The Planning Commission meeting of April 11 ,2006, was called to order at 7:30 p.m.,
in the Council Chambers, 70 North First Street, Campbell, California by Chair Alderete
and the following proceedings were had, to wit:

Motion: On motion of Commissioner Gibbons, seconded by Commissioner
Doorley, the Planning Commission minutes of March 28, 2006, were
approved as submitted. (5-0-0-2; Commissioners Francois and
Rocha abstained)

PUBLIC HEARINGS
Chair Alderete read Agenda Item No. 1 into the record as follows:
1. PLN2006-19
Manson, L.
Public Hearing to consider the application of Mr. Lloyd
Manson for a Site and Architectural Review Permit
(PLN2006-19) to allow the construction of a new single-
family residence on property owned by Mr. Lloyd Manson
located at 1555 Van Dusen Lane in an R-1-9 (Single-
Family Residential) Zoning District. Staff is recommending
that this project be deemed Categorically Exempt under
CEQA. Planning Commission action final unless appealed
in writing to the City Clerk within 10 calendar days. Project

Planner Melinda Denis presented the staff report as follows:
· Reported that a Tentative Parcel Map was approved in 1999 and finaled in 2004.
· Said that a Site and Architectural Review Permit was approved but expired for this
property.
· Explained that this evening's proposal is the same residence originally approved.
· Described the project site as being on the south side of Van Dusen Lane and
consists of a new one-story single-family residence with detached two-car garage.
The home uses simple rectangular shapes and hip and gable rooflines.
· Said that surrounding uses include single-family residences, a vacant lot to the
east and Pollard Road to the south. The zoning is R-1-9.
· Said that the project site must meet the requirements of the San Tomas Area
Neighborhood Plan.
· Recommended approval and advised that the property owner is present this
evening.
Commissioner Roseberry presented the Site and Architectural Review Committee
report as follows:
· Advised that SARC considered the project on March 28th and really liked the house
proposed as a single-story. It has nice frontage to the street and a garage tucked
in the back.
· Stated that SARC was generally supportive with the inclusion of decorative pavers
or stamped concrete along the driveway, the upgrade of the garage door, inclusion
of a chimney cap and enhanced lighting fixtures.
· Reported that the applicant was willing to make changes.
· Said that SARC was supportive of this project.

Chair Alderete opened the Public Hearing for Agenda Item NO.1.
Mr. Scott Eckerman, 1513 Van Dusen Lane, Campbell:
· Said that he owns the property to the west and was present at the previous public
hearing when this project was originally approved.
. Stated that he is glad that it is the same plan proposed.
· Said that drainage was and continues to be a concern and he wants to be sure
that the drainage from this site drains away from his property.
. Asked for an estimate on construction of this home.
Chair Alderete closed the Public Hearing for Agenda Item No.1.
Commissioner Roseberry asked staff to confirm that drainage from a lot is not allowed
to go onto other properties.
Director Sharon Fierro explained that a grading plan is required that demonstrates that
site drainage is directed to storm drains and/or percolates on site.
Commissioner Roseberry added that therefore drainage of this property should not
impact adjacent sites. Nothing should be done that causes the damming of drainage
from other sites.
Commissioner Gibbons said that there have been drainage issues in the past that
caused the need for a lot to be built up to deal with site drainage but that can also
cause problems.
Commissioner Roseberry asked whose problem it is if drainage issues are created.
City Attorney William Seligmann explained that site drainage issues would become an
issue between the two impacted property owners and depends upon how each site
drained in the past to determine whether the new construction caused the impacts or if
the site drainage conditions were pre-existing.
Commissioner Roseberry asked the City Attorney if he is saying that drainage is not a
Planning Commission concern.
City Attorney William Seligmann replied correct.
Planner Melinda Denis:
· Reiterated that during the Building Permit process a grading and drainage plan is
submitted. The plan is reviewed by the Engineering Department. Techniques
such as raised grade or pipes underground are available to deal with site drainage.
· Added that there is a ton of pre-existing drainage issues in the San Tomas Area.
· Stated that the applicant can meet with his neighbor to discuss concerns but that it
is not this applicant's responsibility to fix the adjacent property's existing drainage
problems just not to cause new ones.

Commissioner Rocha pointed out that there are two more lots coming and asked if the
drainage for those is handled independently.
Planner Melinda Denis clarified that each is an individual lot but that there have been
no recent inquiries about the development of the remaining lots as of yet. Each lot is
being sold individually.
Commissioner Rocha pointed out that this issue can be addressed as each lot comes
forward.
Chair Alderete asked for feedback on the timing for construction.
Planner Melinda Denis advised that the property owner is here and can advise on this
issue.
Mr. Lloyd Manson, Applicant and Property Owner, 1555 Van Dusen Lane, Campbell:
· Explained that he would submit his building plans to the Building Department
immediately upon approval.
· Reported that the same civil engineer worked on the grading and drainage plan for
all three lots.
· Assured that there would be no drainage from his property onto his neighbor's
property.
· Offered to get together with his neighbor to work together to help alleviate his
existing drainage issues too.
Commissioner Gibbons asked for the construction schedule.
Mr. Lloyd Manson replied that construction should take less than six months weather
permitting.
Commissioner Gibbons asked Mr. Lloyd Manson if he has studied the imposed
conditions for fencing, nose and construction parking and understands them.
Mr. Lloyd Manson replied that he has been a contractor for 30 years and understands
the requirements.
Motion:
Upon motion of Commissioner Roseberry, seconded by
Commissioner Francois, the Planning Commission adopted
Resolution No. 3713 granting a Site and Architectural Review
Permit (PLN2006-19) to allow the construction of a new single-
family residence on property owned by Mr. Lloyd Manson located
at 1555 Van Dusen Lane, by the following roll call vote:
AYES: Alderete, Doorley, Ebner, Francois, Gibbons, Rocha and
Roseberry

Chair Alderete advised that this action is final unless appealed in writing to the City
Clerk within 10 calendar days.

REPORT OF THE COMMUNITY DEVELOPMENT DIRECTOR
The written report of Ms. Sharon Fierro, Community Development Director, was
accepted as presented with the following additions:
. Reported that there would be four items on the next Planning Commission agenda.
. Pointed out that supplemental information was distributed to the Commissioners
this evening in preparation for the public hearing on the Historic Design Guidelines
that will occur at the next meeting on April 25th.
ADJOURNMENT
The Planning Commission meeting adjourned at 7:48 p.m. to a Study Session
immediately following and subsequently to the next Regular Planning Commission
Meeting of April 25, 2006.
