obligated to the City of Cam~W~ <mr~er .~, a municipal corporatJon under the laws of the State

of which sum we obligate ourselves and our successors and assigns, Jointly and severally by the following
provisions:
The condition of this obligation Is that the Principal entered, or Is about to enter, Into a certain
written contract with the City dated APRIL 22 . 19 94 and entitled Project/Permit
:# 92 -1 0 3 for a one year maintenance period of the work described In said agreement, a true
and correct copy of which Is presently on tue In the office of the City Clerk of the City of Campbell, which
said agreement is hereby referred to and made a part hereof. And, the City requires a guarantee from the
Principal against defective materials and workmanship In connection with that maintenance.
Now, therefore, the Principal agrees that It shall make all repairs or replacements necessary during
the period of one-year from the date of acceptance of the contract work, by reason of defective materials
or workmanship In connection with the contract. If those defective materials or workmanship occur within
that period, the City shall give the Principal and Surety written notice of that defect within 60 days after
discovery. When each replacement Is made to the satisfaction of the City, the obligation of the Principal
and Surety shall be discharged as to that replacement, otherwise to remain in full force and effect.
Any repairs or replacements made under this bond shall In like manner be subject to the tenns and
conditions of it.
No prepayment or delay In payment and no changes, extensions, addition or alteration of any
provision of said contract or In any plans and speciflcations referred to herein, and no forbearance on the
part of the City shall operate to release the Surety from IIabUIty on this bond, and consent to make such
alterations without further notice to or consent by the Surety Is hereby given, and the Surety hereby waives
the provisions of Section 2819 of the CIvil Code of the State of California.

Phyllis, street light # 822 in front of 65 Latimer Avenue here in Campben was
disconnected from it's overhead feed about a year ago and removed as the developer made
improvements. A new foundation and pole was installed about 4 feet west of the old
location. The contractor has installed a PVC stub up the correct quadrant of the utility
pole as indicated by your fax of Oct. 14, 1993 (copy attached). This same fax indicates that
the new pole is to be # 50195.
The City has inspected and accepted the contractor's work. Please have the service
connection made to street light pole # 50195, add it to the City's billing under the LS-2A
rate and please remove street light pole # 822 from the City's billing. The n'Wlre wattage,
type and voltage remains unchanged at 35 watt, LPS, 240 volt.

On February 14, 1994, the City of Campbell wrote to you requesting that the necessary steps be

City is anxious to have these deficiencies corrected. We feel that the corrections necessary to
activate the street light installed with this development are of particular concern. We have received
multiple complaints from residents in the area regarding this inactive street light. If the necessary
corrective actions associated with this street light are not performed by the end of the day on
April 5, 1994, the City will hire a contractor to perform the work and bill Frontier Surety Agencies
for reimbursement. The City will include reimbursement for its staff time associated with hiring
the contractor and administering the work.

In accordance with the requirements of the reinstatement of your Planned Development Permit
at the above location, you have requested a final inspection of subject construction work. There
are deficiencies in the work which are indicated on the attached defici~ncy list dated 11/24/93.
The deficiencies must be corrected in accordance with City standards before we can make a final
inspection or acceptance of the work.
Prior to issuance of building permits for the remaining three units of this development, the
following items must be completed:
I) All of the items on the attached punch list must be corrected.
2) Submit plans and apply for an encroachment permit for the remaInIng offsite
improvements. A $210 application fee is required, but no plan check and inspection fee
will be taken.
3) Submit a copy of the deeds for the remaining three units, and execute an improvement
agreement.
4) Submit improvement bond for the additional offsite improvements in the amount of
$23,000.

It has come to our attention that Nadcon Development intends to
proceed with the construction of the second phase of the above
referenced project. The sanitary sewers for the six completed
units have not yet been accepted by this district.
A punch list of uncompleted work has not yet been compiled. A
television inspection of the on-site sewer system by our
maintenance crews must be completed prior to acceptance.
Additionally, the cleanouts for each unit have not been brought to
grade.

regarding the completion of this project.

The Planning Department has reviewed your request to phase the issuance of
building permits for the above referenced project, allowing issuance of 6
permits for townhomes along East Latimer Avenue, and deferring issuance of
building permits for the 3 detached townhomes along Esther Avenue.
This phasing would be permitted if it is consistent with the approved
development schedule, which requires the issuance of building permits for
all of the townhomes by July 2, 1992. Additionally, occupancy of the first 6
units will be contingent upon commencing construction on the remaining 3
units.
If, at that time, you are not prepared to commence construction on the 3
townhomes along Esther A venue, it will be necessary for you to seek
approval of a revised development schedule for the project.

error was discovered in the improvement plans which you submitted
for the referenced project. The electrolier to be replaced on
Latimer Avenue is not mounted on the joint pole as shown on your
plans. The existing electrolier actually stands a few feet to
the east of the joint pole. The location of this electrolier
creates a conflict with the proposed storm drain to be installed
on Latimer Avenue. Please submit a revised plan showing the
correct location of the existing electrolier, and the new
location of the storm drain and the proposed electrolier.

Dear Steve:
This letter is to follow through on our phone conversation
yesterday relating to bonding requirements for encroachment
permits.
The City needs a form of security that insures faithful
performance of the street improvement obligation. As we
discussed, if the City had to fulfill the street
improvement obligation, the cost is estimated to be
$44,000.00. For this reason, the City needs this amount
secured to assure fulfillment of the street improvement
obligation. Once the street improvements are installed and
accepted by the City, 75% of this amount is returned or
released. The remaining 25% is retained as a maintenance
bond for one year beyond the date of acceptance of the
improvements.
Issuance of a "set-aside" letter from your bank would be an
acceptable form of surety if it contained the items listed
below. A set-aside letter is essentially a letter of
credit issued by the bank who is holding your construction
loan. The "set-aside" letter needs to contain the
following agreements:
o The bank has set aside an amount of $44,000 within
your construction loan to guarantee fulfillment of
your street improvement obligation.
o In the event that the street improvement
obligation is not completed to the City's
satisfaction, the bank will make these funds
($44,000) available to the City for completing the
street improvement obligation.

o The set-aside amount will not be released until
the City has formally accepted the improvements.
o Once the City has accepted the improvements, 25%
of the set-aside amount ($11,000) will be
set-aside by the bank for an additional year to
cover the maintenance period.
o The 25% retention shall not be released until the
City authorizes the release of the maintenance
surety.
If you would like to have your bank draft such a letter and
send it to my attention, I will have it reviewed by the
City Engineer and City Attorney.

Since the City of Campbell does not have a formal agreement with the
Developer, we must rely on this form a guideline as to what our bond
guarantees.
