Sunnyoaks Ave, Suite #202 Campbell,CA 95008 Re: Building Permit Plan Check Comments - BLD 2002-208 Addition to Existing Single-family Residence Dear Mr. Helmonds: The Planning Division has reviewed your building permit submittal for a proposed first and second story addition to an existing single-family residence at 1181 Monica Lane. The setback requirement for a side yard is the greater of five feet, or one-half the height of the building wall adjacent to the property line. Staff's calculation of the wall height is 18 feet, 6 inches, measured from the natural grade to the plate height (see attached handout). The required setback would therefore be 9 feet, 3 inches. Your plans provide a setback of only 6 feet, with the second floor building wall extending vertically from the existing first floor building wall. Staff strongly recommends that you revise your plans to provide the required setback. However, under Section 21.08.070 of the Campbell Municipal Code, the Planning Commission may approve a minimum sideyard setback of five feet for buildings proposed for a second story addition, when it finds: 1. That said sideyard will not be detrimental to the health, safety, peace, comfort or general welfare of persons in the neighborhood, or the city as a whole; and 2. That said sideyards will not unreasonably interfere with the ability of adjoining property owners to enjoy access to sunlight, air, privacy and quiet enjoyment of such owner's property. An application is enclosed that provides additional information on the process of applying for a Modification to the Side Yard Setback Requirement.
