Re: Fence Exception Application (PLN2002-58)
580 E1 Patio Drive
Dear Mr. and Mrs. Gallo:
The Community Development Department has reviewed and approved your Fence Exception
application for a new fence located at 580 E1 Patio Drive. The Fence Exception provides for a wood
fence parallel to the front wall of the residence that consists of three feet of wood panels and two feet of
lattice for a total height of five feet. This fence shall be setback five feet from the front property line and
back of future sidewalk. Staff has determined that this is the minimum distance necessary to provide for
pedestrian safety and to not be detrimental to the health, safety, peace, morals, comfort or general
welfare of the City. The exception also provides for a fence located to the west of the residence that
would consist of five feet of wood panels and one foot of lattice. This fence must also be setback a
minimum of five feet from the front property line and back of future sidewalk. Along this side fence a
new 12 foot wide wood gate will be installed with a maximum height of six feet. No portion of the
fence, including the gate and posts, shall exceed the six foot height limitation.
It has been determined that the requested fence exception: 1. Will not impair vehicular or pedestrian safety;
2. Will result in a more desirable site layout;
3. Will not be detrimental to the health, safety, peace, morals, comfort or general welfare of
the City; and
4. Will not be detrimental or injurious to property and improvements in the neighborhood
or to the general welfare of the City.
A copy of the approved plans are enclosed. If you should have any other questions, please do not
hesitate to contact me at (408) 866-2193.
Sincerely,
Darcy Smith

Re: Fence Exception Request
Gentlemen,
In compliance with city requirements we hereby request exception from the basic fence
ruling per the attached plan for the following reasons.
Our main reason for requesting exception is a privacy issue. Since the completion of the
cul-de-sac, cars are now able to park directly in front of our front door within a very
close proximity (10-12 feet. By having a tall fence at the end of the street vehicles would
see that the street is a dead-end sooner and not have to come to end of street to turn
around. With a taller fence, transient foot traffic from the adjoining railroad tracks
would be less tempted to hop a 6 foot fence thereby making the neighborhood safer for
the children.
The fence would be located at the end of a cul-de-sac where no vehicle vision
impediment would accrue and we feel would enhance the looks of the entire
neighborhood once the fence and landscaping plans are completed.
We hope the City will understand our concerns and grant the above request.
Thank you in advance for considering our submission.
