and Syufy Enterprises for a use permit and approval of

Zoning District.
Mr. Kee reported that a letter had been received from the applicant withdrawing
his application; therefore, staff is recommending that the Commission deny this
application without prejudice in order to remove it from the agenda.

adopt Resolution No. 1826 denying without prejudice
the application of Mr. Jack Haigh and Syufy Enter-

After notification and public hearing as specified by law on the
application of Mr. Jack Haigh and Syufy Enterprises for a use permit and
approval of plans to allow the addition of a screen and projection booth
to an existing drive-in on property known as 535 Westchester Drive in an
M-1-S (Light Industrial) Zoning District, as per application filed in the
Office of the Planning Department on April 27, 1979, and after presentation
by the Planning Director, proponents, and opponents, the hearing was closed
(UP 79-15).
After due consideration of all evidence presented, the Commission did
find as follows:
1. The item should be removed from the agenda per the applicant's
request for withdrawal.
Based on the above findings, the Planning Commission does hereby
deny without prejudice the requested use permit.

STAFF DISCUSSION
This item was continued from the meeting of August 21, 1979, in order that
(1) the applicant would have additional time to prepare a traffic analysis,
and (2) a letter from the Burton Construction Company could be referred to
the Police Department.
A copy of the applicant's traffic analysis is attached for the Con~nission's
review. The City's Traffic Engineer and the Police Department are still
reviewing the existing development. Reports on their findings will be
available at the Planning Commission meeting.
The applicant has submitted a letter requesting another continuance of this
item.

time, it was requested that your department review this letter and report
back to the Commission any findings.
The Commission will again be considering this item at its September 18
meeting; therefore, any input you might have would be appreciated by that

Anticipated traffic conditions associated with the addition of another
screen for a total of six has been evaluated. It has been determined that
the change could improve traffic conditions on access streets by staggering
movie starting times by at least l0 minutes. The effects of movie traffic
on vicinity streets can be improved further by the following measures:
1. Stripe left turn lane on Curtner allowing thru traffic to by-pass
traffic turning left to S. McGlincy.
Stripe right and left turn lanes on McGlincy at Curtner.
Install directional white on blue Winchester Drive-In *signing ~ 250'
from McGlincy turn at Cristich (Now located at intersectio~ faded).
4. Provide G8 white on green directional *signing to Curtner with an
arrow left opposite McGlincy at Cristich.
5. Stripe left turn at driveway from McGlincy to theater entrance to
minimize interference with thru traffic.
6. Recondition lighted theater entrance signs opposite driveway and
Westahester Drive on McGlincy.
7. Provide white on blue advance directional *signs on Union ± 250'
from its intersection with McGlincy (Now at intersection, faded).
Ail unlighted signs should be reflectorized.

entrance on Westchester Drive.

Striping on entrance road should conform with adopted convention -
double yellow separating opposing traffic, single white separating
traffic in the same direction.
10. The 2167 speaker count will not change. Parking stalls will be
rearranged to accommodate additional screen.
Conclusion:
The changes proposed at Winchester Drive-In Theater provide an opportunity
to augment and update traffic controls on access streets. Applying the
measures proposed, particularly staggering movie starting times, should
improve traffic conditions substantially.

Trash container(s) of a size and quantity necessary to serve the
development shall be located in area(s) approved by the Fire
Department. Unless otherwise noted, enclosure(s) shall consist
of a concrete floor surrounded by a solid wall or fence and
have self-closing doors of a size specified by the Fire Department.
All enclosures to be constructed at grade level.
Applicant shall comply with all appropriate State and City require-
ments for the handicapped.
Noise levels for the interior of residential units shall comply
with minimum State (Title 25) and local standards as indicated
in the Noise Element of the Campbell General Plan.

The purpose of this letter is to COMPLAIN about the POOR patrol and
trash collection in the neighborhood of the theater, and to OBIE CT to any
proposed expansion or improvements to the theater ....
It is my understanding that the theater owners, Syufu Enterprises, were to
provide adequate private security and trash collection as one of the conditions
required by the City for previous approvals.
We own industrial i~roperties adjacent to the theater. The theater is an
"Attractive Nuisance" and attracts BUMS and DRUNKS that congregate in our
parking lots to have their 'parties'. These bums & drunks intimadate and scare
the tenants and employees working on the night shifts. Repeated complaints to
the Campbell Police Department have not resolved the problem.

At its meeting of July 3, 1979, the Planning Commission held a continued
public hearing to consider the above referenced use permit. You had re-
quested that this item be continued once more in order that you could
attend the Commission meeting at which a decision would be made on this
application. Pursuant to your request, the Commission took action to
approve a continuance to its August 7, 1979, meeting.
In addition to continuing the hearing, the Commission also expressed
concern about traffic congestion problems in the area. The Commission
has requested that you submit an updated traffic engineering analysis
for the area surrounding the site which would also speak to any impact

Commissioner Dickson raised a point regarding the screens not facing the
freeway, and wondered if this could also be checked into.
Vice Chairman Campos stated he would like to know what the impact would be
on the neighborhood.

of a screen and projection booth to an existing
drive-in theater located on property known as
535 Westchester Drive in an M-I-S (Light Industrial)

STAFF RECOMMENDATION
Approval, subject to the attached conditions.
STAFF DISCUSSION
The applicant is proposing to construct an additional screen, a third
projection booth and another box office booth. The new screen will be
located adjacent to Highway 17, and therefore will not throw any
additional light on the mobil home park located adjacent to the site.
It should be noted by the applicant and the Commission that any change
in the existing signing will require approval by the City Council since
it is adjacent to the freeway.
This item was continued from the meeting of June 19, 1979, because the
applicant was unable to attend that meeting.
The Commission, on June 19, 1979, requested staff to prepare a brief
history of this development.
The Winchester Drive-in was originally located in the County on property
now occupied by the San Tomas Expressway. When the expressway was put in,
the drive-in was relocated to another county parcel - the southerly half
of the present site. At that time there were only two screens.
In 1971 the applicant obtained a Use Permit and approval of plans to
expand the development onto the parcel to the north and to add a third
screen.
In 1976 the applicant reduced the size of the three sub-theaters and
added two additional screens. The applicant is now proposing to add a
sixth screen without increasing the capacity of the development.

This is the time and place for a public hearing to

to allow the addition of a screen and projection
booth to an existing drive-in theater located on

Mr. Kee reported that the applicant has requested a continuance of this item
to the July 3, 1979, Planning Commission meeting.
Commissioner Pack brought to the Commission's attention the traffic problems
that occur in the whole area (Camden, Whiteoaks, McGlincey, and Highway 17)
when the drive-in opens.
Commissioner Vierhus felt, if anything, traffic will be cut down since there
is only a limited number of overall spaces.
Commissioner Kasolas inquired if the Commission could be supplied with the
past history on this entire project.
Mr. Kee stated that it would not be a problem to present a brief history of
this project going back seven or eight years.
Acting City Attorney Marilyn Taketa entered the Council Chambers at 8:20 p.m.
Chairman Samuelson declared the public hearing open and invited anyone in
the audience to speak for or against this project.

Mr. Donald Mandell of 571McGlincey Lane, Campbell, spoke in opposition to
the expansion of this project because of traffic congestion and problems in
the area. He felt this expansion would add to the existing traffic problems.
No one else wishing to be heard, Commissioner Vierhus moved that this item
be continued to the July 3, 1979, Planning Commission meeting, seconded by
Commissioner Pack and unanimously adopted.
