2. The sign structure shall be textured and painted to match the building.

I opened the Round Table Pizza at 711 W. Hamilton Avenue in Campbell in April of 1971. We
struggled for 3 ½ years before turning the corner. During that time, I worked the store daY and
night, seven days a week. We have since expanded our operation throughout Northern California
and presently own an(I operate 21 stores.
During those first years I attempted to get better signage to identify our business. I even wrote
lettem to the CH asking for additional signage. At that time the anchor Tenant, Luc~y's
Supermarket, occupied the large building backing up to the Expressway. There were no Trees or
Landscaping along the San Tomes Expressway side nor has there eve~ been.

Approval of Minor Modifications to an existing shopping center - Riverside Plaza located at
651 W. Hamilton Avenue
Dear Mr. Chan:
The Planning Division has reviewed your letter dated October 28, 1999, indicating your intentions to
conduct minor alterations to the Riverside Plaza Shopping Center located at 651 W. Hamilton Avenue.
Upon review of your letter and the proposed colored elevations and material board you have
submitted, the Planning Director has conditionally approved the proposed alterations as a minor
modification to the previously approved Site and Architectural Review Permit (S 66-1) based upon the'
findings that the proposed modifications will not change the overall character of the development, the
proposed modifications will not substantially alter the design or specifications set forth in the
approved site plan and elevations and the proposed minor modifications will not result in the creation
of a situation or condition contrary to the intent of the ordinance or resolution by which the
development was originally approved. The shopping cente~ is currently within a Planned
Development (PD) zoning district; however, the original shopping center approval was granted under a
Site and Architectural Review Permit. Under the PD zoning ordinance, the Planning Director has the
authority to approve minor changes that meet the above-referenced findings.
The conditions under which the minor modification approval has been granted include the following:
The roof material for the entire shopping center shall consist of the new black "sablewood"
asphalt shingles as submitted in the approved material board. All wooden roof shingles
remaining on the roof shall be removed and replaced with the new black "sablewood" asphalt
shingles.
All metal flashings and fascia on the shopping center building shall be painted to match the
paint colors on the approved material board. The metal trim board and roof cap shall be
painted the "nougat" color and the fascia shall be painted the "wood chip" color as indicated
on the material board.
All graffiti shall be removed from the building. All existing painted surfaces of the building
which have been affected by graffiti shall be re-painted to match the building. All block wall
and brick surfaces shall be power-washed to remove all graffiti and all paint colors that do not
match the building.

The property owner shall be required to conduct routine maintenance of the shopping center
building and site to ensure that the shopping center is maintained free of any trash, debris,
weeds, and graffiti at all times. All trash, debris, weeds and graffiti shall be removed within
twenty-four (24) hours of notice of the presence of any trash, debris, weeds, and/or graffiti, or
as soon as practicable.
The property owner shall provide a landscape plan to be reviewed and approved by the
Planning Department indicating additional landscaping to be installed on site. Please indicate
on the landscape plan the location of the new monument sign and additional landscaping to be
provided at the base of the sign. In addition, existing landscaping shall be trimmed and
routinely maintained on site.
The property owner shall comply with all Building Code requirements and obtain necessary
permits as determined by the City's Building Division for any proposed alterations conducted
as part of the approval of this minor modification.
7. All of the above-referenced modifications to the shopping center shall be completed within
five (5) weeks of the date of this approval letter, on or before December 8, 1999.
With the completion of the above-referenced modifications, the Planning Department can then make
the determination that the proposed monument sign for which you have submitted an application (SA
99-15) is compatible with the shopping center. With that finding, the Planning Department can then
issue the Planning Department approval of the sign application with the understanding that the existing
non-conforming pole sign is removed prior to installation of the new sign.

I received your letter of Sept. 3rd on Sept. 7th, the day afterLabor
Day. First of all, my wife and I are leaving tomorrow, Sept. 15 for
an extended stay in Hawaii. I am 79 years old, and my health is not
good. Enclosed is a copy of my E-Ticket issued June 22 and no refund.
Noel Marquis of Amcoe Sign and I have been in touch constantly and he
will be submitting colored elevations to you shortly. Please note we
nave Just spent $57,000 to Petromat the parking area. (see invoice)
With reference to the other work, I would like very much to meet you
at the center so you can specifically point out what you want as far
as approved colors and paint for the fascia, removal of graffiti, and
extent of landscaping requirements. After paying $57,000 on the park-
ing lot work, our finances are somewhat low. Also I am "gunshy" on
the City requirements as my roofer said asphalt tiles were O.K. and I
didn't check on it with you personally so that's how trouble started.
Please bear in mindthis center was built in 1968, and can't be compared
with a brand new center.
I am returning home the evening of Oct. 21st, Thursday, and would be
very happy if you could meet me at the center either Oct. 25, Monday
or Oct. 27, Wednesday at your choice of 11 AM or 1:]0 PM. As for the
timeline, three weeks maximum after our meeting, should be enough to
do all of the other requirements.
Please let me know which dates and time are best for you. Any letters
will be forwarded from my office to Hawaii.

Dear Mr. Chan:
Pursuant to the letter I sent to you on August 10, 1999, I recently conducted an inspection of your
property and met with Noel Marquis of Amcoe Sign Co. on Monday, August 30, 1999, to discuss the
issues surrounding the deficiency of maintenance on your property, Riverside Plaza Shopping Center
located at 651 W. Hamilton Avenue. In addition, we discussed the replacement of the wood roof
shingles on parts of the roof with black asphalt shingles that was not approved by the City. I have also
communicated these issues to you recently on the telephone.
Upon meeting with Mr. Marquis and as explained to you on the telephone, the current condition of the
shopping center must be brought into compliance with the approved Site and Architectural Review
Permit for the development of the shopping center. This entails proper maintenance of the shopping
center building and site. Currently, many parts of the building are painted with patches of various
colors that are not consistent with the original color of the brick facade of the building. In addition, the
fascia on the building appears faded and has not been maintained, and it appears that the landscaping
on-site has not been properly maintained.
Upon my recent conversations with you, you have indicated that you would like approval by the City to
replace all wood shingles on the roof with the black asphalt shingles to create consistency of roofing
material on the building. As indicated to you previously, the Community Development Director is
requesting that colored elevations of the building be submitted to the Planning Department for review
that indicate the proposed color and material of the new roof material, the color to be used for repainting
the fascia around the building and the removal of graffiti and mismatched paint colors currently found
on the building, prior to making a determination on the proposed roof material.
Currently the site is considered non-compliant with the approved Site and Architectural Review Permit
and it does not appear that any good faith efforts have been made to resolve these issues. Please submit
your proposed colored elevations for the building with the proposed asphalt shingle roofing and a
timeline for compliance with the other deficiencies on site (i.e. graffiti and mismatched paint on the
building, fading of the paint on the fascia of the building, and lack of landscape maintenance) within the
next two (2) weeks, on or before September 17, 1999. If no colored elevations and timeline for
compliance of deficiencies are submitted to indicate efforts to resolve these non-compliance issues by
the above-referenced compliance date, please be aware that failure to bring this matter into conformance
will result in this matter being referred to the City Attorney's Office and/or abatement of the violations
under the police powers of the City.

This letter is written to you in reply to your letter of August
10and as per our conversation of August 12. We are enclosing a
letter from our insurance broker, Jenkins/Athens Insurance Ser-
vices concerning the use of composition shingles versus the use
of wood shingles.
We have discussed this matter with !'~r. Rick Farabee, the owner
of Craftsmen Roofing Co., San Jose, and he is giving us a pro-
posal on installing the asphalt tiles. I asked him to drop by
your office with the proposal as I will be out of to'~m from ?~ug-
ust l~th through August 19th.
As per your letter, we agree to do the following as listed below:
1) Install new black asphalt shingles to replace all wooden ones.
2) Repaint graffiti from buildings with matching paint.
3) Have Round Table Pizza repaint the exterior to the original
color. (They painted it white without our permission)
We agree not to proceed with the roof shingles installation until
written approval has been received by us. We also agree that all
of the above listed items should be finished within two weeks from
receipt of your written approval of the black asphalt shingles.

The City of Campbell Community Development Department has reviewed your sign
application (SA 99-15) for a proposed 14-foot high freestanding sign to be located at the
Riverside Plaza Shopping Center at 651 W. Hamilton Avenue. Upon review of the
proposed sign, the Community Development Department cannot approve your sign
application at this time given that modifications have been made to the shopping center
building on site that have not been approved by the City. In addition, the sign application
is deemed incomplete. According to Amcoe Sign Company, the proposed colors for the
signage have yet to be submitted.
All permanent signs are to be architecturally compatible with and suitable to the building
and structures with which they are associated. The proposed freestanding sign is not
considered consistent with and architecturally compatible with the shopping center
building primarily because alterations have been made to the building that are not
consistent with the original approval of the building.
Upon inspections conducted of the property, new black asphalt shingles have been
installed on parts of the roof which are inconsistent with the originally-approved cedar
shingle roofir~g material. The building currently has a mixture of the black asphalt
shingles and cedar shingles. In addition, the building and property are not being
maintained and there are several areas on the building which have been painted over with
colors that do not match the original colors of the building. Therefore, the Community
Development Department will not approve the proposed signage until the code violation
issues regarding the lack of building and property maintenance and change in roofing
material has been resolved, and the proposed signage can be determined to be compatible
with the building.

You asked us in early July to repaint the roof shingles at our
Riverside Plaza Shopping Center from the Chef King Restaurant
to the Beauty Salon. We contacted our roofer Mr. Rick Farabee
of Craftsmen Roofing Co. who felt that repainting would not be
satisfactory as he had restained in early May afte~ our first
meeting at City Hall (please see invoice). He suggested new
reroofing but it was illegal to use wood shingles as it could
catch fire easily, especially with two restaurants, Chef King
and Round Table Pizza. Mr. Farabee used composition shingles,
matching the color to the adjacent building as close as possi-
ble and the work was completed on July 23rd.(please see invoice)
Our tenants are very happy about the nice new appearance.
I conversed with you, Ms. Irani, about our very low rent receipts.
It has been a hardship with Lucky's, and then their subsidiary
Hancock Fabrics paying us 15¢ per square foot for 20,000 square
feet for the past 26 years from 1972 through November, 1998.

In order to ease our financial hardship, we respectfully re-
quest that you approve our sign application without having more
expenses. This will definitely improve the appearance of our
center as well as Hamilton Avenue with a brand new sign.
