Lisa and I will need to postpone the filing process with the Planning
Division for the Side Yard Setback until Jan - Feb, 2003.
Unfortunately, my father-in-law passed away two weeks ago and
subsequently my mother-in-law will move in with us for the next several
months. Pursuing the addition to the house would be too disruptive
given the current changes. I need to know if you require additional
information and/or a letter stating the project is on hold? Thanks for
all your help.

BUlldll1g Pcnuit process. Please be aware that building codes are changing constantly; plans submitted for building
permit shall comply WIth the code in effect at that time. Submit permit application together with required documents
to the Building Inspection Division to obtain a building permit No construction can be commenced without an
appropriate building penuit
It is recommended that this item be forwarded to the Planning Commission for review, with the following conditions.
TO THE SATISFACTION OF THE BUILDING DIVISION MANAGERJBUILDING OFFICIAL:
I. PERMITS REQUIRED A building permit application shall be required for the proposed addition
to the existing structure. The building permit shall include Electrical/PlumbinglMechanical fees
when such work is part of the permit.
2. PLAN PREPARATiON This addition may require plan prepared under the direction and oversight
of a California licensed Engineer or Architect. When applicable, plans submitted for building
permits shall be "wet stamped" and signed by the qualifYing professional person.
3 CONSTRUCTION PLANS The conditions of Approval shall be stated in full on the cover sheet
of construction plans submitted for building permit.
4. SIZE OF PLANS: The minimum size of construction plans submitted for building permits shall be
24 in. X 36 in.
5. SITE PLAN Application for building permit shall include a competent site plan that identifies
property and proposed structures with dimensions and elevations as appropriate. Site plan shall
also include site drainage details.
6. TITLE 24 ENERGY COMPLIANCE: California Title 24 Energy Compliance forms CF-lR and
MF-I R shall be blue-lined on the construction plans. S% X II calculations shall be submitted as
well
7 SPECIAL INSPECTiONS: When a special inspection is required by U.B.C. Section 1701, the
architect or engineer of record shall prepare an inspection program that shall be submitted to the
Building Official for approval prior to issuance of the building permits, in accordance with U.B.C

Section 106.3.5. Please obtain City of Campbell, Special Inspection forms from the Building
Inspection Division Counter.
8. The City of Campbell, standard Santa Clara Valley Non-point Source Pollution Control Program
specification sheet shall be part of plan submittal. The specification sheet (size 24" X 36") is
available at the Building Division service counter.
9. APPROVALS REQUIRED The project requires the following agency approval prior to issuance
of the building permit.

Minor Modification to Side Yard Setback

Dear Mr. Helmonds:
The Planning Division has reviewed your application for a Minor Modification to the Side Yard
Setback for a second-story residential addition to an existing single-family residence at ll8! Monica
Lane. Your application was distributed to the Building Division, Public Works Department, and
County Fire Department. These departments did not have any comments at this time.
Your application has been deemed incomplete. The following additional information and details are
needed in order to deem your application complete and schedule it for meetings with the Site and
Architectural Review Committee and the Planning Commission.
The setback requirement for a side yard is the greater of five feet, or one-half the height of the
building wall adjacent to the property line. Staff's calculation of the wall height is 18 feet, 6 inches,
measured from the finished grade to the plate height (please note that the plans must denote this
measurement). The required setback would therefore be 9 feet, 3 inches. Your plans provide a
setback of only 6 feet, with the second floor building wall extending vertically from the existing first
floor building wall.
In previous correspondence regarding your building permit application, staff strongly recommended
that you revise your plans to provide the required setback. The Planning Division cannot be
supporti ve of the proposed project since it would be detrimental to the health, safety, peace, comfort
or general welfare of persons in the neighborhood, or the city as a whole. The setback requirement is
intended to provide greater setbacks for second stories in order to reduce the apparent mass of the
building and provide buffers between properties. In your case there are no unusual circumstances
that make it impossible to meet the required setback.

Specific Items that are needed before your project can be scheduled for public hearings include:
1. IS sets of reduced II" by 17" fully colored elevations of the house (side, rear and front).
2. Preliminary Title Report
3. Site Plan - The following information needs to be included on the site plan:
a. Distance from centerline of adjacent street to property line.
b. Existing street improvements.
c. Indicate all required setbacks on site and floor plans. The required setback for the first floor
is five feet and the required setback for the second floor is 9 feet 3 inches.
d. Indicate existing landscaping, including tree size, drip line, and species.
e. Indicating existing fencing, including style and height.
[, Provide outline of buildings on adjacent properties. Describe the height, setbacks and types
of structures.
g. The northern property line according to the County Assessor's Parcel Map measures
101.64' and the southern property line measures 101.53'. The site plan must reflect the
accurate parcel dimensions and provide an accurate calculation of the lot size.
4. Elevations- indicate the wall height, which is the vertical distance from the finished grade
adjacent to the building to the plate height. The existing plans do not denote this measurement.
5. Photos of project site and surrounding properties (mounted on a board).
6. Provide accurate calculations in the "Tabulation" on sheet no. I. It appears that the "total
existing" and "total wi addition" square footage calculations are incorrect. Please provide
accurate calculations and provide a Building Coverage and Floor Area Ratio Calculation. The
Building Coverage is defined as the percentage of net lot area occupied by buildings. Building
coverage includes the first floor of the primary and all accessory buildings on a lot (measured to
the outside surface of exterior walls) including garages, covered porches and covered decks
(measured to the posts). Building coverage does not include eave overhangs, trellises, or
architectural features (e.g, chimneys, bay windows, etc).
The Floor Area Ratio (FAR) is the ratio of gross floor area to the net lot area. Floor area ratio
shall include the floor area of all stories of all buildings and accessory buildings (including
carports) and shall be measured to the outside surface of exterior walls. Floor area ratio does not
include uninhabitable attic space, basements, below-grade parking, unenclosed accessory
structures (e.g. gazebo or trellis), and covered porches.

Dear Mr. Helmonds:
The Planning Division has reviewed your building permit submittal for a proposed first and second story
addition to an existing single-family residence at 1181 Monica Lane.

natural grade to the plate height (see attached handout). The required setback would therefore be 9 feet, 3
inches. Your plans provide a setback of only 6 feet, with the second tloor building wall extending vertically
from the existing first tloor building wall.
Staff strongly recommends that you revise your plans to provide the required setback.
However. under Section 21.08.070 of the Campbell Municipal Code, the Planning Commission may approve
a minimum sideyard setback of five feet for buildings proposed for a second story addition, when it finds:
1. That said sideyard will not be detrimental to the health, safety, peace, comfort or
general welfare of persons in the neighborhood, or the city as a whole: and
2. That said sideyards will not unreasonably interfere with the ability of adjoining
property owners to enjoy access to sunlight, air, pri vacy and quiet enjoyment of
such owner's property.
An application is enclosed that provides additional information on the process of applying for a Modification
to the Side Yard Setback Requirement. Please take into consideration the additional time and fees required to
process this application. The application will also be subject to a thorough architectural design review
process and public hearing.
