JOE SALVADOR LOCATED AT 238-246 RAILWAY AVENUE IN A P-D (PLANNED DEVELOPMENT) ZONING DISTRICT. APPLICATION OF MR. JOE SALVADOR ON BEHAIJF OF RAILWAY DISTRIBUTING, INC. FILE NO. PLN2002-02. After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the City Council did find as follows with respect to application PLN2002-02: The continued use of the property as a commercial construction supply storage yard and parking lot is consistent with the General Plan land use designation of Medium to High Density Residential/Commercial. 2. The proposed project is consistent with the P-D (Planned Development) Zoning District upon approval of a Conditional Use Permit Extension. 3. The continued use of the property as a commercial construction supply storage yard and parking lot is consistent with the SOCA Area Plan. No immediate development activity is proposed for this section of Railway Avenue. Should development activity be undertaken in the area which includes this parcel, the applicant has agreed to sign an agreement to abandon the use upon six months notice from the Redevelopment Agency. 5. The project provides five standard parking spaces and one handicapped parking space. 6. Approval of the Conditional Use Permit Extension will not impede the potential for future redevelopment of the area. 7. The project qualifies as a Categorically Exempt project per Section 15301, Class 1 (Existing Facilities) of the California Environmental Quality Act (CEQA). Based on the foregoing findings of fact, the City Council further finds and concludes that: City Council Resolutic.. The proposed use is compatible with the General Plan of the City and will aid in the harmonious development of the immediate area, 2. The proposed use is consistent with the City's Zoning Ordinance. 3. The proposed use will not be detrimental to the health, safety, or welfare of the neighborhood or the City as a whole. No substantial evidence has been presented from which a reasonable argument could be made that shows that the project, as currently presented and subject to the required Conditions of Approval, will have a significant adverse impact on the environment. 5. There is a reasonable relationship and a rough proportionality between the Conditions of Approval and the impacts of the project. NOW, THEREFORE, BE IT RESOLVED that the City Council approves an Extension (PLN2002-02) to a previously approved Conditional Use Permit (UP 84-19) to allow the continued use of the property as a commercial construction supply storage yard and parking lot on property owned by Mr. Joe Salvador located at 238-246 Railway Avenue, subject to the following conditions: Where approval by the Community Development Director, City Engineer, Public Works Director, City Attorney, or Fire Department is required, that review shall be for compliance with all applicable Conditions of Approval, adopted policies and guidelines, ordinances, laws and regulations, and accepted engineering practices for the item under review. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified: COMMUNITY DEVELOPMENT DEPARTMENT Planning Division Proiect Approval: Approval is granted for an Extension (PLN2002-02) to a previously approved Conditional Use Permit (UP 84-19) to allow the continued use of the property as a commercial construction supply storage yard and parking lot located at 238-246 Railway Avenue. The project shall substantially conform to the project exhibits listed below; except as may be modified by the Conditions of Approval contained herein: a. Project plans prepared by Bruno Marcelic Architect, A.I.A and received by the Planning Division on April 8, 2002. 2. Approval Expiration: The Conditional Use Permit shall be valid for a period of seven years from the date of City Council Ratification. Previous Conditions of Approval: The Conditions of Approval contained herein shall serve as the Conditions of Approval. The previous Conditions of Approval that have been satisfied or are no longer applicable to the current project have been removed. Extension of Time: An extension of time to complete the Conditions of Approval shall be submitted in writing to the Community Development Director prior to the final deadline. The Community Development Director shall review the request and determine whether a reasonable extension of time may be granted. Agreement to Vacate: Within 60 days of City Council Ratification, the applicant shall sign an agreement acceptable to the City Attorney, indicating that the applicant will abandon the use upon six months notice from the Redevelopment Agency should development activity be undertaken in the area that includes this parcel. Failure to satisfy this Condition of Approval within the specified time line will result in the Conditional Use Permit being void. Fencing: Within 60 days of City Council Ratification, the applicant shall install the sight obscuring fencing and shall be maintain such fencing in accordance with the approved plans. Any existing or proposed fencing shall comply with Section 21.59.090 of the Campbell Municipal Code. Failure to satisfy this Condition of Approval within the specified time line will result in the Conditional Use Permit being void. Parking Stall Re-Striping: Within 60 days of City Council Ratification, the applicant shall re-stripe the parking lot in accordance with the approved plans. The handicapped space shall be developed in accordance with all requirements of the California Building Code. Failure to satisfy this Condition of Approval within the specified time line will result in the Conditional Use Permit being void. Parking Area Use: The parking area as delineated on the plans shall not be used for storage of materials or supplies. Landscaping: Within 30 days of City Council Ratification, the applicant shall submit four (4) sets of a landscape plan to the Planning Division which shows the size, species, and method of irrigation for the new landscaping along the southwestern comer of parcel number 412-08-061. The landscape plan shall be reviewed and approved by the Community Development Director and the landscaping and irrigation shall be installed within 60 days of City Council Ratification. Failure to satisfy this Condition of Approval within the specified time line will result in the Conditional Use Permit being void. 10. Parking and Driveways: All parking and driveway areas shall be maintained in City Co,uncil Resoluti, PLN2002-02 - 238-246 Railway Avenue - Extension of a Conditional Use Permit Page 4 of 4 compliance with the standards in Chapter 21.50 of the Campbell Municipal Code. 11. Hours of Operation: The operational hours shall be limited to 6 a.m. to 11 p.m. daily, unless a Conditional Use Permit is obtained from the Planning Commission for late night operations. 12. Signs: No signage is permitted as part of the development application approved herein. New signage shall not be installed prior to approval of a sign permit as required by Chapter 21.53 of the Campbell Municipal Code. 13. On-Site Lighting: Any proposed on-site lighting shall be shielded away from adjacent properties and directed on site. The design and type of lighting fixtures and lighting intensity of any exterior lighting shall be reviewed and approved by the Community Development Director, prior to issuance of a building permit. Lighting fixtures shall be of a decorative design to be compatible with the development and shall incorporate energy saving features. " CITY COUNCIL ACTION The Planning Commission recommends that the City Council take the following action: Adopt a Resolution, incorporating the attached findings, approving an Extension (PLN2002-02) to a previously approved Conditional Use Permit (UP 84-19) to allow the continued use of the property as a commercial construction supply storage yard and parking lot, subject to the attached Conditions of Approval, and finding that this project is Categorically Exempt under Section 15301, Class 1, of the California Environmental Quality Act (CEQA) pertaining to the continued use of an existing facility. BACKGROUND The applicant is requesting a 10-year extension to a previously approved Conditional Use Permit allowing the continued use of the property for supply storage and parking at 238-246 Railway Avenue. The project site is located on the eastern side of Railway Avenue, eight parcels south of Sam Cava Lane. The original Conditional Use Permit approval included the establishment of a supply storage yard on the rear portion of the property and six parking spaces on the front portion of the property. New landscape planters were required along the western property line and a small portion of the southern property line. The Planning Commission and City Council have extended the Conditional Use Permit four times since the original approval in 1985. The property is located within the Redevelopment Project Area and the applicant has been willing both in the past and currently to abandon the use on the property upon six month's notice from the Redevelopment Agency should redevelopment activity be undertaken in the area that includes this parcel. A Condition of Approval has been added to the past Conditional Use Permit Extensions which requires the applicant to submit a written agreement to the City which legally binds the applicant to this agreement. The Planning Commission, at its meeting of May 28, 2002, forwarded a recommendation to the City Council by a 5-0 vote (one commissioner was absent) to approve the pmpose, dln'oj~t. \ , ANALYSIS General Plan Designation: The General Plan land use designation for the project site is Medium to High Density Residential/Commercial. The use of the property as a commercial construction supply storage yard and parking lot is consistent with this designation. South of Campbell Avenue (SOCA) Area: The subject property is located within Sub-Area 3 of the SOCA area and is subject to the SOCA Area Plan. The SOCA Area Plan allows commercial, residential, and mixed use developments within this area. Therefore, the use of the property as a commercial construction supply storage yard and parking lot is consistent with the SOCA Area Plan. Zoning Designation: The zoning designation for the project site is P-D (Planned Development). The proposed project is consistent with this zoning designation upon approval of a Conditional Use Permit Extension. Site Layout: The project site is 8,075 square feet and is used by the applicant as parking and supply storage for the adjacent commercial business (Railway Distributing Inc.) The rear portion of the site, approximately 3,850 square feet, is used as supply storage and the remaining front portion of the site is dedicated to parking and loading. Use: The applicant is requesting a ten-year Extension to the Conditional Use Permit instead of the previously approved five-year period. The applicant has proposed to make site improvements which include sight obscuring fencing on the rolling gate along the western property line, re-striping of the existing parking lot, and a new landscape planter along Railway Avenue on the adjacent property to the south (parcel number 412-08-061) that is also owned by the applicant. Staff is recommending that the City Council approve a seven-year Extension to the Conditional Use Permit with the provision that the applicant provide the proposed site improvements as shown on the proposed site plan and adhere to the Conditions of Approval, including a written agreement to abandon the use on the site upon six-months notice from the Redevelopment Agency if new development occurs in the area that would include this parcel. Landscaping: Two landscape planters are located along the western side of the property, on either side of the rolling gate, and one landscape planter is located along the southern property line. These landscape planters were required as part of the original Conditional Use Permit approval. The applicant is proposing to remove the small landscape planter along the southern property line and replace this landscaping with a new landscape planter along Railway Avenue on the adjacent property to the south (parcel number 412-08-061) that is also owned by the applicant. The applicant has indicated to staff that the proposed location for the new landscape planter would be more visible along Railway Avenue and would be less disturbed by on-site activities. ALTERNATIVES 1. Approve the proposed project subject to additional and/or modified Conditions of Approval. 2..Deny the proposed project. 3. Continue for further review. Commissioner Alderete questioned the criteria for the time limitation. Planner Stephanie Willsey replied that the criteria are typically the prospect for redevelopment of the area. He added that staff has not sought to achieve compliance with other properties as part of this request as they are separate. The uses across the street are existing legal, non-conforming uses. Staff notified him of the violation and a Conditional Use Permit application was submitted. Staff Report - Planning Cormnission Meeting of May 28, 2002 PLN2002-02 - 238-246 Railway Avenue Page 2 of 4 1985 Planning Commission and City Council approved the Conditional Use Permit for a period of three years. 1986 Planning Commission and City Council approved a reinstatement of the Conditional Use Permit for a period of two years since the applicant failed to satisfy the Conditions of Approval within the required 90-day period and the approval became void. 1988 Planning Commission and City Council approved an Extension of the Conditional Use Permit for a period of three years. 1991 Planning Commission and City Council approved an Extension of the Conditional Use Permit for a period of three years. 1994 Planning Commission and City Council approved an Extension of the Conditional Use Permit for a period of three years. 1997 Planning Commission and City Council approved an Extension of the Conditional Use Permit for a period of five years. Background: The original Conditional Use Permit approval included the establishment of a supply storage yard on the rear portion of the property and six parking spaces on the front portion of the property. New landscape planters were required along the western property line and a small portion of the southern property line. The property is located within the Redevelopment Project Area and the applicant has been willing both in the past and currently to abandon the use on the property upon six months notice from the Redevelopment Agency should redevelopment activity be undertaken in the area and include this parcel. A Condition of Approval has been added to the past Conditional Use Permit Extensions which requires the applicant to submit a written agreement to the City which legally binds the applicant to this agreement. ANALYSIS General Plan Designation: The General Plan land use designation for the project site is Medium to High Density Residential/Commercial. The use of the property as a commercial construction supply storage yard and parking lot is consistent with this designation. Therefore, the proposed project is consistent with the General Plan. South of Campbell Avenue (SOCA) Area: The subject property is located within Sub-Area 3 of the SOCA area and is subject to the SOCA Area Plan. The SOCA Area Plan allows commercial, residential, and mixed use developments within this area. Therefore, the use of the property as a commercial construction supply storage yard and parking lot is consistent with the SOCA Area Plan. The applicant has proposed to make site improvements which include sight obscuring fencing on the rolling gate along the western property line, re-striping of the existing parking lot, and a new landscape planter along Railway Avenue on the adjacent property to the south (parcel number 412-08-061) that is also owned by the applicant. Staff is recommending that the Planning Commission approve a seven-year Extension to the Conditional Use Permit with the provision that the applicant provide the proposed site improvements as shown on the proposed site plan and adhere to the Conditions of Approval, including a written agreement to abandon the use on the site upon six-months notice from the Redevelopment Agency if new development occurs in the area and includes this parcel. Landscaping: Two landscape planters are located along the western side of the property on either side of the rolling gate and one landscape planter along the southern property line. The applicant has indicated to staff that the proposed location for the new landscape planter would be more visible along Railway Avenue and would be less disturbed by on-site activities. Redevelopment Agency Review: The site is located within the Redevelopment Project Area. The Redevelopment Agency has reviewed the application and has no objections to the request. As we discussed, some improvements will need to be made to the subject property and adjacent properties. Due to several outstanding issues, your application has been deemed incomplete. Before this project can be placed on the Planning Commission agenda, a complete set of plans needs to be submitted which reflect the issues outlined below. Fences As we discussed, provide sight-obscuring fencing along the front property lines of parcel numbers 412-08-006, -054, -061, and -062, including the sliding gates. Please show al'l the property lines for these properties on the site plan and details on the proposed fencing material. Parking The existing six parking spaces need to be retained to support the business next door. Please indicate these six regular parking spaces on the revised plans. The handicapped parking space should be moved to the adjacent lot (264 Railway.) These spaces will need to be re-striped as part of the project. Please show the adjacent lot's parking spaces, including the moved handicapped parking space. When less than five spaces are provided, the handicapped parking space shall be 14 feet wide and lined to provide a nine foot loading area. Indicate plant/tree material and method of irrigation. Staff believes that these changes and improvements will enhance the site and support the request for the Use Permit extension. We are requesting the term of the permit be extended from 5 years to 10 years. We have had to renew this use permit 5 times since our first application in the early 1980's. We signed an agreement with the city to void the use permit and vacate the property with six months notice; therefore the term of the permit should not be an issue.
