The purpose of this letter is to clarify the timeline for correcting the two remaining violations. A building permit to either remove or legalize the spa cover shall be obtained no later than October 1, 2001 and a building permit to construct a new garage or carport shall be obtained no later than April 1, 2002. Thank you for your cooperation in resolving this matter. Failure to comply with these due dates will result in further code enforcement action which may include a Notice of Non-Compliance being recorded on the title of the above referenced property. It has been determined that the requested fence exception: 1. Will not impair vehicular or pedestrian safety; 2. A more desirable site layout will result; 3. Will not be detrimental to the health, safety, peace, morals, comfort or general welfare of the City; and 4. Will not be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. Therefore, your request for a fence exception has been approved. The fence exception is granted for the above referenced address, subject to the following conditions of approval: 1. The fence shall not exceed eight (6) feet in height and will be constructed of natural wood. The approved design consists of a six (6) foot "good neighbor" type fence. 2. The fence shall be contained entirely within the property lines and shall not encroach onto adjacent properties or the public right-of-way. 3. The existing non-conforming fence along the comer of Rex Circle and Sunberry Drive shall be removed. As you've seen from the footprint and our comer lot location off of Sunberry Drive and Rex Circle, the only space large enough to enjoy and relax outdoors is on the East side of the house on Rex Circle. A 6' high wooden fence located on the property lines of Rex Circle (near sidewalk) would provide us with a private and relaxed green space for our enjoyment and, perhaps in the future, space for our children to play in a safe environment. This fence location will not obstruct the view coming out of my drive way as I am located at the end of the circle. I would not be subject to any fast traffic that might cause a unsafe condition while exiting my driveway. Attached is the plan of the fence location, which I have initialed.
