construction with approved building plans at 507 McGlincey Lane (Building
Permit No. 95-937)
Dear Ms.. Baymiller
The Community Development Department is in receipt of a Certificate of Deposit
(Wells Fargo Bank--CD No. 1514-084946-000) you have submitted in the amount of
$5,000 for the purpose of insuring the completion of construction and improvements on
your property located at 507 McGlincey Lane in accordance with the approved plans
for which you have received a building permit (Building Permit No. 95-937). The
Certificate of Deposit has been submitted to allow conditional occupancy of the
recently reconstructed dog grooming salon prior to the full completion of
improvements required to bring the property into compliance with the Building
Division and Planning Division requirements.
The conditions under which occupancy will be granted by the Planning Division for the
dog grooming salon is based upon completion of the construction and improvements on
site in accordance with the approved building plans within six (6) months from this
date, which is January 10, 1997. The following are the conditions:
Upgrading of the illegal storage shed located at the rear of the property to meet
requirements set forth by the Building Official. This structure is permitted solely as
a storage building in accordance with the M-1-S (Light Industrial) zoning
regulations. Based upon interpretation by the City Attorney, a storage building is
permitted within the M-1-S zone; however, such a structure is not to be used in
conjunction with the dog grooming business as additional storage area or as an
accessory structure for residential use.
Removal of the kennels and kennel structures adjacent to the illegal storage
building. Only two (2) kennels shall be allowed to be maintained which are located
adjacent to the main residence on the west side of the property.
3. Removal of the two storage sheds (8' x 8' shed and 10' x 10' shed) on the west side
of the property.

In addition to the above-referenced site improvement related conditions, the following
condition must also be observed:
The existing residence may be maintained for residential use in accordance with
Section 21.64 (Non-conforming buildings) and Section 21.66 (Non-conforming uses)
of the Campbell Municipal Code. Should the use of the house as a residence become
abandoned or discontinued for a continuous period of one year and/or more, the use of
the structure shall no be re-established and must then comply with the M-1-S (Light
Industrial) zoning designation regulations. In addition, the structure itself may not be
moved, altered, enlarged; exceptions include maintenance, repair and minor alterations
which require no structural alterations.

Enclosed is the project schedule as you requested. Also enclosed is a copy of
the scope of work as issued by myself and the City of Campbell.
The scope of the project has not been altered and the project is still underway.
A large portion of the construction tasks have been completed but to further
the project, I must move onto the next phase which includes the occupancy of
the new salon building.
In order to raise the structure and rework the existing footing, I must have the
building clear. Mrs. Baymiller cannot conduct her business in the building
while construction is underway.
We are presently working on the site development portion of the project which
includes the landscaping, driveway and parking. Expect completion in August.
As soon as I am allowed to relocate Mrs. Baymiller to the new salon, I can begin
the rework of the storage building. I wish to meet all of your demands but
during our phone conversation I felt the demands were unobtainable. I do not
see a way to complete the site development, relocate a business, raise and
rework a building in three months. I hope the enclosed schedule offers some
understanding in the task at hand.
If the Planning Department decides to require a performance bond, I would
have to leave the project and Mrs. Baymiller would need to solicit another
contractor. My company is small and non-union, we would not be bondable
by most surety companies.
If allowed to relocate Mrs. Baymiller this week, I feel confident that I can fully
complete the 7PC of thI project before December.
SCOPE OF WORK
The primary scope of this project is to make alterations to the salon building. The
secondary scope of this project is to make alterations to the house, storage building,
grounds and kennels.
The General Grounds alterations consist of:
Installation of driveway/curb approach
~"Installation of safety bollards adjacent to back flow station
Asphalt seal coat on drive and parking area
~" General area landscaping
The Salon alterations consist of:
~ New slab building foundation
~' Rework of existing walls and sheet rock.
~' Insulation of the exterior walls and ceiling

The Planning Division has reviewed thc revised plans for 507 McGlinccy Lanc and is ready to
approve the plans based upon determination of the following for the non-conforming uses and
structures:
The residence may be maintained for residential use in accordance with Section 21.64
(Non-conforming buildings) and Section 21.66 (Non-conforming uses) of the
Campbell Municipal Code. Should the use of the house as a residence become
abandoned or discontinued for a continuous period of one year, the use of the stmcmm
shall not be m-established and must then comply with the M- 1-S (Light industrial)
zoning designation regulations. In addition, the smcmre itself may not be moved,
altered, or enlarged; exceptions include maintenance, repair and minor alterations which
require no smactural alterations.
Upgradin~of the dog grooming salon (former garage) building for the non-conforming
use of the dog grooming business. The salon building (which was converted prior to
incorporation into the City) and replacement restroom shall not be moved, altered or
enlarged subsequent to the upgrading of the building to meet requirements set forth .by
the Building Official. Exceptions will include maintenance, repatr and minor alterauons
which require no structural alterations.
Removal of the kennels and kennel stmmn'es adjacent to the illegal storage building and
the two storage sheds (8' x 8' shed and 10' x 10' shed) on the west side of the
property.
Maintenance of two kennels for drying of dogs only on the west side of the property.
Property owner has stated that there will be no bording of dogs at this facility.
Upgrading of the illegal storage building located in the rear portion of the prop .e~'ty.to,
meet requirements set forth by the Building Official. This structure is pennittea sorely

regulations. Based upon interpretation by the City Attorney: a storage building is

the non-conforming uses would constitute enlargement of the non-conforming uses.
