Dear Ms. Meyer,
Thank you for your preliminary application for the conversion of existing breezeway to living space
in an existing apartment complex located at 60 W. Latimer Avenue. The existing apartment
complex is a non-conforming use since the number of existing units in the complex exceeds the
number of units allowed by the Campbell General Plan and the R-3 Ordinance of the Campbell
Zoning Code. A non-conforming use of a building may not be expanded or extended into any other
portion of the building under Section 21.66.030 of the Campbell Municipal Code. Therefore, the
proposed project cannot be approved.
Zoning/General Plan Designation
The project site is zoned R-3-S (Multiple Family Residential). The General Plan designation is high
density residential (21-27 units per gross acre). The existing apartment complex exceeds the
maximum density allowed under the General Plan since the current density is 30.1 units per ~oss
acre.
Lot Area and Number of Units
Multiple family residential lots having an area greater than eight thousand square feet may be.
developed at a ratio of four units for the first eight thousand square feet, and one thousand six
hundred square feet for each additional unit in the R-3 Ordinance. Staff's calculations of the
allowable units for this property results in only 27 units allowed under the current Zoning Code.
This calculation is based on a net lot area of 45,940 square feet. Therefore, the existing number of
units (36) exceeds the maximum allowed under the R-3 Ordinance.
Parking
The Campbell Municipal Code requires the following parking spaces for multiple-family residential
units:
One bedroom unit: i-1/2 spaces/unit, one of which must be covered.

Two or more bedroom units: 2 spaces/unit, one of which units must be covered.
In addition to parking required above, a designated guest parking space must be provided for each 5
units or fraction thereof and a handicapped space must be provided for each 40 units or fraction
thereof.
These requirements result in a total parking demand of 74 total spaces, of which 36 would need to
be covered. The current number of parking spaces provided does not fulfill this requirement.

Currently, the building has a breezeway running between the two apartments. Our plan will
enclose the breezeway and turn it into a third bedroom and an extra bathroom for two of the
