Planning has reviewed the Parcel Map for 1418 Abbott Avenue, 1420 Juanita Way and 1440 Juanita
Way and determined that the Map substantially conforms to the Tentative Parcel Map prepared by
Marvin D. Kirkeby dated March 1999 that was approved on November 2, 1999 by the Director of
Community Development.
In general, please refer to the Conditions of Approval in the November 2, 1999 staff report. The
following conditions of approval from the Planning Department must be met prior to recordation:
1) All existing structures on Parcel 3, including the shed straddling the property line of Parcel 2,
shall be demolished or removed from the property.
2) A Park In-Lieu Fee of $8,242.50 is due prior to the Final Map. $2,747.50 is due prior to
occupancy by the Building Division for a new living unit constructed on site.
3) An accurate tree survey must be conducted by a certified arborist.
The conditions above do not include conditions of approval from any Division other than Planning.

DISCUSSION
Applicant's Proposal: The applicant is seeking approval of a Tentative Parcel Map to
create four (4) lots on property located at 1420 Juanita Way, 1440 Juanita Way and 1418
Abbott Avenue.

Background: The subject property consists of three existing lots on east side of Abbott
Avenue between Hacienda and Pollard Avenues. Each existing lot contains a single-
family home that will remain. One shed structure will be removed to accommodate the
new parcel configuration.
GENERAL PLAN AND ZONING CONSISTENCY
General Plan Designation: The proposed map would result in a density of 2.9 units per
gross acre, which is consistent with the low density residential range (Less than 3.5 units
per gross acre) of the General Plan.
Zoning Designation: The subject properties are zoned R-l-10 (Single Family
Residential). The R-1-10 Zoning District requires a minimum lot area of 10,000 square
feet, and a minimum lot width of 80 feet. The proposal is consistent with the standards of
the R-1-10 Zoning District and the San Tomas Area Neighborhood Plan as the lots of the
proposed subdivision range in size from 10,000 square feet to over 14,400 square feet and
maintain a minimum lot width of 80 feet.
ANALYSIS
Subdivision Design: The proposed 4-lot parcel map creates a new lot from a portion of
three existing lots. Two of the lots (Parcels 1 and 2) front Juanita Way, a residential cul-
de-sac. The new lot (Parcel 3) and Parcel 4 front on Abbott Avenue.
Street Design and Improvements: The subject property is located in the San Tomas
Neighborhood and is subject to the standards of the San Tomas Area Neighborhood Plan
(STANP). The city is currently reviewing street standards within the San Tomas
Neighborhood. Should the City Council adopt changes to the standards within 12 months
of Tentative Map approval, street improvements and land dedication shall be made in
accordance with the new standards.
Tree Preservation: The site maintains several mature trees and vegetation. There are no
immediate plans to remove the trees as a result of the subdivision. However, when the
site develops, trees will be removed. Upon development, the site is subject to all
requirements of the Tree Protection Regulations within the Campbell Municipal Code
Chapter 21.56, the San Tomas Area Neighborhood Plan, and the Water Efficient
Landscape Guidelines. As a condition of approval, staff is recommending that a tree
survey and appraisal must be submitted to the Director of Community Development prior
to the recordation of the final map.

SITE DESIGN

LANDSCAPING
Tree Preservation: Prior to final map approval, the applicant shall submit a tree
inventory and preservation plan for review and approval by the Community
Development Director. A mitigation plan shall be included with the tree report for
all trees over eight inches in diameter that will be removed. Any trees designated for
removal shall be replaced in kind at a 1:1 ratio. If the infill of the lots sufficiently
changes the existing grade of the lots, tree protection measures must be identified in
the report to preserve existing trees during and after grading and construction.

Property Maintenance: Parcel 3 shall be maintained free of any combustible trash,

Park In-Lieu Fee: Applicant to pay a fee in-lieu of park dedication up to $43,960 (4
lots ~ $10,990 per lot). Existing legally constructed units within the proposed
subdivision shall be counted as a credit against the fee or dedication requirements.
75% of the fee is due prior to the Final Parcel Map. 25% of the fee is due prior to
occupancy by the Building Division for each single-family dwelling constructed on
site.
PUBLIC WORKS DEPARTMENT
Tentative Parcel Map: The applicant shall submit a Tentative Parcel Map for
consideration by the City. The current application processing fee is $2,150.

Parcel Map Requirements: Prior to issuance of any building permits for the site, the
applicant shall submit a Final Parcel Map for recordation upon approval by the City.
The current plan check fee is $1,060 plus $25 per parcel.
Preliminary Title Report: Prior to recordation of the Parcel Map, the applicant shall
provide a current Preliminary Title Report.
10. Easements: All existing and proposed easements must be shown on the tentative
parcel map.

Monuments: Prior to recording the Parcel Map, applicant shall provide security
guaranteeing the cost of setting all monuments as shown on the record map, as
determined by the City Engineer.
12.
Street Improvements: The applicant shall install all street improvements and
comply will all dedication requirements in accordance with the San Tomas Area
Neighborhood Plan (STANP). The city is currently reviewing street standards
within the San Tomas neighborhood. Should the City Council adopt changes to the
standards within 12 months of Tentative Map approval, street improvements and
land dedication shall be made in accordance with the new standards. The applicant
shall post any necessary sureties as required by the City Engineer to ensure
implementation of this requirement.

Underground Utilities: All new on-site utilities shall be installed underground per
Section 20.36.150 of the Campbell Municipal Code for any new or remodeled
buildings or additions. Applicant shall comply with all plan submittals, permitting
and fee requirements of the serving utility company.
Utility Installation Plan: Prior to issuance of building permits for the site, the
applicant shall submit a Utility Installation Coordination Plan and Schedule for
approval by the City Engineer for installation of street improvements and/or
abandonment of all utilities. Streets that have been resurfaced within the previous 5
years will require boring and jacking for all new utility installations. Applicant
shall also prepare pavement restoration plans for approval by the City Engineer
prior to any utility installation or abandonment.
Maintenance Security: Prior to issuance of occupancy approval for the site, all
public street improvements required by the street improvement agreement and the
encroachment permit must be completed and accepted by the City and the applicant
must provide a one-year Maintenance Security in an amount of 25% of the Faithful
Performance Bond.
Grading and Drainage Plan: Prior to issuance of any grading or building permits
for the site, the applicant shall conduct hydrology studies based on a 10 year storm
frequency, prepare an engineered Grading and Drainage Plan, and pay fees required
to obtain necessary grading permits. The plans shall comply with the 1994 edition
of the UBC including Chapters 18, 33, and Appendix Chapter 33. Should the
development require hauling of soil or other demolition materials on or off site, the
applicant shall request and obtain approval of a haul route from the City Engineer.
Storm Drain Area Fee: Prior to recordation of the Parcel Map, the applicant shall
pay the required storm drainage area fee, which is $2,000 per acre unless previously
paid.
Santa Clara Valley Water District (SCVWD): Prior to recordation of the Parcel
Map, the applicant shall obtain a clearance from the SCVWD and shall comply
with any requirements.
Storm Water Pollution Prevention Measures: Prior to issuance of any grading or
building permits, the applicant shall comply with the National Pollution Discharge
Elimination System (NPDES) permitting requirements and the California Storm
Water Best Management Practices handbook prepared by the Storm Water Quality
Task Force, Santa Clara Valley Water District and the City of Campbell Municipal
Code regarding Storm Water Pollution Prevention.

I have advised Marv Kirkeby to contact you directly regarding the Abbott project, as the
preapplication submittal by him does not indicate the Water District line, which Public Works
informs me is underground along the lot line which is to be moved. I have not yet received
comments from Public Works regarding whether any changes to the ROW improvements are to be
required, and will pass those on to you when I receive them, as they may affect your line. Please
forward a copy of your comments to me for our file.

This is adjacent to the Los Gatos Creek.
Bruce Johnson, architect, will be contacting you soon regarding this project. There are two
particular aspects for which I need your comments:
The location of the retaining wall at the rear of 186 Gilman. Our records indicate that the
location of the retaining wall was approved by the City quite a ways inside the rear property
line, and that no landscaping was required due to a considerable number of mature trees being
located between the wall and the creek, on the applicant's property (see attached site plan). Our
Building Department has on file a permit for a retaining wall, but no site plan indicating its
location.
The wall was not built per the attached plan, but is located on the rear property line, which, of
course, resulted in all the trees being removed. What do your records show regarding the
location of the retaining wall? The applicant indicated the change in location was made at the
request of the District. However, there are many violations on this property (about 6,000 square

feet of additional building construction without permits, etc.) that we want to correctly indicate
them to the Commission and Council in our reports.
Due to the height and location of the retaining wall relative to the trail and to the topography of
the adjacent parcels (see aerial photo), this wall stands out to persons using the Los Gatos Creek
Trail. We would therefore like the applicant to have it covered in a drought-tolerant vine, such
as creeping fig, and to plant trees along it next to the Trail. Both of these types of plants would
need to be on District property 9if the wall stays). What are the District's policies regarding
the types of plants, irrigation, procedure to be followed in the review of
landscape/irrigation plans, and in the planting. What is the timeline for this?

match those on the assessor map for the "existing"; also western border of Parcel 1 at the SW comer (at the FL, EC
239.82) does not appear to meet the proposed property line in a straight line, but in a jog.
