At the regular meeting of June 7,2005, the City Council held a public hearing to

2005-16) to allow the installation of a 122 square foot wall sign, incorporating the
findings and subject to the Conditions of Approval.

At the regular meeting of June 7, 2005, the City of Campbell City Council held a public
hearing to consider your application, on behalf of the Professional Culinary Institute, for a
Sign Application (PLN 2005-16) to allow an expressway-oriented sign on property, owned
by Mr. Scott Cooley, located at 700 W. Hamilton Avenue in a C-2-S (General
Commercial) Zoning District.
After hearing public hearing, and following Councilmember discussion and deliberation,
the City of Campbell City Council adopted Resolution No. 10518 approving an
expressway-oriented sign (pLN 2005-16) to allow the installation of a 122 square foot wall
sign, incorporating Findings and subject to the attached Conditions of Approval. A
certified copy of this Resolution is attached for your records.
Please note that the time within which judicial review of this action must be sought is
governed by Section 1094.6 of the California Code of Civil Procedure, unless another
statute (such as California Government Code Section 65009 or some other applicable
provision of law) sets forth a more specific time period.

BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CAMPBELL APPROVING A SIGN APPLICATION (PLN2005-16) TO
ALLOW AN EXPRESSWAY ORIENTED SIGN ON PROPERTY
OWNED BY MR. SCOTT COOLEY LOCATED AT 700 W.
HAMILTON AVENUE IN A C-2-S (GENERAL COMMERCIAL)
ZONING DISTRICT. APPLICATION OF MR. RICHARD BATTISTA,
ON BEHALF OF THE PROFESSIONAL CULINARY INSTITUTE.

After notification and public hearing, as specified by law and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the City Council did find as follows
with respect to application PLN2005-16:
1. The proposed expressway-oriented sign is limited to identification of an on-site
business located on the project site.
2. The applicant has demonstrated that the business operation is dependent upon
expressway identification and tt:1at denial of said identification would cause an undue
hardship.
3. The school is situated in a building with limited locations to place signage due to the
building design. The building design has significant glazing surfaces that limit the
wall surface that could accommodate a wall sign.
4. The applicant has demonstrated that the signage is similar to other similarly situated
businesses in the area.
5. The proposed expressway-oriented sign would best serve the public welfare and is
necessary to provide adequate visibility from San Tomas Expressway.
6. The height and sign area are the minimums necessary to provide adequate
identification for the business due to it location on the building and distance to the
traveling public. The building is situated 96 feet from the West Hamilton frontage and
approximately 150 feet to San Tomas Expressway.
7. The proposed sign, as conditioned, is architecturally compatible in design and
consistent with other building signage. The letter size is similar in style and size to
the other building wall sign identifying 'Gold's Gym'.
8. The proposed sign is architecturally compatible with the building in terms of color,
style and design and would be constructed of high quality durable materials. The
provision of a raceway to match the wall colors and the provision of individual
channel letters presents a sign that is less obstructive than a cabinet sign. Limiting
the color of the sign letters to two colors results in a simpler more refined
appearance to the sign.

9. The project qualifies as Categorically Exempt project under Section 15311, Class 11
of the California Environmental Quality Act (CEQA), pertaining to the construction of
new on-premise signs.
Based on the foregoing findings of fact, the City Council further finds and concludes
that:
1. The proposed sign is consistent with the purposes of the Sign Ordinance by
preserving and improving the visual character of the community.
2. The proposed sign would not be detrimental to the public welfare or persons in the
neighborhood or the City as a whole and allows for reasonable business
identification.
3. The proposed signs will promote the economic viability of the City by providing
adequate identification and visibility of the business, and will also best serve the
public welfare and be in keeping with the principles and purposes of the City's Sign
Ordinance.
4. No substantial evidence has been presented from which a reasonable argument
could be made that shows that the project, as currently presented and subject to the
required conditions of approval, will have a significant adverse impact on the
environment.
5. There is a reasonable relationship and a rough proportionality between the
conditions of approval and the impacts of the project.
NOW, THEREFORE, BE IT RESOLVED that the City Council approves a Sign
Application (PLN2005-16) to allow an expressway oriented sign on property owned by
Mr. Scott Cooley located at 700 W. Hamilton Avenue in a C-2-S (General Commercial)
Zoning District.
Where approval by the Director of Community Development, City Engineer, Public
Works Director, City Attorney or Fire Department is required, that review shall be for
compliance with all applicable conditions of approval, adopted policies and guidelines,
ordinances, laws and regulations and accepted engineering practices for the item under
review. Additionally, the applicant is hereby notified that he/she is required to comply
with all applicable Codes or Ordinances of the City of Campbell and the State of
California that pertain to this development and are not herein specified.

location submitted for building permits shall substantially conform to the project
plans stamped as received by the Planning Division on February 24, 2005. The
permit allows the placement of an individual channel letters reading 'Professional
Culinary Institute' measuring 2 feet x 56 feet and a three foot logo on a four-foot
raceway.
2. Development Approval Expiration: The Sign approval shall be valid for one year
from the date of City Council approval. Within this one-year period a building permit
must be issued or the Sign Approval shall expire and be deemed void without further
notification by the City.
3. Siqn Maintenance: The sign shall be maintained in good condition at all times and
shall be repaired as necessary.
Building Division:
4. Permits Required: A building permit application shall be required for the proposed
sign. The building permit shall include Electrical/Plumbing/Mechanical fees when
such work is part of the permit. Prior to performing any work, the applicant shall
make application to, and receive from, the Building Division, all applicable
construction permits.

TITLE

CITY COUNCIL ACTION
The Planning Commission recommends that the City Council take the following action:
1. Adopt a Resolution approving an expressway oriented sign (PLN2005-16) to allow
the installation of a 122 square foot wall sign, incorporating the attached findings and
subject to the attached conditions of approval.
ENVIRONMENTAL DETERMINATION
The project qualifies as Categorically Exempt project under Section 15311, Class 11 of
the California Environmental Quality Act (CEQA), pertaining to the construction of new
on-premise signs.
BACKGROUND
Applicant's Proposal: The applicant is requesting approval of a building wall sign that is
oriented to San Tomas Expressway and a sign exception to permit a sign larger than 50
square feet. The proposed sign measures 122 square feet in area and is situated on the
east elevation that faces San Tomas Expressway. The subject property is located at the
southwest corner of West Hamilton Avenue and San Tomas Expressway.
The individual channel letter sign is proposed to be placed on the third story parapet of
the commercial building and reads 'Professional Culinary Institute' and includes a three
foot diameter logo. An existing sign for Gold's Gym is situated on the north elevation
facing Hamilton Avenue precluding the placement of a sign on this elevation. The
request is before the City Council due to the orientation of the proposed sign towards
the expressway.
ANALYSIS
General Plan DesiQnation: The General Plan land use designation for the project site is
Commercial. The project use and proposed sign is consistent with the General Plan
Land Use Element.
ZoninQ DesiQnation: The current zoning designation for the project site is C-2-S
(General Commercial). The proposed project will be consistent with the C-2-S Zoning
District with approval of a Sign Permit.

Sian Ordinance: The applicant is requesting approval of an expressway oriented sign.
The proposal for an expressway oriented sign requires approval of a sign permit by the
City Council upon a recommendation of the Planning Commission. Other freeway and
expressway oriented signs in the community have include the following:
. Fry's Electronics
. Pruneyard Inn
. Campbell Inn
. Larkspur Landing
Other approved signs, not yet installed include but approved are; Kohl's and the
Campbell Gateway Suites signs
The Campbell Municipal Code (CMC) regulates the placement of signs on private
property. The following portions of the sign code are relevant to freeway or expressway
oriented signs:
E. Freeway-oriented signs. Signs oriented to freeways or expressways shall comply with
the following standards:
1. Permanent signs oriented to freeways or expressways shall be limited to identification of
on-site businesses.
2. The applicant shall demonstrate that the business operation is dependent upon freeway
or expressway identification and that denial of adequate identification would cause an
undue hardship.
3. The applicant shall demonstrate that a freeway-oriented sign is necessary due to limited
visibility of the parcel due to its shape and location or other factors unique to the site.
4. The sign shall be the minimum height and size necessary to achieve visibility from the
freeway, expressway, or public facility as determined by the decision making body.
5. Additional landscaping and/or architectural details/elements may be required to be
added as a condition of approval to ensure a well-designed sign, screen the sign's
supporting structure, or to soften and/or enhance the appearance of the sign or the site as
viewed from off-site locations.
The applicant has submitted the attached letter justifying their sign request.
The Planning Commission, at its meeting of April 26, 2005, forwarded a
recommendation to the City Council by a 4-1-1-1 vote (one commissioner voting no, one
absent and one abstaining) to approve the application.
The Planning Commission believe~ that the proposed sign complies with the criteria for
the following reasons:
1. The proposed sign identifies the on-site cooking school.
2. The nature of the cooking school has a business clientele that caters to regional and
national visitors and students that are unfamiliar with the area.

3. The architectural style of the building provides a limited sign surface for displaying
signage on the front elevation.
4. The front building elevation is framed with larger mature trees that limit the visibility of
signage on the elevation facing Hamilton Avenue and another tenant occupies the
center location on the building; and
5. The proposed individual letters are a similar style and size to other signs on the building
thus providing architectural compatibility.
The proposed sign depicts the use of two (2) foot high individual channel letters reading
'Professional Culinary Institute' and a three foot circular logo. The raceway matches the
height and color of the building parapet. The sign area measures 122 square feet and
the applicant has submitted two color schemes. The Planning Commission
recommended approval of the two color scheme concept.
ALTERNATIVES
1. Approve the proposed project subject to additional and/or modified conditions of
approval.
2. Deny the proposed project.
3. Continue for further review.

. Advised that the applicant is seeking approval of an expressway-oriented sign along the
eastern elevation of the building at 700 W. Hamilton Avenue where tenant improvements
are underway to house the Professional Culinary Institute on the third floor.
. Described the surrounding uses as the Riverside Plaza Shopping Center to the north; San
Tomas Expressway to the east, residential and commercial uses to the south and
commercial uses to the west.
. Reminded that expressway-oriented signs must be approved by Council upon
recommendation from the Planning Commission.
. Explained that the building design limits wall signs due to extensive use of glass. The front
elevation has a sign for Gold's Gym.
. Reported that revised findings have been provided this evening.
. Recommended that the Commission forward a recommendation of approval to Council.
Chair Gibbons asked about other similar signs such as for Fry's and Home Depot. Are there
any comparisons available?
Associate Planner Tim J. Haley said that each building is unique as to size and style. There is
a much larger sign at Home Depot. However, signs are tied proportionately to their buildings.
This proposed sign is consistent with the Gold's Gym wall sign.

Chair Gibbons asked if this business is included on the freestanding sign as well.
Associate Planner Tim J. Haley advised that there is a 50 square foot sign for the entire multi
tenant building.
Commissioner Roseberry presented the Site and Architectural Review Committee report as
follows:
. SARC reviewed this project on April 12, 2005.
. Pointed out that this business has lots ofletters in its name.
. Said that SARC was supportive of this request using two colors rather than the originally
proposed three colors.
Chair Gibbons asked if the square footage includes the logo.

· Said that she is not supportive of this request as this sign is too large and fills the entire
fayade distance between the windows and the roof.
. Suggested that this sign could be made smaller.

· Pointed out that since this business is a school and does not solicit business from passing
traffic such as retail and restaurant uses do, he too has problems with the size of this sign as
it seems very large.
. Suggested that a more modest sign would do the job.
Commissioner Roseberry:
· Reminded that this business has a big long name that is impressive and sounds good.
· Stated his support of recognizing this community asset.
· Pointed out that the students of this school may be in the area for the first time.
Chair Gibbons reminded that revised findings were distributed as a table item.

that this project be deemed Categorically Exempt under CEQA.

· Advised that the applicant is seeking approval of a Use Permit for a single-story multi-
tenant building that was constructed in 1947 in Downtown Campbell.
· Explained that there are three tenant spaces in this building. One space is occupied by
Cardiff Lounge, the second by a restaurant and the third space is retail.
· Advised that a Use Permit is required to allow operations after 11 p.m. or prior to 6 a.m.
. Said that the Zoning is C- 3.
· Informed that the applicant seeks hours to 11 p.m. from Sunday to Wednesday and to 3
a.m. from Thursday to Saturday. Staff is recommending hours to 2 a.m. as there are no
other businesses operating beyond 2 a.m. in the Downtown. The Redevelopment Agency
agrees with staff's recommendation.
· Recommended approval and advised that this applicant is participating in the
Redevelopment Agency's Storefront Improvement Program.
Chair Gibbons asked about an outdoor patio area depicted on the plans.
Planner Stephanie Willsey advised that outdoor seating issues are handled at staff level for the
Downtown.

1bis letter is submitted in support of the Professional Culinary Institute's request for a
variance for signage to be placed on the east face of the building located at 700 West
Hamilton Avenue. This request is supported by the following facts;
1. The Professional Culinary Institute, based on the marketing and business plan
which has been established, will very quickly become a regional and soon, a
national destination. This supposition is well supported by the popularity of the
type of programs being offered. This being the case it will be important to have
good visibility and help visitors, who are unfamiliar with the area. find the
location easily and leave them with a positive impression of the City of Campbell
and the ease in which they can navigate through the area.
2. The north face of the building currently has signage belonging to an existing
tenant of the building and is not avai1able. In addition the presence of existing
mature foliage does not leave any additional space on this elevation.
3. There is a precedent for such a variance, as the Larkspur Landing Hotel currently
has signage on their west face, which faces San Tomas Expressway.
4. The Sign designer has addressed all issues ofletter size and sign size so as to
balance visibility and aesthetics issues that are of concern to the City
Development Department.

Background: The Planning Commission approved a Conditional Use Permit to allow the
establishment of a culinary school within the third floor 19,153 square feet of the existing
commercial building. The applicant is requesting approval of a 122 square foot sign on the east
elevation of the building that faces San Tomas Expressway. The first and second floor of the
building are occupied by a fitness facility (Gold's Gym) and a communications school (College
of Communications).
ANALYSIS
Sign Regulations: The proposal for an expressway oriented sign requires approval of a sign
permit by the City Council upon a recommendation of the Planning Commission. Other freeway
and expressway oriented signs in the community include the following:

. Larkspur Landing
The Campbell Municipal Code (CMC) regulates the placement of signs on private property. The
following portions of the sign code are relevant to freeway or expressway oriented signs:
E. Freeway-oriented signs. Signs oriented to freeways or expressways shall comply with the
following standards:
I. Permanent signs oriented to freeways or expressways shall be limited to identification of on-
site businesses.
2. The applicant shall demonstrate that the business operation is dependent upon freeway or
expressway identification and that denial of adequate identification would cause an undue
hardship.
3. The applicant shall demonstrate that a freeway-oriented sign is necessary due to limited
visibility of the parcel due to its shape and location or other factors unique to the site.
4. The sign shall be the minimum height and size necessary to achieve visibility from the
freeway, expressway, or public facility as determined by the decision making body.
5. Additional landscaping and/or architectural details/elements may be required to be added as a
condition of approval to ensure a well-designed sign, screen the sign's supporting structure, or to
soften and/or enhance the appearance of the sign or the site as viewed from off-site locations.
The applicant has submitted the attached letter justifying their sign request.
Staff believes that the proposed sign complies with the criteria for the following reasons:
1. The proposed sign identifies the on-site cooking school.
2. The nature of the cooking school has a business clientele that caters to regional and
national visitors and students that are unfamiliar with the area.
3. The architectural style of the building provides a limited sign surface for displaying
signage on the front elevation.

4. The front building elevation is framed with larger mature trees that limit the visibility of
signage on the elevation facing Hamilton A venue and another tenant occupies the center

thus providing architectural compatibility.
The proposed sign depicts the use of two (2) foot individual channel letters reading 'Professional
Culinary Institute' mounted on a four (4) foot raceway and a three foot circular logo. The
raceway matches the height and color of the building parapet. A raceway is required due to the
concrete construction of the building. The sign area measures 122 square feet and the applicant
has submitted two color schemes. One scheme has red and burgundy color letters and the other
scheme has red, burgundy and green colored letters. The building frontage measures 167 feet
along this building elevation.
Staff is recommending the two color scheme to provide a simpler more refined appearance.
Site and Architectural Review Committee: The Site and Architectural Review Committee
reviewed this application on April 12, 2005. The Committee was supportive of the proposed sign
and concurred with the recommendation to have only two letter colors.

The Planning Commission finds as follows with regard to File No. PLN2005-16:
I. The proposed expressway-oriented sign is limited to identification of an on-site business
located on the project site.
2. The applicant has demonstrated that the business operation is dependent upon
expressway identification and that denial of said identification would cause an undue
hardship.
3. The school is situated in a building with limited locations to place signage due to the
building design.
4. The applicant has demonstrated that the signage is similar to other similarly situated
businesses in the area.
5. The proposed expressway-oriented sign would best serve the public welfare and is
necessary to provide adequate visibility from San Tomas Expressway.
6. The height and sign area are the minimums necessary to provide adequate identification
for the business due to it location on the building and distance to the traveling public.
7. The proposed sign, as conditioned, is architecturally compatible in design and consistent
with other building signage.
8. The proposed sign is architecturally compatible with the building in terms of color, style
and design and would be constructed of high quality durable materials.
9. The project qualifies as Categorically Exempt project under Section 15311, Class 11 of

Based on the foregoing findings of fact, the Planning Commission further finds and concludes

PROPOSAL
The applicant is requesting approval of a building wall sign that is oriented to San Tomas Expressway.
The proposed sign measures 112 square feet in area and is situated on the east elevation that faces San
Tomas Expressway. The individual channel letter sign is proposed to be placed on the third story
parapet of the commercial building and reads 'Professional Culinary Academy.' Another sign is
situated on the north elevation on the third story parapet identifying Gold's Gym. The request is before
the Planning Commission due to the size and orientation of the sign.
The subject property is located at the southwest comer of West Hamilton Avenue and San Tomas
Expressway. The property is surrounded by the following uses:

The site is currently improved with a three story commercial building that is occupied by Gold's Gym,
a Communications School and the Professional Culinary Institute that is under construction.
The project site is located in a C-2-S (General Commercial) Zoning District and is shown as a General
Commercial land use designation on the General Plan.
BACKGROUND
The Planning Commission approved a Conditional Use Permit to allow the establishment of a culinary
school within the third floor 19,153 square feet of the existing commercial building. The applicant is
requesting approval of a 112 square foot sign on the east elevation of the building that faces San
Tomas Expressway. The first and second floor of the building are occupied by a fitness facility (Gold's
Gym) and a communications school (College of Communications).
ANALYSIS
The proposal for an expressway oriented sign requires approval of a Sign permit by the City Council
upon a recommendation of the Planning Commission. Other freeway and expressway oriented signs in
the community include the following:

The Campbell Municipal Code (CMC) regulates the placement of signs on private property. The
following portions of the sign code are relevant to freeway or expressway oriented signs:
E. Freeway-oriented signs. Signs oriented to freeways or expressways shall comply with the following
standards:
I. Permanent signs oriented to freeways or expressways shall be limited to identification of on-site
businesses.
2. The applicant shall demonstrate that the business operation is dependent upon freeway or
expressway identification and that denial of adequate identification would cause an undue hardship.
3. The applicant shall demonstrate that a freeway-oriented sign is necessary due to limited visibility
of the parcel due to its shape and location or other factors unique to the site.
4. The sign shall be the minimum height and size necessary to achieve visibility from the freeway,
expressway, or public facility as determined by the decision making body.
5. Additional landscaping and/or architectural details/elements may be required to be added as a
condition of approval to ensure a well-designed sign, screen the sign's supporting structure, or to soften
and/or enhance the appearance of the sign or the site as viewed from off-site locations.
The applicant has submitted the attached letter justifying their sign request.
The proposed sign depicts the use of two (2) foot individual channel letters reading 'Professional
Culinary Institute' mounted on a four (4) foot raceway. The raceway matches the height and color of
the building parapet. The sign area measures 112 square feet and the applicant has submitted two color
schemes. One scheme has red and burgundy color letters and the other scheme has red, burgundy and
green colored letters. The building frontage measures 167 feet along this building elevation.
STAFF RECOMMENDATION
Staff finds that the proposed sign complies with the criteria for the following reasons:
1. The proposed sign identifies the on-site cooking school.
2. The nature of the cooking school has a business clientele that caters to regional and
national visitors and students that are unfamiliar with the area.
3. The architectural style of the building provides a limited sign surface for displaying signage on
the front elevation.
4. The front building elevation is framed with larger mature trees that limit the visibility of
signage on the elevation facing Hamilton A venue and another tenant occupies the center
location on the building; and
5. The proposed individual letters are a similar style and size to other signs on the building thus
providing architectural compatibility.
If SARC is supportive of the sign request, staff would recommend that the letter colors be limited to
the two color concept.

This letter is submitted in support of the Professional Culinary Institute's request for a
variance for signage to be placed on the east face of the building located at 700 West
Hamilton Avenue. This request is supported by the following facts;
1. The Professional Culinary Institute, based on the marketing and business plan
which has been established, will very quickly become a regional and soon, a
national destination. This supposition is well supported by the popularity of the
type of programs being offered. This being the case it will be important to have
good visibility and help visitors, who are unfamiliar with the area, find the
location easily and leave them with a positive impression of the City of Campbell
and the ease in which they can navigate through the area.
2. The north face of the building currently has signage belonging to an existing
tenant of the building and is not available. In addition the presence of existing
mature foliage does not leave any additional space on this elevation.
3. There is a precedent for such a variance, as the Larkspur Landing Hotel currently
has signage on their west face, which faces San Tomas Expressway.
4. The Sign designer has addressed all issues ofletter size and sign size so as to
balance visibility and aesthetics issues that are of concern to the City
Development Department.

This application has been deemed incomplete. The following additional information and details
are needed in order to deem your application complete:

2. Sign Design: The following revisions are recommended to refine the sign design:
a. Eliminate the raceway or enlarge it to the height of the letters so that it is more
architecturally compatible with the building parapet. If the raceway is maintained, please
indicate that it will be painted to match the building wall color.

b. Consider back lighting the letters versus internally illuminated letters to provide a more
refined appearance.
c. Limit the face color of the letters to a maximum of two colors. Darker colors would
provide contrast during the day and would assist back lighting during the evening.
d. Discuss the need for the size of the letters to provide adequate visibility and to support an
appropriate proportion to the building size.
3. Photograph: It would be helpful to provide a photographic simulation of the sign on the
building to assist the decision makers in visualizing the proposed sign. A couple view point
from San Tomas Expressway as viewed by the traveling public would be recommended.
