We have made final inspection of subject Public Works construction
and find the work is satisfactorily completed in conformance with
City standards. Accordingly, we will recommend acceptance to the
City Council and expect to be filing a Notice of Completion within
thirty (30) days. A copy of the Resolution of Acceptance and the
Notice of Completion will be mailed to you.
Per my letter of May 10, 1989, we are in receipt of your maintenance
bond in the amount of $13,900.00 for subject property. Your subject

MAINTENANCE AMOUNT $13,900.00
Dear Sir:
We have made another inspection of the work covered under the subject
permit. All required public improvements are satisfactorily completed
except the installation of the e1ectrolier. Please be aware that it is
the City's policy not to release posted time certificate and cash
deposits until all required public improvements are completed and
accepted.
In your case, however, since the only remaining work is the installation
of the electrolier, we would accept those improvements that were
completed and release your time certificate and cash deposit, less
charges, provided you post a maintenance bond in the amount of $13,900
to cover the one-year maintenance period and a separate faithful
performance cash bond in the amount of $2,000 to guarantee satisfactory
completion of the electrolier work. This $2,000 deposit will be
released upon acceptance of this work.
You will be responsible for the maintenance, repair and/or replacement
of all work done should any failures occur within one (1) year.
If you have any questions regarding this matter, please do not hesitate
to call me.

This letter is a follow up to our phone conversation today to which I
notified you that per my letter of August 25, 1988, the City of Campbell
is going to remedy the situation at the above address as the September 9th
deadline has passed.
You notified me at that time that this was the only remedy as the job has
been shut down indefinately by the developer.
The City of Campbell has directed a local contractor to make the repairs
outlined in item number one of my letter dated August 25, 1988. The cost
will be $2500.00 and will be deducted from the cash deposits from our
Permits numbers 87-153 and 88-188.

RECOMMENDATION:
That the City Council adopt a resolution accepting street improvements at
586 Hacienda Avenue and ordering a Notice of Completion to be filed.
DISCUSSION:
On January 20, 1987, the City Council adopted Ordinance No, 1629 approving
a planned development permit, plans, elevations, development schedule, and
conditions of approval to allow construction of seven (7) townhomes on
property known as 586 Hacienda Avenue in a PD (Planned Development/low-
medium Density Residential) Zoning District, The conditions of the
approval for the planned development included dedication of additional
right of way and construction of public street improvements.
On AprilS, 1988 the City Council adopted Resolution No, 7520 approving
final map of Tract No. 8073, accepting the dedication offered thereon and
authorizing the Mayor to execute the agreement for street improvements.
Permit No. 87-153 was issued on November 4, 1987 to allow construction of
the street improvements consisting of asphalt concrete overlay and
construction of curb, gutter and sidewalk.
The work has been satisfactorily completed in conformance with City
Standards. It is appropriate for the City Council to accept those
improvements at this time and order a Notice of Completion to be filed.

WHEREAS, the City Council has been advised by the City Engineer that
public improvements in 586 Hacienda Avenue have been completed in
accordance with City standards; and
WHEREAS, the City Engineer recommends acceptance of the improvements;
NOW, THEREFORE, BE IT RESOLVED by the City Council that public
improvements be, and the same are hereby accepted, and that the City
Engineer is hereby ordered to record a Notice of Completion of said
improvements.

The attached memorandum from Hank West to Bob Diaz outlines the incident
that happened at subject project location on March 28, 1989.
A Mr. Les Jump called Public Works at about 8:15 a.m., March 29, 1989
complaining about a damage sustained by his car while traveling through
the project site. At about 8:40 a.m., Mr. Dave Hutchinson who claimed to
be Mr. Les Jump's insurance agent called the office about the same
incident.
I returned both calls advising them to file their claim against the
contractor. I gave them the following information. The name of the
permit applicant is Mr. Iraj Etessam at 1901 S. Bascom Avenue #1625,
Campbell, 95008; phone number (408) 559-6838.
We have advised the contractor to alleviate the problem immediately;
(paving was completed at about 11:00 a.m., 3/30/89). We also advised him
Mr. Les Jump would be filing a claim against them. The contractor
indicated he would resolve the matter.
As far as I know, the matter with Mr. Les Jump has been resolved.
However, should other calls for potential claims trickle down to your
office, please let us know.

This is to advise that I received a call from our dispatcher at approximately
7:30 p.m. on March 28, 1989. The dispatcher stated that cars were "bottoming-
outll on a manhole. The location was given as lion Hacienda, Eastbound between
Capri and Walnut."
I advised the dispatcher that although Gregg Eaton deals with new improvements/
contractors, I would go out and look into the situation.
I arrived at approximately 7:45 p.m. the same date and noted the following:
1) The Eastbound lane of Hacienda, between Capri and Walnut was under
construction and the contractor (unknown to me) had placed his first
lift of asphalt on the South side of the centerline. The new course
of pavement was approximately 5" to 6" below the final paving grade.
2) There was a manhole, exposed to the pending final grade, right in the
center of the Eastbound lane under construction at the time. This
manhole was also situated adjacent to the existing pavement/conform
grade as my picture (see attached) shows. By the way, I took this
picture at 8:10 a.m. on March 29, and it, along with the 2811 traffic
cones which I had rearranged last night, were exactly as I had placed
them, to divert the traffic away from the manhole March 28.
3) When I arrived at approximately 7:45 p.m. last night, March 28, and
noted the problem with the "high" manhole, I observed a couple of
vehicles strike the leading edge of the manhole cover.
4) I quickly placed a lighted barricade over the southerly edge of the
manhole, and rearranged the 28" traffice cones on a taper, so as t~
channel the traffic between the manhole and the higher pavement on the
northerly side of the centerline.
5) I had called for a Campbell Police officer during this time and asked
the dispatcher to contact Gregg Eaton, to identify the responsible
contractor. Agent Kelly Bybee responded at approximately 8:40 p.m.
and together we observed the traffic for approximately fifteen (15)
minutes. The traffic appeared to be negotiating the new channel setup
without any problems. I checked back with the dispatcher for Gregg's
status and the dispatcher advised that Gregg was not home. I advised
that dispatch should attempt to make contact with Gregg, if possible,
so as to appraise him of the situation. Apparently no contact was made
with Gregg, because we briefly discussed the situation this morning in
my office.

6) Note: The contractor did have some asphalt around the manhole
in question. However, it apparently wasn't sufficient to
avoid the problems which developed last night.
7) An insurance agent from Allstate Insurance Company did stop by
while I was on the scene last night and left his business card
with me, stating that one of his clients had hit the manhole and
lost his oil pan with damage to the underside of his vehicle.
8) I left the card, along with a brief report, on Gregg's desk at
approximately 7:50 a.m. this morning. I also appraised Carlos
Jocson of the incident this morning. I went 10-10 at approximately
9:00 p.m. last night, March 28.

Trench paving - 586 W. Hacienda/Permit No. 87-153
This memo is an attempt to outline the events that have lead up to today's
action and to bring you up to date as to what has transpired today.
July 20. 1988 - Galante Bros. begin installation of the sanitary sewer
main extension. (Prior to construction, Tom Galante and I met to discuss
the City's requirements re: traffic control and trench restoration. He
offered that he was also going to do the road reconstruction and that
there would not be any problem with maintaining the trench until that
construction took place.)
July 22 - Au~ust 25. 1988 - Numerous times during this period I had to
call Galante's office and request that they install more cutback over
their trench. They always responded, but always with a minimal amount of
milt.
August 25. 1988 - Don Wimberly directed me to contact Galante Bros. and
instruct them to either reconstruct the road as per plan, or replace the
cutback over the trench with hot mix A.C. I contacted Tom Galante and
relayed same. He explained that the maintenance of the trench was not his
responsibility as a signed contract had never taken place and that he was
premature in telling me that he had the reconstruct job. He also said
that he would no longer maintain the trench. He did say, however, to
contact Ron Brunner at First American Construction (the general
contractor) as the job was his responsibility. - I contacted Ron and
explained the situation to him and followed our conversation up with a
registered letter. (A copy of which is attached.)
*Note: The excavation permit was issued to West Valley Sanitation
District and First American Construction. First American paid all the
fees.
September 9. 1988 - This was the deadline for the work (either option
outlined in the August 25th letter) to have been completed. No work was
attempted at this point nor was this office contacted regarding this
matter by any of the parties involved.

September 13. 1988 - (I was absent on 9/12 therefore the following took
place on this date.) - I called Ron Brunner (First American Construction)
and asked him if he intended to complete the work in question by the end
of the day. He informed me that the owners/developers had "shut the job
down indefinately". He further stated that at this time he was not sure
if he would be paid for work previously done, therefore he had no
intentions of completing the work that we had required in the letter of
August 25th. He felt that the City should proceed with contracting out
the repairs. I followed up with a letter and sent copies to the
owner/developer and the sanitation district. (A copy of which is attached.)
I then contacted Houge Inc. to see if they were available to do the work
and requested a price. - Later that day they submitted a price of $2500
and stated that they were available to perform the work at our request.
After confirming same with you, I directed them to do the work as soon as
possible.
Seotember 14. 1988 - I received a copy of a letter sent to the
owners/develpers from the Don Armstrong of the sanitation district. (A copy
of which is attached.) In his letter, Don gave them until 8a.m. on
September 15th to make appropriate repairs. I called Houge Inc. and asked
them to hold off on the work until I contacted them on the 15th.
September 15. 1988 - At 9a.m. no work had been started. I then called
Houge Inc. and asked them to proceed with the work. - At 11:43a.m. I
received a call from Tom Galante asking me why Houge was working on his
trench. I explained that the time frame that the City had dictated in the
August 25th letter had been not been met and that we had directed Houge to
complete the work. At that time he told me that the night before
(Sept.14) he had signed a contract with the owners to do the road
reconstruct and that he now had a load of cutback in route to the site. I
told him that hot mix only was to be installed over the trench. He then
asked if he could pave it after Houge prepared the trench. I then put him
on hold and called Marshall at Houge and asked if he would agree to that.
And he said yes. I relayed same to Tom and he said that he would send a
truck for mix and get out to the job site so that they could pave right
behind Houge. - At 1p.m. I received a call from Marshall and he explained
that his superintendent had been contacted in the field by Tom Galante.
He stated that Tom was making threats of law suits, etc., and had stated
that he had no intention of paving anything. I told Marshall to proceed
with the paving operation and that I would immediately go out to the job
and straighten things out. - When I got there John Thorton (Houge's
superinte~dent) was there, however Tom Galante was gone. John and I
discussed what had transpired between between Tom and himself and I asked
him to document same.

September 15. 1988 (Continued) - I then proceeded to the Hazel and
Virginia job where Galante is installing a storm drain to find out what
was going 'on. I discussed same with Jack Galante (Tom's brother) and what
I received was a story of misunderstandings and regrets. - Around 2:30p.m.
Tom Galante came into City Hall in regards to Proj. 86-18 (Los Gatos Creek
Bike Path) and the first thing he said to me is that the owners/devlopers
were going to sue the City, but that he didn't have any hard feelings and
didn't want to cause any problems. - At approximately 4p.m. I received a
call from John Vossoughi (one of the owners/developers) and he wanted to
know what was going on and that he was "going to sue somebody!". I
explained to him what had happened and the conditions and time frames that
the City had set forth and that were not met. I also told him that he was
sent copies of our correspondances to First American Construction and he
replied that "I'm suing them for $250,000" and that they had walked off
the job without notifying him. (Never really acknowledging our
correspondances to him.) I told him that that was something he would have
to work out with them, but that the City was looking for an end result and
that is why we took action on their inaction. He asked me what the cost
was of the work being performed by Houge and I told him. He explained
that in fact the maintenance of the trench was Galante's responsibility
and that he was intending on passing on the costs to Galante. He thanked
me for my assistance and said he was calling Galante immediately after our
conversation. I have not had any further communications with any of the
parties involved.
.Due to the possible legal implications I felt it necessary to document the
facts and the chronology. I also wanted to bring you up to date because
of the events that happened during your absence.
I would like to discuss with you in greater detail some of the items in
this memo. Please advise when a good time would be.

notified you that per my letter of August 25, 1988, the City of Campbell
is going to remedy the situation at the above address as the September 9th
deadline has passed.
You notified me at that time that this was the only remedy as the job has
been shut down indefinately by the developer.
The City of Campbell has directed a local contractor to make the repairs
outlined in item number one of my letter dated August 25, 1988. The cost
will be $2500.00 and will be deducted from the cash deposits from our
Permits numbers 87-153 and 88-188.

correct a serious traffic hazard.
This work must be completed by 8:00 o'clock a.m. on September 15,

The District will not accept the project until the trench is
repaired or the invoice paid in full.

Dear Mr. Brunner:
This letter is a follow up to our phone conversation today to which I
expressed the City of Campbell's concern regarding the state of the
sanitary main trench to the referenced property. As we discussed, the
trench has been in a state of repair since July 20, 1988.
Therefore, the City is requesting that you remedy the situation by
September 9, 1988 by one of two methods:
1) Remove the existing temporary asphalt and install hot mix asphalt
until such time that the road is re-constructed per the approved plans.
2) Re-construct the road per the approved plans.
The deadline means that one of two methods must have been completed by
that date. If this deadline is not met, it is the City's intent to have
the work done and deduct the monies from the permit cash deposit.

Gentlemen:
We have made final inspection of subject Public Works construction
and find the work is satisfactorily completed in conformance with
City standards. Accordingly, we will recommend acceptance to the
City Council and expect to be filing a Notice of Completion within
thirty (30) days. A copy of the Resolution of Acceptance and the
Notice of Completion will be mailed to you.
Per my letter of M~y 10, 1989, we are in receipt of your maintenance
bond in the amount of $13,900.00 for subject property. Your subject
time certificate of deposit is hereby released and returned.
