"Contractor") and FARMINGTON CASUALTY COMPANY , a corporation organized under the laws of the State of
CONNECT I CUT , and authorized to transact business in the State of California, as Surety, are obligated
to the City of Campbell, (hereinafter "City") a municipal corporation under the laws of the State of California, in the
sum of TWENTY-FOUR THOUSAND DOLLARS ($24,000.00) for the payment of which sum we obligate ourselves
and our successors and assigns, jointly and severally by the following provisions:
The condition of this obligation is:
Because the obligated Contractor has, on october 7 , 19 96 , entered into written
Contract with the City for the Project entitled S 95-04/UP 95-08, EP 96-127, a copy of which is attached and made a
part of this bond, for construction of Project.
Now, therefore, if the Contractor shall faithfully perform the work in accordance with the plans, specifications
and contract documents during the original term, and any extensions of the contract which may be granted by the City,
with or without notice to the surety, and if it shall satisfy all claims and demands incurred under the contract, and shall
fully indemnify and save harmless the City from all costs and damages which it may suffer by reason of failure to do
so, and shall reimburse and repay the City all outlay and expense which the City may incur in making any default, then
this obligation shall be void; otherwise to remain in full force and effect.
If any legal action be filed upon this bond, it shall be filed within one year after final payment has been made
under the Contract excluding the warranty period, if any, provided for in the Contract, and venue shall lie in the County
of Santa Clara, State of California, and that surety, for value received stipulates and agrees that no change, extension
of time, alteration or addition to the terms of the Contract or to the work to be performed under it or the specifications
accompanying it shall in any way affect its obligation on this bond, and it does by this means waive notice of any change,
extension of time, alteration or addition to the terms of the Contract or the work or to the specifications, and thereby
waives the provisions of Section 2819 of the Civil Code of the State of California.

The condition of this obligation is that the Principal entered, or is about to enter, into a certain written Contract with the

of which is presently on file in the office of the City Clerk of the City of Campbell, which said Contract is hereby referred to and
made a part hereof.
Because Principal is required to furnish a bond in connection with the contract, providing that if Principal, or any of its
subcontractors, shall fail to pay for any materials, or other supplies, or for any work or labor on the contracted work of any kind,
or for amounts due under the unemployment insurance act with respect to any work or labor on this project, the Surety on this
bond will pay for the debt, in an amount not exceeding the sum specified in this bond, and also, in case suit is brought upon the
bond, a reasonable attorney's fee to be fixed by the court.
Now, therefore, we, SUSA PARTNERSHIP LP, A TENNESSEE LIMITED PARTNERSHIP, as Principal, AND
FARMINGTON CASUALTY COMPANY , as Surety, are obligated to the City of Campbell, in the sum of
TWENTY-FOUR THOUSAND DOLLARS ($24,000.00) lawful money of the United States, for the payment of which sums will
and truly to be made, we the said Principal and Surety bind ourselves, successors and assigns, jointly and severally, by these
provisions.
The condition of this obligation is that if Principal, its successors or assigns, or its subcontractor, or subcontractors, shall
fail to pay for any labor, materials, or other supplies, used in the performance of the work contracted to be done, or for amounts
due under the unemployment insurance act with respect to this work or labor, then the Surety on this bond will pay for them, in
an amount not exceeding the sum specified in this bond, and in case suit is brought upon this bond will also pay a reasonable
attorney's fee, to be fixed by the court.
No prepayment or delay in payment and no changes, extensions, addition or alteration of any provision of said Contract
or in any plans and specifications referred to herein, and no forbearance on the part of the City shall operate to release the Surety
from liability on this bond, and consent to make such alterations without further notice to or consent by the Surety is hereby given,

Dear Mr. Jacobs:
The City of Campbell has made a final inspection of subject Public Works improvements and
finds the work to be acceptable and in conformance with City standards. Accordingly, the City
Engineer accepts the improvements.
The one year maintenance period stated in the permit begins as of the date of this acceptance
letter. The permittee is responsible for the repair and/or replacement of any defective work or
failures that occur within one year. The City will inspect the improvements within one year
and notify you, in writing, whether or not any repairs are required.
The City will continue to hold the Faithful Performance Surety bond as your Maintenance
Surety until such time as an alternate surety of $6,000.00 (25 % of the original surety) is
received. A Maintenance Bond form is enclosed if you desire to submit it in exchange for the
Faithful Performance Surety. Additionally, your plan check deposit of $500.00 and
construction emergency cash deposit of $880, plus any interest due, are now being processed
and will be sent to you under separate cover.

1. Complete seal work at saw cuts at both the Sunnyoaks driveway and the Dell Ave.
driveway.
2. Clean and sweep entire site, (remove all construction debris).
3. Remove plastic from the D.l. located at the back of the driveway on Sunnyoaks.
4. Remove the chain-link: fence to the R.O.W. line as per plan.
5. Install second lid at the fire service vault.
6. Provide irrigation and planting of trees as per City of Campbell standards.

Grade Conflicts at Dell Avenue Driveway
Dear Wally:
This letter is to confirm our conversation yesterday regarding the apparent conflict between the
elevation of the driveway approach on Dell Avenue and your on-site curbs and valley gutter.
Sheet C-l, your grading and drainage plan, provides very little information to coordinate the off-
site and on-site improvements. Our standard detail #3, for driveway approaches, a copy of which
is attached, calls for a maximum grade of minus 6% at the back of the approach.
If the Dell Avenue driveway is to be used for emergency access only, perhaps we can
compromise on our standard specifications. However, we need to see your Engineer's proposal
to resolve the conflict at this driveway.

Deferred Street Improvement Agreement
Dear Mr. Karakashian,
In response to your letter of July 18, 1995, requesting clarification on the above
referenced matter, please be advised that the City Engineer has confirmed that a cash
bond or other financial instrument is not required to execute the deferred street
improvement agreement and will not be required to satisfy the condition of
approval referencing this matter. In accordance with the Conditions of Approval
adopted for S 95-04, all public improvements on Sunnyoaks Avenue are not affected
by Condition No. 13 or the requirement for a bond or other legal instrument to
secure the construction of these improvements. If you should have any further

Thank you for discussing and clarifying the above referenced matter with me on
July 20, 1995. As a follow-up, I am providing this memo to confirm the conclusion
of our discussion that the applicant, for the above referenced project, will not be
required to file a cash bond or other financial security in conjunction with
Condition of Approval Number 13, Deferred Street Improvement Agreement
regarding Dell Avenue.
As you may recall, public improvements required along the Sunnyoaks Avenue
frontage are not affected by this agreement, and will be constructed with the
development of the property as specified in the adopted conditions of approval.
At the request of the applicant, I will be providing Mr. Karakashian with a response
indicating that Condition Number 13 of S 95-04, Deferred Street Improvement
Agreement. does not require the provision of a cash bond or other financial security
to satisfy this condition.
