DISCUSSION: The following applicant has applied for a Massage Establishment Permit: Heather M. Shock, Owner 544 Page Street, g48 San Jose, CA 95126 The applicant has over six years of experience as a massagist. She is certified in Deep Therapeutic Tissue Massage and Reflexology, and also has training in Accelerated Healing. Ms. Shock is a holistic health practitioner who specializes in therapeutic massage and Kinesiology. She has been located at the Innovators Beauty Salon, 2260 South Bascom Avenue, for the past three years, and has a Massagist Permit (Business License #014074) through the City of Campbell. The applicant will be the sole proprietor of the business. Initially the applicant will be the only massagist at the proposed site. Services offered will include therapeutic massage and Kinesiology sessions, workshops on stress management and wellness, and the retail sales of vitamins and aromatherapy products. Appointments for in~vidual sessions will be available from 10:00 a.m. to 7:30 p.m. Monday through Friday, and 9:00 a.m. to 4:30 p.m. on Saturdays. The establishment will not significantly disturb the peace and enjoyment of the nearby neighborhood. 7. There is a reasonable relationship and a rough proportionality between the Conditions of Approval and the impacts of the project. Where approval by the Director of Community Development, City Engineer, Public Works Director, City Attorney or Fire Department is required, that review shall be for compliance with all applicable conditions of approval, adopted policies and guidelines, ordinances, laws and regulations and accepted engineering practices for the item under review. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. Square Footage Restriction: The total floor area allowed for the wellness center/massage establishment shall not exceed 1,000 square feet. An expansion of the business to more than 1,000 square feet shall require written application to the Community Development Department for a Modification to the approved Conditional Use Permit. 5. Operational Hours: The operational hours shall be limited to 7 a.m. to 11 p.m. daily, unless a Conditional Use Permit is obtained from the Planning Commission for late night operations. Massage Permit: The applicant shall obtain and maintain a massage permit from the Campbell Police Department prior to the establishment of the business, in accordance with Chapter 5.48 of the Campbell Municipal Code. o Change in Ownership or Operator: A change in ownership or operator shall require a written application to the Campbell Police Department for a new massage permit in accordance with Chapter 5.48 of the Campbell Municipal Code. 8. Certificate of Registration: The applicant shall not employ any person as a masseuse who does not possess a current unrevoked certificate of registration as a masseuse. Si~ Permit: No signage is permitted as part of the development application approved herein. New signage shall not be installed prior to approval of a sign permit as required by Chapter 21.53 of the Campbell Municipal Code. 10. Parking, Driveways and Maintenance: All parking and driveway areas shall be maintained in compliance with the approved plans and Chapter 21.50 (Parking and Loading) of the Campbell Municipal Code, subject to review by the Community Development Director. Building Division: 11. Permits Required: A building permit application shall be required for the proposed tenant improvement to the existing structure. The building permit shall include Electrical/Plumbing/Mechanical fees when such work is part of the permit. 12. Construction Plans: The Conditions of Approval shall be stated in full on the cover sheet of construction plans submitted for building permit. 13. Site plan shall also include site drainage details. Site address and parcel numbers shall also be clearly called out. Site parking and path of travel to public sidewalks shall be detailed. 16. Title 24 Energy Compliance: California Title 24 Energy Standards Compliance forms shall be blue-lined on the construction plans. Compliance with the Standards shall be demonstrated for conditioning of the building envelope and lighting of the building. 17. Special Inspections: When a special inspection is required by U.B.C. The subject tenant space is currently vacant. The project site is located on the northeast comer of Winchester Boulevard and Rosemary Lane and is surrounded by office buildings to the north and south, retail stores to the west, and a parking lot to the east. Winchester Blvd. Page 2 of 4 Applicant's Proposal: The applicant is requesting approval of a Conditional Use Permit to allow a holistic wellness center specializing in therapeutic massage and kinesiology within an existing office building at 1550 S. Winchester Boulevard. The wellness center/massage establishment would occupy 400 square feet of the existing building area. The applicant has operated the business at Innovators Beauty Salon in Campbell for the past three years and would like to relocate to a larger space for expansion of the business. The applicant is a certified massage therapist and has been a member of the Associated Bodywork & Massage Professionals (ABMP) since 1994. ANALYSIS General Plan Designation: The General Plan land use designation for the project site is Commercial. The proposed use within an existing office building is consistent with this land use designation. Therefore, the proposed project is consistent with the General Plan. Zoning Designation: The zoning designation for the project site is C/P-D (Condominium/Planned Development). The C/P-D Zoning District allows for the establishment of a use in an existing building to be approved with a Conditional Use Permit. The proposed project will be consistent with the Zoning Ordinance with approval of a Conditional Use Permit. Massage Establishments: Pursuant to the Campbell Municipal Code, no person shall establish nor maintain a massage establishment without first obtaining and maintaining a permit from the City, nor shall the establishment employ any person as a masseuse who does not possess a current, unrevoked certificate of registration as a masseuse. In addition to receiving a Conditional Use Permit from the Community Development Department, the applicant must also obtain a massage permit from the Police Department to ensure that the massage establishment does not pose a police problem and that the business wilt not be detrimental to the public health, safety, and welfare. Staff considers the proposed establishment a reputable business and is supportive of its approval. Additionally, a massage establishment at this location does not represent a threat to public health, safety, or welfare. Size of Business: The wellness center/massage establishment is proposed to occupy 400 square feet of the existing building area. The applicant's description requests that the Conditional Use Permit allow for a future expansion of the business up to 1,000 square feet. The recommended Conditions of Approval prohibit any expansion of the business lease area to more than 1,000 square feet. Building Design: No architectural changes are proposed with the establishment of this business operation within an existing office building. Landscaping: The existing landscaping in the parking area and around the building will remain and is not impacted by this proposal. Workshops and classes are proposed to be scheduled after business hours in the evening during the week and on weekends until 10:00 p.m. These hours are customary to a commercial property. The recommended Conditions of Approval require that the business hours not extend beyond 11:00 p.m. A Conditional Use Permit must be obtained from the Planning Commission for late night operations past 11:00 p.m. Parking: The site plan shows the location for 30 parking spaces which exceeds the minimum parking requirement of 27 spaces for the entire building. The parking area provides 15 standard spaces, 13 compact spaces, and 2 handicapped spaces. The proposed project is expected to generate a parking demand that is customary to an commercial building and will occupy a proportionate amount of the existing parking spaces. The increase in the parking demand in the evenings for the proposed classes will not affect the availability of parking because the parking demand for the other tenants are during the day. Police Department Review: The Campbell Police Department has reviewed the application and has no concerns or objections to the establishment of a massage business. The recommended Conditions of Approval require that the applicant process a massage permit with the Police Department, consistent with Chapter 5.48 of the Campbell Municipal Code. Failure to meet this deadline will result in the Conditional Use Permit being void. o Revocation of Permit: Failure to comply with the Conditions of Approval or any State or Federal law in connection with the practice of massage or operation of the massage establishment, shall be grounds for consideration of revocation of the Conditional Use Permit by the Planning Commission. Square Footage Restriction: The total floor area allowed for the wellness center/massage establishment shall not exceed 1,000 square feet. An expansion of the business to more than 1,000 square feet shall require written application to the Community Development Department for a Modification to the approved Conditional Use Permit. 5. Operational Hours: The operational hours shall be limited to 7 a.m. to 11 p.m. daily, unless a Conditional Use Permit is obtained from the Planning Commission for late night operations. Winchester Blvd Attachment #2 Page 2 of 6 Massage Permit: The applicant shall obtain and maintain a massage permit from the Campbell Police Department prior to the establishment of the business, in accordance with Chapter 5.48 of the Campbell Municipal Code. o Change in Ownership or Operator: A change in ownership or operator shall require a written application to the Campbell Police Department for a new massage permit in accordance with Chapter 5.48 of the Campbell Municipal Code. 8. Certificate of Registration: The applicant shall not employ any person as a masseuse who does not possess a current unrevoked certificate of registration as a masseuse. Sign Permit: No signage is permitted as part of the development application approved herein. New signage shall not be installed prior to approval of a sign permit as required by Chapter 21.53 of the Campbell Municipal Code. 10. Parking, Driveways and Maintenance: All parking and driveway areas shall be maintained in compliance with the approved plans and Chapter 21.50 (Parking and Loading) of the Campbell Municipal Code, subject to review by the Community Development Director. Building Division: 11. Permits Required: A building permit application shall be required for the proposed tenant improvement to the existing structure. The building permit shall include Electrical/Plumbing/Mechanical fees when such work is part of the permit. 12. Construction Plans: The Conditions of Approval shall be stated in full on the cover sheet of construction plans submitted for building permit. 13. Size of Plans: The minimum size of construction plans submitted for building permits shall be 24 inches × 36 inches. 14. Plan Preparation: This project requires plans prepared under the direction and oversight of a California licensed Engineer or Architect. Plans submitted for building permits shall be "wet stamped" and signed by the qualifying professional person. 15. Site Plan: Application for building permit shall include a competent site plan that identifies property and proposed tenant space with dimensions and elevations as appropriate. Site plan shall also include site drainage details. Site address and parcel numbers shall also be clearly called out. Site parking and path of travel to public sidewalks shall be detailed. 16. Title 24 Energy Compliance: California Title 24 Energy Standards Compliance forms shall be blue-lined on the construction plans. Compliance with the Standards shall be demonstrated for conditioning of the building envelope and lighting of the building. 17. Special Inspections: When a special inspection is required by U.B.C. Section 1701, the architect or engineer of record shall prepare an inspection program that shall be submitted to the Building Conditions of Approval for v.e No. PLN2001 - 116 1550 S.
