To whom it may concern,
We are requesting a waiver of underground utilities, for our parsonage,
and to install overhead services for the following reasons.
1. The cost of the underground srevice would be exorbitant compared to the
several hundred for overhead service, we would be paying eight to twelve
thousand dollars for the underground electrical service. This is a real burden
for a non-profit group who have worshipped here for over sixty years.
2. The houses and businesses around us are overhead electrical services.

At the regular meeting of January 4, 2000, the City Council held a public hearing to
consider approval of an application, on behalf of Calvary Temple of Campbell, for
approval of a Modification (M98-16) to a previously approved Planned Development
Permit to allow the installation of a factory manufactured house and carport, for use as
a residence for the pastor on property located at 202 Railway Avenue, in a PD (Planned
Development) Zoning District.
After due discussion and consideration, the City Council adopted Resolution No. 9628
approving a Modification (M98-16) to a previously -approved Planned Development
Permit as stated in the prior paragraph.
Please find a certified copy of Resolution No. 9628 attached for your records. I have
also attached a copy of the follow-up letter to the applicants.

BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CAMPBELL APPROVING A MODIFICATION (M 98-16) TO A
PREVIOUSLY-APPROVED PLANNED DEVELOPMENT PERMIT TO

After notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the City Council finds as follows with respect
to application M 98-16.
1. The installation of the manufactured housing unit as a residence for the pastor is incidental to
the operation of the site as a church facility.
The proposed project is consistent with the South of Campbell Avenue Area (SOCA) Plan by
siting the proposed dwelling on the Dillon Avenue frontage and using the SOCA guidelines
for residential development to integrate the project with adjacent residential uses.
3. The proposed project is well designed and is architecturally compatible with the surrounding
neighborhood.
4. The proposed project is consistent with other developments in the surrounding area and is
consistent with the development standards for residential uses.
5. Adequate parking is provided for both the chumh facility and the pastor's residence.
Based upon the foregoing findings of fact, the City Council further finds and concludes that:
1. The proposed development and uses are compatible with the General Plan of the City and
will aid in the harmonious development of the immediate area.
2. The proposed development is consistent with the City's Zoning Ordinance.
3. The proposed development and uses clearly will result in a more desirable environment and
use of land than would be possible under any other zoning classification.

The proposed development will not result in allowing more residential units than would be
allowed by other residential zoning districts which are consistent with the general plan
designation of the property.
5. The proposed development will not be detrimental to the health, safety or welfare of the
neighborhood or of the City as a whole.
Further, the applicant is notified as part of this application that they are required to comply with
all applicable Codes and Ordinances of the City of Campbell and the State of California, which
pertain to this application and are not herein specified. And, that this approval is granted subject
to the following Conditions of Approval.
COMMUNITY DEVELOPMENT DEPARTMENT
1. Approved Project:' Approval is granted for a Modification (M 98-16) to a previously
approved Planned Development Permit (PD 80-06) to install a manufactured housing unit to
be located at 202 Railway. Project approval shall substantially comply with the project plans
prepared by Butch Cotton and Richard Haro, date stamped as received by the Planning
Department on November 12, 1999, except as modified by the Conditions of Approval
herein.
2. Use of Residence: The residence shall be used for occupancy by an employee of the church
and shall not be rented out.
Landscaping Plan: The applicant shall submit a landscaping and irrigation plan to be
reviewed and approved by the Community Development Director, prior to issuance of
building permits for the project. The plans shall address the following:
a. Preparation of landscape plans consistent with the City's Water Efficient Landscape
Guidelines (WELS).
b. Provision of street trees and trees in the front yard area with a minimum container size of
15 gallons.
c. Provide shrubs at the base of the unit to screen the foundation.
d. Indicate the installation of an automatic irrigation system.

Compliance with previously-approved Planned Development Permit: The applicant shall be
required to comply with all conditions of approval of the previously-approved Planned
Development Permit (PD 80-06), unless superceded or modified by the Conditions of
Approval herein for M 98-16.
5. Park Impact Fee: The applicant shall be required to paya Park Impact Fee of $10,990 per
unit, prior to issuance of a certificate of building occupancy for each unit.

6. Fences: Any newly proposed fencing shall comply with Section 21.59.090 of the Campbell
Municipal Code. An open slat picket fence shall be installed at the front property line.
Architectural Details: Plans submitted for building permits shall include the following
details:
A minimum roof cave of 8-inches shall be provided.
The front porch shall have a screen at the base to match the porch materials.
Trim materials shall be consistent with the samples submitted to the Planning Division on
November 1, 1999.
8. Parking and Driveways: All parking and driveways shall be developed in compliance with
the standards in Chapter 21.50 of the Campbell Municipal Code.
BUILDING DIVISION
9. Conditions of Approval: Plans submitted for Building Permits shall include a sheet that
contains a copy of the Conditions of Approval.
10. Plans Required: A building permit application shall be required for the proposed structure.
The permit shall include Electrical, Plumbing, and Mechanical fees when such work is
part of the permit.
11. Size of Plans: The maximum size of construction plans submitted for building permits
shall be 24-inches by 36-inches. The minimum size is 18-inches by 24-inches.
12. Title 24 Energy Compliance: California Title 24 Energy compliance forms CF-IR and
MF-1R shall be blue-lined on the construction plans.
13. Approvals Required: The project requires the following agency approval prior to issuance
of the building permit.

14. Calculations and Details: Provide calculations and details required for review and approval

access and water supply as they pertain to fire department operations, and shall not be
construed as a substitute for formal plan review to determine compliance with adopted
model codes. Prior to performing any work the applicant shall make application to the
Building Division for approval of all applicable construction permits.
16. Addressing: Provide minimum 4" address numbers visible to the public right of way.
17.
Required Fire Flow: Required fire flow for this project is 1,000 GPM at 20-psi residual
pressure. The required fire flow is available form area water mains and fire hydrant(s),
which are spaced at the required spacing.
PUBLIC WORKS DEPARTMENT
18. Street Improvements: Prior to issuance of any grading or building permits for the site, the
applicant shall execute a street improvement agreement and shall cause plans for public
Street Improvements to be prepared by a registered civil engineer pay fees, post security and
provide insurance necessary to obtain an encroachment permit for construction of the public
improvements, as required by the City Engineer. The plans shall include the following:
· Removal of the existing driveway approach and construction of replacement sidewalk,
curb and gutter and landscape.
19. Maintenance Security: Prior to issuance of occupancy approval for the site, all public street
improvements required by the street improvement agreement and the encroachment permit
must be completed and accepted by the City and the applicant must provide a one-year
Maintenance Security in an amount of 25% of the Faithful Performance Bond.

RECOMMENDATION
The Planning Commission recommends that the City Council take the following action:
Adopt a Resolution incorporating the attached findings and approving a modification (M
98-16) to a previously approved Planned Development Permit (PD 80-06) to allow the
development of a residence, subject to the attached conditions of approval.
ENVIRONMENTAL DETERMINATION: This project is categorically exempt under
section 15303 (a) Class 3, pertaining to new construction of (three or less) single-family
structures; therefore, no environmental action is required.
BACKGROUND
On November 23, 1999, the Planning Commission adopted Resolution No. 3245
recommending that the City Council approve a Modification to a'previous Planned
Development Permit (PD 80-06) for the Calvary Baptist Church to allow the installation
of a factory manufactured housing unit on the Dillon Street frontage of the site. The unit
is 1,700 square feet in area and has a detached carport. The dwelling will be used by the
church as a residence for the pastor and would be situated in a portion of the existing
parking area.
General Plan and Zoning Consistency: The project is located in the South of-Campbell
Avenue area and is governed by the provisions of the South of Campbell Avenue (SOCA)
Area Plan of the General Plan. The General Plan Land Use Map indicates a mixed-use
designation of Industrial/Commercial and Residential.
The SOCA plan allows residential development where it is contiguous to other residential
development. The Commission found the proposed property to be adjacent to residential
development south of the project site along Dillon Avenue. While the proposed building
will be used as a residence, it is considered an accessory use to the church and has not '
been designed to function independently.

The SOCA plan sets forth project design criteria for new development. The project is
consistent with these guidelines by providing a visible entry, adequate parking and related
landscaping improvements·
The zoning designation for the project site is Planned Development (PD) and a
modification to a Planned Development Permit must be approved by the City Council to
allow construction of the project. The proposed project will be consistent with the zoning
ordinance with approval of the Modification to the Planned Development Permit.
Prqiect Design: The proposed residence will be a single story structure that incorporates
horizontal wood siding with a simple gable roof using composition shingles. This
building style is indicative of other residential structures along Dillon Avenue and the
building placement works well with the existing site layout. The installation of the
manufactured housing unit on an unused portion of the church's parking lot on the Dillon
Street frontage does not impact the required parking for the church.

1. Deny the applicant's proposal
2. Continue for further review.
3. Refer the application back to the Planning Commission.
FISCAL IMPACTS
This project will generate approximately $11,000 in park impact fees at the time of
building occupancy.

· Advised that Calvary Church is seeking approval to install a manufactured housing unit on
their site for use as the Pastor's residence. This housing is integral to the operation of the
church.
· The application requires the Modification to a Planned Development Permit.
· The applicant has worked with staff and the housing unit has been sited to blend in with the
homes in the surrounding neighborhood.
· The one-story housing unit consists of 1,740 square feet of living space which includes two
bedrooms and a den as well as a two-car carport. The entrance faces onto. the street and
includes a porch and well-defined front entry. Sufficient parking is provided and the
applicant will plant street trees. Building materials include composition shingle roofing
material, wood trim and siding and porch and railings painted to match the trim. A curb cut
will be eliminated.
· The property is located within the SOCA (South of Campell Avenue) special development

DISCUSSION
Applicant's Proposal: The applicant is requesting approval of a Modification to the
Planned Development Permit for the Calvary Baptist Church to allow installation of a
factory manufactured housing unit on the Dillon Street Frontage of the site. The unit is
1,700 square feet in area and has a detached carport. The dwelling will be used by the
church as a residence for the pastor.
ANALYSIS
General Plan Consistency:
The project is located in the South of Campbell Avenue area and is governed by the
provisions of the South of Campbell Avenue (SOCA) Area Plan of the General Plan. The
General Plan Land Use Map indicates a mixed-use designation of Industrial/Commercial
and Residential.
The SOCA plan allows residential development where it is contiguous to other residential
development. The proposed project is adjacent to a single-family home to the south.
While the proposed building will be used as a residence, it is considered an accessory use
to the church and has not been designed to function independently.
The SOCA plan sets forth project design criteria for new development.
consistent with these guidelines by providing the following:

Zoning Consistency: The zoning designation for the project site is Planned Development
(PD) and a Planned Development Permit must be approved by the City Council to allow
construction of the project. The proposed project will be consistent with the zoning
ordinance with approval of the Modification to the Planned Development Permit.
Surrounding Neighborhood: The manufactured unit will face Dillon Avenue and has
been evaluated to determine how well it will blend with the adjacent land uses. Dillon
Avenue contains a mix of buildings including small warehouse buildings that are
occupied by contractors and several older single-family homes. The homes are primarily

single story buildings with horizontal wood siding; some have stucco siding. Gable roofs
and wood trim around doors and windows are typical.
Site Plan: The building is located in the existing church parking lot, oriented to face
Dillon Avenue. The unit will be used exclusively as a residence by the pastor of the
church and will remain on the same lot with the Church. The building has a front yard
setback of 20 feet, similar to other homes in the area.
Unit Design: The unit will be one story in height and will incorporate horizontal wood
siding with a simple gabled roof using composition shingles, wood trim around windows
and doors. The front entry is recessed and has a front pomh with wood railings painted to
match the building trim.
Parking: The unit will be installed in a portion of the church's parking lot, reducing the
parking to 55 spaces. The church has a 200-seat capacity, requiting 50 parking spaces.
The parking for the church meets the requirements of the zoning ordinance. The
manufactured unit will meet the parking requirement for a single-family home by
providing a 2-ear eat'pon accessed through the church parking lot on Railway Avenue.
Landscaping: The applicant will be required to plant street trees on Dillon and remove
the existing driveway and curb cut since there will be no access to the carport from
Dillon. A variety of shrubs will be used to enhance the site and a lawn will be planted on
the Dillon frontage to enhance the street appearance.
Site and Architectural Review Committee: The Site and Architectural Review
Committee considered this application at its meeting of October 12, 1999. The
Committee was generally supportive of the application but requested that the applicant
return to SARC at their next meeting with accurate plans and additional details. The
plans were reviewed on October 26, 1999 and SARC is supportive of the project.

Findings for the Planning Commission to recommend that the City Council Approve a
Modification to a Planned Development Permit to allow the installation of a factory
manufactured housing unit to be used as a residence for the pastor of Calvary Baptist
Church.
The Planning Commission finds as follows with regard to File No. M 98-16:
1. The installation of the manufactured housing unit as a residence for the pastor is
incidental to the operation of the site as a church facility.
The proposed project is consistent with the South of Campbell Avenue Area (SOCA)
Plan by siting the proposed dwelling on the Dillon Avenue frontage and using the
SOCA guidelines for residential development to integrate the project with adjacent
residential uses.
3. The proposed project is well designed and is architecturally compatible with the
surrounding neighborhood.
4. The proposed project is consistent with other developments in the surrounding area
and is consistent with the development standards for residential uses.
5. Adequate parking is provided for both the church facility and the pastor's residence.
Based upon the foregoing findings of fact, the Planning Commission further finds and
concludes that ·
1. The proposed development and uses are compatible with the General Plan of the City
and will aid in the harmonious development of the immediate area.
2. The proposed development is consistent with the City's Zoning Ordinance.
The proposed development and uses clearly will result in a more desirable
environment and use of land than would be possible under any other zoning
classification.
The proposed development will not result in allowing more residential units than
would be allowed by other residential zoning districts which are consistent with the
general plan designation of the property.

1. Approved Proiect: Approval is granted for a Modification (M 98-16) to a previously

the project plans prepared by Butch Cotton and Richard Haro, date stamped as
received by the Planning Department on November 12, 1999, except as modified by
the Conditions of Approval herein.
Landscaping Plan: The applicant shall submit a landscaping and irrigation plan to be
reviewed and approved by the Community Development Director, prior to issuance of
building permits for the project. The plans shall address the following:
a. Preparation of landscape plans consistent with the City's Water Efficient
Landscape Guidelines (WELS).
b. Provision of street trees and trees in the front yard area with a minimum
container size of 15 gallons.
c. Provide shrubs at the base of the unit to screen the foundation.
d. Indicate the installation of an automatic irrigation system.
Compliance with previously-approved Planned Development Permit: The applicant
shall be required to comply with all conditions of approval of the previously-
approved Planned Development Permit (PD 80-06), unless superceded or modified by
the Conditions of Approval herein for M 98-16.
4. Park Impact Fee: The applicant shall be required to pay a Park Impact Fee of $10,990
per unit, prior to issuance of a certificate of building occupancy for each unit.

Fences: Any newly proposed fencing shall comply with Section 21.59.090 of the
Campbell Municipal Code. An open slat picket fence shall be installed at the front
property line.

Architectural Details: Plans submitted for building permits shall include the
following details:
· A minimum roof cave of 8-inches shall be provided.

· Trim materials shall be consistent with the samples submitted to the Planning
Division on November 1, 1999.
7. Parking and Driveways: All parking and driveways shall be developed in compliance
with the standards in Chapter 21.50 of the Campbell Municipal Code.
BUILDING DIVISION:
8. Conditions of Approval: Plans submitted for Building Permits shall include a sheet
that contains a copy of the Conditions of Approval.
Plans Required: A building permit application shall be required for the proposed
structure. The permit shall include Electrical, Plumbing, and Mechanical fees when
such work is part of the permit.
10. Size of Plans: The maximum size of construction plans submitted for building
permits shall be 24-inches by 36-inches. The minimum size id 18-inches by 24-
inches.
11. Title 24 Energy Compliance: California Title 24 Energy compliance forms CF-1R
and MF-1R shall be blue-lined on the construction plans.
12. Approvals Required: The project requires the following agency approval prior to
issuance of the building permit.

of site access and water supply as they pertain to fire department operations, and
shall not be construed as a substitute for formal plan review to determine
compliance with adopted model codes. Prior to performing any work the applicant

17. Street Improvements: Prior to issuance of any grading or building permits for the
site, the applicant shall execute a street improvement agreement and shall cause plans
for public Street Improvements to be prepared by a registered civil engineer pay fees,
post security and provide insurance necessary to obtain an encroachment permit for
construction of the public improvements, as required by the City Engineer. The plans
shall include the following:

· Advised that the applicant is seeking a fence exception to allow an 8-foot high fence for 72
feet of fence area located at the rear property line using a lattice extension.
· The subject property is surrounded by single-family residences to the south, east and west and
a multiple family residential project (townhomes) to the north.
· The applicant seeks the extension for safety and privacy reasons, as there is a pool on their
property. They are concerned about youngsters from the townhome project getting into their
· yard and pool.
· Advised that the City has received two letters objecting to the extension from two different
residents of the townhome project. Those property owners are concerned about increased

Land Development Manager, on behalf of the City Engineer, has reviewed your request for an
overhead utilities waiver to permit overhead services to the new parsonage unit on the above-
referenced property in lieu of the requirement to underground utilities on the site.
This request has cannot be approved since there is a high likelihood that other utility lines will
be placed underground in the area in the future. Staff recommends that you consider splicing
utilities off the existing buildings on the site and mnning them underground along the
landscaping areas to the new parsonage unit. If that is not possible, you will need to bore under
Dillon Avenue or nm a line from the utility pole on Railway Avenue underground through the
parking and planting areas to the residential unit.

the submitted information your application has been determined to be incomplete. Additionally, concerns have
been expressed regarding the proposed building design and site layout:
The following information needs to be submitted to complete your request:
1) The site plan needs to depict the following:
a) Dimensions to the center line of the adjacent roadways.
b) Illustration of current improvements such as driveways, sidewalks, street trees and curb cuts on both
street frontages.
c) Locations of buildings and description of uses on adjacent properties.
2) Building Elevations:
a) The proposed covered parking facilities for the residence need to be illustrated with the elevations of the

b) It is recommended that a more traditional building style be presented which is represented along the

The orientation of the residence should present an entrance to the Dillon Avenue frontage. This may be
accomplished through the addition of a pomh element and the provision of a front yard area at this
portion of the site.
3) Building Placement:
a) The current building placement eliminates a row of perpendicular parking spaces by eliminating the
require backup distance. This site layout should be revisited.

Dear Mr. Haynes,
The various departments have reviewed your preliminary plan. During this review a letter was also sent to the
Pastor by the Building Official, Mr. Frank Cauthom, based upon a number of code violations he found on the
site, and which the f'des indicated had been in violation for a number of years.
In response to the code violation letter, the Pastor sent Lester G. Sachs, a lawyer representing the church, to
the City for discussions. A copy of Mr. Sach's response letter is enclosed. In summary, the cargo trailer and
parked track are going to be removed, and you will be pursuing the application for a Planned Development
Permit for the house and redesign of the parking and landscaping in a timely manner. Also, after approval by
the Planning Commission of the PD Permit, the construction of the house and the landscaping and parking
improvements will also be pursued with due diligence. This is in recognition that the use of an RV for living
purposes, as is the situation presently, is not permitted by City codes.
The following are the comments from the various depa, h, ent which should be utilized in composing the
details of your formal application:
1. Any storage capacity needed by the church should be considered in the design, so that no cargo containers
are required, as these are not permitted by the City as a long term use.
2. The landscaping areas should be clearly delineated. They are to include perimeter landscaping of the
parking lot, i.e., between the parking areas and the sidewalk and the parking lot and the side property
lines. The expanse of asphalt on the interior of the parking area should be broken by landscape islands.
The house is to have a landscaped front yard. The plan submitted meets these requirements.
3. It should be understood that one of the Planned Development Permit conditions of approval for the house
will be the subsequent submittal of a landscape and imgation plan by a landscape architect detailing the
layout of the plants and watering system for the landscape areas indicated. The installation of the
landscaping will be required prior to the house being fmalled for occupancy. If time is an issue, the
landscaping may be bonded for, provided the landscape architect's plan has been submitted and approved.
4. If the Church is to qualify under the Park Impact Fee Ordinance for a pastor residence fee ($5,635),
instead of the single family house fee ($10,990), the area used solely for the Pastor's residence must be
limited to a maximum of 640 square feet.
If the Pastor is planning to utilize any of the house for Pastoral office space, this should be noted on the
floor plan. If the bedrooms other than the Master bedroom were to be utilized for meeting rooms for the _
Church, and the large open area constituting the living room, dining room, kitchen and breakfast uses
were to be serving double duty for congregational functions, and were also so labeled, then, perhaps, the
area remaining solely for private residential purposes could be brought under 640 square feet. I
understand that from time to time the Church has visiting pastors who bring their families. If this is not on
a permanent basis, and is limited in time, then the meeting rooms could have daybeds which function as

couches during the times they are used for meeting rooms, and the rooms could be labeled meeting/guest
room.
In the future, if the Church has a different Pastor whose family size requires more than 640 square feet,
the difference in the Park Fee would be required to be remitted ($10,900- $5,635 --.%5,625). If more than
640 square feet are to be private areas, the full fee would be due prior to occupancy.
5. On the site plan, the surrounding buildings and uses should be indicated. I have enclosed an aerial photo to
assist you in this matter.
I have enclosed an application form which includes a list of the items which should be included on the plans.

In August of 1993 we took in an application for a modification to a previous Planned
Development Permit to allow the construction of a 2248 sq.ft, residence in conjunction with
an existing church on the referenced property. A determination of application incompleteness
was sent Oct 1, 1993 to the applicant.
Pastor Watson recentiy contacted the office in regards to the depari~nent's position if a 720
sq. ft. residence (60x12) was proposed and the resulting park fee. Based upon the Park Fee
Ordinance, I explained the restriction of 640 sq.ft, to apply the lesser park fee of $5635
versus $10,990 typically required for a single family residence. _We have not received any
specific plans at this time so site planning and design issue and or options have not been
discussed. The feasibility of this project clearly appears to be fled to the cost.

The Community Development Department has conducted a review of your development

Staff has received a letter from Calvary Temple Church, inquiring about the
possibilities of constructing a parsonage on the above referenced property.
The property is currently zoned Planned Development. An existing day care
center and assembly hall were approved with a Planned Development Permit
(PD 80-06) on January 12, 1981. The Church proposes to build the parsonage
over the assembly hall for the Pastor to use as permanent living quarters.
A review of the previous approval and the zoning ordinance indicates that a
modification to the Planned Development approval would be required for
this process.
In the interim, the Pastor is also requesting temporary approval of a mobile
home to be located on the property until the parsonage is completed. The
proposed temporary use could be included in the modification with a
condition of approval limiting the duration of the temporary living quarters
to the onset of the actual construction of the parsonage, and by requiring
construction to commence and be completed within a specified time period.
Staff is supportive of the applicant's request, and would like to follow-up
with a letter advising them of the process, subject to your approval.

submittals, that joint development of your property is not likely based upon

Dear Sir,
Calvary Temple Church, located at 202 Railway Avenue, has no
parsonage to house its pastor and family. This has presented
the pastor with a serious problem, insamuch as he is
responsible for his own rent pay~mant. In the first
i~ difficult to find living quarters close to the church, and
when a house is found the rent is very high, OUr
at the present is low and the pastor's salary is minimal.
To remedy this problem the church is investigating the
pom~ibilities of building a parsonage above the existing
fellowship hall. A two story building has already been
apporved by the city for the £ellowship hall.
In the meantime, the church is looking for a way to house the
pamtor and his family in quarters that is not too expensive.
There are already connections for a motor home in the ~arkln~
l~t next to the fellowship hall. It would not be a problem
to set up a mobile home at that location, if allowed,
We are asking the city for permission to locate a moblie home
as a parsonage on a temporary basis, until we can build a
h~me. We have investigated the possibilities of a loan to do
this and have found the potential to be promising, At ou~
last board ~eting (3anuary 11, 1993), the church board
agreed to the need. We are hoping to begin construction
soon. Therefore we are asking for a permit to locate a
mobile home on the parking lot for this year~ until the
construction is completed.
