Re: 181/191 W. Rosemary Lane- Fence Exception Application (PEN2003-20)
Dear Mr. Costantino:
The Community Development Director, upon recommendation from the Public Works Director,
has determined that the requested Fence Exception:
1. Will not impair vehicular or pedestrian safety;
2. Will result in a more desirable site layout from a maintenance and use standpoint;
3. Will not be detrimental to the health, safety, peace, morals, comfort or general
welfare of the City; and
4. Will not be detrimental or injurious to property and improvements in the
neighborhood or to the general welfare of the City.
Therefore, your request for a Fence Exception has been approved. The Fence Exception is
granted for the side property line between 181 and 191 West Rosemary Lane, subject to the
following conditions of approval:
1. Prior to construction of the fence, the applicant shall obtain a building permit
from the Campbell Building Division.
2. The fence shall not exceed seven (7) feet in height. The approved design consists
of a six (6) foot high board on board "good neighbor" wood fence with one (1)
feet of lattice on top.
3. The fence shall step down along the eastern property line beginning at 30 feet
from the front property line. The fence shall not exceed a height of 42 inches on
the side property line within fifteen feet of the front property line.
4. The fence shall be contained entirely within the property lines and shall not
encroach onto adjacent properties or the public right-of-way.
If you wish to build a similar fence along any other property lines, you will need to submit for
another fence exception. If have any questions about this approval, please do not hesitate to
contact me at (408) 866-2193.

Dear City Of Campbell,
This is a letter of request for a fence exception between
the properties of 181 and 191 W. Rosemary Lane, Campbell, 95008.
The existing fence, at 6 feet, does not provide sufficient
privacy between the two properties. In addition, the proposed
new fence would boast a one foot decorative strip of lattice on
the top. This would bring the height of the proposed new fence
to 7 feet.
If we were to build the new fence with the lattice on top
to a height of 6 feet, this would lessen the privacy factor
even more.
In addition, the property on the opposite side of our
home also sustained the same amount of damage during the storm.
I have spoken to our neighbor, and she would also prefer the
7 foot fence with the lattice on top. This would mean that after
all is said and done, the fences would match on both sides
of our home.
Thank you for your consideration on this matter.

Dear City of Campbell:
Letter of Consent
I am the homeowner of 191 W Rosemary. I am adjacent to the property of 181 W
Rosemary. Together we are both in agreement that a six-foot fence with a 1-foot lattice
strip will help in the privacy between the two properties.
If you have any questions, please comact me at anytime.
Thanks,
Dominic~ .
