We initially attempted to serve this site from the east since the natural slope of the land is in that direction. We contacted Mr. Bykowski, Mrs. Auger, Mrs. Beckett, the owner of the commercial building on Hamilton and the owner of the Beacon Gas station. All of these parties refused to even discuss the possiblity of granting us an easement except ~trs. Auger. Mrs. Auger seriously considered the idea but ultimately refused our offer of $8,000 to acquire an easement. Being unable to serve this property from the east we redesigned the site to flow to Llewellyn Ave. The closest storm drain main in this vicinity was at Llewellyn and Hamilton. Apparently this design was not acceptable since this site was not planned to drain into that drainage basin. We respectfully request that you reconsider this proposal considering the difficulties inherent on this site. As you know, rrost storm drain master plans and policies call for short return interval storms to be carried underground in pipes, and storms up to 100 year, intervals being carried in the street. I believe Campbell requires storms up to 5 years in recurrence being carried in pipes with the remaining carried overland. Adding our 2 AC subdivision to the drainage basin to the west would result in a storm drainage system for this basin with a capacity of maybe a 4.6 year storm instead of a 5 year storm being carried underground. Since the selection of a 2, 3 or 5 year recurrence interval for storm drain design is somewhat of an arbitrary decision weighing cost against the convenience of eliminating nuisance flooding, I feel this slight exception requested in this incident deserves some consideration. 10050 NO. The addition of this 2 AC site to the western drainage basin would have a insignificant effect if you were routing the 100 year storm. Actually if you were to route the 100 year storm from this site down Llewellyn toward Hamilton the majority of the water would flow down the east side of Llewellyn and turn easterly on Hamilton, toward the proposed basin for this area. If the initial design is unacceptable we would have to extend a storm drain main easterly down Hamilton Ave. from the intersection of Llewellyn to the existing manhole 140 ft. westerly of Carlyn Ave. as shown on the enclosed plans. An out of tract storm drain extension of this magnitude is beyond the financial capabilities generated by this 30 lot subdivision. This out of tract storm drain extension would be sized to handle the 3 acre church site to the south. Since this out of tract extension is oversized to handle the adjacent property, we request the City of Campbell eliminate our storm fee and reimburse us for the cost of running this main down Hamilton from Llewellyn to the existing manhole. We will pay for the installation of the oversized main on Llewellyn from our site to Hamilton Avenue. As a third alternative to our storm drain dilemma we would request that the City of Campbell use their power of condemnation to assist us in obtaining an easement along our northeasterly boundary. To be all at Daiwa House cost. Use of eminent domain subject to Council agreement. Storm drain fee monies could be off-set by their off-site costs in accordance with our schedules. (He said that wouldn't make much difference because our storm drainage area fees are so low). He asked that, in light of our low fees, could they be paid by Church property developers the actual cost of the over- sizing rather than the Church property area fees?
