ARer notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as follows
with respect to application PLN2001-136:
The proposed martial arts academy is consistent with the Commercial land use designation of
the General Plan and the P-D (Planned Development) Zoning District with approval of a
Conditional Use Permit.
2. The project site consists of a 51,631 square foot lot, developed with a 15,776 square feet of
building area, 4,267 square feet of landscaping, and 31,588 square feet of paving.
3. The existing 79 parking spaces will adequately address the parking needs of the subject site
and proposed use.
4. The proposed use will not result in an over concentration of such uses in the City.

The surrounding uses consist of restaurants and retail stores to the north, commercial uses'
south, retail stores to the east, and a restaurant to the west. The proposed martial arts
academy is compatible with the surrounding development and uses.
6. Business houri shall be restricted to 7 a.m. to 11 p.m. daily.
7. Future changes in tenant mix could result in negative parking impacts.
Based upon the foregoing findings of fact, the Planning Commission further finds and concludes
that:
1. The proposed project is consistent with the General Plan and Zoning Ordinance.

The establishment, maintenance, or operation of the use will not be detrimental to the public
health, safety, peace, morals, comfort or general welfare of persons residing or working in the
neighborhood of such proposed use, or be detrimental or injurious to property and
improvements in the neighborhood or to the general welfare of the City.
3. The proposed commercial use is compatible with the uses in the area.
The subject site is adequate in size and shape to accommodate the yards, walls, fences, parking
and loading facilities, landscaping, and other development features required in order to integrate
said use with uses in the surrounding area.
5. The subject site is adequately served by streets of sufficient capacity to carry the kind and
quantity of traffic such use would generate.
6. The establishment will not significantly disturb the peace and enjoyment of the nearby
neighborhood.
7. There is a reasonable relationship and a rough proportionality between the Conditions of
Approval and the impacts of the project.
Where approval by the Director of Community Development, City Engineer, Public Works
Director, City Attorney or Fire Department is required, that review shall be for compliance with all
applicable conditions of approval, adopted policies and guidelines, ordinances, laws and regulations
and accepted engineering practices for the item under review. Additionally, the applicant is hereby
notified that he/she is required to comply with all applicable Codes or Ordinances of the City of
Campbell and the State of California that pertain to this development and are not herein specified.

Project approval shall substantially comply with project plans received by the Community
Development Department on November 29, 2001, and the business description provided by the
applicant, except as may be modified by the Conditions of Approval herein.
Conditional Use Permit Approval Expiration: The Conditional Use Permit approval shall be
valid for one year from the date of final approval. Within this one-year period the use must be
established on the property. Failure to meet this deadline will result in the Conditional Use
Permit being void.
Revocation of Permit: Failure to comply with the Conditions of Approval shall be grounds for
consideration of revocation of the Conditional Use Permit by the Planning Commission. In the

Director as the result of this use, the Director shall have the authority to reduce the operational
hours for this use.
4. Square Footage Restriction: The total floor area allowed for the martial arts academy shall not
exceed 1,100 square feet.
Operational Hours: The operational hours are provided as 8 a.m. to 9 p. m. and shall be limited
to 7 a.m. to 11 p.m. daily, unless a Conditional Use Permit is obtained from the Planning
Commission for late night operations.
Sign Permit: No signage is permitted as part of the development application approved herein.
New signage shall not be installed prior to approval of a sign permit as required by Chapter
21.53 of the Campbell Municipal Code.
Parking, Driveways and Maintenance: Ail parking and driveway areas shall be maintained in
compliance with the approved plans and Chapter 21.50 (Parking and Loading) of the Campbell
Municipal Code, subject to review by the Community Development Director.
Building Division:
Permits Required: A building permit application shall be required for the proposed tenant
improvement to the existing structure. The building permit shall include
Electrical/Plumbing/Mechanical fees when such work is part of the permit.
9. Construction Plans: The Conditions of Approval shall be stated in full on the cover sheet of
construction plans submitted for building permit.
10. Size of Plans: The minimum size of construction plans submitted for building permits shall be 24
inches X 36 inches.
11. Plan Preparation: This project requires plans prepared under the direction and oversight of a
California licensed Engineer or Architect. Plans submitted for building permits shall be "wet
stamped" and signed by the qualifying professional person.
12. Site Plan: Application for building permit shall include a competent site plan that identifies
property and proposed tenant space with dimensions and elevations as appropriate. Site plan
shall also include site drainage details. Site address and parcel numbers shall also be clearly
kalled out. Site parking and path of travel to public sidewalks shall be detailed.
13. Title 24 Energy Compliance: California Title 24 Energy Standards Compliance forms shall be
blue-lined on the construction plans. Compliance with the Standards shall be demonstrated for
conditioning of the building envelope and lighting of the building.
14. Special Inspections: When a special inspection is required by U.B.C. Section 1701, the
architect or engineer of record shall prepare an inspection program that shall be submitted to

the Building Official for approval prior to issuance of the building permits, in accordance with

15. Water Pollution: The City of Campbell, standard Santa Clara Valley Non-point Source Pollution
Control Program specification sheet shall be part of plan submittal. The specification sheet (size
24" X 36") is available at the Building Division service counter.
16. Title 24 Accessibility - Commercial: On site general path of travel shall comply with the latest
California Title 24 Accessibility Standards. Work shall include but not be limited to
accessibility to building entrances from parking facilities and sidewalks.
17. Title 24 Accessibility - Commercial: Projects seeking to use the Title 24 Hardship exemption
clause shall blue-line completed, City of Campbell "20%" exemption form on submitted

Public Heating to consider the application of Mr. Carl Lee, on behalf of
Eagle Talon Martial Arts, for approval of a Conditional Use Permit
(PLN2001-136) to allow a martial arts academy in approximately 1,100
square feet within an existing commercial building on property located at
839 West Hamilton Avenue in the P-D (Planned Development) Zoning
District.
STAFF RECOMMENDATION
That the Planning Commission take the following action:
Adopt a Resolution, incorporating the attached findings, approving a Conditional Use
Permit (PLN2001-136) to allow a martial arts academy within an existing commercial
building, subject to the attached Conditions of Approval.
ENVIRONMENTAL DETERMINATION
This project is categorically exempt under Section 15303, Class 3 (c) of the California
Environmental Quality Act (CEQA) pertaining to the conversion of a small commercial
structure; therefore, no environmental action is required.

DISCUSSION
Background: The subject property is currently developed with two single story multi-tenant
commercial buildings constructed in 1973 under a Planned Development Permit (P-D 73-2). The
proposed tenant space is currently occupied with a television repair use that would be reduced in
size to accommodate the martial arts academy.

The project site is located on the northwest comer of West Hamilton and Darryl Avenues and is
surrounded by restaurant and retail uses to the north and south, a restaurant to the west, and a
variety of retail uses to the east. The project site is developed with two multi-tenant commercial
buildings on the L-shaped parcel.
Applicant's Proposal: The applicant is requesting approval of a Conditional Use Permit to allow
the establishment of a martial arts academy within the smaller commercial building fronting
West Hamilton Avenue. The martial arts academy would occupy 1,088 square feet or 6 percent
of the existing building area on the project site.
ANALYSIS
General Plan Designation: The General Plan land use designation for the project site is General
Commercial. The proposed commercial school use within an existing commercial building is
consistent with this land use designation. Therefore, the proposed project is consistent with the
General Plan.
Zoning Designation: The zoning designation for the project site is P-D (Planned Development).
The P-D Zoning District allows for the establishment of a use in an existing building to be
approved with a Conditional Use Permit. The proposed project will be consistent with the
Zoning Ordinance with approval of a Conditional Use Permit.
Martial Arts Academy: Pursuant to section 21.06.070 of the Campbell Municipal Code, a
Conditional Use Permit is required to allow the establishment of a use in an existing building
where no development plans are required. Further, indoor recreational facilities require a
Conditional Use Permit within commercial zoning districts. Consequently, a Conditional Use
Permit is required.
Staff considers the proposed academy similar to an indoor recreational facility and is supportive
of its approval. Additionally, a smaller facility of this size at this location does not represent a
threat to public health, safety, or welfare and may be accommodated with the existing on-site
improvements.
Size of Business: The establishment is proposed to occupy 1,088 square feet of the existing
building area. The recommended Conditions of Approval prohibits any expansion of the
business lease area of more than 1,100 square feet.
Building Design: No architectural changes are proposed with the establishment of this business.
Landscaping: The existing landscaping in the parking area and around the building will remain
and is not impacted by this proposal.
Operational Hours: The applicant's description indicates that the operational hours will be from
Monday through Sunday, from 8:00 a.m. to 9:00 p.m. The recommended Conditions of
Approval require that the business hours not extend beyond 7 a. m. to 11:00 p.m. A Conditional

Use Permit must be obtained from the Planning Commission for late night operations past 11:00
p.m.
Parking: The site plan shows the location for 79 parking spaces which satisfies the parking
requirement of 79 spaces for the entire building with retail uses at a parking ratio of 1:199. The
proposed use is expected to generate a parking demand that is customary to a commercial
building and will occupy a proportionate amount of the existing parking spaces. The increase in
the parking demand in the evenings for the proposed classes will not affect the availability of
parking because the parking demand for the other tenants is mostly during the day.
Site and Architectural Review Committee: The Site and Architectural Review Committee
reviewed this application at its meeting of December 8, 2001 and was supportive of the
proposed use at this location.

Eagle Talon Martial Arts Academy
Proposed hours of Operations: Monday through Sunday from 8AM until 9PM
Course Description: The course is designed and organized for efficient real world
self defense for children and adults. We will stimulate and foster physical as well
as mental growth through the practice of various types of martial arts. With a
strong basis in Hapkido, Judo, Tae Kwan Do, Kung Fu, and Kendo, we have
developed a program that is best suited for today's real world situations, our
overall well being, and piece of mind. Our program also provides the path to
attaining weight and health goals.
We have designed classes specifically for children, teenagers and adults. We
recognize that at every stage in development there exists a different need and
desired result. Whether it's for a child to gain the self-confidence to do well
academically or to allow women to feel safe in their own environment. We have
put together a program that is delivered in a fun and exciting format while
retaining the effectiveness of our art form.
Class Sizes: We will have public classes with a maximum of 10 students per
class, and private classes with a maximum of 3 students per hour.
Goals: Ultimately our goal is to inform and teach the public of the benefits of
practicing our form of martial art. We live here in Campbell and plan to settle
down here permanently and would like to contribute to the community we live in.
We plan to volunteer our services to the Campbell Police Department, as well as
the Santa Clara County Sheriff's Department.

Re: Conditional Use Permit for a Martial Arts Studio
Dear Sharon,
As per our conversation yesterday, please find attached a brief explanation
of the Martial Arts Studio's business who is proposing to lease space at 839 Hamilton
Ave., Suite B, consisting of 1,080 sf. Four (4) unreserved parking spaces are assigned to
the Tenant, however, there is an excess of parking throughout the day and evening within
the PD.
For example, on 11/13/01 at 7;30am there was 14 vacant regular spaces and all handicap
spaces were vacant. Today at 12:00 noon there was over 19 spaces vacant.
It is our intent here to have a preliminary meeting to ascertain the feasibility of obtaining
a successful approval of a use permit required by the City of Campbell for our prescribed
use. The client, Eagle Talon Martial Arts Academy does not wish to forfeit the $1,783
fee.

Eagle Talon Martial Arts Academy
Proposed hours of Operations: Monday through Sunday from 8AM until 9PM
Course Description: The course is designed and organized for efficient real world
self defense for children and adults. We will stimulate and foster physical as well
as mental growth through the practice of various types of martial arts. With a
strong basis in Hapkido, Judo, Tae Kwan Do, Kung Fu, and Kendo, we have
developed a program that is best suited for today's real world situations, our
overall well being, and piece of mind. Our program also provides the path to
attaining weight and health goals.
We have designed classes specifically for children, teenagers and adults. We
recognize that at every stage in development there exists a different need and
desired result. Whether it's for a child to gain the self-confidence to do well
academically or to allow women to feel safe in their own environment. We have
put together a program that is delivered in a fun and exciting format while
retaining the effectiveness of our art form.
Class Sizes: We will have public classes with a maximum of 10 students per
class, and private classes with a maximum of 3 students per hour.
Goals: Ultimately our goal is to inform and teach the public of the benefits of
practicing our form of martial art. We live here in Campbell and plan to settle
down here permanently and would like to contribute to the community we live in.
We plan to volunteer our services to the Campbell Police Department, as well as
the Santa Clara County Sheriff's Department.
Eagle Talon Martial Arts Academy should be granted this conditional use
permit from the City of Campbell on the grounds that this
Academy/educational facility will be a benefit to the community and to the
other tenants in this retail strip center.. The other tenants in this center will
also benefit from the drive-by exposure from Eagle Talon's customers,
which should be viewed as an asset and vital to their ongoing successful
business.
The Academy focuses a majority of its training for woman and children.
They will also assist in the community by offering a special police program.
The main focus of the training program is self-discipline, exercise and
mental preparedness, and not on the physical fighting.
Eagle Talon's Master Kim is well known and respected throughout the
community. This will also be a positive reflection on the City of Campbell.
Thus, there are many reasons to approve the conditional use permit for Eagle
Talon. The only possible issue would be parking, however, in this situation
it is not because the parking is more than ample and is clearly marked,
striped, and has very good and hardly used handicap parking.
