BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL APPROVING A CONDITIONAL
USE PERMIT (PLN2000-134) TO ALLOW THE
ESTABLISHMENT OF A DAY CARE FACILITY FOR UP TO 60
CHILDREN IN AN EXISTING CHURCH ON PROPERTY
LOCATED AT 62 S. SAN TOMAS AQUINO ROAD IN A C-PD
(CONDOMINIUM/PLANNED DEVELOPMENT) ZONING

After notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as follows
with respect to application PLN2000-134:
The Planning Commission finds as follows with regard to File No. PLN 2000-134:
1. There is adequate parking on-site to accommodate the proposed use based upon the staggered
use of the site by the church and childcare center.
2. The proposed use of a childcare center is consistent with the existing uses on the property.
3. Adequate circulation has been provided on-site and the dropping-off and picking-up of
children will be managed in such a way as to prevent the overflow of cars onto San Tomas
Aquino Road.
Based on the foregoing findings of fact, the Planning Commission further finds and concludes
that:
1. The establishment of a child care center at this site will not be detrimental to the public
health, safety, peace, morals, comfort or general welfare of persons residing or working in the
neighborhood of such proposed use, or be detrimental or injurious to property and
improvements in the neighborhood or to the general welfare of the City.
2. The proposed site is adequate in size and shape to accommodate the yards, wall, fences,
parking and loading facilities, landscaping and other development features required in order
to integrate said use with uses in the surrounding area.
3. The project is adequately served by streets of sufficient capacity to carry the kind and
quantity of traffic such uses would generate.
4. The proposed use is compatible with the uses in the area.

The applicant is hereby notified, as part of this application, that he/she is required to meet the
following conditions in accordance with the ordinance of the City of Campbell and the State of
California. The lead department with which the applicant will work is identified on each
condition where necessary. Additionally, the applicant is hereby notified that he/she is required
to comply with all applicable Codes or Ordinances of the City of Campbell and the State of
California that pertain to this development and are not herein specified:
COMMUNITY DEVELOPMENT DEPARTMENT REQUIREMENTS
1. Capacity: The number of children attending the facility shall be limited to 60.
2. Circulation: The applicant shall establish procedures for the drop-off and pick-up of the
students that would require the responsible adult to park the car in a designated parking space
in order to sign the child into the center. Drive-by drop-offs are not allowed.
3. Noise Management: The hours of operation of the outdoor play area shall be limited to
between 10 a.m. and 4 p.m. In the event complaints are received by the City regarding noise,
the Community Development Director, upon confirmation that the noises are generated by
uses from the outdoor play area, may limit the operational hours of the child care facility
and/or may require a Noise Management Plan to be submitted by the applicant consisting of
an acoustical study by a qualified acoustical engineer for recommendations to attenuate the
noise.
The Noise Management Plan shall require implementation of the mitigation measures as
determined in the acoustical study. Actions by the Community Development Director may
be appealed to the Planning Commission but the reduced hours for the outdoor play area shall
be effective immediately upon notification by the Community Development Director.
FIRE DEPARTMENT REQUIREMENTS
4. Site Inspection by Fire Department: Prior to operation, the applicant shall apply to the State
of California Department of Social Services (DSS) for appropriate licensing. A Request to
Inspect form shall be generated by DSS to the Santa Clara County Fire Department to
facilitate a site inspection. Successful clearance must be obtained by the Santa Clara County
Fire Department prior to the issuance of occupancy by the State.
5. Review of Detailed Floor Plan: Prior to occupancy as a pre-school, the applicant shall
provide to the Community Development Department and to the Santa Clara County Fire
Department a detailed floor plan for review and approval. Compliance with California Code
of Regulations, Title 24, Part II shall be enforced.
PUBLIC WORKS DEPARTMENT REQUIREMENTS
6. Street Improvements: Prior to issuance of any permits for the site, the applicant shall execute
a street improvement agreement and shall cause plans for public street improvements to be
prepared by a registered civil engineer, pay fees, post security, and provide insurance
necessary to obtain an encroachment permit for construction of the standard street
improvements as required by the City Engineer. The plans shall include the following:

a. Removal of existing driveway approaches which are not compliant with the Americans
with Disabilities Act (ADA) requirements.
b. Construction of new ADA compliant driveway approaches.
c. Construction of conforms to existing public and private improvements as necessary.

Public Hearing to consider the application of Ms. Lavinia J. Bahng

establishment of a Day Care Facility for up to 60 children in an
existing church on property located at 62 S. San Tomas Aquino
Road in a C-PD (Condominium/Planned Development) Zoning
District. This project is Categorically Exempt. Planning
Commission decision final in 10 days, unless appealed in writing to

Ms. Kristi Bascom, Planner I, presented the staff report as follows:
Advised that the proposed site is at the Korean Baptist Church of the World Mission, which
was constructed as an office building in 1982 and converted to a church use in 1996. The
building is two floors and 23,000 square feet. The hours of operation are Tuesday through
Saturday, 9 a.m. to 6 p.m. where six people work on site.
· The applicant is seeking a Use Permit to allow the addition of a Day Care Facility. The
proposed hours of operation are from 7 a.m. to 6 p.m., Monday through Friday. The
applicant proposes to start with 28 students and is authorized by the State for up to 44
students on the site with the size of the existing outdoor play area. The applicant is seeking a
Use Permit approval for up to 60 to allow future growth but they have no plans now to
increase to that number of students.
· Five to six employees will staff the Day Care.
· The outdoor play will occur between 10:30 and 11:30 a.m. and between 3 and 4 p.m.
· The site circulation will require parents to enter to the north of the site and exit from the
south. Staff has conditioned that the parents be required to enter into the parking lot, park
their vehicle and enter the school in order sign in their child(ren) to prevent the stacking of
vehicles onto Campbell Avenue. The gate to the south will be closed at all times except for 7
to 8 a.m. and 5 to 6 p.m.
· The site includes 94 parking spaces. As the school and church uses will be staggered, this is
a sufficient number of parking spaces for this site.

Staff recommends the adoption of a Resolution approving this Conditional Use Permit with
the conditions of approval including an added condition concerning noise complaints from
neighbors, which may result in the Use Permit being referred back to the Commission.
Commissioner Doorley asked for clarification between the 44 children the State will allow versus
the 60-student limit the applicant is asking the City to impose for her Use Permit.
Ms. Kristi Bascom replied that the State bases its license on the amount of outdoor playground
available. If the applicant were to stagger the use of the playground, she could accommodate
more children. What is counted is the number of children on the playground at any one time.
Commissioner Jones asked whether the neighbors were notified of this hearing.
Ms. Kristi Bascom replied that they had and no comments have been received.
Commissioner Lindstrom asked for clarification on the number of parking spaces as he noticed a
mention of 108 on one document.
Ms. Kristi Bascom advised that some of the original parking spaces were eliminated when the
playground was created.
Chairperson Gibbons opened the Public Hearing for Agenda Item No. 2.
Commissioner Doorley asked Ms. Lavinia Bahng for clarification about the State licensing for
up to 60 students.
Ms. Lavinia Bahng, Applicant:
· Advised that under her State license she will be permitted to have 28 children utilizing the
playground at any given time. She can alternate the play schedule to accommodate more
children at the Day Care as long as no more than 28 are out in the at a time.
· Added that she has interior space for 44 students right now and there is space to grow.
· Said that in the future, she could envision up to 56 students using three schedules for
playground use.
Commissioner Lowe asked the age of the children.
Ms. Lavinia Bahng replied that they are preschoolers, ranging from two to five years old.
Chairperson Gibbons closed the Public Hearing for Agenda Item No. 2.
Commissioner Doorley expressed his complete support to Ms. Bahng for this Day Care. He
stated Day Cares provide a very important service for the community.

Upon motion of Commissioner Doorley, seconded by Commissioner Lowe,
the Planning Commission adopted Resolution No. 3313 approving a
Conditional Use Permit (PLN2000-134) to allow the establishment of a Day

at 62 S. San Tomas Aquino Road with the added Condition of Approval
regarding possible noise complaints, by the following roll call vote:

REPORT OF THE COMMUNITY DEVELOPMENT DIRECTOR
The written report of Ms. Sharon Fierro, Community Development Director, was accepted as
presented, with the added comments:
· Provided an update of the November 6~h Council meeting.
A. The General Plan Update was continued to allow staff the opportunity to look further into
traffic issues. The Update will tentatively be returned to the Planning Commission at the
second meeting in January and to Council in February.
B. Paul Del Grande's appeal of the Commission's denial of a Use Permit was continued to
November 21, 2000, by Council to allow Mr. Del Grande an opportunity to evaluate
whether he was able to comply with the Conditions of Approval, which include a
requirement for an environmental assessment, paving and landscaping of the property.
Council is considered a limited term Use Permit (two year). Mr. Del Grande will be
required to maintain the three properties up to Code, including Water District and
Hazardous Materials requirements.
C. Council approved the new Research and Development building at 603 Campbell
Technology Parkway.
· Advised that there are four items on the November 28, 2000, Planning Commission agenda.
Commissioner Lowe advised that he will be traveling that week and wilt miss the Commission
meeting.

DISCUSSION
Applicant's Proposal: The applicant is requesting approval of a Use Permit to allow the
conversion of offices to a child care center for up to 60 children at the Korean Baptist Church of
the World Mission. The project site is located on the east side of S. San Tomas Aquino Road
just south of its intersection with Campbell Avenue.
Project Background: The two-story office building was approved as an office condominium in
1982. The church has been operating at this site since the approval of its Use Permit in 1996 (M
95-09). Also in 1996, the City approved a Modification to the Use Permit (M 96-15) to allow the
conversion of eight parking spaces for the construction of an outdoor playground for the church
Sunday School program. This same playground is proposed for use by the child care center.
A Licensing Evaluator from State Child Care Licensing visited the site and has determined that
28 children can attend the pre-school based on the size of the outdoor playground size. The
number of children could be increased to 44 if it could be scheduled so that only half the children
were out on the playground at a time. The applicant plans to open the center with 28 children
and will consider the option of increasing enrollment to 44 after six months. The applicant is
requesting to be allowed up to 60 children at the site so that in the event that the demand
increases in the future, they will not have to apply for another modification to their use permit.
ANALYSIS
General Plan Designation: The General Plan land use designation for the project site is
Commercial. The church use and proposed day car center is considered consistent with the
General Plan designation due to the intensity and size of the uses and the established land use
pattern in the neighborhood. The establishment of the child care center will not impair the
orderly development of the area or hinder further commercial development in the general
vicinity.
Zoning Designation: The property is zoned C-PD (Condominium/Planned Development).
Under this zoning classification, uses which are considered to be consistent with the General
Plan are considered acceptable.
Use: The applicant does not anticipate any substantive changes to be made in order to utilize the
office space as classroom space. Therefore, no tenant improvements are proposed. The area the
day care center is proposing to use for their multi-purpose room is also the church's fellowship
room, and that use will not change.

Hours of Operation: The child care center will be open from 7:00 am - 6:00 pm, Monday
through Friday. The church maintains office hours Tuesday through Saturday from 9:00 am -
6:00 pm with six people working on-site. Aside from these times, all of the other activities at the
church are held on the weekends or in the evenings after the child care center will be closed.
Layout and Landscaping: No modifications to the existing site layout or landscaping are
proposed.
Impacts on Adjacent Properties: The children will be inside the building most of the time, so
noise impacts during most of the day should be minimal. Outdoor play time is scheduled from
10:30 am - 11:30 am and 3:00 pm - 4:00 pm, so any noise impacts should be contained to those
hours. The existing playground is currently used for Sunday School. Staff has not received any
noise-related complaints.
Parking and Circulation: The church has erected a gate on the southern side of the parking lot
which restricts vehicular access on the side of the building near the playground. The applicant
has proposed that cars enter the property on the northerly side to pick-up and drop-off the
children at the child care center. The cars could then drive around the building and exit through
the driveway to the south. The gate on this side would remain unlocked and open between 7:00
am - 9:00 am and 5:00 pm - 6:00 pm, the times when most children will be picked-up and
dropped-off.
Staff has proposed a condition of approval which would require the responsible adult to park the
car to drop off the children, which would prevent the stacking up of cars into a "drop-off line"
which could spill onto San Tomas Aquino Road.
The site provides 94 parking spaces for both church and child care facilities. The peak usage for
the school is during the weekdays, while peak usage of the church is on the weekends and in the
evenings. This combination of uses and schedules allows for sharing the existing parking
facilities.

to the Planning Commission as part of the approval of your project. I spoke to our Public Works
Department regarding your request to have the condition of driveway improvements waived, but
they cannot support a waiver. The requirement to modify the slope of the two driveways is for
compliance with the Americans with Disabilities Act (ADA), something over which the City
does not have jurisdiction, but rather it is a federal requirement. Compliance with the ADA is
usually requested of owners whenever modifications are being done to the property.

Use Permit for Day Care at World Mission Baptist Church

Public Works Department
1. STREET IMPROVEMENTS: Prior to issuance of any permits for the site, the applicant
shall execute a street improvement agreement and shall cause plans for public street
improvements to be prepared by a registered civil engineer, pay fees, post security, and
provide insurance necessary to obtain an encroachment permit for construction of the
standard street improvements as required by the City Engineer. The plans shall include the
following:
a. Removal of existing driveway approach which is not compliant with the
Americans with Disabilities Act (ADA) requirements.
b. Construction of a new ADA compliant driveway approach.
c. Construction of conforms to existing public and private improvements as
necessary.
2. STORMWATER POLLUTION PREVENTION MEASURES: Prior to issuance of any
grading or building permits, the applicant shall comply with the National Pollution Discharge
Elimination System (NPDES) permitting requirements and the California Storm Water Best
Management Practices handbook prepared by the Storm Water Quality Task Force, Santa
Clara Valley Water District, and the City of Campbell Municipal Code regarding Storm
Water Pollution Prevention.

CAPACITY: The number of children attending the facility shall be limited to 44.
CIRCULATION: The applicant shall establish procedures for the drop-off and pick-up of
the students that would require the responsible adult to park the car and register the child.
Avoid drive-by drop-offs, which would allow cars to stack up in the driveway and onto San
Tomas Aquino Road.
Community Development Department, Building Division
1. PERMITS REQUIRED: A building permit application shall be required for the proposed
modifications to the structure necessary for the occupancy change. The building permit shall
include Electrical/Plumbing/Mechanical fees when such work is part of the permit.
CONSTRUCTION PLANS: The conditions of Approval shall be stated in full on the cover
sheet of construction plans submitted for building permit.
SIZE OF PLANS: The minimum size of construction plans submitted for building permits
shall be 24 in. X 36 in.
4. PLAN PREPARATION: This project requires plans prepared under the direction and
oversight of a California licensed Engineer or Architect. Plans submitted for building
permits shall be "wet stamped" and signed by the qualifying professional person.
5. SITE PLAN: Application for building permit shall include a competent site plan that
identifies property and proposed structures with dimensions and elevations as appropriate.
Site plan shall also include; site drainage details, and parking layout. Site address and parcel
numbers shall also be clearly called out.
6. TITLE 24 ENERGY COMPLIANCE: California Title 24 Energy Standards Compliance
forms shall be blue-lined on the construction plans. Compliance with the Standards shall be
demonstrated for conditioning of the building envelope and lighting of the building.
7. SPECIAL INSPECTIONS: When a special inspection is required by U.B.C. Section 1701,
the architect or engineer of record shall prepare an inspection program that shall be submitted
to the Building Official for approval prior to issuance of the building permits, in accordance
with U.B.C Section 106.3.5. Please obtain City of Campbell, Special Inspection forms from
the Building Inspection Division Counter.
8. The City of Campbell, standard Santa Clara Valley Non-point Source Pollution Control
Program specification sheet shall be part of plan submittal. The specification sheet (size 24"
X 36") is available at the Building Division service counter.
9. TITLE 24 ACCESSIBILITY - COMMERCIAL: On site general path of travel shall comply
with the latest California Title 24 Accessibility Standards. Work shall include but not be
limited to accessibility to building entrances from parking facilities and sidewalks.
10. TITLE 24 ACCESSIBILITY - COMMERCIAL: Projects seeking to use the Title 24
Hardship exemption clause shall blue-line completed, City of Campbell "20°/o'' exemption
form on submitted construction plans. Form is available at Building Division service
counter.
11. APPROVALS REQUIRED: The project requires the following agency approval prior to
issuance of the building permit:

Santa Clara County Fire Department
Santa Clara County, Fire Department
1. Prior to operation, the applicant shall apply to the State of California Department of Social
Services (DSS) for appropriate licensing. A Request to Inspect form shall be generated by
DSS to this department to facilitate a site inspection by the fire department. Successful
clearance must be obtained by this department prior to the issuance of occupancy by the
State.

Below are the required information from the Planning Commission.
A) Ability to address circulation needs for pick-up and drop off: The cars will
come in to the parking lot through the driveway close to the Good Will and then
will go out through the gate and the driveway close to Taco Bell ( See the
attached map with arrows indicating the traffic flow.). It is expected
that from 7:00 A.M. to 9:00 A.M. is the time zone that the most children will be
dropped off and from 5:00 P.M. to 6:00 P.M. is the time that the most children will
be picked up. The gate should be remained open during those hours and
should be closed at other hours.
B) Parking needs of employees: There are plenty of parking spaces available
for the employees.
C) Area needs of the children in terms of both interior and exterior spaces: The
Licensing Evaluator, Delores Farrell from the State Child Care Licensing
visited the site and decided the number of children the site can hold. It was
decided that 28 children can be held with the existing outdoor playground size.
D) Potential noise associated with the school use: The children (maximum 28
children in the beginning) will be inside the building most of the time using the
classroom or the Multi-Purpose room. The outdoor play time will be from 10:30
A.M. to 11:30 A.M. and 3:00 P.M. to 4:00 P.M.
E) Operational Hours of the school: The school is open from 7:00 A.M. through
6:00 P.M. from Monday to Friday except holidays.
F) The number of children and staff: The maximum number of children at the
moment is to be 28. The number of staffs at the site at a time is to be five to six.
* The Licensing Evaluator informed us that the number of the children could be
increased up to 44 if half the children are to be out on the playground at a time,
We will consider this option about six months after the child care center is open.

We understand that there was a misunderstanding when we submitted the
Preapplication to Campbell City regarding the number of children the Child Care
Center was to hold. Instead of 100 children as requested, only 28 children were
decided by the State Licensing. Hence, we cordially ask you to reconsider the
requirements.
Our church is looking into the water filter in order to fulfill the request of Storm Water
Pollution Prevention Measures. tt will take approximately six months to complete the
job.
Our church has been working for two years aiming to open the Child Care Center in
September of 2000. Almost everything was ready except the City Use Permit and Fire
Dept. inspection. Many parents and children have anxiously waited for the preschool
to open. Therefore, it is our request that the requirements for the street improvements
be waived.

Thank you for your submittal of a preliminary application for the establishment of a pre-school as a portion
of the church on the subject property. The project site is zoned C-PD and is shown as a commercial land use
on the City's General Plan. The establishment of a preschool will require approval of a Conditional Use
Permit by the Planning Commission at a public hearing. The processing time for a conditional use permit is
approximately 45 to 60 days.
The Planning Commission in reviewing the request for a pre-school use generally seeks information to
support the proposed use if it is found to be compatible with the surrounding neighborhood. Planning
