DISCUSSION On July 27, 1998, the Community Development Director conditionally approved a tentative parcel map for 598 E1 Patio Drive. The approved map creates two parcels from an existing parcel as shown on the attached Exhibit A. Included on the map is an offer of dedication for a public service easement for underground public utility purposes. According to the Subdivision Map Act, dedications offered on maps must be accepted by the legislative body at the time the parcel map is approved. Staff is ready to approve the parcel map, and recommends that the City Clerk be authorized to accept the public dedication as shown on the final parcel map. FISCAL IMPACT None with this action. ALTERNATIVES Do not authorize the City Clerk to accept the dedication of a public service easement for underground public utility purposes. This is not recommended since the public street dedication was a condition of approval for the development. A notation on the map should be made indicating the required 5 foot setback between the fence and the building or that the fence will be realigned to meet the setback requirements. Soils Report: Prior to issuance of any grading, drainage, or building permits for the site, applicant shall provide a soils report prepared by a registered geotechnical or civil engineer. Utilities: All new on-site Utilities shall be installed underground per Section 20.36.150 of the Campbell Municipal Code for any new or remodeled buildings or additions. Maintenance Security: Prior to issuance of occupancy approval for the site, all public street improvements required by the street improvement agreement and the encroachment permit must be completed and accepted by the City and the applicant must provide a one-year Maintenance Security in an amount of 25% of the Faithful Performance Bond. Grading and Drainage Plan: Prior to issuance of any grading, drainage or building permits for the site, the applicant shall conduct hydrology studies based on a 10 year storm frequency, prepare an engineered Grading and Drainage Plan, and pay fees required to obtain necessary grading permits. The plans shall comply with the 1994 edition of the UBC including Chapters 18, 33, and Appendix Chapter 33. Background of Project Area: The subject property is located E1 Patio Drive and west of Poplar Avenue. In the vicinity of the project site, is a mixture of residential projects. E1 Patio Drive is primarily developed with single family residential. The majority of homes on this on E1 Patio Drive were constructed between 1920 and 1930 and is eligible for historic district designation. The property owner has currently rehabilitated the existing mission revival dwelling preserving the historical character of the building and is constructing an architecturally compatible one-car, detached garage. The property owner intends to construct a new single family dwelling on the rear or "flag" lot following the creation of the subdivision. The density of the proposed project site is 6 units per gross acre, which is consistent with the General Plan land use designation. Zoning Designation: The zoning designation for the project site is R-l-6 (Single-Family Residential, 6,000 square foot minimum lot size). The proposed net lot area for each lot exceeds minimum lot size. The existing garage is located over the future property line and must be removed prior to recordation of the map. A condition of approval requires the removal of the garage building. The heating will be to consider the following project: The application Mr. James Kennedy for a Parcel Map (PM 98-07) to create two parcels from a single lot on property located at 598 El Patio Drive. This project is Categorically Exempt, under the California Environmental Quality Act. Interested persons may attend this heating and comment upon the project which is the subject of the heating.
