Gentlemen:
We have an existing electrolier on the west side of Valley
Forge way near the north line of Lot 19 of Tract No. 3586
which has no service to it.
Would you please advise us of the cost for installing an
overhead drop to this electrolier. There is an existing
Pacific Gas and Electric Company power pole located approxi-
mately 100 feet to the west from the electrolier from which
we feel service may be available.
Your early consideration of this matter is requested and
appreciated.

It is stated in section 8 of the agreement between the City of Campbell and Briggs & Bell, ~.
Developers that the City ~ineers estimate of the value of the storm drain facilities installed
by Briggs & Bell in Tract No 3586 exceeds the area storm drain fees by $8,380.00. In recomp-
uti~ it has been found that by using the unit prices as listed in Resolution No 921, the value
of storm drain facilities installed exceeds the storm drain area fees of $3,230.00 by $10,162.75.
( These calculations are included with this letter as Exhibit A.)
The actual price paid to Leo F. Piazza, Contractor, for the installation of the storm drain
facilities was $15,700.25. In view of the fact that RelOlution No 921 says, in port, II Prices
subject to increase upon request by subdivider and lUb.equent approval by City Engineer."
it is hereby requested that the value of actual cost of the storm drain facilities installed ($15,700.25)
less the area storm drain fees ($3,230.00) or an amount of ($12,470.25) be agreed upon as the
amount that the value of the Itorm drain facilities installed exceeds the area storm drain fee
and that this amount of $12,470.25 credit be used in all further discussions. In support of this

At the time of the conception of the HamIlton Ave PfOiect It WCII coneemplCitM to use a
Local Improvement District to puref~.. the Right of Way nec....ry and fJQY for the actual
improvements as well as the incidental ape...s involved with the Looal Improvement District.
At this time the City of Campbell found that it had Insufficient funds to proceed with the
project and had almost decided to delay the project for one or two years. Mr Briggs offered to
contribute the sum of $20,000.00 to the project to purchase Right of Way and pay a portion
of the incidental expenses associated with the Local Improvement District to keep the project
alive and on this basis the project was continued and plans were completed. It was latet',.
found that the property owners fronting on Hamilton Ave were most cooperative and did in fact
contribute all required Right of Way at no cost to the City or the project. This in Itself resulted
in a substantial savings of costs totthe project.
The project was then designated as a gas tax fund project and bids were received on
that basis. The City had budgeted approximately $200,000 for this project, the E~ineer's
Estimate was $202,679. The low bid submitted by J.C.Batemen amounted to $155,755.30 or a
a ratio of 76.47 % of the Engineer's estimate.
It is hereby requested that because of the contribution of required Right of Way by the
owners and because of the change in concept of the job from a Local Improvement District
with its related incidental expenses and higher unit prices and because of the reduction
of bid prices to 76.47% of the budgeted amount for the cost of the job, the contribution
of Briggs and Bell be reduced to the same ratio of 76.47%, that is from $20,000.00 to
$15,294.00
It is further requested that the excess of value of storm drain facilities installed in Tract 3586
over the area storm drain fees, ie, $12,470.25, be credited against the proposed contribution
of $15,294.00 leaving a net contribution of $2,823.75 to be paid by Briggs & Bell. Under this
proposal the $2,823.75 would be paid by Briggs & Bell to the City and the remainder of
Briggs & Bell's property not now developed would be liable to full area storm drain fees
with no credit allowable from Tract No 3586.

Principal's subcontractors, fail to pay for any materials,
provisions, provender or other supplies, or teams, used in,
upon, for or about the performance of the work contracted to
be done, or for any work or labor thereon of any kind, or for
amounts due under the unemployment Insurance Act with respect
to such work or labor, the Surety will pay for the same, in
an amount not exceeding the sum specified in this bond, provided
that any and all claims hereunder shall be filed and proceedings
hud in connection therewith as required by the provisi.ons of
Sections 4200 to 4208, inclusive, of the GoverTh~ent Code of the

request for their being energized should be filed with this
office. If sufficient funds are available within the Dis-
trict at the time of this request, it will not be necessary
to delay service until July of 1965 when the annexation

Since the recordation of the map for your Tract 3586
nort.h 'oJf damilton Avenue, an inadequacy in the stipulated
fire hydrant pattern has been discovered. It is now determined
that sufficient protectivn for the properties conGe~:ned will
be afforded with the installation of an additional hydrant
opposite your lot 19 on Valley porge way. The total number of
hydrants required, then, becomes three instead of the two
previously called for.
The five-year rental fee which was collected a8 a condition
of map approval was $390.00 ($195.00 for each of tbe two hydrants).
An additional f195.00 is now due under this new d.etermination,
and this letter may be considered as billing for such an amount.
The belated nature of this determination is regretted,
however, the rather complex pattern involving future extension
and jurisdictions other than the City of Campbell has necessitated
a reconsideration.

MAYOR TO SIGN THE PROPOSED AGREEMENT.
WHEREAS, there has been submitted to the City Council
of the City of Campbell a final map of Tract No. 3586 for approval:
WHEREAS, an agreement, approved by the City Attorney as
to form, wh~ch covers conditions pertaining to the approval of said
map and acceptance of the dedicated streets, has been presented: and
WHEREAS, the City Engineer has signed the map that it
conforms:
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Campbell that said map be and the same is hereby
approved and that the streets, avenues and public ways shown thereon
be and the same are hereby accepted: and
BE IT FURTHER RESOLVED that the Mayor be and he is hereby
authorized to execute the said agreement on behalf of the City
of Campbell.

Gentlemen:
We have reviewed the Tentative Map lands of Mlll1ch sent to
us under your cover letter dated May 21, 1963, and have the following
comments to make:
1- The area labeled .. Future Flood Control Right of Way'" appears
to be in the proper location for the channel right of way. This should,
however, be verified with the County Department of Public Works, Roads
and Highw~ Division, as the channel right of way Will be adjacent to
and 80 ft. Westerly of their San Tomas Expressway right of way 11ne.
2- The Flood Control right of way should be delineated as be1ng
80ft. Wide.
3- The channel dedication should be made on a proportionate
basis in accordance With the policy set forth in the attached copy of a
letter dated May 17, 1963. This procedure has been discussed With
and is acceptable to both the City of Campbell and the County of Santa
Clara .

Dear Mr. Pott:
Thank you for sending us the map of the San Tomas Expressway
between Rincon Avenue and the extension Gold Finch Way (just north of
Hamilton Avenue) .
The construction of this reach of the expressway will in volve
a considerable relocation of the existing San Tomas-Aquino Creek . We
have been requested to determine the amount of dedication required for
the San Tomas-Aquino Creek Within the new location for the flood control
channel. The prospective filing of a subdivision map on the land of
Millich in the immediate future makes it imperative that the Flood Control
District adopt a pOlicy on dedication of right of way Within the reach
between Rincon Avenue and Gold Finch Way. We feel that the fairest
approach would be to require dedication in the new location for the San
Tomas Creek to the same extent as dedication would have been required
had the Creek followed its improvement of San Tomas Creek in either
its existing or planned location.
We, therefore, request that you require dedication Within this
reach on the properties named below as follows:
