CITY HALL, COUNCIL CHAMBERS MINUTES The Planning Commission of the City of Campbell convened this day in regular session in the City Hall Council Chambers, 70 North First Street, Campbell, California. Chairman Olszewski requested the following amendments: On Page 4, 5th paragraph, sentence amended to read, Chairperson Olszewski queried as to the relevance of Mr. Bowen's attorney addressing a legal point of view regarding a Staff recommended setbacks because of transportation alternatives being considered for Campbell Ave." Eighth paragraph amended to read, "Chair- person Olszewski expressed that he considered Staff's recommended setbacks to be reasonable in light of future transportation needs of this section of the City. On Page 5, second paragraph amended to read in part, "Chairperson Olszewski expressed his concern relating to the unfinished traffic studies and their relative effect by stating that the City Council should make the final decision regarding the traffic studies impact on the subject property." Delete the eighth paragraph. On Page 6, under Discussion on Motion, final paragraph amended to read, "Commissioners Christ and Perrine amended the motion to reflect .... " The Chair approved the Planning Commission Minutes of August 22, 1989, as amended, in the absence of any objection. Planning Commission Minutes 2 September 12~ 1989 COMMUNICATIONS: Planning Director Piasecki noted the following additions to the Agenda: - Revised Conditions of Approval for M 89-13, D. Kobza Associates, Item 1 of the Agenda - A Revised Resolution for ZC 89-12, Bamburg, Item 3 of the Agenda, adding a Condition 26; in addition, numerous letters relating to this Item were before the Commission for consideration - Revised Conditions of Approval for M 89-14, Doise, Item 5, adding a Condition 15 - Amended Findings for V 89-07, Mayer, Item 6 of the Agenda - Revised Conditions of Approval for M 89-15, Anderson, Item 8 of the Agenda ORAL REOUESTS: None. No. 2618 Commending out-going Commissioner Robert Stanton. passed by acclamation; Mr. Stanton thanked the Commission for the Commendation. PUBLIC HEARINGS: 1. M.89-13 (S 88-20) Kobza Associates Continued public hearing to consider the application of Dennis Kobza Associates for a modification to previously approved site plans for a medical office building on property known as 38803 S. Bascom Ave., in a P-O (Professional Office) Zoning District. Chairperson Olszewski read the Application into the record. Principal Planner Stafford reviewed the Staff Report Discussion and Recommendation. Commissioner Perrine reviewed the considerations of the Architectural and Site Review Commit- tee; the Committee recommended a revised Condition of Approval 7. Chairperson Olszewski noted that a parking shortage existed at this site; he was concerned that the City's parking requirements were inadequate for this medical use and parking would spill over into the residential area. A minor reduction in the number of physicians may not address the problem. Planning Director Piasecki responded that this item was discussed at Architectural and Site Review Committee; they asked that any change of substance which may impact the parking ratios be reviewed by the Planning Commission. Chairperson Olszewski added that he had difficulty basing the parking ratio on the number of physicians; a number of medical/dental assistants had their own patient load who required parking. He asked that the basis for establishing the parking ratio be reviewed separate from this Item. Commissioner Perrine added that the out-patient operating theaters were going to be customized which would not lend itself to use by several doctors; furthermore, consideration had been given by the Architectural and Site Review Committee to the fact that the number of physicians was being reduced slightly. The Public Hearing was opened. Planning Commission Minutes 3 September 12, 1989 PUBLIC HEARINGS Continued Mr. Jerry Rehn, Representing the Applicants, stated that the average square footage per physician was 1815 sq. ft. The medical specialities practiced at this center were low traffic generators; in addition, the anesthetist did not have his own patients and cardiac surgeons saw very few patients outside the hospital. Only the dermatologists were considered to be a high traffic generator. M/S Meyer, Perrine That the public hearing on M 89-13 (S 88-20) be closed carried unanimously (7-0). Principal Planner Stafford confirmed that there was a slight reduction in the amount of landscaping per Chairperson Olszewski's question. M/S Perrine,Meyer That the Planning Commission adopt the Findings and approve the requested modification for Application M 89-13, subject-to the revised, attached conditions. Discussion on Motiola: Commissioner Christ stated he was apprehensive regarding the revisions in this Application but, due the assurances of Staff, he would approve this Item. Chairperson Olszewski agreed with Commissioner Christ regarding the changes this Application had under gone; he had some reservations about Condition 6, which allowed 18 physicians on site. Continued public hearing to consider the application of Cosimo and Angie Giancola for approval ora Zone Change from R-l-9 (Single- Family Residential - minimum lot size 9,000 square feet) to R-l-6 (Single-Family Residential - minimum lot size 6,000 square feet) to allow the creation of a 3 lot subdivision on property known as 1253 Harriet Avenue in an R-l-0 (Single-Family/Low Density Residen- tial, less than 4.5 units per gross acres) Zoning District. Tentative City Council hearing - October 3, 1989. Chairperson Olszewski read the Application into the record. Planning Director Piasecki reviewed the Application, presented a Zoning Map and discussed Staff Report General Plan Consistency. Commissioner Alne commented that in keeping with the San Tomas Policy, it was suggested that this street be a candidate for the alternative street standard. The Public Works Director reminded the Commission that the Council had adopted an interpretation of the alternative street standard, which was not substantially different from the standard street requirements. The Public Hearing was opened. Mr. James Riley, Civil Engineer, made himself available for queStions. Planning Commission Minutes 4 September 12, 1989 PUBLIC HEARINGS Continued Mr. Norm Matteoni, Attorney representing the Applicant, commented as follows: - Noted the unique aspects of this property and suggested the item be placed in the proper context - Staff Report stated that the proposed zone change was not consistent with the intent of the San Tomas Policy, which was later adopted into the Land Use Element of the General Plan - General Plan designation for the property called for lower density, residential uses; the Appli- cant's proposal was for three lots (approximately 7,050 sq fi., 7,670 sq. and 9,000 sq. fi.) - Overall density proposed was less than that called for in the General Plan--3.85 units per acre; thus consistency with the General Plan had been achieved, unless the San Tomas Policy which called for a lower density than the minimum lot size, prevailed Circumstances of the subject lot included two existing residences; the lot configuration was not inconsistent with the pattern of development that had occurred in the neighborhood Equally important was the attitude of the neighbors which was reflected in the petition submitted While the request for a rezoning from R-1-9 to R-l-6 appeared to be a significant change, the lots would actually be larger in size than called for in the R-l-6 designation Balancing the intent of the San Tomas Policy with the standard in the General Plan which required less than 4.5 units per acre, showed that the project met the requirements; there was no intention of creating a fourth lot Commissioner Fox felt that only technical compliance had been achieved; if the subject property was an interior lot, and not a corner lot, technical compliance could not have been accomplished. Mr. Matteoni responded that taking advantage of the gross acreage complied with the City's procedures for dealing with corner lots, which had the additional burden in street improvements. Mr. Riley reviewed the calculation of the gross area per the Commission's request. Commissioner Alne questioned whether Mr. Matteoni was familiar with another lot in a semi-rural area with a rear yard area of 12 ft.; Mr. Matteoni thought there would be lots akin to this situation; he stated that a policy should take into account the circumstances and flavor of the neighborhood. Commissioner Fox noted that the existing two lots utilized the majority of the parcel; the addition of a third house which substantially covered its lot would result very little open space being left. Mr. Matteoni responded that a Condition of the Subdivision Approval could define the percentage of the lot coverage; examples of developed lots with open space, were cited for consideration. Commissioner Fox added that there appeared to be little sensitivity shown to the preservation of open space; Mr. Matteoni responded that the Commission had the opportunity to Condition such. Mr. Giancola, Applicant, pointed out new subdivisions in the area and noted the sizes of various parcels in the area; photographs of the area were presented. M/S Christ, Meyer That the public hearing on ZC 89-09 be closed carried unanimously (7-0). M/S Christ, Meyer That the Planning Commission not grant a Negative Declaration in that the project is inconsistent with the General Plan/Policy for the San Tomas Area and will have cumulative impacts which have not been adequately assessed and adopt a Resolution, incorporating the attached findings, recommending that the City Council deny this proposed Zone Change. Planning Commission Minutes 5 September 12, 1989 PUBLIC HEARINGS Continued Discussion on Motion: Commissioner Alne stated that based on testimony, the Ashlock Ct. Subdivision was established prior to the adoption of the San Tomas Policy and thus could not be referenced in relationship to the current proposal. Commissioner Fox stated that approval of this Application would set precedent in the area. Commissioner Perrine noted that while this proposal met the General Plan designation, it did not meet zoning requirements. He wished to retain the single-family character of the neighborhood and would thus, not approve the Application. Commissioner Alne was not favorable to a 12 ft deep rear yard in a semi-rural area and would oppose the Application. Chairperson Olszewski agreed with the Commissioner Fox's comments. Public hearing to consider the application of Mr. Marvin Bamburg for Site and Architectural approval to allow construction of a pro- fessional office building on properties known as 1830 and 1836 East Hamilton Avenue and 1670 Grace Avenue; and, approval of a Zone Change from R-1 (Single-Family Residential) to P-O Profes- sional Office for 1670 Grace Avenue. Chairperson Olszewski read the Application into the record. Planning Director Piasecki reviewed the Application and summarized Staff Report Discussion: an aerial map was displayed and the Traffic Study handed out to the Commission. Commissioner Perrine reported on the Architectural and Site Review Committee's discussions. Commissioner Christ noted that the letters received indicated traffic problems already existed with over spill parking occurring on residential streets; if this were the case, the request to triple the floor area while the parking was only doubled would compound the existing problem. The Public Hearing was opened. Mr. Marvin Bamburg, Applicant, commented as follows: - Concurred with Staff Recommendation to Continue the Site and Architectural approval; in the light of this Recommendation, he deferred his comments on this issue - Reviewed the history of the property and the Application - Cited the proposed tenant mix for this professional office building, i.e., accountants, attorneys, etc.; these tenants would generate very modest traffic - Traffic Circulation Diagram was presented showing the average daily and the anticipated trips; they understood the neighbor's concerns regarding traffic impacts Planning Commission Minutes 6 September 12, 1989 PUBLIC HEARINGS Continued Mr. Bamburg, Applicant, continued his comments as follows: - While the developers believed the traffic impacts to be negligible, they would accept the City's proposal to divert traffic leaving the Grace Ave. driveway - Nineteen of the existing twenty-one parking places could be accessed only from Grace Ave. - With the on-site driveways in the new project leading to Hamilton Ave., there may be less traffic generated on Grace Ave. than currently existed - Noted his interest in placing homes and work sites near each other to eliminate the commute; in addition, such an arrangement was environmentally sound - Applicants were working with the property owner of the building to the west (across Grace Ave.) in an attempt to mitigate traffic impacts from the project property under consideration - The Camphor Trees on-site were large, dirty trees with shallow root structures; he assured the Commission that many new trees would be planted - Contention that parking problems existed was untrue; the existing lot had plenty of extra space.s - ff on-street parking was occurring, despite the on-site parking available, such was probably due to the fact that the street area was shaded; this would be remedied by on-site, covered parking - Concluded that this project met all Ordinances requirements Ms. Joan Regan, 1781 Grace Ave., San Jose, reviewed discussions on the property held by the Santa Clara County Board of Supervisors, at which she was present. The proposed building would not be of similar character as as others on Hamilton Ave.; residents were very concerned about spot zoning the site, which would visually impact residents of Grace Ave. Residents of Meridian Ave. already experienced a loss of residential character in their neighborhood. Mr. Frank Rally, 1796 Grace Ave., Campbell, cited the existing traffic congestion and the spread- ing Professional-Office Use; he wished to retain Hamilton Ave. as it currently existed and to preserve the picturesque view that remained. Ms. Patricia Stutzke, 1690 Grace Ave., Campbell, noted that more homes in the area were being turned into rental units because property owners refused to live with the noise, traffic and other impacts that went along with professional office buildings; she urged that the rezoning requested not be approved. The Professional Office Uses were encroaching on residential areas. Ms. Mary Rally, 1796 Grace Ave., Campbell, reviewed the character of the street. The proposal would place a two-story office building adjacent to single family homes; she asked that the complex be limited to a single story elevation. She noted the increasing traffic, noise and pollution and added that she was concerned for the safety of the many children in the residential areas. Mr. Chris Howell stated that his mother resided at 1680 Grace Ave., Campbell; he cited the park- ing over spill into the residential areas and the increasing traffic congestion at nearby intersections; the residential area was in shambles from these severe impacts. Ms. Esther Remley asked that the Application be rejected; she noted the number of existing office buildings, many of which had vacancies. Ms. Maria Amende, 1770 Mt. Vernon Dr., Campbell, noted the traffic generation and the resulting congestion; an existing office complex was cited as an example of the problems that could develop. The neighborhood did not need another office building; their quality of life was being reduced. Ms. Natalie Rusconi, 1599 Grace Ave., Campbell, stated that it was very dangerous to attempt to cross Hamilton Ave.; this was a special concern for her parents who were aging. Planning Commission Minutes 7 September 12, 1989 PUBLIC HEARINGS Continued Resident at 1657 Hearst Ave., Campbell, wished to attest to the traffic existing problems. The Chair directed that the City send a letter to an near-by property owner of a professional office complex addressing the complaints raised by the speakers during the Public Testimony. Mr. Bamburg responded that parking under the building would be constructed; in addition, the Ordinance required approximately 30% more parking than required by the City of San Jose. He did not wish to be held responsible for the problems of a near-by office building. They did not anticipate similar problems in the new office complex; the tenant mix would be different and the property owner would not tolerate such problems. The pattern of Professional Office Zoning was clear on Hamilton Ave.; the many existing buildings were evidence that this Application was not a request to spot zone the subject property. Develop- ment on Hamilton was proper and in accord with the intent for the street. M/S Perrine, Fox Motion to Continue the Site and Architectural approval to the Plan- ning Commission Meeting of October 10, 1989, to allow the Appli- cant to revise the elevations as recommended by the Architectural Advisor AYES: NOES: ABSTAIN: Commissioners: Commissioners: Commissioners: Vote on Motion: Christ, Fox, Meyer, Wilkinson, Alne, Perrine, Olszewski None. None. M/S Perrine, Fox That the public hearing on ZC 89-12/s 89-14 be closed carried unanimously (7-0). Commissioner Christ stated he was making the following Motion to recommend denial of the zone change requested because such was unnecessary; it was in the best interest of the community to retain the R-1 zoning. Secondly, denying the request did not prevent the Applicant from building the office complex planned. lVl/S Christ, Fox Discussion on Motion: Motion to recommend denial of the Zone Change from R-1 (Single- Family Residential) to PO (Professional Office) Commissioner Christ cited a recent application for an professional office building at the intersection of Hamilton Ave. and Winchester Ave.; retaining the R-1 zoning designation for a development was common and was in the best interest of the City. If the rezoning were approved, and then for some reason the property was sold, the City may see an entirely different project for this property. He felt there was no need to approve the rezoning requested. Commissioner Fox thought that development of professional office buildings on Hamilton Ave. should be encouraged; however, a more contained approach of smaller scale, lower elevations, and perhaps more numerous buildings could be used. Such would not interrupt the skyline of the area. He noted the existing traffic impacts. Planning Commission Minutes 8 September 12, 1989 PUBLIC HEARINGS Continued The City Attorney advised the Commission regarding State Law requiring consistency with General Plan Zoning Designations; secondly, the procedure referenced by Commissioner Christ, namely, obtaining a Use Permit for parking facilities on R-1 lots, required an Ordinance interpretation. Commissioner Wilkinson commented that regardless of the zoning designation, there would still be a professional office complex on the site. Chairperson Olszewski was not supportive of the Motion; this approach could complicate the issue. M/S Perrine, Meyer Motion to adopt the attached Findings and a Resolution recommend- ing that the City Council approve the Zone Change from R-1 (Single Family Residential) to PO (Professional Office) Discussion on Motion: Commissioner Alne noted that the public testimony indicated great frustration on the part of the residents; however, the commercialization of Hamilton Ave. had already been accomplished to a great degree. This Application was an attractive proposal; the current zoning was inconsistent wiht the proposed development. Commissioner Fox felt the property on Hamilton Ave. functioned very well as a commercial use; he did not consider it inevitable that Hamilton Ave. would develop as a commercial zone. He cautioned that concerns of the residents would be overrun in the stampede to develop the street. Commissioner Wilkinson thought that the development proposed was somewhat inevitable; he noted the project's size, the similar uses along Hamilton Ave. and the site depth required to make an office function on the site. Architectural designs would have to be more carefully reviewed in order to integrate a professional office use with the character of the adjacent residential area; the Project Architect had done a good job setting the building away from the residenial structures and screening the office complex. S 89-12 Calhoun, J. Public hearing to consider th e application of Mr. J. Calhoun for Site and Architectural approval to allow construction of office/warehouse building in an M-1-S (Light Industrial) Zoning District on property known as 808 McGlincey Lane. Chairperson Olszewski read the Application into the record. Planning Director Piasecki reviewed the Application and presented a Site Map. Commissioner Perrine reported on discussions of the Architectural and Site Review Committee. Planning Commission Minutes 9 September 12, 1989 PUBLIC HEARINGS Continued The Public Hearing was opened. Mr. Jim Warren, Architect, stated that with respect to the condominium units to the rear of the property, only one unit would look directly at the proposed building; this view had been softened by the slope of the property and the rather large mature landscaping on the adjacent property. The configuration of the walkway would be worked out with the Public Works Department. Mr. Jeff Dalton, Representing Dry Creek Place Townhomes, disagreed with the above statement and pointed out that six condominium units would view the proposed warehouse. He requested denial of the Application; traffic and pollution problems already existed on Union Ave. There were residential homes surrounding the subject site; a townhouse development on this site would be more appropriate. Residents did not want a warehouse in their back yard. Mr. Warren reiterated that only one condominium unit directly viewed the proposed building. M/S Meyer, Fox That the public hearing on be closed carried unanimously (7-0). M/S Meyer, Perrine Motion that the Planning Commission adopt the attached Findings and approve this project, subject to the attached conditions. Discussion on Motion: Chairperson Olszewski commented that the area had been zoned Light Industrial for many years. Public Hearing to consider the application of Mr. E. Doise for ap- proval of a modification to a previously approved site and archi- tectural approval to allow construction of a second story addition to an existing industrial building in a M-1-S (Light Industrial) Zoning District on property known as 203 Kennedy Ave. Chairperson Olszewski read the Application into the record. Principal Planner Stafford reviewed the Application. Commissioner Perrine noted that the Architectural and Site Review Committee recommended a one month Continuance of this Item. The Public Hearing was opened. Mr. Frank D. Oldham, Architect, apologized for being unable to meet with the Architectural and Site Review Committee. With respect to Staff's recommendation for denial, a parking ratio chart was submitted showing that 33 parking spaces existed on-site. Secondly, with respect to the on- site circulation, there were two approaches to the site which had existed for almost twenty years. Commissioner Christ noted that if the only way this parcel could be developed was to install illegal parking spaces to the rear of the site, this site could not be developed. Planning Commission Minutes 10 September 12, 1989 PUBLIC HEARINGS Continued Mr. Oldham responded that they were not illegal spaces; the property owner owned 10 ft. of space which accessed the alley, which he contended was a public right-of-way. Commissioner Christ added that access to the parking through property that was not a public right- of-way could not be allowed. He was prepared to deny the Application if a vote were taken. Mr. Oldham stated that they would accept a Continuance. M/S Perrine, Meyer Motion to Continue M 89-14 to September 26, 1989, was carried unanimously (7-0) 6. V 89-07 Mayer, J. Public hearing to consider the application of Mr. Jim Mayer for ap- proval of a variance to the distance between buildings on the same lot to allow a building addition to an existing single family dwelling in an R-1 (Single Family Residential) Zoning District on property known as 161 N. Milton Ave. Chairperson Olszewski read the Application into the record. Principal Planner Stafford reviewed the Application and presented a Site Plan. The Public Hearing was opened. Mr. Jim Mayer, Applicant, stated that the proposed addition would follow the existing rear wall; the shorter distance of the offset would not create a fire hazard and worked well with the property. Ms. Mayer reviewed their plans and discussed how the new addition fit with the existing structure. Commissioner Christ noted that Variances were granted which demonstrated less hardship than this request; Applicants already had a sliding door and wished to take advantage of the situation. There would be some hardship incurred if the request were denied. Commissioner Alne agreed. Commissioner Fox added that the remodel would not be visible from the street. M/S Perrine, Christ That the public hearing on be closed carried unanimously (7-0). The City Attorney recommended consideration of the Finding prepared, as stated in the Motion. M/S Fox, Christ Motion to grant a Variance making the Finding that the proposed addition would be difficult to locate in any other fashion due to the manner in which the existing building related to the lot; as a conseo quence, the Planning Commission further finds and concludes that: 1) Strict or literal interpretation and enforcement of the specified regulations would result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of the Zoning Ordinance and, 2) Strict or literal interpretation and enforcement of the specified regulations would deprive the applicant of privileges enjoyed by owners of other properties classified in the same zoning district and, 3) The granting of a Variance would not constitute the grant of a special privilege inconsistent with the limitations placed on other properties classified in the same zoning district. Planning Commission Minutes 11 September 12, 1989 PUBLIC HEARINGS Continued Discussion on Motion: Commissioner Perrine commented that granting the Variance requested allowed the house to retain the character of the neighborhood. MISCELLANEOUS: Since there was no one in the audience to address Item 7, the Commission proceeded to Item 8. 8. M89-15 Anderson Consideration of the application of Mr. Kurt Anderson for approval of a modification to a previous Site and Architectural approval to allow expansion of an office space and exterior improvements on property known as 380 Industrial Ave., in an M-1-S (Light Indus- trial) Zoning District. Chairperson Olszewski read the Application into the record. Principal Planner Stafford reviewed the Application. Commissioner Perrine reported on discussions of the Architectural and Site Review Committee. Mr. Kurt Anderson, Applicant, stated that he wished to create a bold statement for his future office; this would be accomplished through the use of color. He wished to move this Application forward. Planning Director Piasecki noted that a revised Condition 7 had been added, which limited the square footage of the building. M/S Perrine, Meyer Motion to approve M 89-15 with Revised Conditions of Approval, with the Application to be returned to the Architectural and Site Review Committee, was carried unanimously (7-0). 9. M 89-08 Hester, L. Consideration of an application of Mr. Larry Hester for approval to allow outdoor storage racks and storage area in conjunction with a drywall operation on property known as 400 Industrial Street in a M-1-S (Light Industrial) Zoning District. Commissioner Christ stated he did not wish to see storage above a 12 ft. height; Mr. Anderson responded that this was the only remaining area available; he suggested that the storage racks be painted to match the building, if the Commission so wished.
