RECORDATION OF HERITAGE TREE
DESIGNATION
This Recordation is executed and delivered as of theo~_~day of March, 2003, by the City
of Campbell, having a business address of 70 North First Street, Campbell, California 95008
(hereinafter referred to as "City"), in favor of and for the benefit of the City of Campbell, having
an address at 70 North First Street, Campbell, CA 95008 (who is hereinafter referred to as
"City").
WITNESSETH:
WHEREAS, Barry Shilman and Susan Blake (hereinafter referred to as "Owners"), are
the sole owners in fee of certain real property commonly known as 84 North Third Street,
Campbell, California (Santa Clara County Assessor's Parcel Number 279-39-006), and more
particularly depicted in Exhibit A attached hereto and made a part hereof (hereinafter referred to
as the "Subject Property");
WHEREAS, on January 22, 2003, the Historic Preservation Board of the City adopted
Resolution No. 2003 approving a Heritage Tree Designation for a sixty-six inch in diameter,'
seventy year-old Redwood Tree on the Subject Property, the location of which is depicted on
Exhibit B attached hereto and made a part hereof.
WHEREAS; the Zoning Code requires the City to record the designation with the County
Recorder's office and a copy shall be provided to the property owner and the Community
Development Department.
NOW, THEREFORE, PLEASE TAKE NOTICE:
1. The tree depicted on Exhibit B has been declared a Heritage Tree under Chapter 21.56 of
the Campbell Municipal Code.
2. The designation set forth herein shall be appurtenant to and run with the land.
3. This Recordation shall be recorded in the Santa Clara County Office of the Recorder.
4. Owner shall obtain all proper City approvals before the removal of the said Heritage Tree
Designation.

BOARD OF THE CITY OF CAMPBELL BESTOWING HERITAGE
TREE DESIGNATION (PLN2002-134) UPON A 66-INCH IN
DIAMETER, 70 YEAR OLD REDWOOD TREE ON PROPERTY
OWNED BY SUSAN BLAKE AND BARRY SHILMAN LOCATED AT
84 N. THIRD STREET IN A P-D/H (PLANNED
DEVELOPMENT/HISTORIC OVERLAY) ZONING DISTRICT.
APPLICATION OF SUSAN BLAKE AND BARRY SHTLMAN. FILE
NO. PLN2002-134.
After notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Historic Preservation Board did find as
follows with respect to application PLN2002-134:
1. This 66-inch diameter, 70-year-old Redwood tree is on the Historic Preservation Board Tree
Survey, which was completed in 2002.
2. This 66-inch diameter, 70-year-old Redwood tree represents an outstanding specimen of a
desirable species.

The tree proposed for Heritage Tree Designation is one of significant age and/or girth and
located within the jurisdiction of the City of Campbell on a property which is included on the
City's Historic Resources Inventory.
Based on the foregoing findings of fact, the Historic Preservation Board further finds and
concludes that:
1. The Tree is unique and important to the Community; and
No substantial evidence has been presented from which a reasonable argument could be
made that shows that the Heritage Tree Designation will have a significant adverse impact on
the environment.
NOW, THEREFORE, BE IT RESOLVED that the Historic Preservation Board bestows Heritage
Tree Designation (PLN2002-134) upon a 66-inch diameter, 70-year-old redwood tree on
property owned by Susan Blake and Barry Shilman located at 84 N. Third Street.

and Susan Blake at 84 N. Third Street in a P-D-H (Planned
Development/Historic Overlay) Zoning District.
STAFF RECOMMENDATION
That the Historic Preservation Board take the following action:
Adopt a resolution, approving the Heritage Tree Designation for a 66-inch diameter, 70-year
old Redwood tree at 84 N. Third Street.
DISCUSSION
The applicant has submitted an application for a Heritage Tree Designation for a 66-inch
diameter, 70-year old Redwood tree, located at 84 N. Third Street, which is a Historical
Landmark. The Coast Redwood tree was planted in approximately 1933 when the existing house
was moved from its original location. The date of planting was confirmed by Mr. Robert Ferro,
deceased, of 90 N. Central Avenue, son of the property owner in 1933. The Redwood tree is
sixty-six inches in diameter, two-hundred eight inches in circumference, ninety-five feet tall and
has a canopy spread of thirty-two feet.
If the Heritage Tree Designation is approve~he City shall record the designation with the
County Recorder's office and a copy shall be provided to the property owner and the Community
Development Department. A listing of designated Heritage Trees and their locations shall be
listed on the Historic Resources Inventory and maintained by the Community Development
Department.
ANALYSIS
Staff is supportive of the Heritage Tree Designation based on the following findings:
1. It is on the Historic Preservation Board Tree Survey, completed in 2002.
2. It is an outstanding specimen of a desirable species.
3. It is one of significant age and/or girth in Campbell.

Notice is hereby given that the Historic Preservation Board of the City of Campbell has
set the hour of 5:30 p.m., or shortly thereafter, on Wednesday, January 22, 2003, in the
City Hall Council Chambers, 70 North First Street, Campbell, California, for a Public
Hearing to consider the following proposed project:

Redwood tree on property owned by Barry Shilman and Susan Blake at 84 N. Third

available for public review in the Planning Office, 70 N. First Street, Campbell,
California. Interested persons may attend this meeting and/or provide written comments
on these projects that may be submitted before that date.
