It ts my understanding that the theater owners, Syufu Enterprises, were to provide adequate private security and trash collect, ion as one of the conditions required by the City for previous approvals. We own industrial l~roperties adjacent to the theater. The theater is an "Attractive Nuisance" and attracts BUMS and DRUNKS that congregate In our parking lots to have their 'parties'. These bums & drunks tntimadate and scare the tenants and employees working on the night shifts. Repeated complaints to the Campbell Police Department have not resolved the problem. Planner I ENCL. jw RESOLUTION NO. 1852 PLANNING COMMISSION CITY OF CAMPBELL, CALIFORNIA After notification and public hearing as specified by law on the application of Mr. Jack Haigh and Syufy Enterprises for a use permit and approval of plans to allow the addition of a screen and projection booth on property known as 535 Westchester Dr. in an M-1-S (Light Industrial) Zoning District, as per application filed in the Office of the Planning Department on December 18, 1979, and after presentation by the Planning Director, proponents and opponents, the hearing was closed (UP 79-35). After due consideration of all evidence presented, the Commission did find as follows: That the establishment, maintenance, and operation of the proposed use will not be detrimental to the health, safety, peace, morals, comfort, or general welfare of persons residing or working in the neighborhood of such use, or be detrimental or injurious to the property and improvements in the neighborhood or the general welfare of the City. Based on the above findings, the Planning Commission does hereby grant the requested use permit subject to the following conditions: A. Underground utilities to be provided as required by Section 20.16.070 of the Campbell Municipal Code. Be Plans submitted to the Building Department for plan check shall indicate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. Ce Sign application to be submitted in accordance with provisions of the sign ordinance for all signs. No sign to be installed until application is approved and permit issued by the Building Department. (Section 21.68.070 of the Campbell Municipal Code.) De Ordinance No. 782 of the Campbell Municipal Code stipulates that ' any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single-family dwellings, multiple apartment units, to all commercial, business, industrial, manu- facturing, and construction establishments. Be Trash container(s) of a size and quantity necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level. -2- FIRE DEPARTMENT F. Provide a minimum of ten foot wide access to all six theaters, for fire engine clearance. PLANNING DEPARTMENT G. This is the time and place for a public hearing to consider the application of Mr. Jack Haigh and Syufy Enterprises for a use permit and approval of plans to allow the addition of a screen and pro- jection booth to an existing drive-in located on property known as 535 Westchester Drive in an M-1-S {Light Industrial) Zoning District. Commissioner Kasolas reported that the applicant met with the Site and Architectural Review Committee this morning. He noted the Committee is recommending approval subject to the conditions listed in the Staff Comment Sheet as well as an added condition which would read "applicant to submit a letter stating that the starting times will be staggered in order to alle- viate some of the traffic problems." Chairman Campos opened the public hearing and invited anyone in the audience to speak for or against this item. Mr. Jack Haigh, applicant, appeared before the Commission to state that he is in agreement with the Committee's recommendation. Commissioner Dickson inquired about who would pay for the striping of areas noted on the traffic study. Engineering Manager Helms responded that the City would participate in this cost as part of the regulatory traffic movements for the area sometime after action on this item has been taken. Commissioner Dickson then inquired about the screens facing the freeway. Mr. Haigh responded that as part of the original application certain require- ments for landscaping were imposed and all of the requirements had been met. Public hearing to consider the application of Mr. Jack Haigh and Syufy Enterprises for a use permit and approval of plans to allow the addition of a screen and projection booth to an existing drive-in located on property known as 535 Westchester Drive in an M-1-S (Light Industrial) Zoning District. STAFF RECOMMENDATIOH Approval, subject to the attached conditions. STAFF DISCUSSION The applicant has resubmitted his request to construct an additional screen, a third projection booth and another box office booth. The new screen will be located adjacent to Highway 17, and therefore will not throw any additional light on the mobil home park located adjacent to the site. The capacity of this development will remain unchanged at 2,167 cars. The Commission may recall that the Winchester Drive-in was originally located in the County on property now occupied by the San Tomas Expressway. When the expressway was put in, the drive-in was relocated to another County parcel - the southerly half of the present site. At that time there were only two screens. In 1971 the applicant obtained a Use Permit and approval of plans to expand the development onto the parcel to the north and to add a third screen. In 1976 the applicant reduced the size of the three sub-theaters and added two additional screens. The previous application (UP 79-15) was removed from the agenda at the applicants request. Last year, while considering this applicant's request the Commission requested that a traffic study be done for this development. A copy of that report is attached for the Commission's review. As indicated in the traffic report, the total number of spaces in the drive-in will remain unchanged. With this in mind, the Police Chief has indicated that his department has no objections to this proposal. We own industrial l~roperties adjacent to the theater. The theater is an "Attractive Nuisance" and attracts BUMS and DRUNKS that congregate in our parking lots to have their 'parties'. These bums & drunks intimadate and scare the tenants and employees working on the night shifts. Repeated complaints to the Campbell Police Department have not resolved the problem. This requirement applies to all single-family dwellings, multlple apartment units, to all commercial, business, industrial, manufacturing, and construction establishments. Trash container(s) of a size and quantity necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level. n/a Applicant shall comply with all appropriate State and City require- ments for the handicapped. n/a Noise levels for the interior of residential units shall comply with minimum State (Title 25) and local standards as indicated in the Noise Element of the Campbell General Plan. It has been determined that the change could improve traffic conditions on access streets by staggering movie starting times by at least 10 minutes. The effects of movie traffic on vicinity streets can be improved further by the following measures: 1. Stripe left turn lane on Curtner allowing thru traffic to by-pass traffic turning left to S. McGlincy. ® Stripe right and left turn lanes on McGlincy at Curtner. Install directional white on blue Winchester Drive-In *signing ± 250' from McGlincy turn at Cristich (Now located at intersectio~ faded). 4. Provide G8 white on green directional *signing to Curtner with an arrow left opposite McGlincy at Cristich. Stripe left turn at driveway from McGlincy to theater entrance to minimize interference with thru traffic. 6. Recondition lighted theater entrance signs opposite driveway and Westchester Drive on McGlincy. 7. Provide white on blue advance directional *signs on Union ± 250' from its intersection with McGlincy (Now at intersection, faded). Ail unlighted signs should be reflectorized. P.O. Install black on yellow EXIT with arrow right ~sign opposite main entrance on Westchester Drive. Striping on entrance road should conform with adopted convent/on - double yellow separating opposing traffic, single white separating traffic in the same direction. 10. The 2167 speaker count will not change. Parking stalls will be rearranged to accommodate additional screen. Conclusion: The changes proposed at Winchester Drive-In Theater provide an opportunity to augment and update traffic controls on access streets.
