The applicant is notified as part of this application that he is
required to 'meet the following conditions in accordance with
Ordinances of the City of Campbell.
A. All parking and driveway areas to be developed in compliance
with Section 9319 of the Campbell Municipal Code.
B. Underground utilities to be provided as required by Section
9110.6 of the Campbell Municipal Code.
c. Plans submitted to the Building Department for plan check
shall indicate clearly the lo.cation of all connections for
underground utilities including water, sewer, electric,
telephone and television cables, etc.
D. Sign application to be submitted in accordance with provisions
of the sign ordinance for all signs. No sign to be installed
until application is approved and permit issued by the Building
Department.
E. Applicant to pay storm drainage area fee in the amount of
$170.00.
The applicant is notified that he shall comply with all applicable
Codes or Ordinances of the City of Campbell which pertain to this
development and are not herein specified.
Approval, subject to the following conditions:
1. Property to be 4~nced and landscaped as indicated and as
added in "red" on plans.
2. Landscape plan indicating type of plant material, location of
hose bibs and type of fencing to be submitted for approval of
Planning Director at time of application for building permit.
3. Faithful performance bond in the amount of $1,000 to be posted
to insuTe landscaping, fencing and striping of outdoor parking
areas \~ithin three months of completion of constructionj or
applicant may file written agreement to complete landscaping,
fencing and striping of parking area prior to final Building
Department clearance.

That we, Calvin D. Falcon as Principal, and HAR TFORD ACCIDENT &
INDEMNITY CO., a corporation organized under the laws of the State of
Connecticut and duly authorized under the laws of the State of California to
become sole surety on bonds and undertakings, as Surety, are held and firmly
bound unto CITY OF CAMPBELL, A MUNICIPAL CORPORATION OF THE STATE
OF CALIFORNIA, as Obligee, in the full and just sum of FIVE HUNDRED
DOLLARS AND NO/ 1 00 ($500.00), lawful money of the United States of America,
to be paid to the said Obligee, successors or assigns; for which payment, well
and truly to be made, we bind ourselves, our heirs, executors, successors,
administrators and assigns, jointly and severally, firmly by these presents.
THE CONDITION OF THE ABOVE OBLIGATION; is such that whereas the said
Principal has to guarantee to the CITY OF CAMPBELL that a 411 Dry Fire Line
with Fittings will be installed at 141 Lost Lake Lane, Campbell, in accordance
with agreement on file.
WHEREAS, to insure the Performance of the condition recited above, the
Principal is required to file with the Obligee, a bond conditioned for such
compliance;
NOW, THEREFORE, if the above bounden Principal shall faithfully perform
the condition above stated relating to the 4" Dry Fire Line with Fittings then
this obligation shall be null and void; otherwise to remain in full force and effect.
It is further provided that this bond will be in force for a period of 12 months
and will be renewed for successive 12 month periods until the improvements
have been installed. The surety herein shall have the right to withdraw as surety
from this bond, except as to any liability already incurred or accrued, and may
do so upon giving the said principal thirty (30) days I written notice to that effect,
and at the end of said thirty days I period of notice the liability of the surety
under this bond, except as to any liabilities or indebtedness already incurred or
accrued, shall cease, and said bond shall thereupon terminate and be of no more
force or effect, except as to any liabilities or indebtedness already incurred or
accrued thereunder.

Section 9316.1 of the Campbell Municipal ~ode reaas as follows:
Any approval granted under this section shall expire one llundred eighty
(180) days after the date upon which such approval was granted, unless
an extension for such approval is obtained by making written application
for same to the Planning Commission at least fifteen (15) days prior to
the expiration date of such approval.
No building permit shall be issued after the expiration date of any
approval until a l~CVJ approval has been obtained in the manner provided
for in this chapter.

INTRODUCTION:
The Fire Department has attempted to work out with Mr. Falcon an equitable
plan to provide for the installation of a dry water line for fire purposes into
his property. Mr. Falcon has requested that the staff hold off any recommendation
to insist upon this line until he has had time to discuss with Santa Clara County
Park and Recreation Department any proposed water line facilities they intend
to install on the Los Gatos Creek Park site which is immediately to the rear of
his property. The staff has offered an altern~te proposal in which Mr.
Falcon would sign an agreement with the City stating that when Mr. Toy of the
adjacent Water Softening Company further develops his business that he. in turn.
would be willing to share the cost of the installation of the required water line.
Mr. Falcon did not appear to be satisfied with this proposal. and stated he would
wait and see what developed at the continued Public Hearing.
RECOMMENDATION:
It is recommended that Mr. Falcon be held to the agreement of the original
proposal to install the dry water line into his property to insure the proper
fire protection as a condition of the 'IS! approval.
DISCUSSION:
I have reviewed the preliminary plan of the ten acre parcel which has been
acquired by the Santa Clara County to be developed for park purposes. In the
way of facilities the plan proposQs only a small restroom building. It is our
opinion that the development of the ten acre park would have no bearing upon
the installation of a dry water line to serve the subject industrial property.
The most equitable method of meeting the fire requirements would be the altcrn~te
proposal made by the Fire Department which provides that Mr. Falcon and Mr. Toy
join together with one line serving both properties. Since Mr. Falcon is not
satisfied with this proposal. we can see no alternative but to recommCi.d the
installation of the dry water line on Mr. Falcon's property at this time.
