Dear Ms, Bryant:
Thank you for your submittal of a Fence Exception Application for your property located at 78 N. Milton
Avenue. The Community Development Department has received and reviewed your application for a
fence exception for the side property line of your property.
Your application has been deemed incomplete. Additional information is needed in order to consider your
application. Please submit the following materials:
Site Plan: The following information should be provided in separate documents:
1. Scaled site plan indicating property dimensions, including existing buildings on your site and
dimensions of all setbacks.
2. Scaled elevation of proposed fence. Elevations shall describe material used for proposed fence.
3. Provide location and uses of buildings on adjacent properties.
If you cannot obtain a letter of consent from your adjacent neighbor at 70 N. Milton Avenue, the
Community Development Director shall refer the matter to the Planning Commission for a decision and it
would be decided upon at a public hearing.

Re: New Fence
To whom it may concern,
I stopped by the city a few days ago to obtain information on building a fence down the
side of my driveway. I obtained a copy of the Excerpt from Municipal Code, Site
Development Standards chapter 21.18. The fence would be built for safety and privacy.
My home was broken into last year. Two men were setting on my driveway pulling
weeds along the side of my neighbor's property at 70 N. Milton on the day of the break
in. The driveways are very narrow at my section of Milton Ave., the homes are very
close together. I have had a continued problem with this neighbor's unsightly yard and
her guests coming on my property to pull weeds and water her side-yard. A see through
chain leak fence divides the property in the back?'ibe chain leak fence afforded no
privacy and her guests/tenants are often watering very late at night. I installed a wood
fence along the side in my back yard (not on the property line) to obtain some privacy. I
asked her to help pay for a privacy fence in the back, she refused. I asked her if I could
remove the chain leak fence and install the privacy fence on the property line, she
refused. I believe chain link fencing is not allowed on the side yards of residential
property, 21.18 # C. prohibited materials, site development standards.
After reading your section on fencing I realized, I need city approval to install a wood
fence over 6ft. High. I would like permission to install a 6ft. wood fence with a I ft.
Lattice along the side of my property on the property line. The fence will be reduced to
3.5 ft toward the front as required. I am more than happy to pay for a permit if required.
The other problem is the cement strip along the side of my house, It is sinking due to the
neighbor's downspout being directed toward my driveway. I believe my cement
driveway is also being compromised due to the water from the downspout draining
towards my driveway. This down spout should be directed away from my property and
out toward the street. I believe the city has some code sating water cannot drain toward
or be diverted toward adjoining property.

The Community Development Director, upon recommendation from the Director of Public
Works, may approved a Fence Exception to allow lesser setbacks and heights greater than six-
feet for fences, walls, lattice, and screens when it is determined that:
1. The change would not impair pedestrian or vehicular safety;
2. Would result in a more desirable site layout;
3. Would not be detrimental to the health, safety, peace, morals, comfort or general welfare of
persons residing or working in the neighborhood of the change; and
4. Would not be detrimental or injurious to property and improvements in the neighborhood or
to the general welfare of the City.
Section 21.18060 of the Campbell Municipal Code requires a letter of consent from adjacent
property owners, or affected property owners directly across the public right-of-way from the
front yard and street yard fences, prior to approval of a Fence Exception. This statement must
accompany an application for a Fence Exception. Please fill,in the spaces, sign, and date the
