Reason for Granting Tree Removal The Tree Removal Permit has been approved based upon the City's determination, with supporting photos and property owner statements, that the tree has grown too large for its location thus causing utility, concrete and roof and gutter damage to the existing residences and their driveways and cannot be controlled or remedied through reasonable relocation or pruning. Staff has determined that the situation cannot be reasonably remedied by means other than removal. Conditions of Approval for Tree Removal The applicant is required to plant one (1) 36-inch box or to contribute to an in-lieu street tree fund if on-site planting is not practical. The applicant has indicated a desire to contribute to the in-lieu street tree fund in the amount of $350.00 due to limited space on- site to accommodate another tree. This approval is final in ten (10) days unless an appeal is received in writing at the City Clerk's Office, 70 N. First Street, Campbell on or before Mondab February 19~ 2002. There is a cedar tree located between our two properties (Photos 1, 2). This tree falls under Section 21.56.050 Protected trees as set forth in Chapter 21.56 Tree Protection under the Municipal Code of the City of Campbell. The tree is a cedar with a diameter of 31 inches and a circumference of 98 inches measured four feet above ground (Photo 3). We are applying for an exemption to the above Section in order to remove the tree. We are basing our exemption request on Sections 21.56.080 b and c. The roots from the tree have done damage to the driveways of both properties, rendering them beyond repair. The 640 Sobrato Way driveway has a drop between the upper and lower portions measuring 8" (Photos 4, 5), and the 630 Sobrato Way driveway is split (Photo 5). This damage is due to tree roots coming up underneath the driveways. The tree roots grow into the main plumbing pipe for the properties causing it to clog and needing professional cleaning each year. The debris from this tree causes the gutters on both properties to clog, preventing proper drainage of water from the roofs. A new roof was installed on 630 Sobrato Way less than four years ago and is already showing damage from the tree. We are also requesting an exemption to the City's requirement to plant a replacement tree. The 640 Sobrato Way property already contains five (5) additional trees: three (3) Japanese Maple, one (1) Birch, and one (1) Mulberry.
