I. RECITALS 1.I A b-?Sing Perm/t was requested to build ~ar'a.ge 31 Hunt Way 404-05-051 in a building located at , A.PN Campbell, California, hereby described in Exkibit "A" attached hereto; and 2001 1.2 On the 6th day of July , t~ , the City approved Permit No. , subject to certain conditions, including conditions that the Owner declare and record certain restrictions on the property; and 1.3 The Owner desires to construct improvements and has requested a building permit from the City, for that purpose. II. CO'¢ENANTS NOW, TH~REFOKE, m consideration of the mutual promises and agreements herein contained, the parties do agree as follows: 2.1 That the only [rnprovements permitted under this Agreement are those set forth in the City of Campbell Building Permit, which indicates: 2.2 .amy future improvements will require further permits. Such additional work done'u.uder requisite permits shall not requ/re amendment of this A~eement so long as the work is consistent with this agreement. 2.3 The restrictions.and conditions of which notice is hereby given are: a. The detached accessory building shall not be utilized for slewing purposes. b. Installation of any appliances for cooking, such as a stove or oven, microwave, hot plate, shall be deemed creation of a kitchen and therefore creation of an additional separate dwelling unit as defined in Sections 21.08.020D and 21.02.015 of the City Zoning Ordinance. c. Maintain at least one covered parking space aczess~ble to an automobile within the garage or carport, or as required by Ordinance Chapter 21.50. d. The property Owner consents to admit access to City Zoning Enforcement Officers upon reasonable notice of not less than twenty-four (24) hours for the purpose of inspecting the premises to ensure that the uses approved by Permit No. __ comply with the City building and zoning laws. BLD 2001-421 Violation of these resections shall constitute a violation of the City's Zoning Ordinance. No release, modification or elimination of these restrictions shall be valid unless notice thereof is recorded on the Land Records by the City of Campbell, unless the City's zoning law changes to permit the future use.
