APN: 406 06 007 Dear Ms. Doh: In response to your facsimile of June 19, 2003 requesting a building rebuild letter regarding the referenced property please be advised of the following: The property at 920 South San Tomas Aquino Road is presently zoned P-D (Planned Development) and is shown on the General Plan as a Neighborhood Commercial land use designation. The existing residence on the property would be considered a non-conforming building and use based upon the Zoning and the General Plan. As such, section 21.64.050 of the Campbell Municipal code would govern its replacement due to fire or damage. This provision limits restoration to seventy-five percent of the cost of construction of a comparable new building as determined by the Building Official. A nonconforming building or structure which is damaged or partially destroyed by fire, flood, wind, earthquake, or other calamity or act of God or the public enemy to the extent that the cost of restoration does not exceed seventy-five percent of the cost of construction of a comparable new building (as determined by the building official) may be restored or reconstructed provided that such restoration is started within a period of one year and restoration completed one year thereafter. In the event such damage or destruction exceeds seventy-five percent of the cost of construction of a comparable new building (as determined by the building official) no repairs or reconstruction shall be made unless every portion of such building or structure is made to conform to all regulations in the district in which it is located. In accordance with the intent of Section 21.03.010(c) of this code, and notwithstanding any provisions to the contrary, a nonconforming building which equals or exceeds seventy. five feet in height shall be allowed to be reconstructed or restored if it becomes damaged or destroyed, in whole or in part, as the result of fire, flood, wind, earthquake, act of God or public enemy.
