyor, as necessary, for the City's review and recordation.

'Unsecured Deferred Street Improvement Agreement: Prior to issuance of any building
permits for the site, the owner shall execute an unsecured deferred street improvement
agreement for construction of standard street improvements.
Storm Water Pollution Prevention Measures: Prior to issuance of any grading or building
permits, the applicant shall comply with the National Pollution Discharge Elimination
System (NPDES) permitting requirements and the California Storm Water Best
Management Practices handbook prepared by the Storm Water Quality Task Force, Santa
Clara Valley Water District and the City of.Campbell Municipal Code regarding Storm
Water Pollution Prevention. The City will provide the applicant with additional
information concerning this subject.

Note: No building code issue has been reviewed at Development Review Committee; it will be reviewed in the
Building Permit process. Please be aware that building codes are changing constantly; plans submitted for

SITE PLAN: Application for building permit shall include a competent site plan that identifies
property and proposed structures with dimensions and elevations as appropriate. Site address
and parcel numbers shall also be clearly called out.

SPECIAL INSPECTIONS: When a special inspection is required by U.B.C. Section 1701, the
architect or engineer of record shall prepare an inspection program that shall be submitted to the
Building Official for approval prior to issuance of the building permits, in accordance with
U.B.C Section 106.3.5. Please obtain City of Campbell, Special Inspection forms from the
Building Inspection Division Counter.

Dear Darcy,
I am submitting applications for a Use permit and a Site and Architectural review for a wireless
communication installation at 1600 Dell Avenue. This unmanned facility is to be constructed with the
equipment shelter built inside the existing building, completely out of view. The antenna arrays will be roof
mounted at two comers of the building, and screened from view behind fiberglass screen walls. As we
discussed on this site, the antenna could not be mounted at the center of the building, because the RF signal
would not clear the roof unless we put them considerably above the allowable zoning height.
This installation will not present any significant "visual impact" as the existing building is set far
back from the property line and most views are screened by the existing trees on the adjacent lot. The
screenwalls will serve to hide the antenna from sight and will be finished to match the existing building.
There are no highly visible views of this building except from on the property, and the rear abuts Santa
Clara County Water District land with the 880 freeway beyond that.
I hope you will agree that this proposal is within the parameters of the zoning ordinance, and that
"architectural" considerations need not be carried to extremes here, given the surrounding neighborhood is
entirely industrial. This site is critical to the service needs of Nextel's customers in the Campbell area,
because of its clear line of sight to the 880 freeway. I feel confident based on our conversations about this
site that a recommendation for approval will be forthcoming. Thank you for your attention to this matter.
