Zoning Letter - 2000 CITY OF CAMPBELL Community Development Department November 17, 2000 Michael J. Callahan President, Callahan Properties 289 Wright Brothers Avenue Livermore, CA 94550 Dear Mr. Callahan, This letter is in response to your inquiry regarding the uses that would be allowed on your property at 181 Kennedy Avenue in Campbell. Currently, the property is zoned M-1 (Light Industrial) and the General Plan designation for the property is Industrial. As you can see in the enclosed M-1 Zoning Ordinance, automobile repair is an allowed use in the district as well as the manufacturing or fabrication of goods and merchandise. These uses must be conducted entirely within an enclosed building. However, these and other uses are prohibited in the M-1 district if they are "offensive or obnoxious or create a nuisance to the area by reason of the emissions of dust, fumes, glare, heat, liquids, noise, odor, smoke, steam, vibrations, or similar disturbances." In short, the use is allowed as long as it is contained entirely within a building and does not produce any of these associated impacts. If the General Plan designation were to change to Medium-Density Residential, the existing auto repair use of the property would be considered a legal non-conforming use, as long as the business is contained completely within the building and is not producing any of the impacts listed above. The use would be allowed to continue, but not expand or intensify operations, as explained in the enclosed section of the City Municipal Code on Non-Conforming Uses. In reviewing your description of the existing and proposed uses, the Community Development Director has determined that based on the type of equipment used in the business of metal fabrication, it would represent a more intense use of the property than the current auto repair business. This intensification of uses would not be permitted under the new General Plan designation. I hope this information is useful. Currently, the building is occupied by Allen's Automotive, who is my tenant. The business is that of general auto repair; tire sales and related uses. The yard area is used for parking and miscellaneous repair functions. The building itself is approximately 4,000 square feet. I have a potential new tenant, which is that of a metal fabricator. Metal fabricators weld, bend steel and generally make custom steel products for a variety of businesses. The yard area would be used for storage of steel products and vehicle parking for his fleet of trucks. This use is not a foundry - all steel products are purchased from outside vendors. I look at the metal fabricator as a less intensive use than that of the automotive use. Please respond to me in writing whether or not a metai fabricator wouid be a ciiy- approved use for my building with its current zoning, as well as the proposed new zoning.
