There appears to have been no repair work completed regarding the
deficiencies outlined in the letter dated Februarv 22. 1990.
These deficiencies must be corrected before the work can be accepted by
the City and bonds and/or deposits released. The City is requesting that
you complete the repair work within 30 days so that you can begin your one
year maintenance period.
Upon completion of all work and correction of all deficiencies, a written
request for final inspection and acceptance of the work must be
submitted. This then sets in motion the actions necessary to release your
bond and refund your deposits. Should you have any questions or require
additional information please contact me as soon as possible.

Public hearing to consider the application of
Hunter Properties for approval of plans and
elevations to construct a retail building on
property known asJi~~ U~~ lI~n a
C-l-S (Neighborhood Commercial) Zoning
District.
Planning Director lee reviewed the Staff Report of March 22, 1988, noting that
Staff is recommending approval of this project.
Commissioner Olszewski reported that this item was considered by the Site and
Architectural Review Committee. The Committee is recommending approval, with
the relocation of the trash enclosure to come back to the Committee with the
submittal of landscaping plans. The loss of any mature trees will be mitigated
with the provision of substantial landscaping. Redlining of the presented
plans indicates a change in the entryway to miss a major utility fault.
Chairman Christ opened the public hearing and invited anyone to speak on this
item.
Mr. Deke Hunter, applicant, indicated that he is looking to attract a major
regional tenant who has ten other stores in the county. The project is about
80' from the adjacent residential area, providing a good buffer.
Linda Fazio, 542 Monica Lane, requested consideration of an 8 foot wall along
her property line to resolve any possible noise problems, noting all the
problems that have occured with the adjacent Mt. Mike's restaurant.
Mr. Hunter indicated that he did not have a problem with an 8 foot wall, and
that he was willing to work with the community and with Staff.
Commissioner Kasolas expressed a concern with an 8 foot wall, in that the
City's policy is for a 6 foot wall or fence.
Commissioner Walker noted that it would be to the City's advantage to have a
firm policy on the issue of fencing/walls between residential and commercial
properties.

4. The 53 parking spaces provided meets/exceeds the code requirements of

5. The project is designed to minimize infringement on neighboring properties.
The building is one-story and setback 55' from the rear property line. A
6' masonry wall is required between the commercial and residential use.
6. Substantial landscaping has been provided which adds to the aesthetics of
the project. An 8'-10' wide landscape area separates the commercial from
the residential area.

The applicant is hereby notified, as part of this application, that he/she is
required to meet the following conditions in accordance with the Ordinances of
the City of Campbell and the Laws of the State of California. Additionally,
the applicant is hereby notified that he/she is required to comply with all
applicable Codes or Ordinances of the City of Campbell and the State of
California which pertain to this development and are not herein specified.
1. Revised elevations and/or site plan indicating relocation of trash
enclosure, and color sample board, to be submitted to the Planning
Department and approved by the Planning Director upon recommendation of the
Architectural Advisor prior to application for a building permit.
2. Property to be fenced and landscaped as indicated and/or added in red on
the plans. Landscaping and fencing shall be maintained in accordance with
the approved plans.
3. Landscaping plan indicating type and size of plant material, and location
of irrigation system to be submitted to the Planning Department and
approved by the Site and Architectural Review Committee and/or Planning
Commission prior to issuance of a building permit.
4. Fencing plan indicating location and design details of fencing and wall to
be submitted to the Planning Department and approved by the Planning
Director prior to issuance of a building permit.
5. Applicant to either (I) post a faithful performance bond in the amount of
$5,000.00 to insure landscaping, fencing, and striping of parking areas
within 3 months of completion of construction; or (2) file written
agreement to complete landscaping, fencing, and striping of parking areas.
Bond or agreement to be filed with the Planning Department prior to
application for a building permit.
7. All mechanical equipment on roofs and all utility meters to be screened as
approved by the Planning Director.
8. Building occupancy will not be allowed until public improvements are
installed.
9. All parking and driveway areas to be developed in compliance with Chapter
21.50 of the Campbell Municipal Code. All parking spaces to be provided
with appropriate concrete curbs or bumper guards.
10. Underground utilities to be provided as required by Section 20.36.150 of
the Campbell Municipal Code.
11. Plans submitted to the Building Department for plan check shall indicate
clearly the location of all connections for underground utilities including
water, sewer, electric, telephone and television cables, etc.
12. Sign application to be submitted in accordance with provisions of the Sign
Ordinance for all signs. No sign to be installed until application is
approved and permit issued by Planning and Building Departments (Section
21.53 of the Campbell Municipal Code).

13. Ordinance No. 782 of the Campbell Municipal Code stipulates that any
contract for the collection and disposal of refuse, garbage, wet garbage
and rubbish produced within the limits of the City of Campbell shall be
made with Green Valley Disposal Company. This requirement applies to all
single-family dwellings, multiple apartment units, to all commercial,
business, industrial, manufacturing, and construction establishments.
14. Trash container(s) of a size and quantity necessary to serve the
development shall be located in area(s) approved by the Fire Department.
Unless otherwise noted, enclosure(s) shall consist of a concrete floor
surrounded by a solid wall or fence and have self-closing doors of a size
specified by the Fire Department. All enclosures to be constructed at grade
level and have a level area adjacent to the trash enclosure area to service
these containers.
15. Applicant shall comply with all appropriate State and City requirements for
the handicapped.

16. The applicant is hereby notified that the property is to be maintained free
of any combustible trash, debris and weeds, until the time that actual
construction commences. All existing structures shall be secured by having
windows boarded up and doors sealed shut, or be demolished or removed from
